TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of CortIandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Deputy Supervisor Raymond Thorpe presiding. Members present: Deputy Supervisor Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Theodore Testa Councilman, Ronal Rocco Deputy Town Clerk, Karen Betters Absent: Supervisorr, Melvin Pierce Town Clerk, Pauline H. Parker Others Present were: CEO, Bruce Weber; Highway Superintendent, Carl Bush; Town Attorney, Phillip Rumsey; Town Historian, Alice Blatchley; Del Palm and town resident Karen Bush, The meeting was called to order by Deputy Supervisor Raymond Thorpe at 7:30 p.m. He requested all those in attendance to rise and Pledge Allegiance to the Flag. Councilman Testa made a motion, seconded by Councilman O'Donnell, to approve, as written, the February 6, 1991 and February 20, 1991 Town Board Minutes' All voting eye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file, the February 21, 1991 Planning Board Minutes. All voting aye, the motion was carried. RESOLUTION #49 AUTHORIZE PAYMENT OF VOUCHERS - MARCH Motion by Councilman Rocco Seconded by Councilmen O'Donnell VOTE: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers 86-108 $14,435.15 General Fund B 19-22 5,784.51 Highway Fund 73-Bl 4,156.12 Water Fund 404,303.04 Sewer Fund 23-26 4r089.82 Capital Projects 9-12 2,241.14 Deputy Supervisor Raymond Thorpe offered the privilege of the floor to Alice Blatchley, Town Historian. Mrs, BIatchIeV spoke about her annual report. Many of Mrs. 8latchley activities are continuations of ones that are on going for every year. She spoke on research that was conducted by her with the assistance of the Town Board about an early cobblestone building that was originally a schoolhouse in Blodgett Mills. A historical project in the hamlet of Blodgett Mills was also conducted. Mrs. BlatchIey attended meetings and workshops for Historians within the year. It has been a very busy year for her. Wednesday, March 6, 1991 PAGE 1 The reports of the various departments are on the table for review, and are available for inspection, on request, in the Town Clerks Office. A motion was made by Councilmen O'Donnell, seconded by Councilman Testa to receive and file a letter from Senator James Seward. All voting aye, the motion was carried. The letter was in regards to an appreciation of support for the Statewide Youth Service System. A motion was made by Councilman Rocco, seconded by Councilman O'Donnell to receive and file a letter from the NYS DEC. All voting aye, the motion was carried. The letter was in regards to the inactive South Hill Dump, located on South Hill Rd. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a letter from NYS DOT. All voting aye, the motion was carried. The letter was in regards to an internal access road between the CortIandville Mall and the proposed Walmart Store. A motion was made by Councilman Rocco, seconded by Councilman O'Donnell to receive and file a letter from the Supreme Court Appellate Division. All voting aye, the motion was carried. The letter was in regards to the results of the judgement between Peter Beaudry and the Town of Cortlandville Zoning Board of Appeals. 1 RESOLUTION #50 SET DATE FOR A PUBLIC HEARING - SPECIAL PERMIT #1 OF 1991 - GRACE BAPTIST CHURCH Motion by Councilmen Rocco Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED WHEREAS, Grace Baptist Church has submitted an application for a Special Permit to develop over the Aquifer, and WHEREAS, the continuing process requires a Public Hearing before this Town Board, therefore BE IT RESOLVED, that a Public Hearing shall be held on April 3, 1991 at 7:30 p.m. to review said application. Del Palm had privilege of the floor. He spoke about the meeting he had with the private haulers for recycling on March 3, 1991. There seems to be a lot of indefinite questions still lingering in the air. Mr. Palm is hoping that decisions will happen soon, April 1, 1991 is coming upon us soon. Deputy Raymond Thorpe stated that our recycling center located at the Town Hall will stay in affect until a final decision is made with the private haulers. Councilman Rocco had questions regarding the proper bags to be used for trash pick up. He stated that he contacted neighboring grocery stores about the clear plastic trash bags that are to be used. Mr. Palm stated that the wording in the law from the Cortland County Legislatures Solid Waste Committee is non transparent bag was to be used. Wednesday, March 6, 1991 PAGE 2 Carl Bush, Highway Superintendent stated that the private haulers are the key people to the recycling problem. An incorrect recycling product left by an individuaI will be at the expense of the town to dispose of. The fee will be $105.00 per ton of incorrect recyclable. A motion was made by Councilman Rocco, seconded by - Co unc i I man Testa, to receive and file a letter from Ralph Pitman, Director Solid Waste Management. AIl voting aye, the motion was carried. The letter was in regards to the "Drop Site" for recyclable items. RESOLUTION #51 REQUEST FOR NEW TYPEWRITER - JUSTICE DEPARTMENT Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED BE IT RESOLVED, Mardis Kelsen, Town Justice is hereby authorized to purchase a new typewriter for her part- time help. Deputy Raymond Thorpe set up March 14, 1991 at 7:00 P.M. as an informal meeting concerning the flooding of water along Route 2131 near the Cortland Country Golf course. Deputy Thorpe will be sending a letter to surrounding property owners that are affected from the excessive water run off, The Town Board wiII act as a moderator in this matter. The Board would like to get the.problem solved without litigation occurring. RESOLUTION #52 AUTHORIZE WATER & SEWER SUPERINTENDENT TO PURCHASE NEW TRUCK Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTE: ALL AYE ADOPTED BE IT RESOLVED` that the Water & Sewer Superintendent, Carl. Bush, is hereby authorized to purchase e new trucP off state bid for a price not to exceed $21,000. RESOLUTION #53 AUTHORIZE HIGHWAY SUPERINTENDENT TO PURCHASE NIEW TRACTOR MOWER Motion by Councilman Testa Seconded by Councilman Rocco VOTE: ALL AYE ADOPTED BE IT RESOLVED, that the Highway Superintendent, Carl Bush, is hereby authorized to purchase a new tractor mower off state bid not to exceed $12,000.00. r.)° Wednesday, March 6, 1991 PAGE 3 RESOLUTION #54 ADOPT ORDER PURSUANT TO TOWN LAW SECTION 209-q (3) "LAMONT CIRCLE AREA SANITARY SEWER IMPROVEMENTS" Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTE: ALL AYE ADOPTED WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a sewer improvement project for the Lamont Circle area and designated "Lemont Circle Area Sanitary Sewer Improvements", as required by Section 209-q and 209-c of the Town Law, and are available for public inspection, and WHEREAS, the proposed improvement consists of the extension of sewer lines to the area of Lamont Circle, Stupke Road, Pheasant Run and Rt. 13 to include approximately 10,500 feet of sewer pipe in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $660,000.00, and WHEREAS, the proposed method of financing of said improvement is by a grant from the State of New York in the amount of $95,000.00 and by the issuance of bonds by the Town of Cortlandville in the maximum amount of $565,000.00 for a maximum term of forty years at prevailing interest; all costs, shall be borne by the lands benefited by such improvement and such costs shall be assessed, levied and collected from the several lots or parcel of land with said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby proposed that all lots or parcels in the Town of Cortlandville outside of Villages, capable of being serviced by the "Article 12-C" Sewer Improvements heretofore and hereafter provided, are lots or parcels benefited by the proposed sewer improvement; and the cost of the proposed sewer project and all previous improvements shall be spread upon and over the enlarged benefited area, all of such improvements constituting one sewer system, such system being described by and including the areas set forth in the "Groton Avenue Plaza, Route 281 & Luker Road Area Sewer Project" Resolution adopted October 17, 1990 and the following parcels designated on the 1991 Cortland County real property tax maps as Cortlandville tax parcels: Tax Map 95.00-01: Parcel: 48. M 1 Ll d Wednesday, March 6, 1991 PAGE 4 Tax Map 95.16-01: Parcels: 01, 24.1, 25, 26, 27, 287 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 397 407 41, 421 43, 44, 45, 46, 47, 46, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 591 60, 61, 62, 63, 641 65, 66, 67, 68, 69, 70, 71, 72, 73, 74 and 75, Tax Map 95.16-02: Parcels: 01, 02, 03, 04, 05, 06, 07, 08, 09, 10, 111 12, 13, 145 15, 16, 17, 10, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 51, 52, 53, 54, 55, 56, 57, 58, 59, 605 61, 62, 63, 64, 65, 66, 67, 68, 69.1, 70 and 80, and WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside Villages and shall be levied and collected in the same manner and at the same time as other- Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from sewer rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by Town Law Article 12-C Sewer Improvements, and WHEREAS, a short Environmental Assessment Form has been prepared pursuant to the State Environmental Quality Review Act, and is available for review by the public at the Cortlandville Town Nall, IT IS HEREBY ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, 15 Terrace Road, Cortland, New York on the 20th day of March, 1991 at 6:00 o'clock p.m, of that day to hear all persons interested in the proposed sewer improvement, and for such other- action of said Town Board with relation to the said sewer- improvement as may be required by law or be deemed proper. A discussion followed concerning this Public Bearing. Deputy Raymond Thorpe will notify by letter, a question and answer sheet to all parcels affected by the "Lamont Circle Area Sanitary Sewer Improvement Project". 3 Wednesday, March b, 1.991 PAGE 5 Councilman Rocco made a motion, seconded by Councilman O'Donnell, to recess the regular meeting and convene to an executive session. All voting aye, the motion was carried. The following information was received from the Deputy Supervisor: Councilman Rocco made a motion, seconded by Councilman O'Donnell, to adjourn the Executive Session and reconvene the regular meeting. No action was taken. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the meeting. All voting aye, the motion was carried.
