AQUIFER PROTECTION PERMIT GARY CRISALLI FOR INTERTEK US ROUTE 11 TAX MAP # 87.00-03-20.000 A Public Hearing was held by the Town Board of the Town of Corllandville at the Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Protection Permit, permitting the construction of a 25,000 square foot office building, parking area, driveway and sidewalk on property located on US Route 11. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Karen Snyder Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Water & Sewer Sup't, Peter Alteri: town residents, Anthony Pace, Wilma Puderbaugh and John Bishop: Town Planning Board member, Nick Renzi; Chris Nolan from the Cortland Standard. Supervisor Thorpe called the Public Hearing to order. The Town Clerk read aloud the Legal Notice, as published, posted and filed. Supervisor Thorpe offered privilege of the floor to those in attendance. Councilman Testa inquired from Town Planning Board member Nick Renzi if any conditions were placed on this Aquifer Protection Permit application by his board. Mr. Renzi stated there were no conditions. No further comments or discussions were heard. Councilman Testa made a motion, seconded by Councilman O'Donnell, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 7:02 p.m. 1 OCTOBER 4, 2000 TOWN BOARD MEETING 7:02 P.M. 1 LJ 1 The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Karen Snyder Others present were: Town Attorney, John Folmer; Highway Sup't., Carl Bush; Water & Sewer Sup't., Peter Alteri: town residents, Anthony Pace, Wilma Puderbaugh and John Bishop: Town Planning Board member, Nick Renzi; Chris Nolan from the Cortland Standard. Supervisor Thorpe called the meeting to order. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file the Cortlandville Planning Board Minutes of June 27, 2000. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Pilato, to receive and file Cortlandville Planning Board Minutes of July 25, 2000. All voting aye, the motion was carried. Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers # 521 - 543 $ 9,365.30 General Fund B 116 - 126 $ 24,326.49 Highway Fund DB 358 - 370 $ 71,253.65 Water Fund 246 - 261 $ 18,529.20 Sewer Fund 147 - 151 $ 26,581.70 Supervisor Thorpe offered privilege of the floor to Nick Renzi. Planning Board member Nick Renzi apprised the Board of two training sessions on "Planning" to be held November 1 & 2, 2000 from 6-9 p.m. at Tompkins Cortland Community College. The Town Planning Board has invited Planning Board members from surrounding towns to attend. Councilman Testa and Mr. Renzi discussed the installation of pipe on Raphael Drive by Grant Street Construction. Attorney Folmer stated he would discuss this issue further with Mr. Renzi at a later time. Councilman O'Donnell apprised the Board of attending a meeting Senator Seward held in the Village of McGraw. The Senator spoke about the CHIPS program being back and improved. Senator Seward also stated the gross receipts tax is down 40% and the STAR program will remain in place entering into its second phase. In answer to questions, Town Clerk Karen Snyder explained someone qualifying for the basic STAR program does not need to reapply every year. A property owner aged 65 and over in the enhanced STAR program must reapply each year. OCTOBER 4 200 0 TOWN BOARD MEETING PAGE 2 Mr. Renzi informed the Board Councilman Testa, Highway Sup't., Carl Bush and himself met with Dave Tagg from MacNeill-Tagg Engineering to discuss the drainage problem behind Anthony Bonarti's house on Raphael Drive. Mr. Tagg estimated a cost of $12.500 to establish a design to rectify the drainage problem in that area. Highway Sup't., Carl Bush stated he has spoken with Homer Highway Sup't., Thomas Bell. Mr. Bell will discuss the water run-off problem, the portion of Cosmos Hill within the Town of Homer, with his Town Board. Councilman Testa apprised the Board of a meeting held with Carl Edhind and NYS DOT at a Rotary meeting. The present plan is to widen Route 281 to three lanes from Exit 12 to Fisher Ave. It was discussed if Route 281 is not changed, in 20 years it would take approximately 45 minutes to travel south from Exit 12 to the Route 13 Route 281 exchange. Councilman Testa also stated the design work for drainage in that area has not yet been accomplished. A discussion was held concerning applying for federal grants regarding the drainage problem. Carl Kimberly, former Village of McGraw Clerk, is assisting the town to look into grants. Supervisor Thorpe stated Bernie Thoma will be at the next Board meeting to discuss the possibility of grants. Supervisor Thorpe offered privilege of the floor to Wilma Pudderbaugh. Mrs. Pudderbaugh inquired into the status of the Keane code violation on Terrace Road discussed at a previous Board meeting. Attorney Folmer stated he has drafted a letter to the Keane's but has not mailed as yet. Attorney Folmer has spoken with Code Enforcement Offices- Bruce Weber regarding restrictions of the side and back yards. Attorney Folmer stated he would be in touch with Mrs. Pudderbaugh. The monthly report for Town Clerk for September 2000, is on the table for review and filed in the Town Clerk's office. RESOLUTION #180 DECLARE NEGATIVE IMPACT FOR AQUIFER PROTECTION PERMIT #5 OF 2000 SUBMITTED BY GARY CRISALLI FOR INTERTEK FOR PROPERTY LOCATED US ROUTE 11 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, an Aquifer Protection Pei-init application was submitted by Gary Crisalli for Intertek, for property located on US Route 11, permitting the construction of a 25,000 square foot office building, parking lot area, driveway and sidewalk, tax map #87.00-03- 20.000 and WHEREAS, the Town Board as Lead Agent, duly reviewed and completed the Short. Environmental Assessment Form, therefore BE IT RESOLVED, the Town Board, as Lead Agent, does hereby declare the proposed project submitted by Gary Crisalli for Intertek, Aquifer Protection Permit #5 of 2000, shall have no significant environmental impact. RESOLUTION #181 AUTHORIZE SUPERVISOR TO SIGN SEQRA APPLICATION OF AQUIFER PROTECTION PERMIT #5 OF 2000 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign the SEQRA application relating to Aquifer Protection Permit #5 of 2000, submitted by Gary Crisalli for Intertek. -3i9 OCTOBER 4, 2000 TOWN BOARD MEETING PAGE 3 RESOLUTION #182 APPROVE AQUIFER PROTECTION PERMIT #5 OF 2000 SUBMITTED BY GARY CRISALLI FOR INTERTEK FOR PROPERTY LOCATED AT US ROUTE 11 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the, Cortland County Planning Department and the Town Planning Board have reviewed and recommended approval of this Aquifer Protection Permit application, and WHEREAS, a Public Hearing was duly held by this Town Board, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Protection Permit #5 of 2000, submitted by Gary Crisalli for Intertek, for property located on US Route 11 permitting the construction of a 25,000 square foot office building, parking lot area, driveway and sidewalk, tax map #87.00-03-20.000, and itis further RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. RESOLUTION #183 ACKNOWLEDGE RECEIVING 2001 TENTATIVE BUDGET Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Clerk received the 2001 Tentative Budget on September 29, 2000, and has presented it to Town Board members, in accordance with Town Law. The Board decided to meet with bookkeeper, Gina Nourse, on October 16, 2000 at 5:00 p.m. for a workshop regarding the 2001 budget. Attorney Folmer reported: Amending Zoning Law for Aquifer Protection Permit notifications: Attorney Folmer distributed a draft of a proposed amendment to the Zoning Law for changing the time element of notification of Public Hearings for Aquifer Protection Permits. He also requested a Public Hearing be scheduled in regards to this amendment.. RESOLUTION #184 SCHEDULE PUBLIC HEARING FOR LOCAL LAW-2000 AMENDING THE ZONING LAW FOR THE TIMING OF NOTICE OF PUBLIC HEARINGS FOR AQUIFER PROTECTION PERMITS Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be scheduled for October 18, 2000 at 5:00 p.m. for Local Law-2000 amending the Zoning Law for the timing of notice of Public Hearings for Aquifer Protection Permits. Davinci Drive: Attorney Folmer stated the discussions concerning the water line on Davinci Drive are continuing. Smith -Corona: Attorney Folmer received notification of a meeting concerning the bankruptcy of Smith -Corona to be held October 31, 2000 in Wilmington, Delaware. Attorney Folmer will not be attending. OCTOBER 4, 2000 TOWN BOARD MEETING PAGE 4 Councilman Pilato made a motion seconded by Councilman O'Donnell, to receive and file three letters of correspondence between Code Enforcement Office Bruce Weber and Richanna Patrick, Terry and Brian Mingle. All voting aye, the motion was carried. The correspondence is in reference to code violation at 1249 Isabel Drive. Privilege of the floor was given to Tony Pace. Mr. Pace representing his mother of 1250 Isabel Drive explained difficulties with Brian & Terry Mingle at 1249 Isabel Drive. The Mingles have started a band and are practicing three nights a week. A school bus used to transport their band equipment is parked at the Mingle's Isabel Drive residence. The Paces have spoken to the Mingles several times asking for consideration in regards to noise and not leaving their bus parked in the driveway for an extended period of time. Mr. Pace also spoke with the Sheriff's Department and Code Enforcement Officer Bruce Weber. Mr. Weber has spoken and corresponded with the Mingles and the property owner Richanna Patrick regarding the bus being parked at 1249 Isabel Drive. Mr. Weber has informed the Mingles and Ms. Patrick the bus is in violation of Cortlandville's code. Attorney Folmer stated that the nominal procedure is Mr. Weber informs the Board of any code violations. The Board then determines if these violations should be referred to the Town Attorney to review and proceed with compliance. RESOLUTION #185 REFER CODE VIOLATION OF BRIAN AND TERRY MINGLE OF 1249 ISABEL DRIVE, TO TOWN ATTORNEY FOR REVIEW AND PROCEED AS REQUIRED Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the code violation of Brian and Terry Mingle at 1249 Isabel Drive, tax map #96.06-02-05.000 is hereby referred to the Town Attorney for review and direct him to proceed with compliance, as required. RESOLUTION #186 REFER ZONE CHANGE REQUEST AND AQUIFER PROTECTION PERMIT APPLICATION OF REROB, LLC TO THE TOWN AND COUNTY PLANNING BOARDS FOR THEIR REVIEW AND RECOMMENDATIONS Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Zone Change Request and an Aquifer Protection Permit application submitted by Rerob, LLC for property located at Route 13 and Lime Hollow Rd. Tax Map #95.00-06-12.100, shall be referred to the Town and County Planning Boards for their review and recommendations. RESOLUTION #187 REFER AQUIFER PROTECTION PERMIT APPLICATION OF PALL TRINITY MICRO CORP. TO THE TOWN AND COUNTY PLANNING BOARDS FOR THEIR REVIEW AND RECOMMENDATIONS Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, an Aquifer Protection Permit application submitted by Pall Trinity Micro Corp. for property located at NYS Route 281, Tax Map #95.12-01-07.000, shall be referred to the Town and County Planning Boards for their review and recommendations. OCTOBER 4, 2000 TOWN BOARD MEETING PAGE 5 �a ' RESOLUTION #188 SCHEDULE A PUBLIC HEARING FOR AN AQUIFER PROTECTION PERMIT APPLICATION SUBMITTED BY PALL TRINITY MICRO CORP. FOR OCTOBER 18 2000 Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, a Public Hearing shall be scheduled. for October 18, 2000 at. 5:00 p.m. for an Aquifer Protection Permit application submitted by Pall Trinity Micro Corp. for property located at NYS Route 281, tax map #95.12-01-07.000. Water and Sewer Sup't., Peter Alteri, apprised the Board of the lowest bid for the proposed new municipal water and sewer building was $465,000. MacNeill-Tagg Engineering had estimated the cost at. $580,000. A discussion was held regarding the feasibility of renovating the old fire station opposed to the construction of a new building, also the selling of Citizen's Park which includes the old fire station. It was decided to table a decision in regards to awarding the bid for the proposed new municipal water & sewer building for further research for funds. Supervisor Thorpe opened a discussion concerning the Town Justice's request to hire a new Deputy Court Clerk due to the resignation of Peggie J. Petrie. RESOLUTION #189 AUTHORIZE TOWN JUSTICE TO HIRE PART TIME DEPUTY COURT CLERK Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a vacancy for a part time Deputy Court Clerk has occurred due to the resignation of Peggie J. Petrie, therefore BE IT RESOLVED, the Town Board does hereby authorize Town Justice to hire a part time Deputy Court Clerk. RESOLUTION #190 AUTHORIZE USE OF TOWN HALL FOR THE DEFENSIVE DRIVING COURSES FOR THE YEAR OF 2001 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Safety Council of Central New York is hereby authorized to use the Town Hall to conduct their Defensive Driving Course for the year of 2001, per the schedule submitted. Councilman Pilato made a motion, seconded by Councilman Testa, to recess the Regular Meeting to an Executive Session regarding a personnel matter. All voting aye, the motion was carried. The meeting was recessed at 8:00 p.m. The following information was received from the Supervisor's office.
