Meeting of the Town Board of the Town was held at the Town Hall, 15 Terrace New York with Supervisor Raymond Thorpe Members present: Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, Philip Rumsey; Highway Supt', Carl Bush; Town Engineer, Hayne Smith; CEO, Bruce Weber; Nancy Jarvis of County Planning Dept.; Jeff TenEyck of Cortland County Soil and Water Conservation District; County Legislator, Frank Barbieri; Kevin Hanifin of NY DEC; Tom Dumas of Cortland County Cooperative Extension; Joe Eggleston of Cortland County Highway Dept; and Newsreporter, Skip Chapman, and Mike and Jeanette Smith, Doug and Carol Treacey, residents of the McGraw Marathon Road. The Regular Town Board Meeting was called to order AT 5:00 P.M., by Supervisor Raymond Thorpe following the Pledge of Allegiance to the Flag. Nancy Jarvis of County Planning and Jeff TenEyck of County Soil and Water Dept., spoke to the Town Board in regards to the proposed Stormwater Erosion Plan. By using proper stormwater management, more ground water discharge can be accomplished, which is important to this area. A slide show regarding stormwater management was shown. A Model Ordinance was developed by the NYS DEC and has been localized for the needs of Cortland County. When a developer requests approval of a project, they would be required to meet with several agencies to develop a plan for the needs of their project. Inspections could be done by County staff or train Town personnel. Stormwater management would occur when they are building their development as well as when they are installing a road. The cost is less to the developers, using this program, than trying to fix it afterwards. A sample ordinance will be presented to the Town Board for their review. It could be included into our current Zoning Law. If approved, both water quality and quantity could be accomplished. It would accomplish better use of our lands. Councilman O'Donnell made a motion, seconded by Councilman Testa, to recess the Regular meeting to hold a Public Hearing for the Starr Road Water Improvements Project. Mr. Smith apprised the Town Board of the damages done to his property, and his neighbors, due to high water and the erosion of their land by the stream located behind their homes. He has lost an additional 25-30 feet of land this spring. He would like to get back what he has lost, if possible. More important, is to find a solution to safeguard what they have left. You cannot just sit and watch your property be washed away. In 1974 or 1975 the County rerouted the stream as a result of a flash flood that caused many problems in the Village of McGraw. Around 1985 the County filled in with rift -raft to attempt to control the situation. This has not worked. The problem was reviewed again two years ago. Nothing was done. Exactly what was discussed then, has now happened. If nothing is done now, it will get worse. A large elm tree, located on the bank, will not withstand another bad storm. If it goes, it will be against -the small bridge located in the Village. Mr. Smith reported that he has requested both financial aid and assistance from Federal, State and County and local agencies for assistance, but has not accomplished. A discussion followed among those County and Town officials in attendance. It was so stated that it is almost impossible to receive funding for private property, and difficult for public funding. The Town Board requested Councilman O'Donnell to meet with Town and County officials, at the site, and attempt to reach a consensus concerning the problem. Reports of various departments are on the table for review, and are available for inspection, upon request, in -the Town Clerks Office. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a letter from John A. Fitch, Mayor of McGraw. All voting aye, the motion was carried. The letter advised of two large -trees in the stream east of McGraw which is diverting water out of the stream when the water is high, and has contributed to flooding at the Village Park. They asked if our Highway Dept. could clean out the trees and roots. Supervisor Thorpe reported that the matter has been referred to the Highway Sup't. RESOLUTION ft82 AUTHORIZATION TO GO OUT TO BID FOR STARR ROAD SEWER, STARR ROAD WATER AND STUPKE ROAD WATER IMPROVEMENTS PROJECTS Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Starr Road Sewer Improvement Project was approved by the Town Board on December 16, 1992, and the Starr Road Water Improvement Project was approved by the Town Board on April 21, 1993, and the Stupke Road Water Improvement Project was approved by the Town Board on January 6, 1993, therefore BE IT RESOLVED, the Town Engineer is hereby authorized and directed to let out for bid the three named projects, and such bids shall be opened on May 24, 1993 at 3:00 p.m.. Councilman Rocco made a motion, seconded by Councilman Pilato, to receive and file a complaint from Niagara Mohawk Power Corporation in regards to their 1993-1994 Special Franchise Assessments. All voting aye, the motion was carried. M APRIL 21, 1993 TOWN BOARD PAGE 7 Water and Sewer Administrator, Carl Bush informed the Town Board that they have attempted to hire an additional full time person through the civil service process. The need is for an Working Superintendent position. Civil Service does not have a job description for that position. One is being written now, and must be approved by Albany. Because it is a new position, a test will have to be given. The process could take as long as one year. Another delay, is the lack of a Personnel Director at the County level, The Town Board suggested to Carl that he contact The Association of Towns to see if they could help with this, or offer an alternative. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the meeting. All voting aye, the motion was carried.
