PUBLIC HEARING
AQUIFER SPECIAL PERMIT - PALL TRINITY MICRO CORP.
A Public Hearing was held by the Town Board of the
Town of Cortlandville on December 01, 1993 at 7:00 p.m.
at the Town Hall, 15 Terrace Road, Cortland, New York,
concerning an Aquifer Special Permit to construct a 30'
x 40' covered outdoor metal framework storage area
enclosed by a full height chain link fence sides,
located at 3643 NYS Route 281 corner of NYS Route 281
(west Road) and McLean Road, owned by Pall Trinity Micro
Corp.
Members present: Supervisor, Raymond Thorpe

Supervisor Thorpe called the Public Hearing to
order at 7:00 p.m.
The Town Clerk read aloud the Legal Notice as
posted and filed.
Supervisor Thorpe stated that the Town Planning
Board have advised they recommended approval of this
Aquifer Special Permit for Pall Trinity Micro Corp. at
their meeting held on November 30, 1993.
This application was also approved by the Cortland
County Planning Board.
Mr. Young of Pall Trinity Micro advised that he
would be willing to answer questions.
Supervisor Thorpe asked if anyone in attendance
wanted to speak or ask any questions about this project.
No comments were heard.
Councilman Testa made a motion, seconded by
Councilman O'Donnell to close the Public Hearing. All
voting aye, the motion was carried.
The Public Hearing was closed at 7:05 p.m.

PUBLIC HEARING
AQUIFER SPECIAL PERMIT - MARSHALL COMPANIES
A Public Hearing was held by the Town Board of the
f Town of Cortlandville on December 01, 1993 at 7:05 p.m.
at the Town Hall, 15 Terrace Road, Cortland, New York
concerning an Aquifer Special Permit from Marshall
Companies concerning placement of a 10,000 gallon fuel
tank in a dike. Said use is proposed to be located at
3741 Route 11, owned by Theodore J. and Nancy C.
Marshall.

Skip Chapman.
Supervisor Thorpe called the Public Hearing to
order at 7:05 p.m.
The Town Clerk read aloud the Legal Notice as
posted and filed.
Councilman Rocco stated that he attended the
Planning Board Meeting on this subject. The Planning
Board received a letter from Joan Guard of the Cortland
County Health Department stating many concerns. They
are doing more there than what their permit allows and
concerns have been heard from neighbors.
Supervisor Thorpe stated that the Town Planning
Board did not take action at their meeting on November
30th. It was tabled until they receive more
information.
Attorney, Rick Shafer spoke on behalf of the
Marshall Companies. He reported that the issue of
storage of empty propane tanks on the property has been
met. They are not filled on their premises.
The Planning Board has agreed to hold another
meeting on December 14, 1993 to review this request
again if the necessary information is available at that
time.
Councilman Rocco made a motion, seconded by
Councilman Testa, to recess this hearing until 5:00 p.m.
on December 15, 1993 or until such time as the Town
Planning Board has taken action on this application. All
voting aye, the motion was carried.
The meeting was recessed at 7:20 p.m.

TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 15 Terrace
Road, Cortland, New York, on December 01, 1993 at 7:00
p.m. with Supervisor Raymond Thorpe presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Pauline Parker
Others present were: Town Attorney, Phillip Rumsey;

Victor Havran and Newsreporter, Skip Chapman.
The Regular Meeting was called to order by
Supervisor Thorpe at 7:20 p.m., following Public
Hearings for an Aquifer Special Permit application
submitted by Pall Trinity Micro Corp. and Marshall
Companies.
Councilman Rocco made a motion, seconded by
Councilman Testa, to approve as written, the Town Board
minutes of October 06, 1993 and October 20, 1993. All
voting aye, the motion was carried.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file the
Cortlandville Planning Board minutes of October 26,
1993. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to receive and file the Zoning Board
of Appeals minutes of October 26, 1993 and November 09,
1993. All voting aye, the motion was carried.
RESOLUTION #205 AUTHORIZE PAYMENT OF VOUCHERS

Supervisor Thorpe offered Privilege of the floor to
those in attendance.

Mr. Victor Havran of 32 Halstead Road, once again,
informed the Town Board of his concerns, and problems

with his business neighbor, Mr. Newell Willcox, owner of
Willcox Tire.
Mr. Havran thanked Supervisor Thorpe for speaking
to Mr. Willcox about the dead tree between the property
lines. The tree has since been cut down.
His elderly neighbor, Mrs. Gibson, reported that
Mr. Willcox advised that he would not do anything
further. Left to do, as required, was to remove trash
along the hedge row and plant a few pine trees along the
property line between their properties and Willcox Tire.
Mr. Havran took pictures, and presented them to
the Town Board members. The pictures showed the trash
still remaining in the hedge row. They also showed
another problem of garbage and trash being dumped in and
around the open dumpster that was recently placed in
back of Willcox Tire.building. He has spotted rodents
running from the dumpster.
Old tires dumped in back of the building still
remain there.
A discussion was held concerning the problem.
Supervisor Thorpe stated that he would give the pictures
to CEO, Bruce Weber, and request him to pursue the
matter. He will, once again, speak to Mr. Willcox about
the unsightly problem.
The reports of various departments are on the table
for review, and are available for inspection, upon
request, in the Town Clerk's office.
RESOLUTION #206 PETITION STATE OF NEW YORK -
COMMISSIONER OF TRANSPORTATION
CONCERNING THE RAILROAD CROSSING
ON SOUTH LOOPE ROAD
Motion by Councilman Testa
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, a petition has been forwarded to the State of
New York - Commissioner of Transportation, under Section
91 of the Railroad Law, for an Alteration and
Rehabilitation of the At Grade Crossing of South Loope
Road and Declaration of Public Crossing, therefore
BE IT RESOLVED, the petition shall be received and
filed.
RESOLUTION #207 DECLARE NEGATIVE IMPACT - AQUIFER
SPECIAL PERMIT #10 OF 1993 - PALL
TRINITY MICRO CORP.

VOTES: ALL AYE ADOPTED
WHEREAS, an Aquifer Special Permit application, #10 of
1993, was submitted by Pall Trinity Micro Corp. for
their property located at 3643 NYS Route 281, corner of
NYS Route 281 (West Road) and McLean Road, Town of
Cortlandville to construct a 30' x 40' covered outdoor
metal framework storage area enclosed by full height
chain link fence sides, and
WHEREAS, the Cortland County Planning Board and the Town
Planning Board have reviewed and recommended approval of
this project, and

WHEREAS, a Public Hearing was duly held by the Town
Board, and
WHEREAS, the Town Board, as Lead Agent, has completed
the short environmental Assessment form for SEQRA,
therefore
BE IT RESOLVED, the Town Board does hereby declare the
proposed project of Pall Trinity Micro Corp., shall have
no significant impact on the environment.
RESOLUTION #208 APPROVE AQUIFER SPECIAL PERMIT #10
OF 1993 FOR PALL TRINITY MICRO CORP

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby approve
Aquifer Special Permit #10 of 1993, submitted by Pall
Trinity Micro Corp., and
RESOLVED, the Supervisor is hereby authorized to sign
the application.
Supervisor Thorpe reminded those in attendance that
no action would be taken concerning the Aquifer Special
Permit application of Marshall Company as it was
recessed until the Town Planning Board takes action.
RESOLUTION #209 AUTHORIZE DISPOSAL OF RECORDS IN
ACCORDANCE WITH RECORDS RETENTION
AND DISPOSITION SCHEDULE

Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, records stored within the files of the Town
Clerk have been reviewed and determined eligible for
disposal in accordance with the Records Retention and
Disposition Schedule MU-1, therefore
BE IT RESOLVED, the Town Board does hereby authorize
disposal of records per list submitted and dated
December 1, 1993.
RESOLUTION #210 AUTHORIZATION TO RELEVY DELINQUENT
WATER AND SEWER ACCOUNTS TO THE
1994 TAX ROLL FOR THE TOWN OF
CORTLANDVILLE

VOTES: ALL AYE ADOPTED
WHEREAS, information was submitted by the Water and
Sewer Department of the Town of Cortlandville, advising
of delinquent accounts, therefore
BE IT RESOLVED, the Town Board does hereby authorize the
delinquent water and sewer accounts of the Town shall be
forwarded to Cortland County Real Property Tax Office to
be relevyed onto the 1994 tax roll for the Town.

REFER AQUIFER PERMIT APPLICATION
FROM ALDI FOOD STORE TO TOWN AND
COUNTY PLANNING BOARDS AND SET DATE
FOR A PUBLIC HEARING

VOTES: ALL AYE ADOPTED
WHEREAS, Resource Associates has submitted a proposal
from Aldi Food Store, which requires an Aquifer Permit
to locate a 14,860 retail food store and associated
parking, located at NYS Route 13, in the Town of
Cortlandville, therefore,
BE IT RESOLVED, the Town Board is hereby declared Lead
Agent for the proposed project, and further
RESOLVED, that the request shall be forwarded to the
Town and County Planning Boards for their review and
recommendations, and further
RESOLVED, a Public Hearing shall be held on January 4,
1994 AT 5:00 P.M. for such application.

WHEREAS, the usual date and time for the first Town
Board Meeting of the Month is the first Wednesday at
7:00 p.m., and must be changed, therefore

Meeting of the Town Board shall be scheduled on Tuesday
January 4, 1994 at 5:00 p.m.
RESOLUTION #213 RECEIVE REQUEST FOR STREET LIGHTS
TO BE INSTALLED ON DEMEREE DRIVE

VOTES: ALL AYE ADOPTED
WHEREAS, a request was received from Eleanor C. Demeree,
a resident of Demeree Drive, to have street lights
installed on Demeree Drive, therefore
BE IT RESOLVED, the Town Board does hereby request Carl
Bush, Highway Supt. to review the request and report his
findings to the Town Board.
Highway Supt., Carl Bush distributed copies of the
Parking Ordinance to Town Board Members. This has
recently been advertized in the Cortland Standard, as
they had requested. No "over night parking" is allowed
from November 1st thru April 1st.
