PUBLIC HEARING AQUIFER PERMIT - MARSHALL COMPANIES A Public Hearing was held by the Town Board of the Town of Cortlandville on November 03, 1993 at 7:00 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York, concerning an Aquifer Permit request from Marshall Companies for placement of a 10,000 gallon fuel tank in a dike located at 3741 Route 11, in the Town of Cortlandville. Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present: Town Attorney, Phillip Rumsey; Attorney, John Ryan; Highway Superintendent, Carl Bush; Assessor, David Briggs; Cindy Bickford of Resource Associates; Fire Commissioners, Tom Honour, Doug Staley, Treasurer, Joe During; Town residents, Fred Little and Robert Payne and Newsreporter, Skip Chapman. Supervisor Thorpe order at 7:00 p.m. The Town Clerk posted and filed. called the Public Hearing to read aloud the Legal Notice as Supervisor Thorpe stated that this application was denied in August due to concerns related to environmental housekeeping problems, and is being resubmitted for further consideration. The Town Planning Board elected not to act on the matter at their meeting on October 26, 1993. Representatives of Marshall Company called and requested the Public Hearing to be postponed. Because the legal notice was published in the paper, the hearing is being held. Supervisor Thorpe asked if anyone in attendance wanted to speak or ask questions about this project. No comments were heard. The Town Attorney advised that the Public Hearing could be rescheduled. Councilman Rocco made a motion, seconded by Councilman Testa, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 7:05 p.m. 132 Wednesday, November 03, 1993 7:00 P.M. PUBLIC HEARING AQUIFER PERMIT - MOHAWK VALLEY OIL, INC. A Public Hearing Was held by the Town Board of the Town of Cortlandville on November 3, 1993 at 7:30 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York, concerning an Aquifer Permit request from Mohawk Valley Oil, Inc. to install an above -ground 10,000 gallon, low sulfur diesel tank into existing storage and containment area located at the intersection of NYS Route 11 and NYS Route 41. Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present: Town Attorney, Phillip Rumsey; Attorney, John Ryan; Highway Superintendent, Carl Bush; Assessor, David Briggs; Cindy Bickford of Resource Associates; Fire Commissioners, Tom Honour, Doug Staley, Treasurer, Joe During; Town residents, Fred Little and Robert Payne and Newsreporter, Skip Chapman. Supervisor Thorpe called the Public Hearing to order at 7:30 p.m. 11 The Town Clerk read aloud the Legal Notice as posted and filed. Michael Roehm spoke on behalf of Mohawk Valley Oil, Inc. and explained that this project is necessary to comply with new Federal regulations. Supervisor Thorpe read the resolution #93-75 of the Cortland County Planning Board for the recommendation of approval of this Aquifer Permit for the Mohawk Valley Oil, Inc. Supervisor Thorpe offered the floor for comments or questions. None were heard. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the Public Hearing. All voting aye, the motion was carried. The Public Hearing was adjourned at 7:40 p.m. 133 Wednesday, November 03, 1993 7:00 P.M. PUBLIC HEARING PRELIMINARY BUDGET FOR THE YEAR 1994 A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, 15 Terrace Road, Cortland, New York, on November 03, 1993 at 7:45 p.m. in regards to the 1994 Preliminary Budget of the Town. Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Bush; Assessor, David Briggs; Fire Commissioners, Tom Honour, Doug Staley, Treasurer, Joe During; Town residents, Fred Little and Robert Payne and Newsreporter, Skip Chapman. Supervisor Thorpe called the Public Hearing to order at 7:45 p.m. The Town Clerk read aloud the Legal Notice as posted and filed. Supervisor Thorpe advised the proposed Town rate is reduced for next year due to increased revenues from Sales Tax, which were higher than expected. The Town Board decided to keep our rate low to assist our residents as the rates in other areas are increasing. The Town rate is reduced from $3.18 to $1.55. The Village rates go from $1.54 to $1.55. Because the Villages also receive sales tax, we cannot apply our sales tax revenues to their portion of the budget. The Fire rate will remain the same. Councilman Rocco expressed pleasure of the business's that have chosen to locate in the Town. Wal- Mart and others have contributed to the town in many ways. Councilman O'Donnell recognized the attendance of the fire commissioners. This year there appears to be no questions relating to that area by the residents. He has not been contacted recently from McGraw area residents. Fire Commissioner, Tom Honour, spoke to the Town Board of improved communication between Town residents and the Fire Department. He also expressed appreciation of the work done by the Fire Department and the amount of monies raised by them, during the year, for their many projects. Treasurer, Joe During, commended the commissioners for the work they have accomplished. Councilman Rocco asked questions of the commissioners concerning their pension fund, and investment policy. A discussion ensued. Councilman Rocco made a motion, seconded by Councilman Testa to adjourn the Public Hearing. All voting aye, the motion was carried. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, on November 03, 1993 , at 7:00 p.m. with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present: Town Attorney, Phillip Rumsey; Attorney, John Ryan; Highway Superintendent, Carl Bush; Assessor, David Briggs; Cindy Bickford of Resource Associates; Fire Commissioners, Tom Honour, Doug Staley, Treasurer, Joe During; Town residents, Fred Little and Robert Payne and Newsreporter, Skip Chapman. The Regular Meeting was called to order by Supervisor Thorpe at 7:05 p.m., following a Public Hearing for Marshall Co., Aquifer Permit. Councilman Pilato made a motion, seconded by Councilman Rocco, to receive and file the Planning Board Minutes of September 28, 1993. All voting aye, the motion was carried. RESOLUTION #191 AUTHORIZE PAYMENT OF VOUCHERS NOVEMBER Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #398 - 420 $ 7,352.07 General Fund B 95 - 98 $ 3,991.66 Highway Fund 398 - 416 $ 81,277.41 Water Fund 217 - 232 $ 5,900.47 Sewer Fund 123 - 129 $ 77,206.26 Capital Projects 86 - 89 $108,012.12 Privilege of the floor was given to Councilman O'Donnell. He informed Town Board members of the status relating to the Bennett Street bridge located in McGraw. He distributed estimated cost figures received from Walt Tennant, Supt. of the Cortland County Highway Department. It included figures for three options, which was explained. He has advised that the bridge will need to be rebuilt or replaced in a few years. Councilman O'Donnell met with the Village of McGraw Officials to discuss the matter. They expressed interest about rebuilding the bridge at the same location. When he reported that the County would pay 85% of the cost and the remainder would be shared by the Village and Town, they wanted to review the other alternatives. Village Attorney, John Ryan, thanked Councilman 1 NOVEMBER 3, 1993 TOWN BOARD PAGE 2 O'Donnell for meeting with Village Officials and explaining the desire of this Town Board to work with them on this matter. He explained that he is reviewing the ownership of the old trolley lines and explained the process if land acquisition is necessary. Privilege of the floor was given to Cindy Backfired of Resource Associates. She submitted information and explained a request of Jim May Pontiac to relocate their business, which requires an Aquifer Permit. RESOLUTION #192 REFER APPLICATION FOR AN AQUIFER PERMIT FROM JIM MAY PONTIAC DEALERSHIP TO TOWN AND COUNTY PLANNING BOARDS Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, Resource Associates submitted a proposal from Jim May Pontiac Dealership, which requires an Aquifer Permit to construct a building on NYS Route 281, tax map #86.17-01-10.211, which is currently owned by Benderson Development Co., Inc., 570 Delaware Avenue, Buffalo, New York 14202, and BE IT RESOLVED, the request shall be forwarded to the Town and County Planning Boards for their review and recommendations. The reports of the various departments are on the table for review, and are available for inspection, upon request, in the Town Clerk's Office. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a letter from Nancy Sherman, President of Cortland County Chamber of Commerce. All voting aye, the motion was carried. The letter included the third quarter Income - Expenditure Statement for the Economic Development Program which the Town contributes to. RESOLUTION #193 SET DATE FOR A PUBLIC HEARING FOR A LOCAL LAW TO AMEND THE TOWN ZONING LAW RELATING TO MOBILE HOMES ON DECEMBER 15, 1993 AT 5:30 P.M. Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Local Law No 1 of 1993 relating to a Mobile Home Moratorium shall expire on December 31, 1993, therefore BE IT RESOLVED, that a Public Hearing shall be held on December 15, 1993 at 5:30 p.m. concerning the adoption of a Local Law to amend the Town Zoning Ordinance relating to Mobile Homes in areas of the Town zoned Agriculture, as proposed. Supervisor Thorpe reported that Bestway Enterprises Inc., located at 3877 Luker Road, has sent a letter NOVEMBER 3, 1993 TOWN BOARD PAGE 3 requesting an extension of the Towns sewer lines to accommodate their retail store, Builders Best. They have offered to contribute monies to accomplish this. He reported that this Town Board has justified an extension of our utility lines, in the past, to a facility if such action creates more jobs for area residents. The business has been required to contribute 37% of the construction cost. A discussion followed whereby the Town Board acknowledged that the sewer lines need to be extended in that area to protect the Aquifer. They requested time to review this request, and discuss it with the Town Engineer. No action was taken. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file the Water & Sewer Department's Aged list. All voting aye, the motion was carried. The Regular Meeting was recessed to hold Public a Hearing for the Aquifer Permit of Mohawk Valley Oil, Inc. RESOLUTION #194 DECLARE NEGATIVE IMPACT - AQUIFER SPECIAL PERMIT #7 OF 1993 - MOHAWK VALLEY OIL, INC. Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an Aquifer Special Permit application, #7 of 1993, was submitted by Mohawk Valley Oil, Inc. for their property located at the intersection of Route 41 and 11, to install an above -ground, 10,000 gallon low sulfur diesel tank into existing storage and containment area, and WHEREAS, the Cortland County Planning Board and the Town Planning have reviewed and recommended approval of this project, and WHEREAS, a Public Hearing was duly held by the Town Board, and WHEREAS, the Town Board, as Lead Agent, has completed the short environmental Assessment form for SEQRA, therefore BE IT RESOLVED, the Town Board does hereby declare the proposed project of Mohawk Valley Oil, Inc., shall have no significant impact on the environment. RESOLUTION #195 APPROVE AQUIFER SPECIAL PERMIT #7 OF 1993 FOR MOHAWK VALLEY OIL, INC. Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby approve Aquifer Special Permit #7 of 1993, submitted by Mohawk Valley Oil, Inc., and 1 1 RESOLVED, the Supervisor is hereby authorized to sign the application. NOVEMBER 3, 1993 TOWN BOARD PAGE 4 Supervisor Thorpe recessed the Regular Meeting to hold a Public Hearing regarding the 1994 Budget of the Town. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the regular meeting. All voting aye, the motion was carried.
