PUBLIC HEARING
SMALL CITIES COMMUNITY DEVELOPMENT
GRANT APPLICATION FOR BLODGETT
MILLS AREA - HUD
A Public Hearing was held by the Town Board of the
Town of Cortlandville on April 15, 1992 at 5:30 p.m. at
the Town Hall, 15 Terrace Road, Cortland, New York for a
Small Cities Community Development Grant Application for
the Blodgett Mills Area.

The Public Hearing was called to order by Deputy
Supervisor, Raymond Thorpe at 5:30 p.m.
The Town Clerk read the Legal Notice as posted and
filed.
Linda Armstrong of Thoma Developments Inc,
Cortland, NY explained the process and intent of the
application that they are submitting to HUD for
approval.
They are resubmitting the same application that was
turned down last year. A few minor changes have been
made. At one time HUD wanted actual figures, now they
would prefer estimated figures.
The purpose of the grant, if approved, is to
improve substandard buildings in the Blodgett Mills
area. The intent is to assist those that are elderly,
and low -to -moderate income.
The application also includes a request of
$12,500.00, by the Town, to build sidewalks in the area.
The Town has dedicated $22,000.00 of in -kind services,
which would include labor and equipment, to accomplish
the project.
There being no further questions, Councilman Rocco
made a motion, seconded by Councilman O'Donnell, to
adjourn the Public Hearing. All voting aye, the motion
was carried.
The Public Hearing was closed at 5:40 p.m.

TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 15 Terrace
Road, Cortland, New York, with Deputy Supervisor,
Raymond Thorpe presiding.

The Meeting was called to order by Deputy
Supervisor Raymond Thorpe at 5:00 p.m. following the
Pledge of Allegiance to the Flag.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to approve, as written, the March 18,
1992 Town Board Minutes. All voting aye, the motion was
carried.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file the Zoning Board
of Appeals Minutes of March 24, 1992. All voting aye,
the motion was carried.
RESOLUTION #77 AUTHORIZE PAYMENT OF VOUCHERS

Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file "News Items
Record 1991" report from Town Historian, Alice
Blatchley. All voting aye, the motion was carried.
The reports of the various departments are on the
table for review and are available for inspection, upon
request, in the Town Clerk's Office.

RESOLUTION #78 ACCEPT STATEMENT OF COMPLETION FOR
MCLEAN ROAD SEWER PROJECT - 1990
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Statement of Completion for the
McLean Road Sewer Project - 1990, in the amount of
$330,358.98, is hereby accepted and shall be received
and filed.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file correspondence
from Richard J. Elliott, Director of the Cortland County
IDA. All voting aye, the motion was carried.
The correspondence is in reference to a request for
state funding for repairs to a number of railroad grade
crossings in Cortland Co., specifically Route 281 in the
vicinity of Pall Trinity Micro Corporation.
It was announced that an invitation for the Town
Board was received from the J.M.Murray Center, for their
25th Annual Meeting, which will be held on April 22,
1992 at Labrador Mountain Ski Area, Truxton, NY. Anyone
interested may contact them for reservations.
RESOLUTION #79 AUTHORIZE CONTRIBUTION TO VETERANS
MEMORIAL PARK WITH IN -KIND SERVICES
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a request was heard from several area veterans
for contributions for the construction of a Veterans
Memorial Park, and
WHEREAS, after researching Town Law, it is not
permissible to contribute taxpayers monies for such
project, however it was the consensus that it is
important to support our many veterans, therefore
BE IT RESOLVED, that the Town Board does herebv
authorize the Highway Dept. of the Town to contribute -
in -kind services to assist in the construction of the
Veterans Memorial Park, for a total value of $1500.00.
Deputy Supervisor Thorpe reported that he had
requested the Assessor, David Briggs, to review our
assessment program in regards to values of vacant lots
owned by contractors, as requested by the Town Board.
What would the impact be on property owners if those
lots were assessed at 70%.
Assessor, David Briggs advised that he has
researched the request, and has looked for advice from
those at the state level. The State has established
programs of exemptions to property owners such as
elderly and veteran exemptions etc, but there is no
avenue for the Town to institute a program to grant
relief for one class of property. Changing the benefit
tax was permissible because it would only effect a
district. Changing assessments would affect the whole
Town.

The Town Board cannot act or adopt procedures for
schools or the County. This change would affect their
tax levy.
State Officials have advised that they would send
information if there was another method. To date, he
has received nothing.
Assessor Briggs reported that he had reviewed the
tax liability of several of the newer subdivisions in
the Town. Their total tax liability on the whole
development equaled 50 to 60 percent of the value that
they are receiving for the sale of one lot.
It was the intent of the Town Board to encourage
development which would enlarge our water and sewer
services in the Town.
No action was taken.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file two letters
received from Senator Ralph Marino, and Assemblyman
Clarence D. Rappleyea in regards to the State Water Tax.
All voting aye, the motion was carried.
RESOLUTION #80 APPROVE WATER & SEWER PLUMBER'S
APPLICATION OF HAROLD MAYBURY
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, an application was submitted from Harold
Maybury, 270 Strong Road, Preble, New York to be allowed
to make water and sewer connections within the Town, and
WHEREAS, such application included references and
previous experience, therefore
BE IT RESOLVED, that the application submitted by Harold
Maybury is hereby approved for both water and sewer
connections, and further
RESOLVED, that his name shall be added to the approved
plumber list of the Town of Cortlandville.
RESOLUTION #81 SET DATE FOR PUBLIC HEARING FOR
LOCAL LAW NO. 2 FOR THE YEAR 1992
Motion by Councilman O'Donnell

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that a Public Hearing shall be held on
May 6, 1992 at 7:30 p.m. for Local Law No. 2 for the
year 1992 to provide new requirements for the size,
placement and location of mobile homes.
RESOLUTION #82 APPROVE MCGRAW CENTRAL SCHOOL
DISTRICT TO USE VOTING MACHINE
FOR THE ANNUAL BUDGET VOTE

WHEREAS, McGraw Central School District sent a letter to

Town Supervisor, Melvin Pierce, requesting the use of
the Cortlandville voting machine for their annual Budget
Vote, therefore
BE IT RESOLVED, that approval is hereby granted for the
McGraw Central School District to use the Cortlandville
voting machine for Wednesday May 1, 1192 and allow the
custodians to pick up the machine on May 5, 1992 to have
it prepared for voting.
RESOLUTION #83 APPOINT RONAL ROCCO AS AD HOC MEMBER
TO THE WASTEWATER TREATMENT FACILITY
ADVISORY BOARD
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a request has been received from Douglas F.
Jones, Chief Operator of the City of Cortland Wastewater
Treatment Facility, for an appointment of an alternative
person to serve on their Advisory Board, due to the
absence of the Town Supervisor, therefore
BE IT RESOLVED, that Councilman Ronal Rocco is hereby
appointed as an Alternate ad hoc member, to represent
the Town of Cortlandville on the Wastewater Treatment
Facility Advisory Board, effective immediately, with
their next meeting scheduled April 20, 1992.
RESOLUTION #84 AUTHORIZE BOOKKEEPER TO WITHHOLD
FICA AND MEDICARE FROM ELECTION
INSPECTORS. PER IRS RULING
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, NYS Audit and Control, NYS Social Security and
the IRS have advised of a new ruling in regards to
withholding taxes for anyone receiving monies over the
limit of $100.00, and
WHEREAS, those election inspectors who work more than
one day during the year exceed the $100 limit on the
monies paid to them, and because this year is a
Presidential Election, more sittings are required of
election inspectors, therefore
BE IT RESOLVEd, that the bookkeeper is hereby authorized
and directed to withhold FICA and Medicare taxes from
the monies paid to election inspectors, and process
their payments through the Town payroll system.
Councilman Rocco asked about
the status of
Tax
Collection this year.
Pauline Parker, Tax Collector,
reported that
this
years collections compare to that
in the past.
Most
bills are paid. A letter will be sent
to every one
that
has an unpaid tax bill the beginning
of next month.
The
law was changed last year concerning this.
Taxes will be collected until the
end of May.
All
unpaid bills are returned to the
County Treasurers
Office the first week of June.

The regular meeting was recessed to hold a Public
Hearing concerning the Proposed Small Cities Community
Development Grant Application for the Blodgett Mills
Area.
The regular meeting was reconvened following the
Public Hearing.
RESOLUTION #85 APPROVE AND AUTHORIZE SUPERVISOR TO
SIGN $392,918 SMALL CITIES COMMUNITY
DEVELOPMENT GRANT APPLICATION FOR
BLODGETT MILLS AREA
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, Thoma Development Consultants was authorized
to investigate and prepare a Small Cities Community
Development Grant Application for housing rehabilitation
in the Blodgett Mills area, and
WHEREAS, a Public Hearing was duly held by the
Cortlandville Town Board on April 15, 1992, and
WHEREAS, the Cortlandville Town Board has reviewed that
submitted from Thoma Development Consultants, therefore
BE IT RESOLVED, that the Town Board of the Town of
Cortlandville does hereby approve the $392,918 Small
Cities Community Development Grant Application
presented for housing rehabilitation in the Blodgett
Mills area, and
FURTHER RESOLVED, that the Deputy Supervisor is hereby
authorized and directed to sign the Grant application to
be submitted to HUD
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to adjourn the regular meeting and
convene to an executive session to discuss possible
litigation.
The following information was received from the
Supervisor's office.
Councilman Rocco made a motion, seconded by Councilman
O'Donnell to adjourn the executive session and reconvene
to the regular meeting. All voting aye, the motion was
carried.
RESOLUTION #86 AUTHORIZE SUPERVISOR TO EXECUTE AN
EASEMENT REGARDING WATER LINES ON
HIGHLAND ROAD AND RELEASE SECURITY
CHECK TO WM. MCDERMOTT
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, this Board adopted Resolutions No. 233 and 234
September 21, 1988 and Resolution No. 317 on December
20, 1989 resolving to hold a check in the amount of
$35,000.00 from William McDermott relating to water
lines and water pumps at the location of Highland Road
and "Wood Edge" Subdivision, and

WHEREAS, there currently exists no town -owned or
serviced water lines from Highland Road to Wood Edge
Subdivision, but a privately owned 6 or 8 inch line runs
from the Highland Road Town water line to the William
McDermott home (the only currently constructed home in
Wood Edge Subdivision), and
WHEREAS, said privately -owned 6 or 8 inch water line has
insufficient pressure for water service for additional
homes to be constructed in the "Wood Edge" Subdivision
without an appropriate pump station being designed and
constructed for such service, and
WHEREAS, said privately -owned 6 or 8 inch water line is
believed to be located within the right-of-way of a
proposed road conditionally dedicated to the Town, it is
hereby
RESOLVED, that the Cortlandville Town Supervisor is
authorized to execute an easement, in form approved by
the Town Attorney, to the appropriate owner, to maintain
the existing private water line outside the proposed
pavement area and within the right-of-way of the
conditionally accepted road dedication running from
Highland Road into the Wood Edge Subdivision, and it is
further
RESOLVED, that the Town Clerk is hereby authorized to
return to William McDermott the check #2396 payable to
the Town of Cortlandville in the amount of $35,000.00
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to adjourn the regular meeting.
All voting aye, the motion was carried.
The Regular meeting was adjourned at 6:10 p.m.
