PUBLIC HEARING
CORTLANDVILLE MASONIC LODGE - AQUIFER PERMIT
A Public Hearing_ was held by the Town Board of the
Town of Cortlandville on October 2, 1991 at 7:30 p.m. at
the Town Hall, 15 Terrace Road, Cortland, New York for
an Aquifer Permit.
Members Present: Supervisor, Melvin Pierce
Councilman, Edwin O'Donnell
Councilman, Theodore Testa
Councilman, Raymond Thorpe
Councilman, Ronal Rocco
Town Clerk, Pauline Parker
Others present were Highway Supt., Carl Bush; CEO,
Bruce Weber; Atty Frank Casullo; Residents, Charles
Dellow and Doug Hawks; and Newsreporter, Laura Jones.
Supervisor Melvin Pierce called the Public Hearing
to order at 7:SO p.m.
The Town Clerk read the Legal Notice as posted and
filed.
The privilege of the floor was given to those in
attendance.
Attorney Frank Casullo from the law office of
Fitzgerald, Taylor, Pomeroy & Armstrong, who represent
the Masonic Lodge, advised that the County Planning
Board and the Town Planning Board, have approved this
project.
The new location on Rt. 13, North of the Lorings
Crossing -intersection, has been more favorable for
everyone.
No other comments or questions were heard.
Councilman Thorpe made a motion, seconded by
Councilman Testa, to adjourn the public hearing. All
voting aye, the motion was carried.
The Public Hearing was adjourned at 7:35 p.m.

TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at 7:30 p.m. at -the Town Hall,
15 Terrace Road, Cortland, New York with Supervisor,
Melvin Pierce presiding.
Members Present: Supervisor Melvin Pierce
Councilman Edwin O'Donnell
Councilman Theodore Testa
Councilman Raymond Thorpe
Councilman Ronal Rocco
Town Clerk Pauline Parker
Others present were Highway Supt., Carl Bush: CEO,
Bruce Weber; Town residents, Charles Dellow and Doug
Hawks: and newsreporter, Laura Jones.
The meeting was called to order by Supervisor,
Melvin Pierce following the Pledge of Allegiance to the
Flag.
A Public Hearing was held concerning an Aquifer
Permit for the Cortlandville Masonic Lodge No. 470.
Councilman Thorpe made a motion, seconded by
Councilman Rocco to receive an file the Cortlandville
Planning Board Minutes of August 27, 1991. All voting
aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Thorpe to receive and file the Zoning Board
of Appeals Minutes of September 16, 1991. All voting
aye, the motion was carried.
RESOLUTION #190 AUTHORIZATION PAYMENT OF VOUCHERS
OCTOBER
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:
General Fund A Vouchers 324-337 $ 2,284.53
General Fund B 111-118 4,004.52
Highway Fund 316-329 21,985.33
Water Fund 191-202 31,383.47
Sewer Fund 89- 95 35,53i.86
Capital Projects 112-114 58,831.75
The reports of the various departments are on the
table for review, and are available for inspection, on
request, in the Town Clerk's Office.
Councilman O'Donnell requested privilege of the
floor. He inquired about the status of the Trailer
Moratorium.
Supervisor Melvin Pierce stated that he has heard
nothing, but will make some inquiries.

RESOLUTION +191 STATEMENT OF COMPLETION FOR LIME
HOLLOW ROAD -- WATER PROJECT
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Statement of Completion for
Well No. 4, Lime Hollow Road, Cortlandville, NY,
completion of Contract No.1 and portion of Contract. No.2
shall be received and filed.
RESOLUTION #192 ACCEPT DENIAL LETTER FROM THE U.S.
DEPT. OF HOUSING AND URBAN
DEVELOPMENT FOR THE BLODGETT MILLS
BLOCK: GRANT
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, an application was submitted by Thoma
Developments, on behalf of the Town, for monies through
the 1991 Small Cities Community Block Grant, for
improvements of the Blodgett Mills area, and
WHEREAS, our application received 226 points and ranked
125 among a total of 191, and due to limited funds our
application was denied, therefore
BE IT RESOLVED, that the denial letter from the U.S.
Dept, of Housing and Urban Development is hereby
accepted and shall be received and filed.
RESOLUTION #195 DECLARE NEGATIVE DECLARATION FOR
AQUIFER SPECIAL PERMIT #5 OF 1991 OF
_CORTLANDVILL.E MASONIC LODGE NO. 470
Motion by Councilman Thorpe
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, an application for a Aquifer Special Permit,
#6 of 1991, was submitted by Cortlandville Masonic Lodge
No. 470, and
WHEREAS, this Town Board, as Lead Agency, has reviewed
the Short Environmental Assessment Form as required by
SEQRA. therefore
BE IT RESOLVED, that the Town Board does hereby declare
that the proposed project of Cortlandville Masonic Lodge
No. 470, will have no significant impact on the
environment.

RESOLUTION #194 APPROVE AQUIFER SPECIAL PERMIT #6 OF
1991 FOR CORTLANDVILLE MASONIC LODGE
NO. 470 ON RT #13
Motion by Councilman Thorpe
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, an application for an Aquifer Special Permit,
#6 of 1991, was submitted by Cortlandville Masonic Lodge
No. 470, and
WHEREAS, a Public Hearing was duly held by the Town
Board, and all necessary requirements have been met,
therefore,
BE I:T RESOLVED, that the Town Board does hereby approve
the Aquifer Special Permit #6 of 1991 for Cortlandville
Masonic Lodge No. 470 to locate on Rt #13 in the Town,
and further
RESOLVED, that the Supervisor is hereby authorized to
sign -the application.
Supervisor Pierce reported that the Town Attorney
is reviewing the current status of the Alternative
Veterans Exemption, and will report to us later.
RESOLUTION #195 ACKNOWLEDGE RECEIVING 1992
TENTATIVE BUDGET
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Clerk presented the 1992
Tentative Budget to all members of the Cortlandville
Town Board in accordance with Town Law.
RESOLUTION #196 AUTHORIZE SAFETY COUNCIL OF CENTRAL
NEW YORK TO USE COURTROOM FOR
SCHOOLING PURPOSES FOR 1992
Motion by Councilman Rocco
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the request from the Safety Council
of Central New York to use the Courtroom in 1992 for the
Defensive Driving Courses, is hereby approved.
RESOLUTION #197 RECEIVE AND FILE STATEMENT OF
POPULATION - 1990 CENSUS
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the letter from the State of New
York Department of State with the Population totals for
the 1990 Census, be received and filed.
The letter indicates that the total population for
the Town of Cortlandville is 8,054.

RESOLUTION #196 APPROVE CORTLAMD ESTATES NUBILE
HOME PARK PERMIT FOR 1992
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Cortland Eotatea Mobile Home
Park permit for the year 1992, be approved, subject to
Cortland NHP Associates Inc. providing the Town Board
with a Health Permit'
Councilman Rocco voiced his concerns about the
speed ljmit on Luker Road. He thinks there should be a
lower speed limit in that area due to the fact that
there have been a number of accidents there.
He reported that he also has received a telephone
call from a neighbor voicing the same concern.
A motion was made by Councilman O'Donnell` seconded
by Onuncilman Testa to adjourn the regular meeting and
convene to an executive session in the matter of real
estate. All voting aye, the motion was oarried.
The following information was received from the
Supervisor's office.
Councilman Rocco made a motion, seconded by
Councilman Testa, to adjourn the executive session rand
reconvene the regular meeting' All voting sye, the
motion was carried.
--- RESOLUTION #199 CONVEY QUIT-CL4IM DEED TO RICHAHD
Notion by Councilman Thorpe
Seconded by Councilmen O`Donnell
VOTES: ALL AYE ADOPTED
BE IT RES0LYED, that a triangular -shaped parcel of land
being 0.042± acres located easterly of the east street
line of Alexandria Drive adjacent to property of Sadler
and Herter and further located at the intersection of
Alexandria Drive and Blue Creek Road is of no value to
the Town of Cortlandville and is not property held for
public use, and be it
FURTHER RESOLVED, that as requested by Richard J.
Sadler, the Town of Cortlandville shall convey to him by
quit -claim deed the said parcel of lend in which the
Town may have an interest or ownership, subject to all
coota aSanoiated with the transfer being paid by Richard
J. 8mdler, and be it
FURTHER RESOLVED' that this Resolution is adopted
subject to permissive referendum'
Councilman O'Donnell made -a motion, seconded by
Councilman Thorpe' to adjourn the meeting. All voting
aye, the motion was carried.
