PUBLIC HEARING A Public Hearing was held by the Town Board of the Town of Cortlandville on January 8, 1992 at 7:00 P.M. at the Town Hall, 15 Terrace Road, Cortland, New York for Local Law No.1 of 1992 providing for the extension of moratorium on the issuance by the Cortlandville Planning Board of Site Plan Approvals for mobile homes through March 31, 1992. Members Present: Absent: Deputy Supervisor, Councilman, Councilman, Councilman, Town Clerk, Raymond Thorpe Edwin O'Donnell Theodore Testa Ronal Rocco Pauline Parker Supervisor, Melvin Pierce Others present were: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Bush; Typist, Edna Puzo, Mr. and Mrs. Carl Applegate of Blodgett Mills and Melvin Simon of MVE Homes.and several Town residents. The Public Hearing was called to order by Deputy Supervisor Raymond Thorpe at 7:00 p.m. The Town Clerk read the Legal Notice as posted and filed. Deputy Supervisor Raymond Thorpe advised that this is only an extension of the time limit on Local Law No.1 of 1991 for the moratorium on the issuance by the Cortlandville Planning Board of Site Plan Approvals for Mobile homes. This will only affect Ag district only. Deputy Supervisor Raymond Thorpe offered the privilege of the floor to Melvin Simon, co-owner of MVE Mobile Home Sales. He spoke of the effect that the moratorium would have on his business, and submitted a letter, which he requested it to be acknowledged as part of the minutes. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the letter from Mr. Melvin Simon and Mr. Phillip Simon, owners of MVE Mobile Home Sales. All voting aye, the motion was carried. The letter expressed opposition to the extension of the Mobile Home Moratorium. No other questions or comments were heard. TOWN BOARD MEETING The Regular Meeting of the Town of Cortlandville has held at 7:00 p.m. 15 Terrace Road, Cortland, New Supervisor, Raymond Thorpe presiding. Members present: Absent: Deputy Supervisor, Councilman, Councilman, Councilman, Town Clerk, Supervisor, Board of the Town at the Town Hall, York with Deputy Raymond Thorpe Edwin O'Donnell Theodore Testa Ronal Rocco Pauline Parker Melvin Pierce Others present were: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Bush; Typist, Edna Puzo, and Mr. and Mrs. Carl Applegate of Blodgett Mills. The meeting was called to order by Deputy Supervisor Raymond Thorpe following the Pledge of Allegiance to the Flag. A Public Hearing was held concerning Local Law No.1 of 1992 provided for an extension of time for the moratorium of mobile homes through March 31, 1992. Councilman O'Donnell made a motion, seconded by Councilman Testa, to approve, as written, the Town Board Minutes of October 2, 1991, and October 16, 1991. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the Planning Board Minutes of November 26, 1991. All voting aye, the motion was carried. RESOLUTION #1 AUTHORIZE PAYMENT OF VOUCHERS FINAL PAYMENTS OF 1991 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows to finalize payment for 1991: General Fund A Vouchers #463-504 $ 14,192.09 General Fund B 139-144 $ 5,230.61 Highway Fund 435-473 $ 54,810.99 Water Fund 254-264 $ 4,217.97 Sewer Fund 119-121 $ 3,964.59 Capital Projects 139-141 $102,551.19 The reports of various departments are on the table for review and are available in the Town Clerk's office upon request. 1 1 1 Deputy Supervisor Raymond Thorpe offered those in attendance the privilege of the floor. No comments or questions were heard. 173 JANUARY 8, 1992 PAGE 2 Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file an agreement with the Cortland County Society for the Prevention of Cruelty to Animals for the year 1992. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file an agreement with TLC Ambulance Service, for the year 1992. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file an agreement with Atlantic -Inland, Inc. for the year 1992. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file an agreement with the Cortland Free Library for the year 1992. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file an agreement with the Lamont Memorial Library for the year 1992. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a letter from Mr John Fitch, Mayor of McGraw, concerning the recycling operation at Polkville. All voting aye, the motion was carried. The letter states that as of January 1, 1992 they will no longer provide a person to supervise the recycling center on Saturdays at Polkville. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a letter from Bernard Thoma concerning the re -submittal of the Town's HUD Grant for Blodgett Mills. All voting aye, the motion was carried. RESOLUTION #02 ACCEPT LETTER FROM THE CORTLAND SAVINGS BANK FOR AVAILABILITY OF FUNDS FOR PROJECTS OF WALDEN OAKS SUBDIVISION Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, Barden & Robeson Corporation has deposited funding in the amount of $16,800.00 for the land project at Walden Oaks Subdivision, and WHEREAS, a letter has been received from Cortland Savings Bank stating that the funds are on deposit in their bank and will be held until released by the Town, therefore BE IT RESOLVED, that the letter received from Cortland Savings Bank is hereby accepted for projects at the Walden Oaks Subdivision and shall be received and filed. 174 JANUARY 8, 1992 PAGE 3 RESOLUTION #03 AUTHORIZATION FOR MAINTENANCE CONTRACT FOR COMPUTERS AND PRINTERS WITH B & H OFFICE EQUIPMENT Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: AYE: Thorpe, Testa, O'Donnell NO: Rocco ADOPTED WHEREAS, quotes have been received from B&H Office Equipment for a maintenance contract agreement for computers and equipment for Town Employees, and has been reviewed, therefore BE IT RESOLVED, that the Town Board does hereby authorize a maintenance contract with B&H Office Equipment of Dryden, NY for Town Employees. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file information from the Association of Towns. All voting aye, the motion was carried. The letter is in regards to their Annual Meeting and training sessions for Town Officials, to be held at the New York Hilton Hotel, New York City, February 16- 19, 1992. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file an Inspection Report from Atlantic -Inland, Inc. All voting aye, the motion was carried. The report is the results of the fire inspection of the Town Hall performed by Atlantic -Inland, Inc.. RESOLUTION #04 APPROVAL OF CRASH BARS TO BE INSTALLED ON THE TOWN HALL DOORS Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a fire inspection of the Town Hall Building was performed by Atlantic -Inland, Inc., and WHEREAS, OSHA is now inspecting all of the Town of Cortlandville buildings, and WHEREAS, OSHA and Atlantic -Inland Inc. have made a recommendation to install crash bars on the Justice Department doors and the front doors of the Town Hall building, therefore BE IT RESOLVED, that Carl Bush is hereby authorized and requested to make the necessary arrangements to install crash bars on the doors at the Justice Department and on the front doors of the Town Hall building. 1 1 1 -17- JANUARY 8, 1992 PAGE 4 RESOLUTION #05 MAINTENANCE PLAN FOR CLUSTER DEVELOPMENT FOR DR. LEE AMBROSE, RENAISSANCE Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Dr. Lee Ambrose, owner of the Renaissance Project, located on the West Rd, appeared before the Town Board with a proposed agreement to be used in accordance with his proposed cluster development and a Homeowner's Association,therefore BE IT RESOLVED, that the proposed agreement submitted for the Renaissance cluster development is hereby approved subject to review and approval by the Town Attorney. RESOLUTION #06 ADOPT LOCAL LAW NO. 1 OF THE YEAR 1992 PROVIDING FOR A MORATORIUM ON THE ISSUANCE BY THE CORTLANDVILLE PLANNING BOARD OF SITE PLAN APPROVALS FOR MOBILE HOMES, THROUGH MARCH 31 1992 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED SECTION 1. Legislative Intent. The Cortlandville Town Board reaffirms the concerns regarding the growing number of mobile homes in the Town as set forth in the Legislative Intent of the Town Board set forth on Local Law No. 1 of the Year 1991, and the Board further determines that a moratorium on the issuance of site plan approvals for mobile homes is necessary for an additional period of time in order to finalize a planned approach to the issue. SECTION 2. There is hereby ordered by the Cortlandville Town Board a moratorium on the issuance of site plan approvals for mobile homes by the Cortlandville Planning Board through March 31, 1992. SEC^1ION 3. This Local Law temporarily supersedes Section 3.4 of the Cortlandville Zoning Law (Local Law No.1 for the year 1986). SECTION 4. RESOLUTION #12 APPOINT RAYMOND THORPE AS DEPUTY SUPERVISOR Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby reappoint Raymond Thorpe as Deputy Supervisor for two years commencing January 01, 1992 and shall expire December 31, 1993, and further RESOLVED, that Mr. Thorpe may be compensated $25.00 for each time he acts in the stead of the Supervisor. If such day falls on a holiday, the meeting shall be held the next business day for the year 1992. COMPAGNI CONSTRUCTION CO. INC. Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the application submitted for plumber approval by David J. Compagni, for F.G. Compagni Construction Co. Parker, is hereby appointed as Delegate, and the Town Justice, Mardis F. Kelsen, is hereby appointed alternate to represent the Town of Cortlandville at the Association of Towns Annual Meeting, to be held in New York City from February 16-19, 1992 183 JANUARY 8, 1992 PAGE 12 RESOLUTION #30 RE -APPOINT PHILLIP R. RUMSEY AS TOWN ATTORNEY Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that establishment of the office of Town Attorney as of January 1, 1992, by Resolution adopted December 18, 1991, is hereby reaffirmed, and it is further RESOLVED, that Phillip R. Rumsey Esq. is hereby appointed Town Attorney. RESOLUTION #31 TABLE REQUEST FOR STREET LIGHTS ON WESTVALE DRIVE, WEATHERVANE SUBDIVISION Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Mr Scott Flatt, developer of Weathervane Subdivision, has requested street lights to be put on Westvale Drive, which is part of the Weathervane Subdivision, and BE IT RESOLVED, that Highway Superintendent, Carl Bush will verify the total number of street lights needed on Westvale Drive and report back to the Town Board at the next meeting BE IT FURTHER RESOLVED, that the request be tabled until information is received from Carl Bush. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the regular meeting and convene to an executive session in the matter of personnel. All voting aye, the motion was carried. The following information was received from the Supervisor's office: Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the Executive Session and reconvene the Regular Meeting.
