TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at 7:30 p.m. at the Town Hall, 15 Terrace Road, Cortland, NY with Supervisor Melvin Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline Parker Others present were Town Att.orney,Phillip Rumsey; Highway Supt., Carl Bush; Newsr.eponter, Skip Chapman; Town resident, Robert Buerkle, and ...John �Tinkham and Donald Westcott. The meeting was called to order by Supervisor Pierce following the Pledge of Allegiance to the flag. Councilman O'Donnell made a motion, seconded by Councilman Testa, to approve the minutes of December 5, 1990, as written. All voting aye, the motion was carried. .Councilman Thorpe made a motion, seconded by Councilman O'Donnell, to receive and file the Planning Board mi.nutes of December 18, 1990. All voting aye, the motion was carried. RESOLUTION ##01 AUTHORIZE PAYMENT OF VOUCHERS .FINAL PAYMENTS OF 1990 Motion by Councilman Thorpe Seconded by Councilman.O'Donnell VOTES: ALL.AYE . ADOPTED BE IT RESOLVED, that audited and shall be payments for 1990: General Fund A General Fund B Highway Fund Water .Fund .. Sewer Fund Capital Projects the vouchers submitted have been .paid. as follows to finalize Vouchers #479 - 497 128 - 144 380 - 402 .167 - 170 100 - 101 180 - 181 Supervisor Pierce offered those privilege: of the floor. 13,098.71 11,963.29 45,429.57 507.41 117.72 527.87 in attendance the Robert Buerkle,.of Carr..Hill Road, stated that he would like to become a member of.the Cortlandville Planning Board if a vacancy. should occur. He is interested in the future of the Town and explained his credentials. Wednesday, January 2, 1991 PAGE 2 The reports of various departments are on the table for review, or available on request, in the Town Clerk's office. Councilman Rocco made a motion, seconded by Councilman Thorpe, to receive and file a copy of the letter and correspondence received from Attorney Kevin M. Gilligan of Costello, Cooney & Fearon. All voting aye, the motion was carried. The Town Planning Board will be acting as "Lead Agency" with respect to the Conditional Permit application of Cortland Housing Group. Councilman Rocco made a motion, seconded by Councilman Thorpe, to receive and file the letter received from State Comptroller, Ed Regan. Al voting aye, the motion was carried. The letter was in regards to the approval process of the State for the creation and extension of town special districts. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the letter received from Azalea Martelli. All voting aye, the motion was carried. The letter advised of a meeting to be held for Cortland citizens for peace in the Persian Gulf. Councilman Thorpe made a motion, seconded by Councilman O'Donnell, to receive and file a copy of a letter sent to George Ottenschot by J. Lee Ambrose. All voting aye, the motion was carried. The letter was in regards to water drainage problems on their properties. Supervisor Pierce requested the Town Board to make a decision of a zone change request received From Donald Osbeck. A Public Hearing was held on October 17, 1990. Mr. John Tinkham stated that they would change their request to rezone only seven acres instead of the whole parcel, as originally requested. Councilman Rocco made a motion that the seven acres be rezoned. No second to the motion was heard. A discussion followed whereby each councilman presented their views. The Town Attorney advised that if the request for the number of acres to be rezoned has changed, it would be necessary to start the process over. It was the consensus of the Town Board that they have learned many more aspects of the aquifer due to this request, and apologized for the delay. RESOLUTION #02 SET DATE FOR A PUBLIC HEARING FOR A ZONING CHANGE REQUEST FOR DONALD OSBECK - LOCAL LAW NO 1 OF 1991 Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES. ALL AYE ADOPTED 3 January 2, 1991 PAGE 3 BE IT RESOLVED, that a Public Hearing shall be held on January 16, 1991 at 5:00 p.m. for Local Law No. 1 of 1991 regarding a Zoning Change request from Donald Osbeck to rezone 22 acres on Rt. 13 from Agriculture to Business. RESOLUTION #03 ACKNOWLEDGE APPROVAL .FROM STATE COMPTROLLER FOR GROTON AVENUE PLAZA, ROUTE 281 AND LUKER ROAD SEWER PROJECT - 1990 Motion by Councilman'O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board of the Town of Cortlandville does hereby acknowledge receipt from the New York State Comptroller for their approval of the Groton Avenue Plaza, Route 281 and Luker Road Sewer Project of 1990, and RESOLVED, that such approval shall be received and filed. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the information received from -the Association of Towns. All voting aye, the motion was carried. The information provided information of their 1991 Annual Meeting. Councilman Rocco Councilman Testa, to received from the NYS was carried. The letter stated Town Board as Lead Facility on Rt. 13. made a motion, seconded by receive and file the letter DEC. All voting aye, the motion that they had no objection to the Agency for the proposed Retail RESOLUTION #04 APPOINT DELEGATE AND ALTERNATE TO THE ASSOCIATION OF TOWNS ANNUAL MEETING - FEBRUARY 1991 Motion by -Councilman Thorpe ' Seconded by Councilman O'Donnell VOTES: ALL AYE 'ADOPTED, BE IT RESOLVED, that the Town Clerk, Pauline H. Parker, is hereby appointed as Delegate, and the Town Justice, Mardis F. Kelsen, is hereby appointed alternate to represent the Town of, Cortlandville at the Association of Towns Annual Meeting, to be held in New York City from February 17-20, 1991. RESOLUTION #07 REAPPOINT OSCAR TAYLOR TO CORTLANDVILLE ZONING BD. OF APPEALS Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Oscar Taylor be, and hereby is reappointed to the Cortlandville Zoning Board of Appeals for a five year term commencing January 01, 1991 and shall expire December 31, 1995. RESOLUTION #11 DESIGNATE THE CORTLAND STANDARD AS THE OFFICIAL NEWSPAPER FOR THE TOWN OF CORTLANDVILLE FOR THE YEAR 1991 Motion by Councilman Rocco Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Cortland Standard is hereby designated as the Official Newspaper for the Town of Cortlandville for the year of 1991. RESOLUTION #12 TABLE PAY SCALE OF ELECTION INSPECTORS FOR 1991 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the pay scale for Election Inspectors for the year 1991 is hereby tabled. A discussion was held concerning employees using their sick days for vacation days. This would jeopardize them if a serious illness or surgery occurred. Sick Days accumulate and may be credited for retirement purposes. No problem areas were heard from Department Heads in attendance. 1 11 1 January 2, 1991 PAGE 7 RESOLUTION #13 DESIGNATION OF DEPOSITORIES FOR TOWN ACCOUNTS FOR THE YEAR 1991 Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the First National Bank of Cortland is hereby designated as the depositary for the various accounts as follows: General Account (Whole Town) General Account (Town Outside) Town Clerk Account Tax Collectors Account Highway Account Justice Account Water Fund Account Sewer Fund Account RESOLUTION #14 SET DATES FOR TOWN BOARD MEETINGS FOR THE YEAR OF 1991 _Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the regular meetings of the Town Board of the Town of Cortlandville shall be held the first Wednesday of each month at 7:30 p.m., and the third Wednesday of each month at 5:00 p.m. at the Town Hall, 15 Terrace Road, Cortland, New York. If such day falls on a holiday, -the meeting shall be held the next business day. - RESOLUTION #15 AUTHORIZE EXTENSION OF THE SUPERVISORS ANNUAL REPORT FOR THE YEAR OF 1990 Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby authorize the Town Clerk to accept the Supervisor's Annual Financial Report to the State Comptroller 60 days after the close of the fiscal year 1990, and BE IT FURTHER RESOLVED, that the Town Clerk shall cause a notice to be published within ten (10) days after receipt thereof, stating that a copy of such report is on file in the Town Clerk's Office and available for public inspection and copying, in accordance with Town Law, Section 29, Article 10-A, amended June 29, 1979 0 January 2, 1991 PAGE 8 RESOLUTION #16 DELEGATE TOWN BOARD MEMBERS TO AUDIT 1990 RECORDS OF TOWN OFFICIALS Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the records of Town Officials and employees for the year 1990 shall be audited by Town Board members by January 20, 1991, as follows: Supervisor's Office Theodore Testa Town Clerk's Office Edwin O'Donnell Justice Office Raymond Thorpe Highway, Water & Sewer Ronal Rocco RESOLUTION #17 AUTHORIZATION TO ACCEPT THE AGREEMENT OF EXPENDITURES OF HIGHWAY MONIES FOR THE YEAR OF 1991 Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the agreement for the expenditure of highway monies in accordance with Section 284 of the Highway Law, was submitted for signatures for the year 1991, and WHEREAS, such agreement has been reviewed by all members of the Cortlandville Town Board, therefore BE IT RESOLVED, that the Agreement of Expenditures of Highway Monies for 1991 shall be signed by the Supervisor, the Town Highway Superintendent and members of the Town Board. Kotwica is hereby approved. January 2, 1991 PAGE 10 RESOLUTION #21 DETERMINE CORTLAND COUNTY LEGISLATURE AS LEAD AGENCY - SEQRA- COUNTY'S COMPREHENSIVE SOLID WASTE MANAGEMENT PLAN Motion by Councilman Testa Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS. notification has been received from the Cortland County Legislature that they are working to develop a Comprehensive Solid Waste Management Plan and wish to be named Lead Agency to meet the requirements of SEQRA, therefore BE IT RESOLVED, that the information received shall be received and filed, and RESOLVED, that the Town Board of the Town of Cortlandville determines that the Cortland County Legislature should be named the SEQRA Lead Agency. RESOLUTION #22 ACCEPT DIVINCI DRIVE AND MADDON LANE Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby accept DiVinci Drive and Maddon Lane in the Renaissance development. RESOLUTION 11:23 ACCEPT ROADS OF MURDOCK SUBDIVISION KNOWN AS CEDAR CREST SUBJECT TO CONDITIONS Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby accept the addition to Sleepy Hollow, Worthington Place, Spruce Run, and Cedar Crest Drive in John Murdock's Development known as Cedar Crest, subject to the following conditions: 1) Receipt of a proper agreement, and security deposit to be submitted by the developer, to the satisfaction of the Town Highway Supt. 2) The Town would not be responsible for plowing and maintaining the roads for the winter season of 1990 - 1991. 3) Approval by the Town Attorney of all title and transfer documents. M January 2, 1991 PAGE 11 RESOLUTION ##24 REFER AQUIFER PERMIT REQUEST OF BERGMANN & ASSOC. TO TOWN AND COUNTY PLANNING BOARDS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a request for an Aquifer Special Permit has been submitted by Bergmann & Assoc., therefore BE IT RESOLVED, that the request shall be forwarded to the Town and County Planning Boards for their review and recommendations. A discussion was held concerning the installation of street lights in the Renaissance Subdivision. It was reported that Niagara Mohawk has been advised and the delay appears to be due to their schedule. The meeting closed with the Supervisor wishing all the best for the coming year, and for a productive year. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the meeting.
