TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 15 Terrace
Road, Cortland, New York, on September 4, 1991, at 7:30
p.m. with Supervisor Melvin Pierce presiding.
Members presents: Supervisor Melvin Pierce
Councilman Edwin O'Donnell
Councilman Theodore Testa
Councilman Raymond Thorpe
Councilman Ronal Rocco
Town Clerk Pauline Parker
Others present were: Town Attorney, Phillip Rumsey;
Cortland Standard Newsreporter, Laura Jones; Douglas
Staley, Fire Commissioner of the Cortlandville Fire
Dept., and Mr. Angelo Cincotta of Blodgett Mills.
The Town Board Meeting was called to order by
Supervisor Melvin Pierce, at 7:30 p.m., followed by the
Pledge of Allegiance.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to approve, as written, the Town Board
Minutes of June 5, 1991 and June 19, 1991. All voting
aye, the motion was carried.
A motion was made by Councilman Thorpe, seconded by
Councilman Rocco, to receive and file the Cortlandville
Planning Board minutes of July 30, 1991 and August 6,
1991. All voting aye, the motion was carried.
RESOLUTION #176 AUTHORIZE PAYMENT OF VOUCHERS
SEPTEMBER
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:
General Fund A Vouchers 287-295 $ 1,412.76
General Fund B 101-107 $ 3,948.31
Highway Fund 278-293 $53,293.77
Water Fund 171-178 $ 7,608.93
Capital Projects 99-106 $60,792.75
Supervisor Melvin Pierce gave privilege of the
floor to Councilman Edwin O'Donnell.
Councilman O'Donnell reported that he had received
a telephone call from Angelo Cincotta from Blodgett
Mills. He was concerned about the unsightly property
located across the road from him, which is owned by Kris
Larsen. Mr. Larsen owns the Plastic and Metal Recycling
plant which employees 8 to 10 people. Mr. Larsen had
agreed to clear his property of debris, and it has not
been done. Councilman O'Donnell reported that he has
driven down to the area, and agrees that the problem
still exists.
A discussion was held concerning the problem.

Councilman O'Donnell requested Supervisor Pierce to
write a letter to Mr. Larsen to praise his
accomplishments to date, but advise him that it will be
necessary -to clear his property of debris so that it
would be more appealing to neighbors and others who
happen to drive into the area.
Privilege of the floor was also granted to Doug
Staley, Commissioner of the Cortlandville Fire District.
He informed the Town Board that they were recently
inspected by the Federal EPA, Environmental Protection
Agency, and have been cited by them for possible
contamination of the Aquifer because of the floor drains
at the Fire Station. Their Board has determined that the
only solution to the problem is to be allowed to connect
into the Town's sewer system, if possible. They have
been given 30 days to correct this.
A discussion was held concerning the request. The
Town's sewer lines are on the other side of the road at
that location. Sewer lines have been installed by the
contractor at the new student housing project, but the
lines have not been dedicated to the Town. It would be
very costly to run lines from the other direction. It
will be the responsibility of the Fireman to install
laterals.
The Fireman are no longer washing their vehicles
inside the station because of the problem. This must be
corrected before bad weather arrives. McNeill
Engineering and Buck Environmental Labs. are performing
studies of their dry well to see if there are any
contaminates.
Commissioner Staley requested permission to have
the Town Engineer, Hayne Smith, assist them to solve the
problem.
RESOLUTION ##177 AUTHORIZE TOWN ENGINEER TO ASSIST
FIREMAN WITH POSSIBLE SOLUTION TO
HOOK INTO TOWN SEWER LINES
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Engineer, Hayne Smith, is
hereby authorized and directed to assist the Fire
Commissioners for the best possible plan of hooking
their building into the Town Sewer System and report his
findings back to the Town Board for review.
Councilman O'Donnell referred to the letter
received from Town Engineer, Hayne Smith regarding the
Groton Avenue Plaza/Luker Road Sewer Project. Has his
concerns of the contractors not starting the job been
satisfied?
Supervisor Pierce reported that the Town will carry
out the threat of a $2,500.00 a day penalty if the job
is not completed on schedule. A meeting has been
scheduled with the contractor and Town Engineer to
address these concerns.
A motion was made by Councilman O'Donnell, seconded
by Councilman Testa, to receive and file an appreciation
letter to Ken Andrews from NYS Parks and Recreation.
All voting aye, the motion was carried.
The letter was to recognize Ken Andrews for his
contribution in assisting with the 1991 NYS Parks Senior
Games which was a great success.

A motion was made by Councilman O'Donnell, seconded
by Councilman Testa, to receive and file correspondence
from Congressman Sherwood Boehiert to Councilman Thorpe
in regards to 'the 1991 Small Cities, Community
Development Block Grant for Blodgett Mills. All voting
aye, the motion was carried.
Announcements to award the Grants are expected to be
made early September. Any information about the Grant
awards, Congressman Boehlert will contact Councilman
Thorpe immediately.
A motion was made by Councilman O'Donnell, seconded
by Councilman Thorpe, to receive and file information
received from US Senator Alfonse M. D'Amato in regards
to the 1991 Small Cities Community Development Block
Grant for Blodgett Mills. All voting aye, the motion
was carried.
A motion was made by Councilman O'Donnell, seconded
by Councilman Rocco, to receive and file a letter from
Friendly's Ice Cream in regards to the status of an
easement with them. All voting aye, the motion was
carried.
They have not received the Easement Agreement
executed by them at the request of Roger Branchini which
was needed for installing sewer lines on his property.
They requested assistance from the Town regarding this
as it appears that the sewer lines are in.
RESOLUTION #178 ACKNOWLEDGE AQUIFER PERMIT REQUEST
FROM MASONIC LODGE NO 470, AND SET
DATE FOR PUBLIC HEARING
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTE: ALL AYE ADOPTED
WHEREAS, a request for an Aquifer Special Permit has
been received from Masonic, Lodge No 470 to construct a
building on Rt 13 in the Town, therefore,
BE IT RESOLVED, that the request shall be forwarded to
the proper agencies for review and recommendation, and
further
RESOLVED, that a Public Hearing shall be scheduled for
October 2, 1991 at 7:30 p.m. on the matter.
RESOLUTION 0179 APPROVE PLUMBER REQUEST OF JON
HAMMOND FOR WATER AND SEWER
CONNECTIONS IN THE TOWN
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTE: ALL AYE ADOPTED
BE IT RESOLVED, that the application of Jon Hammond of
Hammond Heating & Plumbing Systems, Inc. to install
water and sewer connection in the town is hereby
approved, and
RESOLVED , that his name shall be added to the approved
plumber list.

RESOLUTION #180 AUTHORIZATION FOR BUDGET
TRANSFERS - CAPITAL PROJECTS
Motion by Councilman O'Donnell
Seconded by Councilman Thorpe
VOTE: ALL AYE ADOPTED
BE IT RESOLVED, that the
Budget
Officer is hereby
authorized and directed to
transfer
$687.50 from the
General Fund A Surplus, and
$1,3581.53
from the Water
Fund Surplus into the Capital
Project
Fund. This is for
the following projects which
have not
been bonded:
Town Hall Expansion = $ 687.50
Blue Creek Water Tank= $1,3581.53
Total $1,4269.03
RESOLUTION #181 AUTHORIZE PURCHASE OF FAX MACHINE
FOR TOWN HALL IN 1991 BUDGET
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, Town Justice Mardis Kelsen provided information
regarding cost and needs of a fax machine for the
offices of the Town, and
WHEREAS, other departments have expressed needs of these
services, therefore
BE IT RESOLVED, that approval was granted to purchase a
fax machine for -the Town Hall and funds shall be
included in the 1992 budget to include a fax machine and
operating expenses.
A motion was made by Councilman Thorpe, seconded by
Councilman Testa, to adjourn the regular meeting, and
convene to an executive session to discuss pending
litigation. All voting aye, the motion was carried.
The following information was received from the
Supervisors office.
Councilman Rocco made a motion, seconded by
Councilman Thorpe, to adjourn the executive session, and
reconvene the regular meeting. All voting aye, the
motion was carried.
No action was taken.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to adjourn the meeting. All voting
aye, the motion was carried.
The meeting was adjourned at 8:33 p.m.
