PUBLIC HEARING LOCAL LAW NO. 2 OF 1992 AMENDING ZONING LAW - MOBILE HOMES DEFINITION OF COMMUNICATION TOWER A Public Hearing was held by the Town Board of the Town of Cortlandville on March 18, 1992 at 5:30 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York for Local Law No. 2 of 1992 providing for the Amendment of Local Law No. one for the year 1986 relating to the definition of communication tower and the requirements and locations of mobile homes. Members present: Absent: Deputy Supervisor, Councilman, Councilman, Councilman, Town Clerk, Raymond Thorpe Edwin O'Donnell Theodore Testa Ronal Rocco Pauline Parker Supervisor, Melvin Pierce Others present were: Town Attorney, John Ryan; Highway Sup't., Carl Bush; Assessor David Briggs; Code Enforcement Officer, Bruce Weber, and several residents from the Town and also several from the County and surrounding areas. The Public Hearing was called to order by Deputy Supervisor, Raymond Thorpe at 5:30 p.m. The Town Clerk read the Legal Notice as posted and filed. Comments were heard from those in attendance: Mr. Gerald Filletta, spoke on behalf of the Cortland County Communications Group. He expressed their concerns in regards to Ham Radio Operators. He explained that they are regulated by Federal and State regulations, because they provide a service for an emergency occasion. A copy of the Town of Homer's ordinance was supplied to the Town Board. It was explained that their's was a workable ordinance. Others in attendance offered similar comments. It was a consensus of the Town Board that the matter should be referred back to the Town Planning Board for further review. After a short intermission, the hearing continued concerning the matter of Mobile Homes. A letter from Melvin and Phil Simon, owners of MVE Homes, was read. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to acknowledge the letter as a part of the hearing. All voting aye, the motion was carried. Their letter expressed their concerns of the proposed changes. They also submitted a list of recommendations. 1 LJ 1 Public Hearing PAGE 2 205 1 1 1 In attendance were residents that live within the Cortland Estates Mobile Home Park. Due to the problems they are having there, they encouraged the Town Board to make allowances to place Mobile Homes someplace within the Town other than for farming tenant purposes. Comments were heard from senior citizens that many of them do not require the additional room, that a double wide mobile home would provide. A single wide mobil home is sufficient, and the cost is something that they can deal with. An explanation of the permanent masonry foundation was explained. It was not the intent that it would require a cellar. A crawl space beneath the mobil home is sufficient. Councilman O'Donnell made a motion, seconded by Councilman Testa, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was adjourned at 6:40 p.m. 206 Wednesday, March 18, 1992 5:00 P.M. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Deputy Supervisor Raymond Thorpe presiding. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Supervisor, Melvin Pierce Others present were: Assessor, David Briggs; Town Engineer, Hayne Smith: Highway Sup't., Carl Bush, and Mr. William McDermott. The meeting was called to order by Deputy Supervisor Raymond Thorpe at 5:00 p.m. RESOLUTION #58 AWARD BID FOR BLUE CREEK RD. WATER STORAGE TANK, CONTRACT NO. 2 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, per Resolution #41 of February 5, 1992, authorization was given to the Town Engineer, to let out for bid for the Blue Creek Rd. Water Storage Tank, Contract No. 2, and WHEREAS, the following bids were opened on March 17, 1992, at 3:00 p.m. and given to the Town Engineer for review, Preload Inc. $714,887.00 839 Steward Ave. Garden City, NY 11530 Natgun Precast Inc. $619,016.00 11 Teal Rd. Wakefield, Ma. 01880-1292 THEREFORE, BE IT RESOLVED, that the bid for the Blue Creek Rd. Water Storage Tank, Contract No.2 project, is hereby awarded to Natgun Precast, Inc. in the amount of $619,016.00. Councilman O'Donnell made a motion, seconded by Councilman Testa, to approve as written,the Town Board minutes of February 5, 1992. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the Zoning Board of Appeals minutes of February 25, 1992. All voting aye, the motion was carried. :207 MARCH 18, 1992 PAGE 2 RESOLUTION #59 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #100 - 137 $22,084.99 General Fund B 16 - 19 $ 484.67 Highway Fund 61 - 78 $10,710.33 Water Fund 39 - 51 $ 9,023.44 Sewer Fund 20 - 27 $ 558.66 Capital Projects 11 - 13 $ 958.77 Town Justice, Mardis Kelsen, presented a form to be used by Police Agencies for a Parking Violation Summons in the Town of Cortlandville. The form is a three part form. One for the court, one for the issuing officer and the third, for the violator. This can be used as a mail in, if desired. The address and all information is available on the form. All revenues derived from this will come back to the Town. Mr. William McDermott of Woods Edge Road, advised the Town Board that he wishes to dedicate 800 feet of his road to the subdivision. Town, due to a pending sale in his RESOLUTION #60 ACCEPT ROAD DEDICATION OF 800 FEET WITHIN HIGHLAND HEIGHTS SUBDIVISION CONTINGENT UPON APPROVAL BY TOWN ATTORNEY Motion by Councilman O'Donnell Seconded by Councilman Testa Votes: ALL AYE ADOPTED WHEREAS, due to a pending sale within the Highland Heights subdivision owned by William McDermott, and WHEREAS, Mr. McDermott desires to dedicate 800 feet of his road, known as Woods Edge, to the Town of Cortlandville, and WHEREAS, construction of said road is not yet complete in accordance with Town specifications, therefore BE IT RESOLVED, that upon receipt of necessary deposited escrow construction funds, contracts and other documents submitted to the Town Attorney, and approval of such, the Town of Cortlandville shall accept the dedication of 800 feet of the road known as Woods Edge, as a dedicated road in the Town of Cortlandville. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the Town Justices February 1992 monthly report. All voting aye, the motion was carried. MARCH 18, 1992 PAGE 3 RESOLUTION #61 AUTHORIZE PURCHASE OF WATER SAVING SHOWER HEADS AND ESTABLISHING A REVOLVING FUND ACCOUNT Motion by Councilman Testa Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED WHEREAS, Engineer, Hayne Smith, requested that the Town purchase water saving shower heads, and have them available to sell to the public,in the Water and Sewer Department of the Town, and WHEREAS, such action would be a water conservation effort on behalf of the Town, therefore BE IT RESOLVED, that the Water and Sewer Department of the Town of Cortlandville is hereby authorized to purchase a supply of water saving shower heads, with a maximum cost of $400.00, and RESOLVED, that the water saving shower heads will be sold to the public, and RESOLVED, that a Revolving Fund Account shall be set up to accommodate the program. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the letter received from John E. Corp, Project Manager of the New York State Revolving Fund for Water Pollution Control. All voting aye, the motion was carried. The letter advised that our project has been deleted from their list for proposed funding, per their telephone conversation with the Town Engineer. Councilman Testa made a motion, seconded by Councilman O'Donnell, to receive and file the correspondence relating to a bill received from Cortland Memorial Hospital. All voting aye, the motion was carried. A blood test was drawn at the Cortland Memorial Hospital as requested by a New York State Trooper. The hospital was directed to send the bill to the Town. The Town felt it was not our responsibility to pay. RESOLUTION #62 AUTHORIZE RESOLUTION REQUIRED BY STATE COMPTROLLER RELATING TO LAMONT CIRCLE SEWER EXTENSION Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, by Resolution of April 3, 1991 this Board has determined to extend the Town of Cortlandville "Article 12-c" Sewer Improvement to the Lamont Circle area of the Town, and WHEREAS, said sewer extension requires approval of the Comptroller of the State of New York, now therefore, be it RESOLVED, that with regard to the Lamont Circle Area Sewer Improvement Extension application to the State Comptroller, verified March 13, 1992 this Town Board MARCH 18, 1992 PAGE 4 1. directed the preparation of said Application; and it was prepared at such direction; 2. believes the contents of the Application to be accurate; 3. has determined that the said extension and expenditure therefore, for which permission is sought, is in the public interest and will not constitute an undue burden on the property which will bear the cost thereof; 4. has determined that all real property to be assessed in whole or in part as a benefited area will be benefited by the proposed improvements, and no benefited property has been excluded. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file the responses received from State Officials in regards to the CHIPS program. All voting aye, the motion was carried. The letters were received from Assemblyman, Clarence Rappleyea; Senator Ralph Marino and Assemblyman, Michael Bragman, as a result of our request to continue with funding for the CHIPS program. RESOLUTION #63 AUTHORIZE DAVID DALEY TO MAKE WATER AND SEWER CONNECTIONS WITHIN THE TOWN Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an application was received from David Daley, P.O. Box 148, Truxton, New York, to be allowed to make water and sewer connections within the Town, and WHEREAS, such application included information of previous experience, therefore BE IT RESOLVED, that the application submitted by David Daley is hereby approved for both water and sewer connections within the Town, and RESOLVED, that his name shall be added to the approved plumber list of the Town of Cortlandville. Water and Sewer Administrator, Carl Bush, requested the Town Board to approve future plumbers upon his recommendation. He had not reviewed the application. RESOLUTION #64 SET DATE FOR A PUBLIC HEARING FOR THE COMPREHENSIVE HOUSING AFFORDABILITY AND STRATEGY FOR THE BLODGETT MILLS COMMUNITY BLOCK GRANT Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that a Public Hearing shall be held by Thoma Development on April 15, 1992, at the Town Hall at 2:00 p.m. for the Comprehensive Housing Affordability and Strategy for the Blodgett Mills Community Block Grant. 21- 0 MARCH 18, 1992 PAGE 5 RESOLUTION ##65 AUTHORIZE JUNKING OF OLD ROTARY TELEPHONES Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a new telephone system has been installed at the Town Hall, therefore BE IT RESOLVED, that the Town Board does hereby authorize junking of old rotary telephones. Councilman Ronal Rocco advised that he has audited the books of the Supervisor of the Town and all is in order. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the regular meeting and hold a Public Hearing for Local Law No. 2 of 1992. All voting aye, the motion was carried.
