The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, on February 19, 1992. at 5:00 p.m. with Deputy Supervisor Raymond Thorpe presiding. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Theodore Testa Deputy Town Clerk, Patricia O'Mara Absent: Supervisor, Melvin Pierce Town Clerk, Pauline Parker Others present were: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Bush; Town Assessor, David Briggs; Newsreporter, Laura Jones; numerous Cortland Area Veterans, representing, Disabled American Veterans, Veterans of Foreign Wars, and several other Cortland County Chapter Veterans. The Town Board Meeting was called to order by Deputy Supervisor Raymond Thorpe, at 5:00 p.m. followed by the Pledge of Allegiance to the Flag. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the Cortlandville Zoning Board of Appeals minutes of January 09, 1992, and January 28, 1992. All voting aye, the motion was carried. RESOLUTION #46 AUTHORIZE PAYMENT OF VOUCHERS FEBRUARY Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers 48-86 $12,933.55 General Fund B 9-11 $ 3,286.70 Highway Fund 24-43 $ 8,543.74 Water Fund 21-30 $ 3,695.02 Sewer Fund 16-18 $ 2,501.15 Capital Projects 6- 8 $ 1,377.80 Deputy Supervisor, Raymond Thorpe offered the privilege of the floor to the many Veterans that were in attendance. Mr. Frank Barbieri, County Legislator, made an introduction to the Town Board, on behalf of the Cortland County Veterans. He stated that a Veterans Memorial Park is being constructed in the City of Cortland, on the property of the Cortland County Court House. The Park will be dedicated to MIA's. They are requesting this Town Board to assist in paying for the construction cost. 95 FEBRUARY 19, 1992 PAGE 2 Mr. Dexter Paddock read a letter that he had published in the Cortland Democrat in regards to the Benefit of the Memorial Park. Mr Dick Parker introduced himself as the Treasurer to accept donations for the Cortland County Veterans Memorial Park. Mr. Fred Janke distributed a map, showing how the park will look after it has been constructed. He also explained the Theme of the Memorial Park. Mr John Morris is the architect and spoke of the construction of the Park. Dedication of the Park is set for Memorial Day 1992. They have raised $60,000 in 2 1/2 years for the construction cost. It will cost approximately $10,000 to $15,000 more for completion. Deputy Supervisor, Raymond Thorpe, addressed the Veterans to advise that the Councilmen would have to discuss this issue further, and confer with Council to see if a donation is appropriate. Those in attendance reported that The Village of McGraw is giving them a donation. The City of Cortland has given In -kind Services. No action was taken. RESOLUTION #47 REQUEST COMMITMENT OF CHIPS FUNDS AND LONG TERM DEDICATED HIGHWAY FUNDS FROM THE STATE HIGHWAY ASSISTANCE PROGRAM Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the current State budget proposes a 20 million dollar reduction in CHIPS 0 & M funds which represents an overall 24% reduction to the 1991 CHIPS 0 & M funding level; and WHEREAS, the Town of Cortlandville is responsible for the maintenance and operation of 67.87 centerline miles of highways which the CHIPS money has been an integral part of the Town's operation and maintenance effort; and WHEREAS, any reduction of this assistance at this time would deny the residents of Cortlandville with essential maintenance that promotes their health, safety and overall economic well being; and WHEREAS, the Town Board of Cortlandville represents a total population of approximately 8.054, which current CHIPS funding could be reduced from $59,872 to $45,502, which could seriously effect the local maintenance of town roads; and now THEREFORE BE IT RESOLVED, that the 1991 CHIPS FUNDS be maintained and committed to a properly funded long term DEDICATED HIGHWAY FUND become a permanent component of the State Highway Assistance Program. This resolution shall take effect immediately upon its adoption. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the Water and Sewer Annual Budget Report for 1991. All voting aye, the motion was carried. 196 FEBRUARY 19, 1992 PAGE 3 Councilman Testa made a motion, seconded by Councilman Rocco, to receive and file correspondence to James J. Baranello Esq. from Phillip Rumsey Esq..All voting aye, the motion was carried. The letter explained the process and the requirements necessary of Walden Oaks regarding the proposed road dedication within their subdivision. Councilman Testa made a motion, seconded by Councilman Testa, to receive and file a letter from William G. Bailey, President, of George B. Bailey Agency, Inc., concerning the Denniston Agency. All voting aye, the motion was carried. They have recently purchased The Denniston Agency, and advised that they are looking forward to doing business with the Town. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file a copy of a letter from Douglas C. Staley, Fire Commissioner, of the Cortlandville Fire District. All voting aye, the motion was carried. The Fireman advised the U.S. Environmental Protection Agency that they are working together with 'the Town concerning their dry wells and septic system. They anticipate that the Town will provide a sewer line connection sometime in 1992. RESOLUTION #48 SET DATE FOR A PUBLIC HEARING FOR LOCAL LAW NO.2 OF 1992 AMENDING THE ZONING ORDINANCE OF THE TOWN OF CORTLANDVILLE - MOBILE HOMES AND COMMUNICATION TOWERS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Local Law No. 1 of 1992 provided for a moratorium for Mobile Homes in the Town, and the matter was referred to the Cortlandville Planning Board, and WHEREAS, -the Cortlandville Planning Board has submitted their recommendation of suggested amendments to the Town's Zoning Ordinance in regards to Mobile Homes, and WHEREAS, the Cortlandville Planning Board has also requested the Town's Zoning Ordinance to include a definition of Communication Towers, therefore BE IT RESOLVED that a Public Hearing shall be held on March 18, 1992, at 5:30 P.M., at the Town Hall, concerning Local Law No. 2 of 1992. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to recess the Regular Meeting and convene to an Executive Session to discuss a personnel problem. All voting aye, -the motion was carried. All voting aye, the motion was carried. No action was taken. Councilman Rocco made a motion, seconded by Councilman O'Donnell to adjourn the Regular Meeting. All voting aye, the motion was carried.
