The Regular Meeting of the Town Board of the `Down
of Cortlandville was held at 7:00 p.m. at the Town Hall,
15 Terrace Road, Cortland, New York with Super,.%isor
Raymond T'hor,)e presiding.
Members present: Supervisor; Raymond Thorpe

Privilege of the floor was granted to Councilman
O'Donnell. He reported that he attended the Village of
McGraw Budget Meeting last creek. They asked of him the
intent of the Town relating to an update for evaluation
of properties in the Town, which would include the
Village of McGraw. They wished this to be done soon to
benefit them with State Aid revenues.
A discussion was held whereby it was stated that
Assessor, David Briggs, plans to do this as soon as that
process is completed in the City of Cortland.
Supervisor Thorpe informed the Town Board that
?Dater & Sewer Supt., Carl Bush, has had the budgets of
the Water & Sewer Dept. reviewed by an outside
consultant. He has reported that the rate increases, as
proposed, were recommended. If it is not done now, a
larger increase would be necessary next year.
RESOLUTION 970 ADOPT RESOLUTION TO ESTABLISH NEW
WATER RATES
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a Public Hearing was duly held on March 16,
1994 at 7:30 p.m. in the matter of establishing new
water rates, and
WHEREAS, the Town Board deems such proposed water rate
increase to be in the best interest of the Town,
therefore
BE IT RESOLVED, the Water District Ordinance of the Town
of Cortlandville, enacted September 30, 1957, and
thereafter amended, is hereby further amended to provide
the establishment of new water rates as follows:
A.) $1.65 per one thousand (1,000) gallons of
consumption, per quarter, for all water
consumed up to and including fifty thousand
(50,000) gallons per quarter, with a minimum
fee of $13.20 per quarter.
B.) $1.21 per one thousand (1,000) gallons of
consumption, per quarter, for all water
consumed consisting of fifty-one thousand
(51,000) gallons per quarter, up to and
including three hundred thousand (300,000)
gallons per quarter.
C.) $0.95 per one thousand (1,000) gallons of
consumption, per quarter, for all water
consumed in excess of three hundred thousand
(300,000) per quarter.

RESOLUTION #71 ADOPT RESOLUTION TO ESTABLISH NEW
SEWER RATES
Motion by Councilman Pilato
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a Public Hearing was duly held on March 16,
1994 at 7:30 p.m. in the matter of establishing new
sewer rates, and
WHEREAS, the Town Board deems the proposed sewer rate
increase to be in the best interest of the Town;
therefore
BE IT RESOLVED, the Sewer District Ordinance of the Town
of Cortlandville, enacted September 30, 1957, and
thereafter amended, is hereby further amended to provide
the establishment of new sewer rates as follows:
Non -industrial users - For water consumption of six
thousand (6,000) gallons or less per quarter, the
sewer rate shall be a charge of $14.70 per quarter.
For consumption exceeding six thousand (6,000)
gallons per quarter, the rate shall be $2.45 per
one thousand (1,000) gallons for all water
consumed.
Industrial users - $1.21 per one thousand (1,000)
gallons of consumption per quarter for all water
consumed.
RESOLUTION #72 APPROVE "UTILITY WORK AGREEMENT"
WITH NYS DOT - RESURFACING STARR
ROAD AND MCLEAN ROAD AND AUTHORIZE
SIGNING OF AGREEMENT

Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, NYS DOT forwarded a Utility Work Agreement
which would authorize proposed work on the Suter valves,
appurtenances, and sanitary sewer manholes on the McLean
Road and Starr Road, when the road is resurfaced, and
WHEREAS, such agreement has been reviewed by the Town
Attorney, and found to be in order, therefore
BE IT RESOLVED, that the Supervisor or Deputy Supervisor
is authorized to enter into any and all agreements with
the State of New York Department of Transportation for
the State's resurfacing of McLean and Starr Roads
(Capitol Project No.3752.21.121, County of Cortland) -
pursuant to Section 10 (24) of the Highiaay Law of the
State of New York, such work to be accomplished at no
cost to the Town.
Councilman O'Donnell made a motion, seconded by
Councilman Pilato, to receive and file acknowledgement
-of a letter from Assemblyman Daniel J. Fessenden in
regards to the Resolution we sent to him urging his
support for continuance of the Local Government Records
Management Improvement Fund. All voting aye, the motion
was carried.

Town Clerk, Pauline Parker, distributed to the Town
Board members information, including the registration
form, regarding upcoming seminars relating to Planning
and Zoning. The seminars will be conducted by the County
Planning Dept. at the Cortland County Office Building in
April and May 1994. Copies of the information has also
been distributed to our Planning and Zoning Boards.
RESOLUTION #73 AUTHORIZE HIRING OF DOROTHY H. DRACH
PART TIME DEPUTY TOWN CLERK
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, there is a vacancy in the Town Clerk's Office,
and
WHEREAS, an application has been submitted by Dorothy H.
Drach of 3595 Parti Drive, in the Town of Cortlandville,
and recommended by the Town Clerk, therefore
BE IT RESOLVED, that the Town Board does hereby
authorize the Town Clerk to hire Dorothy H. Drach, as
part time Deputy Town Clerk, and shall be paid an hourly
rate of $6.95 per hour, effective March 21, 1994.
Attorney Folmer informed the Town Board of the
Public Hearing held concerning the Loope Road Railroad
crossing. About 15 residents attended with other local
and state officials. No one appeared to represent the
rail_ -road.
Concern was expressed by those in attendance by the
action taken by the railroad. In December 1992, the
Railroad closed the North Loope Road crossing. If
something should happen at the South end crossing, there
would be no wav for the residents to get out.
A decision should be forthcoming soon from the
results of the Public Hearing.
Attorney Folmer expects to have information
prepared for Engineer, Hayne Smith, in a couple of
weeks, relating to the Luker Road Sewer project.
Attorney Folmer reported that he has received the
Abstract of Title for the property given to us by the
Cortland City School District, to construct a pumping
station. The deed is being prepared now, and will be
filed as soon as -the proper signatures are affixed by
the school district, and returned to him.
Attorney Folmer stated he is reviewing the
information he has regarding eminent domain procedures
done on Route 281 for the water and sewer project. An
easement will be drafted soon, as well as other
necessary papers to terminate this proceeding. When
this is accomplished, he will need the $4,000., approved
by this board, to finalize this.
RESOLUTION #74 AUTHORIZE REQUEST OF JAMES REENERS
FOR AN ADJUSTMENT OF SEWER CHARGES

WHEREAS, Mr. James Reeners, 790 N. Lamont Dr., has sent

WHEREAS, this was the first sewer bill received by the
residents of Lamont Circle, and was unaware of Town
procedures, and
WHEREAS, that 20,000 gallons of water did not go into
the sewer system, therefore
BE IT RESOLVED, the Town Board does hereby authorize a
credit, in the amount of $51.90, to the sewer account of
James Reeners.
RESOLUTION ##75 AUTHORIZE HIGHWAY SUPERINTENDENT
TO CONTACT STATE LEGISLATORS IN
REGARDS TO INCREASED MONIES OF STATE
PROGRAMS DUE TO THE UNUSUAL SEVERE
WINTER OF 1994
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
WHEREAS, information was received from G. Jeffrev Haber
of the Association of Towns suggesting a request be sent
to State Legislators for an increase of funding of their
revenue sharing and CHIPS programs, to deal with the
unusually severe winter we are experiencing, therefore
BE IT RESOLVED, Highway Superintendent, Carl Bush, is
hereby authorized and directed to send letters to State
.Legislators encouraging the allocation of additional
monies for state programs, for this year.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file information
received from Director, Thomas A. Cookingham of the
Cortland County Planning Department. All voting aye,
the motion was carried.
Included was a resolution adopted by the Cortland
County Planning Board regarding Lot Coverage to apply to
approval of proposed projects overlaying the Otter
Creek -Dry Creek Aquifer. It encouraged the Town to also
adopt the resolution.
Supervisor Thorpe reported that this information
has been forwarded to our Planning Dept. for their
review.
RESOLUTION #76 AUTHORIZE MCGRAW CENTRAL SCHOOL
DISTRICT TO USE TOWNS VOTING MACHINE
FOR THEIR ANNUAL SCHOOL BUDGET VOTE
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that McGraw Central School District is
hereby authorized to use the Towns voting machine for
their annual school budget vote to be held Wednesday,
May 18, 1994.

Councilman O'Donnell made a motion, seconded by
Councilman Testa, to adjourn the regular meeting. All
voting aye, the motion, was carried.
