HomeMy WebLinkAbout08-19-1992Wednesday, August 19, 1992 5:00 P.M. 277 1 1 TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at 5:00 p.m.at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor, Raymond Thorpe presiding. Members present: Supervisor, Councilman, Councilman, Councilman, Councilman, Town Clerk, Others present were: Highway Bush and Newsreporter, Jenna Baer. Raymond Thorpe Edwin O'Donnell Theodore Testa Ronal Rocco Donald Beard Pauline Parker Superintendent, Carl The meeting was called to order by Supervisor Thorpe following the Pledge of Allegiance to the Flag. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the Zoning Board of Appeals Minutes of July 21, 1992. All voting aye, the motion was carried. RESOLUTION #158 AUTHORIZE PAYMENT OF VOUCHERS - AUGUST Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #306 - 327 $ 8,932.67 General Fund B 82 - 83 473.63 Highway Fund B 1 288.00 Highway Fund A 251 - 273 12,047.35 Water Fund 153 - 167 6,625.95 Sewer Fund 90 - 29.79 Capital Projects 52 - 55 1,057.53 Monthly reports are on the table for review and may be seen, upon request, in the Town Clerk's office. RESOLUTION #159 ACKNOWLEDGE DENIAL OF SMALL CITES BLOCK GRANT APPLICATION Motion by Councilman Beard Seconded by Councilman Testa VOTES; ALL AYE ADOPTED WHEREAS, Thoma Developments had submitted an application to the HUD Grant Program for a Small Cities Community Development Block for the Blodgett Mills area, therefore BE IT RESOLVED, the denial of the Town's application has been received, and such denial shall be received and filed. AUGUST 19, 1992 PAGE 2 Councilman Testa made a motion, seconded by Councilman O'Donnell, to receive and file the Notice of Extension, under Mechanic's Lien Law, on behalf of A. J. Vel, Ltd., against Piccirilli Bros. General Contractors, Inc., for the public improvement project, Groton Ave./ Rte 281 Sewer Project. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file a letter from Cort-Lanes Inc. All voting aye, the motion was carried. The letter advised that they have applied for a liquor license renewal. RESOLUTION #160 SET DATE FOR A PUBLIC HEARING FOR PALL TRINITY MICRO CORP. AQUIFER PERMIT #4 OF 1992 Motion by Councilman Beard Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, Pall Trinity Micro Corporation has submitted an application for an Aquifer Permit, therefore BE IT RESOLVED, that a Public Hearing shall be scheduled for October 7, 1992 at 7:30 p.m. for an Aquifer Permit for Pall Trinity Micro Corp, and FURTHER RESOLVED, that the application shall be referred to the Town and County Planning Boards for their review and recommendations. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file a letter received from Shirley A. Adams, of 4460 West Road. All voting aye, the motion was carried. The letter expressed concerns and questions about where to discard lawn debris, such as grass, leaves, tree branches and trimmings in the Town. Also, the lack of a noise ordinance within the Town. A discussion was held whereby Supervisor Thorpe agreed to contact Mrs. Adams and advise her of the status of her concerns. RESOLUTION #161 RESOLUTION TO BE PAID DIRECTLY ALL OF TOWN'S SHARE OF COUNTY SALES TAX Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town of Cortlandville pursuant to Tax Law Section 1262 elects to be paid directly all of its share of county sales tax which would otherwise be applied to reduce the county taxes levied upon real property in the Town of Cortlandville, and be it further RESOLVED, that pursuant to Tax Law Section 1262, this resolution shall be effective commencing with calendar year 1993, and it is further RESOLVED, that the Cortlandville Town Clerk shall forward a certified copy of this resolution to the Cortland County Treasurer and the Cortland County Director of Real Property Tax Services by registered or certified mail before September 1, 1992. 27- AUGUST 19, 1992 PAGE 3 RESOLUTION #162 AUTHORIZE A DOG ENUMERATION FOR THE TOWN OF CORTLANDVILLE Motion by Councilman Rocco Seconded by Councilman Beard VOTES: ALL AYE ADOPTED WHEREAS, the Budget Officer is reviewing the contract's to be renewed for 1993, one of them being the SPCA as the Dog Control Officer and to provide shelter for seized dogs, as required by the state, and WHEREAS, the income received from the dog licensing program is used entirely to pay for the cost of the required contract, and WHEREAS, the Town Clerk has advised that a dog enumeration has not been done in the Town of Cortlandville since 1984, and WHEREAS, the employees of the SPCA are familiar with the rules and regulations of the dog program, therefore BE IT RESOLVED, that the Town Board does hereby authorize an enumeration of the dogs within the Town, and RESOLVED, that the Supervisor is hereby authorized to contact the SPCA and negotiate a contract for next year which would include an enumeration. RESOLUTION #163 AUTHORIZE ESTABLISHING A NEW ACCOUNT, GENERAL FUND A3320.4 FOR ON -STREET PARKING Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Town Board authorized the purchase of traffic tickets to be used for Parking Violation Summons within the Town, therefore BE IT RESOLVED, that the Budget Officer is hereby authorized and directed to establish a new account, General Fund A3320.4 for the expenses of On -Street parking, and further RESOLVED, that the Budget Officer is hereby authorized to transfer $400.00 from A1990.4, Contingent Account, to A3320.4. RESOLUTION 0164 AUTHORIZE THE TRANSFER OF FUNDS Motion by Councilman O'Donnell Seconded by Councilman Beard VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Budget Officer is hereby authorized and directed to transfer $3,220.39 from B1990.4, Contingent Account, to the following to balance the 1992 budget: $1,196.00 to B1910.4, Unallocated Insurance and $2,024.39 to B7140.4, Recreation Center. AUGUST 19, 1992 PAGE 4 Councilman Rocco reported on his attendance of the Sewage Treatment Plant Commission meeting. The Town is an ad hoc member, only. Councilman Rocco asked to be replaced on this committee. A discussion was held whereby it was decided that Carl Bush or an employee of the Water and Sewer Dept. would attend the meetings on behalf of the Town. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the regular meeting. All voting aye, the motion was carried.
