PUBLIC HEARING AMENDIMIENTS TO THE C0I<TLA11,_'DV1LLE WATER ORDINANCE AND AMENDMENTS TO T"'1E CORTLANDVILLE SEWER ORDINANCE AND ESTABLISHMEitlT OY NEW WATER AND SEWER RATES. A Public Hearing was held by the Town Board of the Town of Cortlandville. on March 16, 1994 at 5:30 rn. at the Town Hall; 15 Terrace Road; Cortland New York, concerning increasing of Town Water rates and Town Sewer rates. Members present: Supervisor, Raymond Thorne Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman:, Ronal Rocco Councilman, John Pilato `Down Clerk, Pauline Parker Others :resent were: Town Attorney, John Folmer; Highway Superintendent, Carl Bush; Town Typist Edna Puzo; Towr.. Residents, Jeff Hering and Mr. and Mrs. Donald McClor_v, and News reporter, Dan McDonald. Supervisor Thorne called the Public Hearing to orde _ at. 5; 30 p.m. The 1'own Clerk read aloud the Legal Notice as posted and filed. Supervisor Thorne stated it is necessary to have a rate increase at this time because the Town has been absorbing the maintenance and operating cos .from surplus funds. This cannot continue. We have needed to construct additional pumping stations due to extansion of lines. The cost of operating these continue to -increase because power costs continue 41--o rise. We must take the necessary steps to operate these syste:ris at a break-even level. The proposer' increase of rate; should allow us to accomplish this. Supervisor Thorpe offered the floor for questions or comment:.. Jeff He- inr1 of > amont. Circle, stated that the percentage rates of 26.9% fo_ ;rater and 16.7% for sewer increases are unconscionahle. These are higher than the both; the cost of living and the inflation rate. In his area, with tho- recent sewer line extension, there wil ll be a sewer cost to them as well as a water increase. Supervisor Thorpe explained that a rate increase has not occurred in several vears. It is the intent of this Board to review this annually to keep any increases a.t a minimus-�i. With the proposed increases, our charges are still below average rates of surr-ouindlnu communities. It was s ated that' Smith Corolla used an estimated 300,000 gallons of water a day. This usage has been cut dramatically. 194 MARCH 16, 1994 PUBLIC HEARING PAGE 2 Councilman Pilato reported that he also must pay for installation of a sewer hookup to his residence. This does add to their financial burden, however this Board has used surplus monies to keep the rates down for the past several years. The time has come for an adjustment of rates. Mr. John McCloy of Starr Road, also voiced his opposition of the rate increases. It would be easier to have smaller increases charged. This causes a hardship for those on fixed incomes. The Board explained that the proposed rate could be lowered, but cannot be raised higher than that proposed. It is the intent of this Board to increase annually, if necessary. Action will not be taken on this matter tonight. It will happen at a future meeting. No other comments or questions were heard. Councilman Rocco made a motion, seconded by Councilman Pilato, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:50 p.m. 195. ,':. TOWN BOARD MINUTES The Regular Meeting of the Town Board of the Town of Cortlandville was held at 5:00 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present .were; Town Attorney, John Folmer; Highway Superintendent, Carl Bush; Town Typist, Edna Puzo, and Newsreporte_, Dan McDonald. The Meeting was called to order by Supervisor Thorpe at 5:00 p.m. Councilman O'Donnell made a motion, seconded by Councilman Plato, to approve as Written, the Town Board Minutes of January 19, 1994 and February 2, 1994. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Mato, to receive and file the Planning Board Minutes of February 23, 1993 and February 22, 1994. All voting aye, the motion was carried. RESOLUTION #60 AUTHORIZE PAYMENT OF VOUCHERS MARCH Motion by Councilman O'Donnell Seconded by Councilman Pilato MOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited anc`.', shall be paid as follows: General Fund. A VoucAers # 97 - 115 $13,063.23 General Fund B 11 - 12 $ 30.40 Highway Fund 80 - 98 $55,463.12 Water Fund 57 - 69 $ 2,583.08 Sewer Fund 30 - 34 $ 2,455.3_ Capital Projects 5 v 50.00 Privilege of the Floor was offered to those in attendance. Ho comments were heard. Reports of various departments are on the table for review, a_n_O are available for inspection, upon request, in the Town Clerk's Office. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file correspondence received from Daniel K. Greene, Gen. Mgr., Bestway of New England, concerning Bestway Enterprises, Inc. at 3877 Luker Road, Cortland, NY. All voting aye, the motion was carried. Included was a Tier Two - Emergency and Hazardous 196 MARCH 16, 1994 TOWN BOARD MEETING PAGE 2 Chemical Inventory form for 1993, as required, in accordance with Federal Register Notice, dated October 15, 1987. RESOLUTION #61 AUTHORIZE EXTENSION OF BID PRICES SUBMITTED FROM SENSUS TECHNOLOGIES INC. FOR WATER METERS FOR THE TOWN Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, per Resolution #35, adopted January 22, 1992 the bid schedule submitted by Sensus Technologies was awarded and approved, therefore BE IT RESOLVED, the Town Board does hereby authorize an extension of the bid until February 25, 1995, per letter dated March 7, 1994, and such shall be received and filed. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file a notification from Mohawk Valley Oil, Inc. at 3947 West Road, Cortlandville, in regards to renewing their liquor license. All voting aye, the motion was carried. RESOLUTION #62 ACCEPT RESIGNATION OF MARY H. SAYRE AS PART TIME DEPUTY TOWN CLERK Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the resignation of Mary H. Sayre, as Deputy Town Clerk, part time, is hereby accepted, with regrets, and shall be effective March 16, 1994. Attorney Fulmer reported that he has investigated the status Df the Mid -Town Sewer Improvement Project after receiving a call from Engineer, Hayne Smith asking for short term financing of this project. The approval from the State Comptroller's office should be coming in April or May. They have advised that this process takes about four months. Attorney Folmer advised that he was notified the Cortland City School Board has approved the conveyance of property to the Town of Cortlandville. The Town will be responsible for filings, so he has ordered an update of the abstract and title, and will proceed with filing of a deed as soon as he receives the necessary documents RESOLUTION #63 ACKNOWLEDGE NOTIFICATION OF PUBLIC HEARING TO BE HELD APRIL 5, 1994 CONCERNING SOUTH LOOPE ROAD RAIL ROAD CROSSING Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, The New York, Susquehanna and Western Railroad Corp. closed the railroad crossing on Loope Road on December 1, 1992, which has caused concern for residents of the area, and 1971 MARCH 16, 1994 WHEREAS, the Commissioner of rehabilitaticz therefore TOWN BOARD MEETING PAGE 3 Town petitioned the State of New York Transportation for an alteration and of the grade crossing on Loope Road, BE IT RESOLVED, the Town Board -does hereby acknowledge notification from NYS DOT that a Public Hearing shall be held, by them, on April 5, 1994 at 7:00 p.m., at the Cortlandvilin Town Hall to determine whether South loope Road should be made a public crossing and how it should cross the tracts of New York, Susquehanna and Western Railroad. Attorney Folmar .eported that Town Justice, Mardis Kelsen has contacted him concerning outstanding parking violations. Those named on the summons have not appeared before her, and as a follow up, they have been notified by letter that the matter is still pending. There has been no response from the parties involved, and has forwarded the information to him. RESOLUTION #64 AUTHORIZE TOWN ATTORNEY TO PROCEED AS REQUIRED REGARDING OUTSTANDING PARKING VIOLATIONS Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Town Attorney, John Folmer, is hereby authorized and directed to proceed with the required action to execute the outstanding parking violations of the Town's Justice Department. RESOLUTION #65 AUTHORIZE REQUEST FOR ADJUSTMENT OF SEWER CHARGES FOR QUARTERLY BILLING OF VACANT RESIDENCE AT WALDEN OA7Q Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, a request was received from Mr. David Olp, of Barden & Robeson Corp. to have the sewer charge relieved due to the bursting of a heating pipe in an unfinished Town House at Walden Oaks, and WHEREAS, none of the water went into the sewer lines therefore, BE IT RESOLVED, the sewer bill for the this quarter be forgiven at the named location, and further RESOLVED, that the letter from Mr. Olp be received and filed. RESOLUTION #66 APPROVE RENEWAL OF CONTRACT WITH THE CORTLAND COUNTY CHAMBER OF COMMERCE SUB .,CT TO TOWN P VAr, -,-------ATTORNEY APPROVAL_ Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the 1994 Contract between the Town of Cortlaniviiie and the Chamber of Commerce is hereby approved, subject to Town Attorney approval. MARCH 16, 1994 TOWN BOARD MEETING PAGE 4 Attorney Folmer explained the process he would use for filing of deeds for laud conveyed to the Town. He will. have -the deed recorded with the County Clerk and request the original deeds be returned to him. He will make copies for his records and send the originals to the Town Clerk's office for filing. Supervisor Thorpe received today, a letter and suggested resolution, from the NYS DOT in regards to the resurfacing of McLean and Starr Road. The resolution needs to be adopted by the Town and forwarded to the NYS DOT. The attorney has not reviewed it. RESOLUTION #67 AUTHORIZE UTILITY WORK AGREEMENT WITH_ NYS DOT FOR RESURFACING STARR ROAD AND MCLEAN ROAD SUBJECT TO TOWN ATTORNEY REVIEW AND APPROVAL Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, information was received from NYS DOT regarding a Utility Work Agreement which would authorize proposed work on the water valves, appurtenances, and sanitary sewer manholes on the McLean Road and Starr Road, therefore BE IT RESOLVED, the Supervisor or Deputy Supervisor is authorized to enter into any and all agreements with the State of New York Department of Transportation for the States's resurfacing of McLean and Starr Roads, subject to Town Attorney review and approval. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the Regular Meeting. All voting aye, the motion was carried.
