HomeMy WebLinkAbout12-20-2000DECEMBER 20, 2000 5:00 P.M. 1 TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Town Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Karen Q. Snyder Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Sup't.., Carl Bush; Water & Sewer Sup't. Peter Alteri; Planning Board Member, Nick Renzi; town bookkeeper, Marcia Hicks, ReRob LLC Attorney., Mike Shafer; Alliance Bank representative, Jeff Armstrong: town resident, Anthony Bonarti; and News Reporter, Chris Nolan. Supervisor Thorpe called the meeting to order. Supervisor Thorpe noted to those in attendance the two Public Hearings scheduled for tonight's meeting have been postponed until January 3, 2001. Councilman Testa made a motion seconded by Councilman O'Donnell, to approve the Town Board Minutes of October 4, 2000, as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion seconded by Councilman Testa, to approve the Town Board Minutes of October 18, 2000, as written. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the Zoning Board of Appeals Minutes of October 31, 2000 as written. All voting aye, the motion was candied. RESOLUTION #239 AUTHORIZE PAYMENT OF VOUCHERS-DECEMBER Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as f ollows: General Fund A General Fund B Highway Fund DB Water Fund Sewer Fund Capital Projects Vouchers #690 - 719 $27,348.31 149 - 156 $ 1,403.54 455 - 467 $41,863.99 318 - 330 $ 4,959.75 190 - 200 $ 1,629.44 50 - 51 $ 27.80 Supervisor Thorpe offered privilege of the floor to Jeff Armstrong. At the request of town bookkeeper, Marcia Hicks, Alliance Bank representative, Jeff Armstrong distributed brochures regarding PC Banker and explained some of the advantages of this service. PC Banker would assist the bookkeeper with viewing town accounts on line, making direct deposits and trips to the bank. The costto the town would be $14.95 a month with the first three months at no charge. Mrs. Hicks agreed this service would benefit the banking process for the town. �36 0 DECEMBER 20, 2000 TOWN BOARD MEETING PAGE 2 RESOLUTION #240 AUTHORIZE SUPERVISOR TO SIGN AGREEMENT WITH ALLIANCE BANK TO ESTABLISH PC BANKER Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Board does hereby authorize and direct the Supervisor to sign an agreement with Alliance Bank to establish PC. Banker for town banking needs at a cost of 14.95 per month. Planning Board member, Nick Renzi inquired into the status of Renaissance Development drainage project with MacNeill and Tagg Engineers. Councilman Testa explained the contract was signed and he will f ollow up with Mr. MacNeill. Monthly reports for the Supervisor and SPCA for November 2000 are on the table for review and filed in the Town Clerk's office. Attorney Folmer stated representatives from ReRob, LLC are present and are requesting a elate for a public hearing for their Aquifer Protection Permit application. The Board has not received recommendations from the Town Planning Board but these should be available by January. Attorney Folmer recommended the Board act as Lead Agent for this application regarding their SEQRA. RESOLUTION #241 SCHEDULE A PUBLIC HEARING FOR AN AQUIFER PROTECTION PERMIT APPLICATION SUBMITTED BY REROB, LLC FOR PROPERTY LOCATED AT NYS ROUTE 13 AND DECLARE THE TOWN BOARD AS LEAD AGENT Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be scheduled for January 17, 2001 at 5:00 p.m. for an Aquifer Protection Permmitapplication submitted by ReRob, LLC for property located at NYS Route 13 and Lime Hollow Rd. tax map #95.00-06-12.120, and it is further RESOLVED, the Town Board does hereby declare Lead Agent for said Aquifer Protection Permit application. Attorney Folmer reported: Orders for the financing of Crestwood Court and Page Green Road: Attorney Folmer has prepared the Orders for Crestwood Court and Page Green Road Water and Sewer projects. He will give these to Town Clerk, Karen Snyder for signatures and pick up later in the week. Resources Associates: Attorney Folmer stated in regards to a letter he forwarded to Tim Buhl of Resource Associates concerning Mr. Buhl's meeting with the Board on December 20, 2000. Mr. Buhl has requested postponing the meeting to January 17, 2001. Attorney Folmer agreed to this request. School Bus Violation on Isabel Drive: Attorney Folmer explained his determination regarding a school bus being parked at the Mingle's property on Isabel Drive. Attorney Folmer senta letter to the Mingles explaining the hours in which their- bus may be parked in their driveway. As long as these hours are adhered to and no other complaints are received, no formal prosecution will be filed. DECEMBER 20,2000 TOWN BOARD MEETING PAGE 3 Pall Trinity Micro: Attorney Folmer spoke with Mark Lockerby of Pall Trinity Micro concerning the meeting to be held with Les Sandman and the Board. Mr. Sandman is ill and the meeting has been postponed until January. Councilman O'Donnell made a motion seconded by Councilman Testa, to receive and file correspondence from Attorney Folmer to Tim Buhl of Resource Associates. All voting aye, the motion was carried. The correspondence was requesting Mr. Buhl meet with the Board regarding William McDermott Subdivision - Water Booster station, amending the date of December 20, 2000 to January 17, 2001. Councilman O'Donnell made a motion seconded by Councilman Testa, to receive and file correspondence from Attorney Folmer to Supervisor Thorpe. All voting aye, the motion was carried. The correspondence was regarding a zoning violation of a parked school bus located on Isabel Drive. RESOLUTION #242 AUTHORIZE HIGHWAY SUP'T. TO PURCHASE TWO MCK-UP TRUCKS FROM STATE BID Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Highway Sup't., Carl Bush, to purchase two 4x4 pick -Lip trucks, one for the highway department and one for the water and sewer department, from the State Bid list not to exceed $20,972.50 per truck, RESOLUTION #243 AUTHORIZATION TO RELEVY DELINQUENT WATER AND SEWER ACCOUNTS TO THE 2001 TA -A ROLL OF THE TOWN Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the list of delinquent accounts of the Water & Sewer Dept. of the Town was submitted, as required, therefore BE IT RESOLVED, the Town Board does hereby receive and forward the list of delinquent water and sewer accounts of the Town of Cortlandville to the Cortland County Real Property Tax Office, to be relevied onto the 2001 tax roll of the Town. RESOLUTION #244 AUTHORIZE SUPERVISOR TO TRANSFER $8.00 FROM THE WATER SURPLUS FUND TO THE CAPITAL PROJECT WATER ACCOUNT Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the bookkeeper has requested a cash advance be transferred from the Water Surplus Fund to the Capital Project Water Account for the Page Green Road Water Project, therefore BE IT RESOLVED, the Supervisor is hereby authorized and directed to transfer $8.00 from the Water Surplus Fund to the Capital Project Water Account, and it is further, RESOLVED, the Town Water Surplus Fund will be reimbursed when the project is bonded. 3 6,;),- DECEMBER 20, 2000 TOWN BOARD MEETING PAGE 4 Supervisor Thorpe opened a discussion regarding the installation of sidewalks by NYS DOT in conjunction with the widening of Route 281 from Fisher Avenue to the intersection of Route 281 and Route 13. The main concern discussed was the responsibility of keeping the sidewalks clear of snow. It. was decided if a problem arises with plowing, it would be dealt with at that time. The town should not be held responsible. In the future an ordinance will need to be drafted delegating responsibility. The Board agreed the proposed sidewalks will be an asset to the town. Also discussed was the Cortland Standard article referring to a traffic light being installed at the Luker Road and McLean Road intersection. Councilman O'Donnell made a motion seconded by Councilman Testa, to receive and file correspondence from County Legislator Chau-man, W. Stephen Harrington regarding the Board requesting a public hearing for a proposed security fence around the Cortland County Airport. All voting aye, the motion was carried. A discussion was held concerning the first Board meetings in January and February being at 5:00 p.m. It was decided February 7'h2001 would be held at 5.:00 p.m. RESOLUTION #245 ESTABLISH SCHEDULE OF TOWN BOARD MEETINGS FOR THE YEAR OF 2001 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the regular meetings of the Town Board of the Town of Cortlandville shall be held at the Town Hall, 3577 Terrace Road, Cortland, New York on the first 'Wednesday of each month at 7:00 p.m. and the third Wednesday of each month at 5:00 P.M. If such day should fall on a holiday, the meeting shall be held the next business day, and further RESOLVED, the May 2, 2001 meeting will be held in the Village of McGraw at the Community Center, and the June 6, 2001 meeting will be held in Blodgett Mills at the Blodgett Mills Independent Baptist Church, both held at 7:00 p.m., and it is further RESOLVED, the Town Clerk shall have the meeting schedule posted in the newspaper in Legal Notice form. RESOLUTION #246 APPROVE HOLIDAY SCHEDULE 2001 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the following Holiday Schedule for the year 2001 is hereby approved as f ollows: New Year's Day Monday January 01, 2001 Martin Luther Ding Birthday Monday January 15, 2001 Washington's Birthday Monday February 19, 2001 Good Friday Friday April 13, 2001 Memorial Day Monday May 28, 2001 Independence Day Wednesday July 04, 2001 Labor Day Monday September 03, 2001 Columbus Day Monday October 08, 2001 Election Day Tuesday November 06, 2001 Veterans Day Monday November 12, 2001 Thanksgiving Day Thursday November 22, 2001 Friday November 23, 2001 Christmas Eve Day Monday December 24, 2001 Christmas Day Tuesday December 25, 2001 New Years Eve Day Monday December 31, 2001 1 1 RESOLUTION #247 APPROVE CONTRIBUTION TO CORTLAND REPERTORY THEATRE Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a request was received from the president of the Board of Directors of Cortland Repertory Theatre for a contribution to their not -for -profit Cortland based theatre, therefore BE IT RESOLVED, the Town Board does hereby approve a $100.00 contribution to the Cortland Repertory Theatre. Attorney Foliner apprised the Board of the pending purchase offer for property located on the comer of Blue Creek Road and Route 281 is expected to be approved by Judge Rumsey soon. In anticipation of this approval, Attorney Folmer recommended the Board authorize the Supervisor to complete the purchase in this calendar year. The purchase is necessary to align Blue Creek Road with Fisher Avenue. RESOLUTION #248 AUTHORIZE SUPERVISOR TO COMPLETE PURCHASE AGREEMENT OF PROPERTY ON BLUE CREEK ROAD SUBJECT TO JUDICIAL APPROVAL Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Board approved a purchase offer of $35,000 of a parcel located at the corner of Blue Creek Road and Route 281 tax map #76.18-01-09.000, to align Blue Creek Road with Fisher Avenue (Res. #229 of 2000), therefore BE IT RESOLVED, the Board does hereby authorize and direct the Supervisor to complete said purchase of property, subject to judicial approval. Town Clerk, Karen Snyder, stated the NYS Racing and Wagering Board has been very helpful concerning the implementation of Bingo. She has forwarded all the necessary documentation to them and is now waiting for the town's municipal code number. Bingo can not be held in the town until that number is designated and received. Any organization wanting to begin their application process with the state can contact the Town Clerk's office for the NYS Racing and Wagering Board's phone number and address. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the Regular Meeting. All voting aye, the motion was carried.
