She has given her approval for this project. Nancy Jarvis prefers the project be located at the proposed site and proposed facility. Councilman Rocco stated there will be test wells placed up and down stream. The pad will be 120' X 1807 slope. Air quality r.vi l l be within acceptable limits and the traffic will increase 15%. Councilman Rocco also added the DEC and the Cortland County Planning Board have agreed the proposed project is a good operation and has been approved. Deputy Supervisor stated we should regard this project- as a public service. Deputy Supervisor explained if an accident occurred with fuel oil where the fuel oil has spilled, the oil would be cleaned up and brought to this proposed facility of Suit -Dotes to be recycled. As this point in time there is no method of cleaning up a spill locally. This procedure would eliminate a land fill problem. No other comments or questions were heard. The Public Hearing was called to order by Deputy Supervisor Raymond Thorpe at :46 p.m. The le Town Clerk read the Legal Notice as posted and filed. Deputy Supervisor sor Thorpe offered the privilege ^f the floor to Ms. Linda Armstrong, representative of T homa Development. Ms. Armstrong explained tale HUD (Housing t;4.,b3n Development) Program. She stated it would be a housing rehabilitation program for the Blodgett Mills area. Letters of intent were sent to all property owners in the rehabilitation area to hear their input on t, program. M. Armstrong stated the HUD Program is a grant to be used er 'target areas, for buildings, that need to be safer to live in and for code violations. Targeted -areas would be based on the letters of intent returned ty the oroperty owners to T homa Development and income in the targeted area. She added 61 % of he .:ra;, . need's to be low o moderate income. This could he f ror;l owner occupied properties and or income properties. Ms. Armstrong sated based on their survey 72 . 8% residents living in the targeted area had low to moderate income. C na hundred eighteen of hose people have row to moderate i t d,me e e l . Wednesday, June 5, 1991 PAGE 2 Ms. Armstrong stated the budget is $310,000.00 for low to moderate individuals. She added $63,475.00 will be for non low to moderate individuals. If sidewalk work should be done, $11,400.00 would be set aside. Approximately $15,000.00 would be for administrative expenses. The maximum benefit to be applied for is $400,000.00. Ms. Armstrong stated one of the requirements of using HUD monies, 70% of the dollars awarded to the Town has to benefit the low to moderate income individuals. Ms. Armstrong added, the application needs to be submitted no later than June 28, 1991. There will be a seventy-five day review period. Town could expect to hear on or about September 15, 1991. Once the money is awarded to the Town, the process of paperwork will begin. Sixty days later the money will be available for the start up of work. Ms. Armstrong added the time element involved would bring us past the construction time in Central NY, interior rehabilitation will still occur. The program will not get into full swing until the spring of 1992. The Town of Cortlandville has adopted a Displacement Plan, Community Development Plan and a Relocation Plan, which are filed in the Town Clerk's office, as stated by Ms. Armstrong. Deputy Supervisor Thorpe asked if the current financial situation continued, would the application be approved. Ms. Armstrong stated the monies involved are appropriated funds. These funds will not likely to be cut. The program is becoming more and more competitive. The funds are not going as far as they did in the past. Councilman O'Donnell stated funds are being cut at the State and Federal levels. He added we should act on this program. The program may not be available in the form it is now, at a later time. Robin Quail, of Blodgett Mills, asked Ms. Armstrong if our chances would be diminished if the letters of intents are not returned. Ms. Armstrong stated yes it Would. She emphasized the letter of intents need to be mailed back as soon as possible. David Quail from Blodgett Mills, asked what tax return would be used. Ms. Armstrong stated they would use your most current tax return for income purposes. Councilman O'Donnell asked if there was a time limit to use these funds. Ms. Armstrong stated you would have 18 to 24 months, which would approximately bring you to September of 1993. No other- comments or questions were heard. PUBLIC HEARING BESTWAY ENTERPRISES, INC. - AQUIFER SPECIAL PERMIT A Public Hearing was held by the Town Board of the Town of Cortlandville on June 5, 1991 at 8:20 o'clock at the Town Hall, 15 Terrace Road, Cortland, New York for an Aquifer Permit for Bestway Enterprises, Inc. on Luker Road. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Town Clerk, Pauline H . Parker Absent: Supervisor, Melvin Pierce Others present were: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Buse.; CEO, Bruce Weber; Newsreporter, Laura Jones; Mr. Charles Seymoun of Suite-Kote Corp.; Richard Crozier; Jeff Ten Eyck of Cortland County Soil conservation; Edna Puzo and several residents of the Blodgett dills area. Deputy Supervisor, Thorpe offered the privilege of the floor to those present. John Decker Mated Bestway Lumber has withdrawn its request based on comments from the Cortland County Planning Board. Mr. Decker added we are redeveloping our plans to conform to all Boards involved. Deputy Supervisor, Raymond Thorpe stated we will reschedule a Public Nearing at a later date when Bestway Lumber is prepared. No other comments or questions were heard. TOWN BOARD MEETING The Regular Meeting of the Town of Cortlandville was held at 7:30 p.m. at the Town Hail, 15 Terrace Road, Cortland, New York with Deputy Supervisor, Raymond Thorpe presiding. Members present: Deputy Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Ronal Rocco Councilman, Edwin O'Donnell Town Clerk, Pauline H. Parker Absent: Supervisor, Melvin Pierce Others present were: Town Attorney, Phillip Rumsey; Highway Superintendent, Carl Bush; CEO Bruce Weber; Edna Puzo; Newsreporter, Laura Jones. The meeting was called to order by Deputy Supervisor, Raymond Thorpe following the Pledge of Allegiance to the flag. Three Public Hearings were held concerning the HUD Grant Application for the Blodgett Mills area; and an Aquifer Permit for Suit-Kote and Bestway Enterprises. RESOLUTION #115 APPROVE AND AUTHORIZE SUPERVISOR TO SIGN $400,000 SMALL CITIES COMMUNITY DEVELOPMENT GRANT APPLICATION FOR BLODGETT MILLS AREA Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Thoma Development Consultants was authorized to investigate and prepare a Small Cities Community Development Grant Application for housing rehabilitation in Blodgett Mills area, and WHEREAS, a Public Hearing was duly held by the Cortlandville Town Board on June 5, 1991, and WHEREAS, The Cortlandville Town Board has reviewed that submitted for Thoma Development Consultants, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby approve the $400,000 Small Cities Community Development Grant Application presented, for housing rehabilitation in the Blodgett Mills area, and FURTHER RESOLVED, that the Deputy Supervisor is hereby authorized and directed to sign the Grant Application to be submitted to HUD. Mr. Ten Eyck discussed the need for the Town V) consider developing an ordinance, planning guidelines, and approval procedure to address stormwater management and erosion/sediment control plans. Due to nel development within the Town there has been a prop lem with stormwater runoff wjich can lead to of problems including flooding; damage frorn erosion/sediment to culverts, ditches, storm drains, and private property. A sample model ordinance and i Ormation were distributed to the Town Board no review. Copies wqll be sent to the Town Planning Board for their review. Mr. Jetf Hall, of Tower Road, on behalf of john Morton, was granted privilege of the floor. He apprised the Town Board that he and many neighbors were present to express their concern about the Town allowing the placement of house trailers in their area. They were advised to come to the Town Board. A petition was presented RESOLUTION #117 RECEIVED PETITION REQUESTING NO N0,,,( PERMITS FOR TRAILERS IN THE BLODGETT I =A Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the residences of tne Blodgett Mills area submitted a 00ned petition requesting that no new permits Ve issued for placement of trailers on Clute Road5 from the West Blodgett Mills Road to tne intersection by the eastern end of Tower Road that extends from Clute Road to the intersection at Pendleton Street Extension in the Town of 'wort landville. This is currently zoned agricultural, and WHEREAS, the Petition had been submitted tc the Cortl andvi l l e Planning Board on May 28, 1991, and WHEREAS, the Cortlanoville Planning Board referred the request to the Corti andville Town Board for the ii, review, now THEREFORE BE IT RESOLVED, the petition requesting tnat no new permits be issued for placement of any new trailers in the described Blodgett Mills area, is hereb-,,, received and filed. 88 Wednesday, June 5, 1991 PAGE 3 A discussion was held with the residents of the Toyer Rd. and Clute Rd. regarding residents of the Town receiving approval to place house trailers on their property in the Town. A letter was also read and presented by Georgianna Applegate. The people in attendance expressed concern that property owners were getting approval for subdivisions and it could be possible that a trailer park scenario could appear overnight. A request was heard that a moratorium on house trailers be considered to prevent this from happening. Deputy supervisor, Raymond Thorpe requested that the Town Board be given time to review their request. Mr. and Mrs. David Qualle were granted privilege of the floor. They advised the Town Board of their safety concerns of the playground areas in Blodgett Mills. Due to excess traffic in the summer because of a race track being open, they requested if a fence or guard rails could be placed around the playground. They also asked -for assistance with the water and drainage problems at the ball field on Kellogg Road. A discussion followed whereby it was the consensus of the Town Board that Councilman O'Donnell and the Highway Sup't., Carl Bush will meet with these people to discuss their needs and work with them. Mr. Richard Crozier was granted privilege of the floor. He advised the Town Board that he was in attendance on behalf of the Vietnam Veterans Chapter 377, as their president. There will be a parade, followed by celebrations to be held at the County Fair grounds, on July 5th and 6th, 1991 to honor all veterans and -to welcome home those from the Persian Gulf. He also requested that the Town Board review their action taken a few years ago regarding the exemption status for tax relief for veterans. RESOLUTION #118 AUTHORIZE REVIEW OF TOWN'S VETERANS EXEMPTION STATUS Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby request the Town Assessor to provide them with information relating to the current Veterans Exemptions of the Town and the impact to Town residents if the program were changed. Councilman O'Donnell reported that he had contacted the Cortiandville Fire Chief in regards to the request from Carolyn Tainter from the Village Park Condo Assoc., to use our meeting room for meetings once a month. He was given permission to advise Mrs. Tainter that they could use their meeting room upstairs for this purpose. The monthly meeting will be held at the Fire Station and the Annual Meeting will be held at the Town Hal 1 . A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a letter from Jeff Ten Eyck of the Cortland Co. Soil & Water - Conservation District. All voting aye, the motion was carried. For the specific object or purpose of paying the cost of the extension of sewer lines to the area of the Groton Avenue Plaza, Route 281 and Luker Road, to include approximately 6800 feet of sewer pipe and a pumping station, for the Groton Avenue Plaza, Route 281 and Luker Road Area Sewer Project - 1990 Sewer Improvement of said town, there are hereby authorized to be -issued $525,000 serial bonds of the Town of Cortlandville, Cortland County, New York, pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of such specific object or purpose is $525,000, and that the plan for the financing thereof shall consist of the issuance of the $525,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Further details concerning said bonds will be prescribed in the further resolution or resolutions of this Town Board. Section 3. It is hereby determined that the period of orobable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision 4 of paragraph a of Section 11.00 of the Local Finance Law. it is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bonds anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 5. The faith and credit of said Town of Cortlandville, Cortland County, New York, are hereby irrevocably pledged to the payment of the principal of the interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year.
