The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, on February 2, 1994, at 7:00 p.m. with Deputy Supervisor, Theodore Testa presiding. Members present: Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Supervisor, Raymond Thorpe Councilman, John Pilato Others present were: Town Attorney, John Folmer; Town Typist, Edna Puzo; Highway Superintendent, Carl Bush; and Newsreporter, Connie Nogas. The Regular Meeting was called to order by Deputy Supervisor Testa at 7:00 p.m.. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to approve, as written, the Town Board Minutes of December 01, 1993 and December 15, 1993. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the Cortlandville Planning Board Minutes of December 28, 1993. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the Zoning Board of Appeals Minutes of January 11, 1994. All voting aye, the motion was carried. RESOLUTION #38 AUTHORIZE PAYMENT OF VOUCHERS FEBRUARY Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers# 28- 48 $ 9,420.55 General Fund B 6- 8 $ 3,886.66 Highway g y mound 24- 44 $17,346.93 Water Fund 16- 24 $ 2,780 64 Sewer Fund 12- 16 $ 442.52 Privilege of the floor was granted to Water & Sewer Superintendent, Carl Dusi-1. He apprised the Town Board of -the necessity to increase the water and sewer rates to keep up with current demands of those departments. Surplus monies are being depleted. 182 FEBRUARY 2, 1994 TOWN BOARD MEETING PAGE 2 He reported that he has compared rates of surrounding areas and ours are low. Our minimum water charge is $10. Minimum for the City of Cortland is $12.50. Approximately 15% of our users pay the minimum charge. A discussion was held whereby the Town Board will review the program and make a decision concerning this at the next meeting. No action was taken. Councilman Rocco reported that he has audited the Justice Department records of 1993. Everything is in order. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a letter from Janis M. Gross, of NYS DOT. All voting aye, the motion was carried. The letter advised they had received our correspondence concerning SEQRA, and Lead Agency Designation for the project of Top's Supermarket, to be located on Route 281. They advised they had not received the traffic study for this project yet, and would need adequate time to review and make their recommendation. Attorney Folmer reported that Ms. Cindy Bickford from Resource Associates has advised the Traffic Study in regards to the Tops Supermarket, Route 281, project has just been forwarded to NYS DOT, for their review. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a copy of the denial letter sent to Mr. David Parke from Supervisor Thorpe, regarding Mr. Parke's request to reduce his Water Benefit Tax Unit charge. All voting aye, the motion was carried. RESOLUTION #39 RECEIVE CONTRACT AGREEMENT BETWEEN THE TOWN AND SPCA FOR THE YEAR 1994 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the 1994 contract between the Town and Cortland County SPCA, in the amount of $14,500.00, has been signed, and shall be received and filed. RESOLUTION #40 TABLE DECISION OF EXTENDING SEWER LINES FOR THE PROPOSED MAYBERRY SUBDIVISION Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, Water Superintendent, Carl Bush, requested the Town Board to consider extending Town sewer lines near Bowling Green to have available for the proposed Mayberry Subdivision, therefore BE IT RESOLVED, the Town Board does hereby table the decision of extending Town sewer lines to allow time for the Town Attorney, Supervisor and County Health Dept. to review the status of the project. FEBRUARY 2, 1994 TOWN BOARD MEETING PAGE 3 Attorney Folmer advised Town Board Members that TLC had sent their 1994 Contract for review. In checking, he found it was not written the same as last year. Upon discussing this wi.t.h them, they advised that they had used the wrong form. Attorney Folmer has rewrote the contract and sent it to them for their review and signatures. RESOLUTION #41 DENY REQUEST OF DOROTHY FURMAN FOR REMOVAL OF SEWER BENEFIT TAX Motion by Councilman Rocco Seconded by COurlcilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a request was received from Dorothy Furman, 14 Levydale Park, requesting -the removal of the Sewer Benefit Tax on her 1994 tax bill, due to a past agreement with the City of Cortland, and WHEREAS, per Resolution #34, adopted January 19, 1994 this Town Board referred the request to Attorney Folmer for review, and WHEREAS, Attorney Folmer reported that he could not locate documentation of an agreement, therefore BE IT RESOLVED, -the Town Board does hereby deny the request received from Dorothy Furman, and further RESOLVED, the letter written by Attorney Folmer be sent to Mrs. Furman, and received and filed. Tax Collector, Pauline Parker, spoke to the Town Board about problems she has had with her computer tax collection program. The annual update, providing the information of the new rolls, are not received in a timely matter. This year, she did not receive 11:he information until January 14th. Communication, by letter, will be attempted to eliminate this problem for the future. RESOLUTION #42 AU`.iHORIZE EXTENSION OF TIME FOR TAX _COLLECTION TO JUNE 1, 1994 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign and forward a request for an extension of the tax collection program until June 1, 1994, to the Cortland County Treasurer, in compliance with Section 938 of the Real Estate Property Tax Law. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the Regular Meeting and convene to an Executive Session in the matter of ligation. All voting aye, the motion was carried. The following information was received from the Supervisor's office. All voting aye, the motion was carried. No action was taken. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to adjourn the Regular Meeting. All voting aye, the motion was carried.
