TOWN BOARD MEETING
The Regular
Meeting of the Town Board of the Town
of Cortlandville,
was held at the Town
Hall, 15 Terrace
Road, Cortland,
New York, with
Supervisor, Raymond
Thorpe presiding.
Members Present: Supervisor,

Others present were Town Attorney, Phillip Rumsey;
Highway Superintendent, Carl Bush; and Newsreporter, Jon
Blackwell.
The meeting was called to order by Supervisor
Thorpe at 7:00 p.m., followed by the Pledge of
Allegiance.
Councilman O'Donnell made a motion, seconded by
Councilman Beard, to approve, as written, the Town Board
Minutes of April 1, April 15, May 6, and May 20, 1992.
All voting aye, the motion was carried.
Councilman Beard made a motion, seconded by
Councilman O'Donnell, to receive and file the Planning
Board Minutes of May 26, 1992. All voting aye, the
motion was carried.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file the Zoning
Board of Appeals Minutes of June 23, 1992. All voting
aye, the motion was carried..
RESOLUTION #152 AUTHORIZE PAYMENT OF VOUCHERS
AUGUST
Motion by Councilman O'Donnell
Seconded by Councilman Beard
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:
General Fund A Vouchers #277-305 $ 29,058.73
General Fund B 69- 81 38,031.84
Highway Fund 229-250 5,172.88
Water Fund 143-152 130,126.26
Sewer Fund 80- 89 77,072.07
Capital Projects 47- 51 355,972.63
Reports are on the table for review and may seen,
upon request, in the Town Clerk's office.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file a report of the
activities for 1991 from Warren Eddy of the Cortland
Free Library. All voting aye, the motion was carried.

Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file a letter received
from David P. Verostko, Corporate Vice President of
Smith Corona Corporation. All voting aye, the motion
was carried.
The letter informed the Town Board that they will
be reducing their work force, with mass layoffs
occurring, at their Smith Corona Plants in the Cortland
area. The letter is for compliance with the provisions
of the Worker Adjustment and Retraining Notification
Act.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file a letter from
Senator Daniel P. Moynihan. All voting aye, the motion
was carried.
The letter is in regards to Small Cities Hud Grant
for Blodgett Mills.
Councilman O'Donnell made a motion, seconded by
Councilman Beard, to receive and file a letter from Mr.
Barry A. Stevens, Regional Traffic Engineer of NYS DOT
in Syracuse. All voting aye, the motion was carried.
The letter advised that they have initiated a new
procedure to expedite completion of speed zone requests
on local roads. The letter was in reference to our
request to lower the speed limit on Sears Road.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file an Extension
of Notice under Mechanic's Lien Law for Public
Improvement. All voting aye, the motion was carried.
Vellano Bros., Inc. has extended their lien against
Piccirilli Bros., the contractor that was awarded the
bid for our Groton Ave./ 281 Sewer Project.
Councilman O'Donnell made a motion, seconded by
Councilman Beard, to receive and file a Notice of
Petition in regards to the assessment for Smith Corona
Corp. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file a Notice of Claim
on behalf of Arthur Dayton against the Town of
Cortlandville. All voting aye, the motion was carried.
The claim is a result of injury to Mr. Dayton when
the vehicle he was a passenger in struck the Towns
sweeper truck on April 29, 1992.
RESOLUTION #153 APPROVE CHANGE ORDER FOR BLUE CREEK
WATER STORAGE TANK FOR SUBGRADE
LEVELING BY SUBCONTRACTOR
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, there was a change order submitted for the
Blue Creek Water Storage Tank, Contract No. 2, for the
furnishing and placing subgrade leveling course by
subcontractor on a 'time and materials basis in
accordance with the extra work order no.1., therefore

BE IT RESOLVED, that approval be granted for change
order no.1 for the Blue Creek Water Storage Tank,
Contract No. 2 in the amount of $520.26.
RESOLUTION 0114 APPROVE CHANGE ORDER NO.2 FOR BLUE
CREEK WATER STORAGE TANK TO APPLY
THOROSEAL AND THOROCOAT SYSTEM TO
TANK WALLS
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, there was a change order submitted for the
Blue Creek Water Storage Tank to apply thoroseal and
thorocoat system to the tank walls, therefore
BE IT RESOLVED, that approval be granted for change
order no.2 for the Blue Creek Water Storage Tank in the
amount of $4,800.00. walls
RESOLUTION #155 AUTHORIZE TOWN ATTORNEY TO PROCEED
WITH PROCESS FOR A LIGHTING DISTRICT
FOR THE WALDEN OAKS SUBDIVISION
Motion by Councilman O'Donnell
Seconded by Councilman Beard
VOTES: ALL AYE ADOPTED
WHEREAS, there was a letter received from Barden &
Robeson Corp. requesting a special lighting district for
the Walden Oaks Subdivision, and
WHEREAS, the Town Board discussed the request and the
need for a special lighting district for the area
requested, therefore
BE IT RESOLVED, that the Town Attorney is hereby
authorized and directed to proceed with the process to
establish a Lighting District for the Walden Oaks
Subdivision.
A discussion was held concerning contractors and
developers submitting a "letter of credit" to us when a
monetary security is required. In the past it was
required to deposit monies in an account or issue a
certified check in the name of the Town.
The process was explained by the Town Attorney.
RESOLUTION #156 ACCEPT DEDICATION OF LANDS OF ROAD
REFERRED TO AS COMMONS AVENUE
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: AYE Councilman Testa,
O'Donnell and Beard
OPPOSED: Councilman Rocco
ADOPTED
WHEREAS, the Town of Cortlandville Highway
Superintendent has conditionally approved the road
currently referred to as "Common Avenue1° approximately
375 feet in length (extended from a portion additionally
proposed as a road section in the City of Cortland) as
shown on an "as -built" survey map of lands of Lee
Ambrose dated June 8, 1992 and certified July 30, 1992
by John S. MacNeill, Jr., P.C., and

WHEREAS, certain items such as completion of the surface
course and adequate "turnaround" area and Town water and
sewer construction are among the specifics required for
completion of the road, now, therefore
BE IT RESOLVED, that the Town of Cortlandville hereby
accepts the dedication of the lands referred to on the
above referenced map for road and highway purposes,
subject to the approval by the Town Attorney of the
title, deed and related necessary documents and further
subject to the approval of the town Superintendent of
Highways, with any conditions either or both deem
appropriate, and further subject to the placing of
monetary security (which may include and acceptable
letter of credit from a local bank) with the town of
Cortlandville to assure completion of the road, said
security to be in an adequate amount as determined by
the Town Superintendent of Highways.
Supervisor Thorpe apprised the Town Board of a
recent letter received from Cortland County Health
Director, James V. Feuss. The letter was his response
and concerns for a proposed subdivision to be located
east of the Walden Oaks Project. Water and sewer
concerns need to be addressed.
RESOLUTION #157 AUTHORIZE SUPERVISOR TO ADVISE TOWN
PLANNING BOARD OF CONCERNS WITH NEW
SUBDIVISIONS
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Board does hereby
authorize and direct the Town Supervisor to write a
letter to the Cortlandville Planning Board and request
that all future subdivisions be required to install
water and sewer lines within their proposed
developments, if at all feasible, to prevent further
contamination of wells due to septic tank failure.
Councilman Testa addressed the Town Board
concerning a call he received from a Town resident.
They asked where to dispose of leaves, brush or
branches.
A discussion followed. The Town nor County has an
area for compost materials. It would be necessary to
make arrangements with their private hauler.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to adjourn the regular meeting. All
voting aye, the motion was carried.
The meeting was adjourned at 7:35 p.m.
