TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Melvin Pierce Presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Theodore Testa Town Clerk Pauline Parker Absent: Councilman Edwin O'Donnell Councilman Ronal Rocco Others Present were: CEO, Bruce Weber; Town Justice, Mardis Kelsen; Highway Superintendent, Carl Bush; Town Attorney, Phillip P,umsey; Newsreporter, Laura Jones, and several residents of the Blodgett Mills area. The meeting was called to order by Supervisor Melvin Pierce at 5:00 p.m. He requested all those in attendance to raise and Pledge Allegiance to the Flag. RESOLUTION 1182 AUTHORIZE PAYMENT OF VOUCHERS SEPTEMBER Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A. Vouchers 29+6-323 - $12,41t .4S General Fund B 108-110 = 362.36 Highway Fund 294--315 = 21 .3S6.47 Water- Fund 179-190 = 6,847.09 Sewer Fund 81- 88 = 27843.50 Capital Projects 107-111 = 5,648.76 Supervisor- !Melvin Pierce offered the privilege of the floor- to Town Justice, Mardis Kelsen. Ms. Kelsen was asked by the Town Board Members to do some research on Fax Machines. The Board Members have a proposal for a Panasonic Plain Paper Fax Machine to be purchased by the Town of Cortlandville. After reviewing State Bids for numerous Fax Machines, Mardis felt strongly that the Panasonic would be the best option. The Panasonic can take plain paper, it has all the memory in going and outgoing, automatic redial. There is a package to upgrade the memory from 12 to 30 pages, with a cost of $112.00. The Cost for the machine alone is $1 2 , 0+6 . 00 , there is a 12 month warrantee after 12 months the service contract is $220.00 a year for a service contract. There should not be any problems, but Panasonic has an 800 number if there should be'any problems or questions. There is a computer that will hook up to the fax machine ne to find the problem if it should brake down, 24 hour a day service. The machine would be slit up, and maintained by a Panasonic representative. The Representative would also teach us how to use the Fax. 1.32 Wednesday, September 18, 1991 PAGE 2 RESOLUTION #183 AUTHORIZE PURCHASE OF PANASONIC FAX MACHINE FOR TOWN HALL Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Town Justice Mardis Kelsen is hereby authorized to purchase a Panasonic Fax Machine to be used by the employees of Town Hall. Many Blodgett Mills residents voiced their concerns about a single family home that was converted into a four -Family home on Main Street in Blodgett Mills. Was this approved by the Town Zoning process? Town CEO, Bruce Weber spoke of the single family home being converted without a permit and without being approved by -the Town Planning Board. The Original owner was Mr. Thomas Grassi. The house was purchased by Bancorp Trust, Ltd., signed by Lowell Craft of DeRuyter, and is the current landlord. He applied for a variance to the Zoning Board of Appeals, which was denied. He proceeded to rent the apartments, and has been notified that he was in violation of the Town Regulations. Attorney Rumsey explained that this matter may be something that can be taken into local Civil Court. Because the property is owned by a Corporation, any action taken would have to be with the Corporation. The Blodgett Mills Residents also concerned about the possibility of contamination of neighboring wells due to the fact that so many people are using the septic system for the converted house. They contacted the County Health Department but they stated they can not do anything unless the system fails. They would need to be contacted at that time, however they have no jurisdiction to intervene now. Judy Stone is currently living in one of the apartments, along with her husband and three children, in the four unit house. There are only two apartments rented at the present time. Mrs. Stone apparently is paying the electrical bill for her apartment and part of the apartment above hers. Mrs. Stone spoke to a representative from Niagara Mohawk about the bill and was told that the tenant above her is paying a low bill. Charles Wilcox did inspect the electrical system and it passed inspection for the interior wiring. There were concerns about parking expressed. Tenants are parking on the lawn and in the street. The Blodgett Mills residents are also concerned about junk cars and tires starting to pile up at the location of -the old store on Main Street. This has recently been purchased by someone else and they are hoping that this problem can be taken care of now, before it becomes a big problem. An old truck has also been setting there for a long time. The residents also requested that a four way stop sign be placed at the intersection there. Supervisor Pierce advised that because those roads were County Roads, it would be necessary to present a petition, forward the request to the County and the State. The State will make the final discission, and direct the County to place the sign, if approved. Supervisor Pierce reported that improvements to the Ball Park in Blodgett Mills are happening. Local industries are contributing, which is appreciated. 133 Wednesday, September 18, 1991 PAGE Mr. Richard Elliott. Executive Director, of Cortland County Economic Development Committee, was granted privilege of the floor. Ile informed the Town Board Members that he was seeking financial support for the County's Economical Development Program. Part of their program is the Cortland County Industrial Development Agency, or the IDA. For several years they have received monies from the City of Cortland for the Town's contribution tc their program. This was an agreement, with all parties concerned, due to the loans between the City of Cortland and Pali Trinity Micro Corp. Because this loan shall soon; expire, it is :,,ecessary to ask the Town to continue to contribute to their program. He discussed past accomplishments and some projects they are working on now. A discussion period followed. The new di rectory of the IDA was given to Town Board members for their future use. RESOLUTION #184 AUTHORIZE TOWN CONTRIBUTION TO THE CORTLAND COUNTY ECONOMIC DEVELOPMENT AGENCY PROGRAM FOR 1992 _ Motion by Councilman Testa Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, the Town has contributed to the Cortland County Economic Development Agency program in the past, per an agreement ,,,, i th the C i of Cortland and their loan wit; r Pall Trinity Micro Corp.; and WHEREAS, such loan shall soon expire, and a request has been heard that, the Town continue to contribute, as we have received many benefits from their program, therefore BE IT RESOLVED, that the Town Board does hereby, authorize coritr,ibuting $15,000.00, annually to thie Cortland County Economic Development Agency, and further RESOLVED, that such funds will be assigned to the 1992 Budget of the Town of Cortiandvilie. RESOLUTION! #185 ACCEPT DEED AND ABSTRACT FOR BLODGETT MILLS PARK LAND Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the deed and abstract dated November 16, '1990 from James P. Byrnes Jr. and Ramona M. Byrnes, conveying the property on Kellogg Road to the Town for purposes of park land and topsoil, has been filed in the County Clerk's Office and shall hereby be received and filed in the Town Clerk's Office. RES: LUTIGiJ #t 1 86 ACCEPT DEED FOR ROADS FOR QUAIL RIDGE Motion by Councilman Testa Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the deed and abstract dated July 29, 1990 conveying the roads for Quail Ridge of the Quail Ridge Subdivision, owned by David J. Yaman, William F. Coati and Michael R. Stokoe. and Has been filed in the County Clerk's Office and shall hereby be received and filed in the Town Clerk's Office. 134 Wednesday, September 18, 1991 PAGE 4 Councilman Testa made a motion, seconded by Councilman Thorpe to receive and file a letter from Senator James L. Seward. All voting aye, the motion was carried. The letter advised that the request for a Grant on behalf of the Polkville Fire hydrants has not been included in the State's 1991-92 Budget. Councilman Thorpe made a motion, seconded by Councilman Testa, to receive and file a letter received from Frederick Beck Jr, Attorney for Friendly's Ice Cream Corp.. All voting aye, the motion was carried. The letter was regarding an easement and Right -of - Way Agreement for the sewer project of the owner of the Student Housing project. A discussion was held concerning this matter. Attorney Rumse_v advised the Town Board that the delay of this matter has occurred because of the complexity of it. He could not proceed until he received an indemnification agreement, which he now has. As soon as he has received a map, the easement process shall be completed. Highway Superintendent, Carl Bush, reported that the owner of the Student Housing Project will soon dedicate the sewer line, along the road only, to the Town. They will be checking the pumping station and make a determination later. A discussion was held concerning the current status of -the Alternative Veteran Exemption. A request had been received to review it and hopefully change it so that the Vietnam Veterans would be eligible. Information was received from Assessor David Briggs, explaining the program. The matter was referred to the Town Attorney for his review. No action was taken. A motion was made Councilman Thorpe, seconded by Councilman Testa to receive and file a letter from Earl and Betty Wild, owners of the Golden Lunch Restaurant, West Road, in the Town of Cortlandville. All voting aye, the motion was carried. The letter advised that they were renewing their beer and wine license at that location. A motion was made by Councilman Thorpe, seconded by Councilman Testa to receive and file a correspondence from Bruce Weber to Mr. Kenneth Burnham, Manager- of Cortland Estates Mobile Home Park. All voting aye, the motion was carried. The letter is in regards to the consolidation of lots 8, 9, and 25 in the mobil park. A motion was made by Councilman Thorpe, seconded by Councilman Testa to receive and file correspondence from Edith Carrier, of 31 Locust Ave., Cortlandville, to CEO Bruce Weber. All voting aye, the motion was carried. The letter is in regards to Zoning regulation violations in her neighborhood. 1 1 F� u September 18, 1991 PAGE 5 A motion was made by Councilman Thorpe, seconded by Councilman Testa to receive and file a letter from Raymond D. Franco, of SUNY Cortland College. All voting aye, the motion was carried. The letter expressed concern about a gate located near the Pineview Apartments on a steep graded hillside. They requested that the gate be relocated. A discussion was held whereby it was determined that the gate is not an access gate. It was put there for those playing ball, only. Mr. Pierce stated that he has discussed this matter with Mr. Franco. No action was taken. RESOLUTION 1137 APPROVE MONIES TO BE BUDGETED FOR NEW PHONE SYSTEM - 1992 Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, information has been received from our current telephone supplier to update the current system, which is completely filled with; no room for expansion, and WHEREAS, when necessary, such process shall be let out for bid purposes, therefore BE IT RESOLVED, that monies shall be budgeted in the 1992 budget, not to exceed $10,000, for a new telephone system for the Town Hall. RESOLUTION 088 APPOINT KAREN BETTERS AS SECRETARY TO THE CORTLANDVILLE PLANNING BARD AND ZONING BOARD OF APPEALS _ Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED; Karen Betters is hereby appointed secretary to the Cortlandville Planning Board and Zoning Board of Appeals due to the death of Mildred Brookins. Councilman Testa asked if something was being done for Mrs. Brookins. Supervisor Pierce reported that a plaque will be purchased to coincide with the one for Lelan Brookins. More information will be forthcoming. Supervisor Pierce reported that he had received a recommendation from David Plew, Chairman of the Town ZBA. He reported that a recommendation was also received from past member, Oscar Taylor. A discussion was held whereby it was the consen&us of the Board that Supv. Pierce will discuss the matter further with Mr. P1ew. 136 Wednesday, September 18, 1991 PAGE 6 RESOLUTION #189 AUTHORIZE BUDGET TRANSFER Motion by Councilman Thorpe Seconded by Councilman Testa VOTE: ALL AYE ADOPTED BE IT RESOLVED, that the Budget Officer is hereby authorized and directed to transfer from the following accounts: FROM TO AMOUNT A1990.4 A1910.4 $466.00 87310.2 B7310.4 $108.85 Councilman Thorpe made a motion, seconded by Councilman Testa, to adjourn the Regular Meeting and ad.iourn to an executive to discuss a matter of litigation. All voting ave, the motion was carried. The following information was received from the Supervisor's office. Councilman Thorpe made a motion, seconded by Councilman Testa, to adjourn the executive session and reconvene to the Regular Meeting. All voting ave, the motion was carried. No action was taken. Councilman Testa made a motion, seconded by Councilman Thorpe to adjourn the regular meeting. All voting aye, the motion was carried.
