TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, on November 20, 1991 at 5:00 p.m. with Deputy Supervisor Raymond Thorpe presiding. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman. Theodore Testa Town Clerk, Pauline H. Parker Absent: Supervisor, Melvin Pierce Councilman, Ronal Rocco Others present were: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Bush; Town Assessor, David Briggs; Town Engineer, Hayne Smith; Town Typist, Edna Puzo; Town Planning Board Members, Kathy Wickwire, and Eleanor Tarbell; Town Historian, Alice Blatchley; A former Zoning Board of Appeals Member, Oscar Taylor; Family members of Millie Brookins, Michael, Mickey, Mr. & Mrs. Donald Brookins and family: Town resident Richard Alger; Newsreporter, Laura Jones. The Meeting was called to order by Deputy Supervisor, Raymond Thorpe following the Pledge of Allegiance -to the Flag. Deputy Supervisor Raymond Thorpe presented a plaque in memory of Millie Brookins to the family. Deputy Supervisor Thorpe spoke about Mrs. Brookins and how she was a. faithful servant to the Town of Cortlandville for over 35 years. Her husband became Town Clerk on January 1, 1956 and Millie was appointed the Deputy Town Clerk at the same time with no salary. At that 'time, the Town Hall was in the garage of the Brookins home on Pleasentview Drive. Millie also served under Christine Canastro and eventually becoming the Zoning Board of Appeals Secretary in 1982 in addition to the Planning Board Secretary. The Plaque for Millie, which will be mounted under the Plaque for Lelan Brookins reads: Mildred M. Brookins, October 3, 1910- September 11, 1991. She will long be remembered with affection as a dedicated Public Servant and a delightful human being who served the Town of Cortlandville for over 35 years. The Plaque will be displayed in the Town Clerks office. A motion was made by Councilman O'Donnell, seconded by Councilman Testa to receive and file the Cortlandville Planning Board Minutes of October 29, 1991. All voting aye, the motion was carried. RESOLUTION #214 REPORT OF EXAMINATION FOR THE AUDIT FOR FISCAL YEAR ENDING DECEMBER 31 1990 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYES ADOPTED 1 1 1 BE IT RESOLVED, that the Report of Examination for the Audit for Fiscal Year ending December 31, 1990 be received and filed. 155 Wednesday, Nlovember 20, 1991 PAGE 2 Counc- 1f-ii n C-)2 Dor ne 1 1 °ia given privilege of the floor. Mr. O'Donnell reported on the progress of Town Supervisor Melvin Pierce. He stated Mr. Pierce was coming along fine and hoped to be bark amongst his fellow workers soon. RESOLUTION #21 5 AUTHORIZE PAYMENT OF VOUCHERS FOR NOVEMBER Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: .ALL ,AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be maid as follows: General Fund .. Coordinator for- Groundwater Management. The release stated there will be a public informational meeting on Thursday. December 5, 1991, regarding the Otter Creek/Dry Creek Remedial Investigation. The investigation is being conducted by local and state officials, 1n conjunction with the United States Geological Survey, in accordance with a 1989 settlement agreement with Smith Corona Corporation . The meeting will be held at 7:30 p.m. in tI-,e Cortland ,County Office Buildingg, auditorium. T4-re residents of the City of Cortland and the Town of GortIandville are invited to learn more about their water- supply. RESOLUTION #t215 ADOPT THE TOWN BUDGET FOR FISCAL Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, on the Gth day of November, 1991, the To,,gn Board of the TOwl') of Cort 1 andv i l l e, het d a Put; l i c Hearing cri the Preliminary budget and proposed amounts to be raised by the benefit tax on the benefit­d properties in the Town Sewer Improvements District, approved by the Town Board, and filed with the Town Clerk, for the f1scai year commencing January 01, 1992 and having heard all persons in favor of, or against any items therein contained, therefore BE %T RESOLVED, that the preliminary budgets approved, filed and amended, and the same is hereby adopted and established as the annual budget of this Town for the fiscal _>,ear beginning January 01, 1992, and such annual budget, as so adopl-led, is filed with the Town Clerk, and 156 Wednesday, November 20, 1991 PAGE 3 RESOLVED, that the Town Clerk of this Town shall prepare and certify, as provided by law, duplicate copies of the annual budgets hereby amended and adopted, together with the assessment rolls for the benefit of improvement for the Water Fund and the Sewer Fund, adopted pursuant to Section 202-a of the Town Law and within five days -thereof, deliver two copies to the Supervisor of the Town, and the Supervisor shall present the copies of the annual budget to the Legislature of Cortland County within ten days, after his receipt thereof from the Clerk. A discussion occurred regarding a letter from the Mayor of the Village of Homer, Mary Alice Bellardini. The letter was in regards to a possible agreement and contract between the Village of Homer and the Town of Cortlandville that would allow the Village to use Cortlandville water in the event of some unforseen and serious water problem. The contract is also written so that if Cortlandville needed water, the line could also be used to provide Village water to the Town. The water would be metered in either instances and the rates would be basic. It was stated the Town of Cortlandville has a greater water pressure than that of the Village of Homer. The Board members feel the contract could be a one way advantage to benefit the Village of Homer and not the Town. The Board would like to take an opportunity to review contracts they have with the City of Cortland. The Board members could then approach the Village of Homer with a solvable contract. RESOLUTION #217 TABLE CONTRACT BETWEEN THE VILLAGE OF HOMER AND THE TOWN OF CORTLANDVILLE FOR USE OF WATER IN AN Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, a proposed contract between the Village of Homer and the Town of Cortlandville for the use of water in an emergency, be tabled for further review from the Town Attorney, Phillip Rumsey. RESOLUTION ##218 AUTHORIZE THE SIGNING OF THE VILLAGE OF HOMER'S SEWER CONTRACT SUBJECT TO THE APPROVAL OF THE TOWN ENGINEER Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign -the sewer contract with the Village of Homer, subject 'to approval of the Town Engineer. A discussion occurred regarding the existing Village of Homer's sewer line from the City line to Fisher Avenue. A request was made to the Town to purchase the line from the Village. Wednesday, November 20, 1991 PAGE Highway Superintendent Carl Bush spoke of street lights for Allen Drive and Route 281 from the Pine View Apartments to the Gunzenhauser farm. Mr. Bush stated the request was from -the fireman regarding Cortland State college students walking back and forth to the college. The Board members agreed to table thi's request until they receive more information. RESOLUTION ##222 TABLE REQUEST FOR STREET LIGHTS FOR ALLEN DRIVE AND ROUTE 281 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the request for street lighting along Allen Drive and Route 281 between Pine View Apartments and the Gunzenhauser farm be tabled until further review. RESOLUTION ##223 AUTHORIZATION TO COMPENSATE SCM FOR AN OVERBILLING Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Water and Sewer Superintendent is hereby authorized to compensate SCM for an overbilling with their water and sewer billing. RESOLUTION #224 AUTHORIZE PARTICIPATION IN "HOLIDAY ON ICE" PROGRAM FOR CORTLAND YOUTH BUREAU Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a request was received from Francis N. Tokar, Director of the Cortland Youth Bureau, asking the Town to participate again this year for the Cortland Holiday 0111 Ice Program, therefore BE IT RESOLVED, that the Town Board chooses to participate in the "Holiday on Ice" program, and further RESOLVED, the budget officer is hereby authorized to send $275.00 for the Town's cost of the program. RESOLUTION #225 SET DATE FOR PUBLIC HEARING FOR LOCAL LAW NO. 2 OF 1991 FOR THE ALTERNATIVE VETERAN EXEMPTION Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that a Public Hearing shall be set for December 4, -1991 at 7:30 p.m. to review Local Law No. 2 of 1991 for the Alternative Veteran Exemption. A motion was made by Councilman Testa, seconded by Councilman O'Donnell to recess the regular meeting in memory of Millie Brookins and convene to an executive session in the matter of litigation.
