PUBLIC HEARING LOCAL LAW NO. 1 FOR THE YEAR 1991 A Public Hearing was held by the Town Board of the Town of Cortlandville on July 2, 1991 at 7:30 p.m. at the Town Hall, 15 Terrace Rd., Cortland, New York for Local Law No. 1 for the 1991 Year. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Theodore Testa Town Clerk, Pauline H. Parker Absent: Supervisor; Melvin Pierce Others present were: Town Attorney, Phillip Rumsey; CEO, Bruce Weber; Highway Superintendent, Carl Bush; Newsreporter, Laura Jones; Katherine Wickwire and her mother; John Buck from Buck Environmental Lab.: Phil Simon; Russ McCall; and several other residents. Deputy Supervisor, Raymond Thorpe called the Public ;Tearing to order at 7:30 p.m. The Town Clerk read the Legal Novice as posted and filed. Deputy Supervisor, Raymond thorpe offered the privilege of the floor to those in attendance. Deputy Supervisor, Raymond Thorpe explained the 1955 zoning law, which was instituted in the Town of Cortlandville. He stated the decision at the time came about due to the expressed purpose for permitting farmers in an agricultural district to house their farming tenants. It was never intended, with the original ordinance, to permit trailers to be placed anywhere indescr'iminatly in an agricultural zone. He also added the reason why the Public Hearing is being held is due to concern of the Board and residents within areas where trailers are being placed. Deputy Supervisor, Raymond Thorpe stated it was not the intention of the Town Board to disallow trailers at all. He added the Board would like time to examine the s i -cuat i on as it appears now . Councilman, Ronal Rocco stated he reviewed the Trailer Ordinance of 1964 for the Town of Cortlandville. He added he Has reviewed other Town's updated Trailer Ordinances and agrees ours should be updated also. Deputy Supervisor, Raymond Thorpe stated asking to place a moratorium on trailers would allow enough time for the Board to make a decision. Russ McCall asked if the Public Hearing was the beginning of the zoning against mobile homes. Deputy Supervisor, Raymond Thorpe stated this is not the beginning of the zoning against mobile homes. He stated this is to permit mobile homes to be used in selected areas. Councilman, Edwin O'Donnell stated an outside firm will be hired to review our zoning ordinances. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held July 2, 1991 at 7:30 p.m. at the Town Hall, 15 Terrace Rd, Cortland, New York, with Deputy Supervisor, Raymond Thorpe presiding. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Theodore Testa Town Clerk, Pauline H. Parker Absent: Supervisor, Melvin Pierce Others present were: Town Attorney, Phillip Rumsey; CEO, Bruce Weber; Highway Superintendent, Carl Bush; Newsreporter, Laura Jones; Katherine Wickwire and her mother; John Buck from Buck Environmental Lab.; Phil Simon; Puss McCall; and several other residents. The meeting was called to order by Deputy Supervisor, Raymond Thorpe at 7:30 p.m. followed by the Pledge of Allegiance and two Public Hearings. Councilman, O'Donnell made a motion, seconded by Councilman Testa to receive and file the June 25, 1991 Planning Board minutes. All voting aye, the motion was carried. RESOLUTION #144 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE 1T RESOLVED, the vouchers submitted Have been audited and shall be paid as follows: General Fund A Vouchers 213-224 $2,477.20 General Fund B 68-74 6,868.25 Highway Fund 213-222 9,390.35 Water Fund 124-129 3,933.05 Sewer Fund 57-59 8,999.97 Capital Projects 81-88 4,911.28 Deputy supervisor, Raymond Thorpe offered privilege of the floor to Linda Allen of 839 N. Lamont Circle. Ms. Allen stated how concerned she was with the activities of the Cortlandville Park. She stated her home backs up to the Cortlandville Park, and asked what time the park should close and are the gates to be locked. Deputy Supervisor, Thorpe stated the hours are 8:00-9:30 p.m. and the gates are to be locked. Ms. Allen had many questions in regards to the Cortlandville Park, which she submitted a list. She was also concerned with the student housing that is now being built next to the park. She suggested signs be placed around the park regarding the rules and regulations and copies of the ordinance of the park be given to the owner of the student housing to be handed out to the students. Legislative intent. The Cortlandville town Board acknowledges the growing number of mobile homes being placed in areas of the Town zoned Agricultural at rates and densities differing from area to area. The Board further acknowledges the concerns expressed by Cortlandville residents about the need to develop a planned approach to address the circumstances. During the remaining months of calender year 1991, it is the intention of the Town Board to consult with planning boards and to propose amendments to the Zoning Law relating to mobile homes. The Board further determines that without a moratorium on the issuance of site plan approvals for mobile homes, a planned approach to the circumstances may be frustrated or impossible. SECTION 2. There is hereby ordered by the Cortlandville Town Board a moratorium on the issuance of site plan approvals for mobile homes by the Cortlandville Planning Board through December 31, 1991. SECTION 3. This Local Law temporarily supersedes Section 3.4 of the Cortlandville Zoning Law Local Law No. 1 for the Year 1 986) . SECTION 4. This Local Law shall take effect immediately upon filing with the Secretary of State. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a letter from Linda Allen of Lamont Circle. All voting aye, the motion was carried. The letter was in regards to the Cortlandville Park. A discussion occurred regarding the street lights at the Renaissance subdivision. Deputy Supervisor Thorpe stated the Renaissance area has been waiting for street lights for approximately thirteen months. He added he has contacted the proper departments within Niagara Mohawk and they have stated that they would take care of the matter right away. He also added this prcbiem has been going on for some time. Councilman Testa seated there is a concern of an accident happening at the base of DaVinci Drive. He added there are only seven street Lights within the subdivision and are incomplete. Deputy Supervisor Thorpe stated he will continue to press the issue with Niagara Mohawk for them to place the agreed street lights within the Renaissance subdivision. 1 1 1 �Aledne,sday.
