FOR PROPOSED LOCAL LAW NO. 1 FOR 1993, PROVIDING FOR A MORATORTUM ON THE ISSUANCE BY THE CORTLANDVILLE PLANNING MOARD OF .ITT UMCEMBEP 31, PLAN APPROVALS FOR MOBILE HOMES THROUGH 1993 A Public Hearing was held by the Town Board of _Le Town of Ccro3andvilla on july G7, 1993 at 7:00 p.m. at the Town Hall. 15 T?rrace Road, Cortland, New York, ccncerning Qe proposed Local Law No. 1 for 1993, providing for a moratorium on the issuance by the CortlandVile Planning Board of site plan approvals for mobile homes Ohruugh December 91, 1993 Members prsFent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Edwin O'Donnell. Others preEent were: CEO, Bruce Weber; Highway Sup't, Carl Bush; many Town residants, and Newsreporter, ichn Heid. The puhiic HEaring was called to order by Supervisor Raymond Thorpe at 7:00 p.m. The Town Clerk r3ad aloud the Legal Notice as posted and filed. Supervi8or Thorpe read the contents of the proposer� Local Law and explained the intent of this law. He then offered those 0 attendance the privilege of the floor. Mr Phillip Simon, co-owner of MVE Homes, Tompkins St. Ext., sPeke to tLe Town Board. He reported that due to the motorjuw last year, they lost 8 to 9 months of their selling season. This causes a hardship lox their business. He requested that a moratorium not be placed on the whole Town because of concern for a very small area. Their manufactured homes meet Federal building codes, and mest, or exceed State building codes. Mr. Simon feels that a moratorium of this kind will effect his business Hlung with other mobile home dealers in this area, which also effects their many employees. Many resMents of tha McGraw Ridge Road and South, Hill ROad areE expressed their concerns. Some wanted a moratorium townwide, others wanted it only for the area of the Heller Yarms, locat2d in their area. They were concerned that mobile homes would be allowed on the lots at thG Heller Farms or that a trailer park b---: allowed. He expresse6 concern abont providing affordable M.s_.ntJ for resSents, but alto anVerstecd the concerns of those who own homes and Au not wish to have a mobile home placed on tK6 !nt next to them. iULY 7, 1993 PUBLIC HEARING PAGE 2 Eon Beilby reported that according to census records the ratio for mobile homes in the Town of Cortlandvil.le is lower that other towns within the county. Other issues were discussed such as financing of mobile homes, restrictions and rules that would be .required for mobile homes, life expectancy of mobile homes, continued additions to mobile homes, increasing the tax base for the Town, etc. Code Enforcement Officer, Bruce Weber, explained the process at the present. time. A site plan permit is required for placement of a mobile home in an Ag District. It is submitted to the Town Planning Board for review, and action. A Public Hearing is not required for a site plan. A Variance is required in any other District. A Public Hearing is required for a variance, and the surrounding property owners are notified of -the Public Hearing. Supervisor Thorpe requested that a moratorium be put into effect and allow this board and other boards within the Town to review the thoughts that were presented, and modify the Town's Ordinance to accommodate the needs of the Town. Councilman Testa made a motion, seconded by Councilman Rocco, to adjourn the Public Hearing. All voting aye, the motion was carried. All voting aye, the motion was carried. RESOLUTION #112 AUTHORIZE PAYMENT OF VOUCHERS JULY Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #268 - 290 $ 30,648.30 General Fund B 47 - 62 $ 38,412.64 Highway Fund 230 - 257 $ 29,528.06 Water Fund 117 - 126 $ 2,035.53 Sewer Fund 62 - 71 $ 9,888.52 Capital Projects 43 - 48 $287,351.73 Reports of various departments are on the table for review, and are available for inspection, upon request, in the Town Clerks Office. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a copy of the letter sent to Mrs. Sheila Williams, of Pendleton St. Ext. by Supervisor Thorpe. All voting aye, the motion was carried. Included with the letter was the report of the County Sheriff's Department when they monitored traffic speeds on Pendelton Street Extension, per the petition request. RESOLUTION #113 ADOPT LOCAL LAW NO.! FOR THE YEAR 1993 MOBILE HOME MORATORIUM THROUGH DECEMBER 31, 1993 Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT ENACTED, by the Town Board of the Town of Cortlandville as follows: SECTION 1. Legislative Intent. The Cortlandville Town Board acknowledges the growing number of mobile homes being placed in the areas of the Town zoning Agricultural at rates and densities differing from area to area. The Board further acknowledges the concerns continuing to be expressed by Cortlandville residents about the need to develop a planned approach to address the circumstances. During the remaining months of calender year 1993, it is the intention of the Town Board to consult again with planning boards and to and to propose amendments to the Zoning Law relating to mobile homes. The Board further determines that without a moratorium on the issuance of site plan approvals for mobile homes, a planned approach to the circumstances may be frustrated or impossible. SECTION 2. RESOLUTION #117 REFER AQUIFER PERMIT REQUEST OF TED MARSHALL TO TOWN AND COUNTY PLANNING BOARDS AND SET DATE FOR PUBLIC HEARING FOR AUGUST 4, 1993 AT 7:00 P.M. Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, a request for an Aquifer Permit has been submitted by Ted Marshall, for Marshall Company, therefore BE IT RESOLVED, that the request be forwarded to the Town and County Planning Boards for their review and recommendations, and FURTHER RESOLVED, a Public Hearing date be set for August 4, 1993 at 7:00 p.m. RESOLUTION #118 SET DATE FOR A PUBLIC HEARING ON JULY 21, 1993 AT 5:00 P.M.
