PUBLIC HEARING DONALD OSBECK - ZONE CHANGE - RT. #13 A Public Hearing was held by the Town Board of the Town of Cortlandville on January 23, 1991 at 5:00 P.M. at the Town Hall, 15 Terrace Road, Cortland, New york for a zone change request' Members present:Deputy Bupervisor,Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Theodore Testa Town Clerk, Pauline Parker Absent: Supervisor, Melvin Pierce Others present were Highway Supt., Carl Bush; CEO, Bruce Weber; Newsreporter, Laura Jones; Nancy Jarvis of the Cortland County Planning Dept.; Mr. John Tinkham, and Mr. Donald Westcott of Yellow Freight: Town residents, Mr. Robert Moore, Lois Schneider, Eugene Schepker; and college student, Karen Holbrook. Deputy Supervisor, Ray Thorpe called the Public Hearing to order at 5:00 p.m. The Town Clerk read the Legal Notice as posted and filed. The privilege of the floor was given to those in attendance, I Lois Schneider asked the Town Board if they were still pursuing the idea of the Town purchasing this land in question with the intent of protecting the aquifer. Deputy Supervisor Thorpe advised that this is still being considered, however it is impossible to purchase all the land located over the aquifer. We are investigating the availability of grant monies, etc. however, no final decision has been made. Eugene Schepker expressed his opposition for any development in this area, located over the aquifer. He expressed concern for keeping clean drinking water for both the Town and the City of Cortland, for now and for the future. Nancy Jarvis of the Cortland County Planning Dept. reviewed her thoughts and opinions of her letter to the Town Board and explained future programs to be completed by Todd Miller of the U.S. Geological Survey. Nancy Jarvis explained that, to date, there has been no problems caused to our aquifer due to agriculture problems. This has been a problem to other areas of the state, but none have been found here. Any and all problems that we have had to deal with, to date, has been caused by Industry. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:15 p.m. Wednesday, January 23, 1991 5:00 P.M. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at 5:00 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York with Deputy Supervisor, Raymond Thorpe presiding. Members present:Deputy Supervisor, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Theodore Testa Town Clerk,, Pauline Parker Absent: Supervisor, Melvin Pierce Others present were Highway Supt., Carl Bush; CEO, Bruce Weber; Nancy Jarvis of the County Planning Dept.; Newsreportery Laura Jones; Mr. John Tinkham and Mr. Donald Westcott; Mr. Robert Moore of Pheasant Run and College Student' Karen Holbrook. The meeting was called to order by Deputy Supervisor, Raymond Thorpe following the Pledge of Allegiance to the flag. A Public Hearing was held concerning a zone change request submitted by Donald Osbeck. RESOLUTION #25 AUTHORIZE PAYMENT OF VOUCHERS FOR JANUARY Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #01 - 39 $23,592.14 General Fund B 01 - 07 3,576.44 Highway Fund 01 - 35 71,290.52 Water Fund 01 - 15 12,092.67 Sewer Fund 01 - 10 5,002.52 Capital Projects 01 800.00 Deputy Supervisor Thorpe gave those in attendance the Privilege of the Floor. Councilman Rocco stated that action was taken today by Congress to assist military personnel, for tax relief, who are now serving in the Persian Gulf. Is it possible to take action at the local level to assist, and show support to our residents. A discussion was held whereby the tax collector advised that NY State has advised, upon request, special 0�0 consideration can be given to those called for military duty. No one has come forth at this time. Also the taxes being collected are both Town and County taxes. 14 Wednesday, January 23, 1991 PAGE 2 RESOLUTION #26 SEND LETTER TO COUNTY LEGISLATURE TO REQUEST TAX DELAY FOR RESERVISTS THAT ARE RESIDENTS OF THE TOWN Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Deputy Supervisor, Ray Thorpe is hereby authorized and directed to send a letter to the Cortland County Legislature expressing our desire to allow a tax delay for reservists that have been called to duty in the Persian Gulf, and request that they approve and adopt similar legislation. The reports of various departments are on the table for review, and may be seen, upon request, in the Town Clerk's Office. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the information received from the Cortland County Legislature, i•n regards to the Dog Quarantine, which is now in effect until April 15, 1991. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the 1991 Contract with the Lamont Memorial Library in McGraw. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the 1991 Ambulance Contract with Hayes Ambulance Service. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the 1991 Contract with the Cortland Free Library. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the 1991 Contract with the Cortland County S.P.C.A.. All voting aye, the motion was carried. Councilman Rocco asked if a determination has been made regarding giving money to the S.P.C.A. for cats. Deputy Supervisor Thorpe advised that we have ben advised that we cannot do this as we are allowed to only financially support a program of which we receive a service. They have been advised of this. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the 1991 Contract with Ryan & Rumsey for legal services. All voting aye, the motion was carried. 15 Wednesday, January 23, 1991 PAGE 3 Councilman Testa made a motion, seconded by Councilman O'Donnell, to receive and file the letter received from Dennis Horner of the Cortland County Health Dept. All voting aye, the motion was carried. The letter was a report of the Annual Water Supply Inspection performed by Dennis Horner, recently. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the letter received from the Cortland County Health Dept. All voting aye, the motion was carried. The letter was in regards to the future development of water supply, sewage collection, treatment and storm water drainage systems of the Walden Oak Subdivision. RESOLUTION #27 DENY ZONE CHANGE REQUEST FOR DONALD OSBECK - ROUTE 413 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES. ROLL CALL VOTE Testa NAY O'Donnell NAY Thorpe NAY Rocco NAY ADOPTED WHEREAS, a request was received from Donald Osbeck in August of 1990 to change the zoning of his property for parcel #105-01-48.000 from Agriculture to Business Zoning, and such.request was forwarded to the necessary agencies for review and a Public Hearing was. held on October 17, 1990 and WHEREAS, a second request was received, and a Public Hearing was duly held on January 23, 1991, and WHEREAS, many concerns have been Heard and reviewed concerning the effect such zone change might have on the Aquifer, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandvill.e does hereby deny the request to change the zoning from Agriculture to Business for parcel #105-01- 48.000, located on Route #13 in the Town. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the Annual Town Clerk's Report for 1990. All voting aye, the motion was carried. A discussion was held concerning charging a fee to an escrow company to return a copy of paid tax receipts to the customer. The tax collector has received an inquiry concerning this. She recommended a fee of $1 per tax bill, paid in advance, if the request were to be honored. It was the consensus of the Town Board that this duty should not be imposed on the collector, and the responsibility should remain, as tax law directs. 16 Wednesday, January 23, 1991 PAGE 4 RESOLUTION #28 AUTHORIZE MARDIS KELSEN TO ATTEND ASSOCIATION OF TOWNS ANNUAL MEETING IN NEW YORK - FED 17 - 20 1991 Motion by Councilman Rocco Seconded by Councilman O'Donnell. VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Mardis F. Kelsen is hereby authorized to attend the Annual Meeting of the Association of Towns Meeting to be held in New York City From February 17 to 20, 1991., and further RESOLVED, that the expenses incurred shall be reimbursed, subject to audit by the Town Board. RESOLUTION #29 AUTHORIZE HIRING ADDITIONAL FULL- TIME DEPUTY COURT CLERK - DUE TO EMERGENCY ILLNESS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a regular full-time employee of the Town Justice Dept. has had to have emergency surgery and WHEREAS, a part-time position was approved by the Town Board, commencing Jan 1, 1991, therefore BE IT RESOLVED, that the Town Board does hereby approve the firing of Peggie Petrie as a temporary full-time Deputy Court Clerk, at a salary of $7.00 per hour, with benefits waived, effective January 18, 1991, until such time as the regular employee shall return, and RESOLVED, that the salary and hours of Peggie Petrie shall return, as usual, as part-time. RESOLUTION #30 AUTHORIZE VILLAGE PARK CONDO ASSOCIATION USE OF MEETING ROOM FOR THEIR MEETINGS Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby authorize the request of Village Park Condo Association to use the meeting room -for their meetings, providing no one else has one scheduled, which is approximately three to four times a year. Their first meeting to be held on Wednesday, March 13, 1991. 1 Wednesday, January 23, 1991 PAGE 5 RESOLUTION #31 AUTHORIZE BUDGET- OFFICER TO AMEND 1990 BUDGET APPROPRIATION Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Budget Officer is hereby authorized to manually correct Voucher #17 on abstract. #3 of 1990 from F9710.6 To F9710.7. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the meeting. All voting aye, the motion was carried.
