TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at 5:00 p.m. at the Town Hall,
3577 Terrace Road, Cortland, New York with Deputy
Supervisor, Theodore Testa presiding.
Members present: Deputy Supervisor, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Pauline Parker
Absent: Supervisor, Raymond Thorpe
Others present were: Town Attorney, John Folmer;
Highway Superintendent, Carl Bush; Town Typist, Edna
Puzo; Attorney, Dave Hartnett; Tim Buhl, of Resource
Associates and Bill McDermott, and Newsreporter, Trish
Hansen.
The Meeting was called to order by Deputy
Supervisor, Theodore Testa at 5:00 p.m.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to approve, as written, the Town
Board Minutes of June 1, and June 15, 1994. All voting
aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Pilato, to receive and file the Planning
Board Minutes of May 31, and June 28, 1994. All voting
aye, the motion was carried.
RESOLUTION #120 AUTHORIZE PAYMENT OF VOUCHERS

BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

RESOLUTION #121 AUTHORIZE WATER AND SEWER PLUMBER'S
APPLICATION FOR REGGIE B. BROWN
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
WHEREAS, an application was submitted by Reggie B. Brown
of 116 North St, P.O. Box 1095, Dryden, NY 13053, for
authorization to install water and sewer services in the
Town, and
WHEREAS, such application included references and
previous experience, as required, and has been approved
by Carl Bush, therefore

BE IT RESOLVED, the application submitted by Reggie B.
Brown is hereby approved and his name shall be added to
the approved plumber's list of the Town.
RESOLUTION #122 SET BID OPENING DATE FOR HIGHWAY
GARAGE PROJECT - PHASE ONE
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, the Highway Supt. was authorized per Resolution
#117, adopted July 6, 1994 to let out for bid, Phase One
for Highway Garage Improvements, therefore
BE IT RESOLVED, the Bid Opening shall be held on August
11, 1994 at 4:00 p.m. at the Town Hall, and shall be
awarded on August 17, 1994 at 5:00 p.m.
Councilman Pilato reported that he attended the
meeting announcing the plans for building a new Youth
Center on Port Watson St. in the City of Cortland. It
will be a multi -purpose use facility, and a true asset
to the community.
For sure, Cortlandville Youth will also be using
this facility and requested the Town Board to consider
some funding from the Town.
A discussion was held whereby this would need to be
accomplished with the 1995 budget process.
Councilman Rocco requested the Highway Supt. to
clean out the debris in the ditches on Lighthouse Hill.
Because this is a County road, it will be referred to
Mr. Tennant.
He also requested the Highway Supt. to accomplish
what is necessary to satisfy a resident on MacBean Lane
whose solar lights were damaged by on of our Highway
Trucks.
Reports of various departments are on the table for
review, and are available for inspection, upon request,
in the Town Clerk's office.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to receive and file a letter from NYS
DEC regarding Smith Corona property. All voting aye,
the motion was carried.
The letter advised of a change in classification on
their Registry where hazardous waste disposal has
occurred. It is now Code 4 which means the site is
p-roperly closed - requires continued management.
Deputy Supervisor Testa distributed copies of a
memo from Town Engineer, Hayne Smith relating to
anticipated water and sewer improvement projects for the
Town, as requested of him.
A discussion was held concerning this. No action
was taken.
A discussion was held by board members relating to
notification to residents when a construction project
occurs. It was determined that notice by mail should
occur, as well as a notice in the paper.

RESOLUTION #123 REQUEST TOWN ATTORNEY TO REVIEW
COMPLIANCE OF A FENCE AT CORTLAND'S
COUNTRY MUSIC PARK CAMPGROUND
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, information was received from Attorney John
Fitzgerald regarding compliance of a fence between
properties of Cortland Country Music Park Campground
and Michael Colasurdo, and
WHEREAS, also included was a copy of action taken by the
Cortlandville Zoning Board of Appeals dated July 17,
1974, therefore
BE IT RESOLVED, the Town Attorney is hereby requested
and directed to review this complaint and report back to
the Town Board, and further
RESOLVED, the information received shall be received and
filed.
A discussion was held concerning the difference
between camping trailers and/or house trailer within a
campground. No action was taken.
Another discussion was held concerning a house
trailer located on Lighthouse Hill Road. Deputy
Supervisor Testa will discuss this with CEO, Bruce
Weber.
Attorney Folmer introduced his law partner,
Attorney David Hartnett. As agreed, he will attend the
mid -month meeting in August, as Attorney Folmer will be
on vacation.
Attorney Folmer reported on the following:
It will be necessary to reschedule the Public Hearings
of United Methodist Church and Top's Supermarket. Time
restraints for submission of Legal Notices can be
trying.
Attorney Pomeroy has advised him that repairs of sewer
lines on Raphael Dr. have been completed. Carl Bush can
now inspect these.
A letter has been drafted, and will be left with the
Supervisor for signatures, of the concerns of the
Polkville area.
Certiorari proceedings have been filed with the Town
from Friendly's and Niagara Mohawk in regards to their
assessments.
Loope Road Railroad Crossing: the railroad has
responded to the questions asked of them. We should
receive something soon from Judge Loomis.
Information has been prepared.for signatures of the deed
from the Cortland City School District.

RESOLUTION #124 SET DATE FOR A SPECIAL MEETING AND
RESCHEDULE PUBLIC HEARINGS
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, a Special Meeting will be held by the
Town Board of the Town of Cortlandville on July 27, 1994
at 5:00 p.m., and further
RESOLVED, Public Hearing's will be rescheduled for July
27, 1994 at 5:00 p.m. for the Aquifer Special Permit
applications of United Methodist Church and Benderson
Development Co. (Top's Supermarket).
RESOLUTION #125 AUTHORIZE BUDGET TRANSFER FOR
SEWER CAPITAL PROJECTS
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Budget Officer is hereby authorized
and directed to transfer $2,880.00 from Sewer Surplus
Funds, and transfer $1,080.00 into Luker Road Sewer
Extension Project and transfer $1,800.00 into Mid Town
Sewer Improvement Project.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to recess the regular meeting and hold
an Executive Session to discuss matters of pending
litigation. All voting aye, the motion was carried.
