TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 15 Terrace
Road, Cortland, New York, with Deputy Supervisor Raymond
Thorpe presiding.
Members present: Deputy Supervisor, Raymond Thorpe
Councilman, Edwin O'Donnell
Councilman, Theodore Testa
Councilman, Ronal Rocco
Deputy Clerk, Patty O'Mara
Absent: Supervisor, Melvin Pierce
Town Clerk, Pauline Parker
Others present were: Town Attorney, Phillip Rumsey;
Highway Superintendent, Carl Bush; Town resident, Mr.
William Pauldine with Attorney, James Baranello, and
Newsreporter, Trish Prospero.
The meeting was called to order by Deputy
Supervisor, Raymond Thorpe at 5:00 p.m. He requested
those in attendance to rise and Pledge Allegiance to the
Flag.
RESOLUTION # 94 AUTHORIZE PAYMENT OF VOUCHERS
MAY
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

Deputy Supervisor Thorpe offered privilege of the
floor to those in attendance.
No comments were heard.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to receive and file a letter from
Senator James L. Seward concerning the Chips program.
All Voting aye, the motion was carried.
He reported that monies were kept in the new state
budget for the Chips Program.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file a letter from
Senator Alfonse D'Amato concerning the Small Cities
Community Development Block Grant. All voting aye, the
motion was carried.

RESOLUTION # 95 AUTHORIZE PREPARATION OF DRAINAGE
EASEMENT FOR PAULDINE PROPERTY ON
BELL DRIVE
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, Mr. William Pauldine is attempting to sell his
property on Bell Drive and has requested the Town Board
to accept a drainage easement to complete the necessary
process, and
WHEREAS, the drainage situation has been reviewed by
many with expertise and experience of such, therefore
BE IT RESOLVED, that the Town Board does hereby
authorize the preparation of a drainage easement for the
property of William Pauldine on Bell Drive on the east
side of Lot #4, with conditions as required by the Town
Highway Sup't., and
FURTHER RESOLVED, that acceptance of such easement is
subject to approval of the Town Highway Sup't. and the
Town Attorney.
RESOLUTION # 96 RECEIVE PETITION TO REDUCE SPEED
LIMIT ON SEARS ROAD AND FORWARD TO
COUNTY AND NECESSARY AGENCIES
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, Town residents appeared before the Town Board
and requested the speed limit be reduced on the Sears
Road and were advised to present a petition, therefore
BE IT RESOLVED, that the petition of the residents of
the Sears Road is hereby received and filed, and further
RESOLVED, that the petition and request is forwarded to
the County Highway Sup't. as the Sears Road is a County
Road.
RESOLUTION # 97 ACKNOWLEDGE RECEIPT OF HUD
APPLICATION FOR "BLODGETT MILLS
REVITALIZATION AREA."
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Board does hereby
acknowledge receiving a copy of the application from
Thoma Development Consultants for the Blodgett Mills
Revitalization Area which was submitted to HUD.

RESOLUTION # 98 ACKNOWLEDGE REQUEST FROM TOWN ZONING
BD. OF APPEALS REGARDING ILLUMINATED
SIGNS
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, a request was received from the Town Zoning Bd.
of Appeals asking the Town Board to review the Town
Zoning Law regarding illuminated building mounted signs
because all variance request to date have been granted,
and
WHEREAS, concern was expressed by the Town Board of
changing the regulations because without reviewing the
variance requests, undesirable signs could be erected,
therefore
BE IT RESOLVED, that the request is hereby acknowledged
and shall be received and filed, and
RESOLVED, that the Town Attorney will contact General
Codes for sample codes on the matter, and report back to
the Town Board.
RESOLUTION # 99 AUTHORIZE PICCIRILLI BROS.TO MAKE
WATER AND SEWER CONNECTIONS WITHIN
THE TOWN
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, an application was received from Piccirilli
Bros. General Contractors, Inc. of Binghamton, NY, to be
allowed to make water and sewer connections within the
Town, and
WHEREAS, approval was recommended by the Town Engineer,
Hayne Smith, therefore
BE IT RESOLVED, that the
plumbers approval by
Contractors, Inc. is hereby
sewer connections within the
application submitted for
Piccirilli Bros. General
approved for both water and
Town, and
RESOLVED, that their name shall be added to the approved
plumber list of the Town of Cortlandville.
RESOLUTION # 100 AUTHORIZE TOWN JUSTICE TO HIRE MRS
VIRGINIA A. LANG AS TEMPORARY CLERK
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES ALL AYE ADOPTED
BE IT RESOLVED, that the Town Justice is hereby
authorized to hire Virginia A. Lang, as temporary Deputy
Court Clerk, for the maternity leave of Deputy Court
Clerk Margaret A. Capps, effective May 18, 1992, as per
requested and
BE IT FURTHER RESOLVED, that the salary be set at $6.50
per hour.

RESOLUTION # 101 ACCEPT RESIGNATION OF MELVIN H.
PIERCE AS TOWN SUPERVISOR
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, due to illness, Melvin H. Pierce , has advised
that he is no longer able to discharge his duties to the
Town, therefore
BE IT RESOLVED, that the Town Board does hereby accept
the resignation of Melvin H. Pierce as Supervisor of the
Town of Cortlandville, with sincere regret, effective
May 20, 1992, and further
RESOLVED, that the resignation is hereby received and
filed.
RESOLUTION # 102 ACCEPT RESIGNATION OF RAYMOND G.
THORPE AS TOWN COUNCILMAN
Motion By Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, Raymond G. Thorpe was elected as a Town
Councilman and also appointed as the Deputy Supervisor
of the Town of Cortlandville, and
WHEREAS, the resignation of Town Supervisor , Melvin H.
Pierce has been received and accepted, therefore
BE IT RESOLVED, that the Town Board does hereby accept
a letter of resignation from Raymond G. Thorpe as Town
Councilman, and
RESOLVED, that the resignation is hereby received and
filed.
RESOLUTION # 103 APPOINT RAYMOND G. THORPE AS TOWN
SUPERVISOR
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, due to the resignation of Melvin H. Pierce as
Supervisor of the Town of Cortlandville, and
WHEREAS, Raymond G. Thorpe was appointed the Deputy
Supervisor and has conducted the business of the Town
in the absence of the Supervisor, therefore
BE IT RESOLVED, that the Town Board of the Town of
Cortlandville does hereby appoint Raymond G. Thorpe as
Town Supervisor of the Town of Cortlandville, effective
immediately.

RESOLUTION # 104 APPOINT THEODORE TESTA AS DEPUTY
TOWN SUPERVISOR
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, Supervisor Raymond Thorpe has requested the
appointment of Theodore Testa as Deputy Supervisor
because as an independent business man he is more
accessible to the Town Hall, therefore
BE IT RESOLVED, that Theodore Testa is hereby appointed
Deputy Town Supervisor of the Town of Cortlandville,
effective immediately.
RESOLUTION # 105 AUTHORIZE LOWERING OF THE
SUPERVISOR'S SALARY
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, newly appointed Town Supervisor, Raymond Thorpe
reported that the experience during his tenure as Deputy
Supervisor, and partial retirement status,he has found
that the Department Heads and employees of the Town have
conducted the Town's business properly, and
WHEREAS, the duties of a Town Supervisor is the
administrative office of the Town Board and does not
warrant a full time Supervisor, therefore
BE IT RESOLVED, that, as requested, the annual salary of
the Supervisor of the Town of Cortlandville shall be
lowered to $5,000.00, effective immediately, and
BE IT RESOLVED, that hours established by Supervisor
Thorpe are hereby approved and are as follows:
Monday and Friday Available
Tues, Wed, Thurs. One hour per day
BE IT FURTHER RESOLVED, that Supervisor Thorpe will
continue as the Budget Officer, with no change.
RESOLUTION # 106 AUTHORIZE TOWN ENGINEER TO PREPARE
MAP, PLANS AND REPORT FOR THE WEST
ROAD PHASE I AND II WATER
IMPROVEMENT PROJECT
Motion by Councilman Testa
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Engineer, Hayne Smith, is
hereby authorized to prepare maps, plans and reports for
the West Road Phase I and II Water Improvement Project.

RESOLUTION # 107 AUTHORIZE TOWN ENGINEER TO PREPARE
MAP, PLANS AND REPORT FOR THE WEST
ROAD PHASE I AND II SEWER
IMPROVEMENT PROJECT
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Engineer, Hayne Smith, is
hereby authorized to prepare maps, plans and reports for
the West Road Phase I and II Sewer Improvement Project.
RESOLUTION # 108 AWARD BID FOR GUIDE RAIL AND BRIDGE
RAIL TO ELDERLEE, INC.
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, the Town Highway Superintendent was authorized
to let out bids for guide rails and bridge rails for two
bridges on Hoxie Gorge Road on May 6, 1992, and
WHEREAS, the following sealed bids were opened, and read
aloud on May 18, 1992 and given to the Highway Sup't.

Road, Oaks Corners, NY in the amount $21,177.30 for
option #2 which is to supply all the components and
install the post
RESOLUTION # 109 AWARD BID FOR BRIDGE REHABILITATION
TO KHM INC.
Motion by Councilman O'Donnell

VOTES: ALL AYE ADOPTED
WHEREAS, the Town Highway Superintendent was authorized
to let out bids for the bridge rehabilitation project on
Hoxie Gorge Road, and
WHEREAS, the following sealed bids were opened and read
aloud on May 18, 1992 and given to the Highway Sup't.

THEREFORE, BE IT RESOLVED, that the bid for Bridge
Rehabilitation on Hoxie Gorge Road is hereby awarded to
KHM, Inc of Binghamton, New York in the amount of
$55,900.00, subject to approval of the Town Highway
Sup't. and the Town Supervisor.
Due to a request of a Town resident, Councilman
O'Donnell asked for a clarification of our Zoning Law
in regards to size of building lots. In some zoning
areas, lot size requirements are larger if municipal
water and sewer are not available. What needs to be
done when the lot receives municipal services.
The Town Attorney reported that the language in our
Zoning Law already includes such wording. No change is
necessary.
RESOLUTION # 110 REQUEST SUPERVISOR TO REVIEW IDEAS
OF HONORING MELVIN H. PIERCE
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE adopted
BE IT RESOLVED, that the Town Board has requested the
Supervisor to review ideas to honor Melvin H. Pierce for
the many years of dedicated service that he has given to
the Town.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to adjourn the regular meeting and
convene to an executive session to discuss a matter
relating to personnel. All voting aye, the motion was
carried
The following information was received from the
Supervisors office:
A motion was made by Councilman O'Donnell, seconded
by Councilman Testa, to adjourn the executive session
and reconvene to the regular meeting. All voting aye,
the motion was carried.
No action was taken.
