HomeMy WebLinkAbout05-04-1994•'2 0 9 Wednesday, May 04, 1994 TOWN BOARD MEETING 0911i2V� The Regular Meeting of the Town Board of the Town of Cortlandville was held at 1:00 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were; Town Attorney, John Folmer; Highway Superintendent, Carl Bush; and Newsreporter, Trish Hansen. The Meeting was called to order by Supervisor Thorpe at 7:00 p.m. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to approve as written, the Town Board Minutes of March 16, 1994 and April 06, 1994. All voting aye, the motion was carried. Councilman Testa made a motion, seconded by Councilman Rocco, to receive and file the Cortlandville Planning Board Minutes of March 29, 1994. All voting aye, the motion was carried. RESOLUTION #86 AUTHORIZE PAYMENT OF VOUCHERS MAY Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #171 - 187 $10,764.92 General Fund B 21 $ 3,630.00 Highway Fund DB 142 - 158 $ 7,560.71 Water Fund 101 - ill $ 6,116.87 Sewer Fund 51 - 59 $69,054.81 Capital Project 7 - 8 $ 2,185.00 Privilege of the floor was granted to Councilman O'Donnell. He reported that residents of the Blodgett Mills area are asking the status regarding the Public Hearing held by the NYS DOT due to the Railroad closing the railroad crossing on Loope Road on December 1, 1992. A discussion was held concerning this. What needs to be determined is if the railroad crossings on the Loope road are Public Crossings or Private Crossings. The action taken by the railroad indicates that it is classified as a Private Crossing. Attorney Folmer reported that he has drafted questions as a result of the hearing and is waiting for further direction from Judge Loomis. He will send a letter to Judge Loomis asking the current status, and report back to the Board. MAY 04, 1994 TOWN BOARD MEETING PAGE 2 Councilman Testa reported that Engineer Hayne Smith cannot proceed with the necessary process for bidding etc. of the Midtown Sewer project until approval has been received from the State. Attorney Folmer reported that he called Albany and spoke with a Robert Marsh concerning this. He followed up with a letter confirming the conversation. Hopefully the approval will be received soon. Councilman O'Donnell reported that he was disappointed to learn of the denial of the grant for the purchase of the Contento property to do away with the Junk Yard. Supervisor Thorpe confirmed the denial. Councilman Pilato reported that several residents of the Lamont Circle area have contacted him regarding cars speeding in their area. They have requested a reduction of the speed limit. A discussion was held concerning this. Councilman Rocco reported that they have had success in the Bowling Green area since a stop sign was put there. RESOLUTION #87 AUTHORIZE HIGHWAY SUPERINTENDENT TO PUT UP A STOP SIGN AT LAMONT CIRCLE INTERSECTION Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Highway Superintendent, Carl Bush, is hereby authorized and directed to post a stop sign at the entrance intersection of Lamont Circle. Reports of various departments are on the table for review, and are available for inspection, upon request, in the Town Clerk's Office. Councilman Rocco made a motion, seconded by Councilman Pilato, to receive and file a letter from Nancy Mueller, Cortland County Ground Water Management Coordinator. All voting aye, the motion was carried. The letter advised the NYS DEC are inspecting the South Hill Dump site as a hazardous waste site again. Supervisor Thorpe reported that he just received a questionnaire from New York DEC regarding the South Hill Dump Site. They are asking that it be returned to them by May 25, 1994. The information has been given to Attorney Folmer for assistance and advice. This dump was a public dump. The Town had no control over who used the dump. There were no records kept at the dump. A few years ago, the Town received a letter stating that it would cost 10 million dollars to clean up the dump site. In 1991 a bill was introduced to the Senate by Senator Cook which demanded that the State pay for 750 of the cost of clean up. In 1992 we had to pay $22,123.67 to the State for the expenses incurred for drum removal. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a letter from the State of New York DOT in regards to the CHIPS monies. All voting aye, the motion was carried. Because the State budget has not been approved, the April 1994 payment has been delayed. I- I 211 MAY 04, 1994 TOWN BOARD MEETING PAGE 3 Tax Collector, Pauline Parker, reported to the Town Board of the 1994 Tax Collection process. We are into the last month of collection at the Town level. Per State Law, 418 notices were sent to property owners of unpaid taxes. The law was changed to protect property owners that have an escrow account. Balancing with the County will occur soon after June 1st. RESOLUTION #88 REFER ZONE CHANGE APPLICATION OF DOUGLAS STALEY TO TOWN AND COUNTY PLANNING BOARDS FOR REVIEW Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an application for a zone change, from Agricultural to Industrial, was submitted by Douglas Staley for property located between NYS Route 11 and NYS Route 81 in the Town of Cortlandville, therefore BE IT RESOLVED, the Town Board does hereby refer this zone change application to the Cortland County Planning and the Town Planning Boards for their review and recommendations. RESOLUTION #89 AUTHORIZE BUDGET TRANSFER FOR CAPITAL PROJECTS FOR LUKER ROAD SEWER EXTENSION AND MID TOWN SEWER Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Budget Officer is hereby authorized and directed to transfer $2,578.00 from the Sewer Fund Surplus Fund and deposit $744.00 into the Luker Road Sewer Extension Capital Project and $1,834.00 into the Mid Town Sewer Capital Project. RESOLUTION #90 REVIEW AND DECLARE NEGATIVE IMPACT OF SEQRA, FOR KINGSLEY AVENUE WATER IMPROVEMENT PROJECT - 1994 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board reviewed and completed the SEQRA, Short Environmental Assessment Form for the Kingsley Avenue Water Improvement Project -1994, and declared it to have no environmental impact and RESOLVED, that the assessment form shall be received and filed. RESOLUTION #91 ADOPT ORDER PURSUANT TO TOWN LAW SECTION 209-q (3) FOR THE KINGSLEY AVENUE WATER IMPROVEMENT PROJECT- 1994, AND SET DATE FOR A PUBLIC HEARING ON MAY 18, 1994 AT 5:30 P.M. Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED 212 MAY 04, 1994 TOWN BOARD MEETING PAGE 4 WHEREAS, there were filed and made available for public inspection in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a water improvement project for the Cortlandville area of Kingsley Avenue and designated "Kingsley Avenue Water Improvement Project-1994", as required by Section 209-q and 209-c of Town Law; and WHEREAS, the proposed improvement consists of the replacement of 500 feet of existing undersized water mains in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $40,000, and WHEREAS, the proposed method of financing of said improvement is by the issuance of bonds of the Town of Cortlandville in the principal sum of $40,000.00; all future costs including the repayment of the principal and interest of such bonds, shall be borne by the lands benefitted by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportioned to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby proposed that all lots or parcels of the Town of Cortlandville outside of Villages, capable of being serviced by the "Article 12-C" Water Improvements heretofore and hereafter provided, are lots or parcels benefitted by the proposed water improvement; and the cost of the proposed water project and all previous improvements shall be spread upon and over the enlarged benefitted area, all of such improvements constituting one water system, such system being described by and including the areas set forth in the "Starr Road Water Improvement Project" Resolution adopted April 21, 1993; and WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from water rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by the Town Law Article 12-C Water Improvements, and WHEREAS, a short Environmental Assessment Form has been prepared pursuant to the State Environmental Quality Review Act, and is available for review by the public at Cortlandville Town Hall, IT IS HEREBY ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, 15 Terrace Road, Cortland, New York on the 18th day of May, 1994 at 5:30 o'clock p.m. of that day to hear all persons interested in the proposed water improvement, and for such other action of said Town Board with relation to the said water improvement as may be required by law or be deemed proper. RESOLUTION #93 ADOPT ORDER PURSUANT TO TOWN LAW SECTION 209-Q (3) FOR THE LUKER ROAD SEWER PROJECT - 1994 AND SET DATE FOR A PUBLIC HEARING ON MAY 18, 1994 AT 5:30 P.M. Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, there were filed and made available for public inspection in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York general plans relating to the establishment of a sewer improvement project for the Cortlandville area of Luker Road and designated "Luker Road Sewer Improvement Project-1994", as required by Section 209-q and 209-c of the Town Law; and WHEREAS, the proposed improvement consists of the extension of sewer lines into the said area by construction of an extension to existing sewer mains in a westerly direction along Luker Road for a distance of approximately 1300 feet to provide service for additional residential and commercial residents of said area in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $116,700, and WHEREAS, the proposed method of financing of said improvement is by the issuance of bonds of the Town of Cortlandville in the principal sum of $116,700.00; all future costs including the repayment of the principal and interest of such bonds, shall be borne by the lands benefitted by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby proposed that all lots or parcels of the Town of Cortlandville outside of Villages, capable of being serviced by the " Article 12-C" Sewer Improvements heretofore and hereafter provided, are lots or parcels benefitted by the proposed sewer improvement; and the cost of the proposed sewer project and all previous improvements shall be spread upon and over the enlarged benefitted area, all of such improvements constituting one sewer system, such system being described by and including the areas set forth in the "Mid Town Sewer Project" Resolution adopted January 6, 1993 and the following parcels designated on the 1989 214 MAY 04, 1994 TOWN BOARD MEETING PAGE 6 Cortland County Real Property Tax Maps as Cortlandville tax parcels: Tax Map Parcel Number: 85.20-01-35.110, 85.20-01- 35.120, 85.20-01-35.200, 85.20-01-34.000, 85.20-01- 33.000, 85.20-01-32.200, 86.17-01-15.000, 86.17-01- 16.000, 86.17-01-12.200, 86.17-01-12.100, 86.17-02- 04.000, 86.17-02-01.000, 86.17-02705.000, and 95.00-05- 10.200; and WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from sewer rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by Town Law Article 12-C Sewer Improvements, and WHEREAS, a short Environmental Assessment Form has been prepared pursuant to the State Environmental Quality Review Act, and is available for review by the public at the Cortlandville Town Hall, now IT IS HEREBY ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at Town Hall, 15 Terrace Road, Cortland, New York on the 18th of May, 1994 at 5:30 o'clock p.m. of that day to hear all persons interested in the proposed sewer improvement, and for such other action of said Town Board with relation to the said sewer improvement as may be required by law or be deemed proper. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file a letter received from Manny Lann of the Youth Bureau. All voting aye, the motion was carried. Information was sent recommending the manner to advertise of fees for our youth programs. Supervisor Thorpe spoke to the Town Board about a letter he received from Nancy and Sandy Samson, who reside at 1795 East Homer Road. The letter explained of their concern of public safety due to a call they placed for TLC Ambulance Service. The Samson's stated they were put on hold too many times and for too long. Supervisor Thorpe contacted Mr. Butler of TLC. He explained that the new 911 number was called for this occasion. That program was not in effect at that time, however, the message was relayed immediately to the ambulance. He assured him that these problems are being corrected. Councilman Pilato made a motion, seconded by Councilman Testa, to adjourn the regular meeting. All voting aye, the motion was carried.
