TOWN BOARD MEETING
The Regular Town Board Meeting of the Town Board of
the Town of Cortlandville was held at the Town Hall, 15
Terrace Road, Cortland, New York with Deputy Supervisor
Raymond Thorpe presiding.
Members present: Deputy Supervisor Raymond Thorpe
Councilman Edwin O'Donnell
Councilman Theodore Testa
Town Clerk Pauline Parker
Absent: Supervisor Melvin Pierce
Councilman Ronal Rocco
Others present were: Highway Superintendent, Carl
Bush; Town Attorney, Phillip Rumsey; newsreporter, Laura
Jones.
The meeting was called to order by Deputy
Supervisor, Raymond Thorpe, at 5:00 p.m., followed by
the Pledge of Allegiance.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to approve, as written, the Town Board
Minutes for September 18, 1991. All voting aye, the
motion was carried.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to receive and file the
Cortlandville Zoning Board Minutes of November 21, 1991.
All voting aye, the motion was carried.
RESOLUTION #238 AUTHORIZE PAYMENT OF VOUCHERS
DECEMBER
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

RESOLUTION #239 SEWER AGREEMENT BETWEEN THE TOWN
OF CORTLANDVILLE AND THE VILLAGE
OF HOMER
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Sewer Agreement between the
Town of Cortlandville and the Village of Homer, dated
December 11, 1991, be received and filed.

RESOLUTION #240 ACKNOWLEDGEMENT FROM THE STATE FOR
LOCAL LAW NO. 2 OF 1991
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the acknowledgement from the State
for Local Law No. 2 of 1991 has been received.
RESOLUTION #241 APPROVE CHANGE ORDER NO. 2 AND 3 FOR
NORTHWEST WATER, BELL DRIVE AND
MARYLAND AVENUE SEWER IMPROVEMENTS
FOR DEPUTY SUPERVISOR TO SIGN
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that approval is hereby granted for
change orders no. 2 and 3 for Northwest Water, Bell
Drive and Maryland Avenue Sewer Improvements, further
RESOLVED, that the Deputy Supervisor is hereby
authorized and directed to sign the Change orders.
RESOLUTION #242 AUTHORIZE DEPUTY SUPERVISOR TO
EXECUTE CONTRACTS FOR THE YEAR OF
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Deputy Supervisor is hereby
authorized to execute contracts for the year of 1992
with Ryan and Rumsey, Cortland County SPCA, Cortland
Free Library, Lamont Memorial Library, TLC Ambulance and
Atlantic Inland.
RESOLUTION #243 ADOPTION OF RESOLUTION SUBJECT TO
PERMISSIVE REFERENDUM TOWN OF
CORTLANDVILLE
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, this Board adopted a Resolution on October 2,
1991 relating to the conveyance of a parcel of land to
Richard J. Sadler, for which a survey map dated October
31, 1991 by James P. McNamara is now available, and
WHEREAS, the Town Board desires to reaffirm said
resolution of October 2, 1991, now therefore, be it
RESOLVED, that a triangular -shaped parcel of land being
0.042+ acres located easterly of the east street line of
Alexandria Drive adjacent to property of Sadler and
Harter and further located at the intersection of
Alexandria Drive and Blue Creek Road is of no value to
the Town of Cortlandville and is not property held for
public use, and be it further

RESOLVED, that as requested by Richard J. Sadler, the
Town of Cortlandville shall convey to him by quit -claim
deed the said parcel of land in which the Town may have
an interest or ownership, subject to all costs
associated with the transfer being paid by Richard J.
Sadler, and be it further
RESOLVED, this resolution is adopted subject to
permissive referendum.
RESOLUTION #244 SET DATE FOR A PUBLIC HEARING
LOCAL LAW NO. 1 OF 1992
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, Local Law No.1 of 1991 provided for a
moratorium on the issuance by the Cortlandville Planning
Board of Site Plan approval for mobile homes through
December 31, 1992, and
WHEREAS, those agencies involved have requested more
time for review, and to extend the moratorium, therefore
BE IT RESOLVED, that a Public hearing will be held on
January 8, 1992 at 7:00 p.m. at the Town Hall for Local
Law No. 1 of 1992
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to recess the regular meeting and
convene to an executive session. All voting aye, the
motion was carried.
The following information was received from the
Deputy Supervisor:
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to adjourn the executive session and
reconvene the regular meeting. All voting aye, the
motion was carried.
RESOLUTION #245 ESTABLISH OFFICE OF TOWN ATTORNEY
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, the office of Town Attorney was established by
resolution adopted February 3, 1960 and thereafter
abolished by resolution adopted February 2, 1983, it is
hereby
RESOLVED, that pursuant to Town Law Section 20 (2) (a),
the office of Town Attorney is hereby established
effective January 1, 1992.
Councilman O'Donnell made a motion seconded by
Councilman Testa to adjourn the meeting. All voting
aye, the motion was carried.
The meeting was adjourned at 5:45 p.m.
