RESOLUTION 4181 AUTHORIZE RELEASE OF SECURITY
FUNDS FOR PROJECTS AT WALDEN OAKS
SUBDIVISION
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, the Barden & Robeson Construction Division Inc.
has deposited monies at the Cortland Savings Bank in the
amount of $29,691.00 for security reasons for completion
of roads within the Walden Oaks Subdivision, and
WHEREAS, these roads have been completed, accepted and
dedicated to the Town, therefore
°E IT RESOLVED, the Town Board of the Town of
Cortlandville does hereby authorize the release of the
funds held at the Cortland Savings Bank in the amount of
v29,691.00 to The Barden & Robeson Construction Division
Inc.
Privilege of the floor was given to Mr. Victor
Havran of 32 Halstead Road, Cortland.
He informed the Town Board about problems that have
not been 'taken care of by his business neighbor, Newell
Willcox, owner of Willcox Tire. fir. Willcox had spoke
to himself and his neighbor, Mrs. Flora Gibson, about
gutting a fence along their property lines. They did
not want a fence and requested a few pine trees be
planted along their property lines. Mr. [Willcox
promised the tress would be planted in the Spring of
1993, and this has not been done.
He also agreed to clean up debris and dead trees
located on the property line. Some of this has been
removed, However a large dead tree is still there and if
it were to fall, it could land on his house. Limbs from
t.�.is tree have all ready fallen.
Supervisor Thorpe stated that he would inform Mr.
Willcox of the situation, and request that the problem
be corrected.

WHEREAS, change order No. 4 has been submitted by the
Town Engineer for the Lamont Circle Sewer, Cortlandville
Fire Station Sewer, West Road Sewer and West Road Water
Improvement Projects for itemized changes, therefore
BE IT RESOLVED, the Town Board does hereby approve
Change Order No. 4 in the amount of $19,455.00 and the
contracts with Vacri Construction is hereby amended
accordingly.
