HomeMy WebLinkAboutZBA Minutes 2015-04-20 TOWN OF ITHACA ZONING BOARD OF APPEALS Monday April 20,2015 Present: Rob Rosen, Chair; Members Christine Jung, Christine Decker, Alternates George Vignaux and Caren Rubin Absent: John DeRosa and Bill King A9peal of Country Stones, LLC, owner and Fangjiang Guo, applicant, requesting a variance from the requirements of Chapter 270-71 F(1)"Garages", to allow an existing garage that was found to be in violation of the required side yard setback, located at 135 Simsbury Dr. Tax Parcel No. 72.4-1.57, Medium Density Residential (MDR). Mr. Guo was present to answer any questions. Mr. Rosen opened the discussion to the Board and Ms. Jung stated that it seems pretty minor and Mr. Rosen added that it seems it was an oversight during the building of the house and has been there for quite some time. Mr. Rosen opened the public hearing at 7:06 pm; there was no one wishing to address the Board and the public hearing was closed. ZBA Resolution 0028-2015 Area Variance Country Stones, LLC; Fangiiang Guo,Applicant 135 Simsbury Dr.,TP 72.4-1.57 MDR April 20,2015 Motion made by Mr. Rosen, seconded by Ms. Jung Resolved that this Board grant the appeal of Country Stones, LLC, owner and Fangjiang Guo, applicant, requesting a variance from the requirements of Chapter 270-71 F(1)"Garages", to allow an existing garage that was found to be in violation of the required side yard setback, located at 135 Simsbury Dr, Tax Parcel No. 72.4-1.57, Medium Density Residential (MDR) with the following: Findings 1. That the benefit sought by the applicant cannot be achieved by any other means feasible in that it is the residence itself encroaching into the setback and the building would have to be moved, and 2. That there will not be an undesirable change in the neighborhood character or to nearby properties because the house has been there for almost 40 years, and 3. That the request is not substantial,being less than one foot in length, and 4. That there will not be any adverse physical or environmental effects as this is a SEQR ZBA 4-20-2015 Adopted 5-15-2015 Pg. 1 Type II exempt action,and 5. That the alleged difficulty is not self-created as this house has been sold a number of times since it was built and the nonconformity was never caught, and 6. That the benefit to the applicant does outweighs any detriment to the health, safety and welfare of the community. And with the following: Conditions 1. That the setback be no smaller than 9 feet from the side lot line, and 2. That no construction be permitted that moves the garage any closer to the side lot line or changes made to the garage that might increase the non-conformity. Vote: Ayes—Rosen, King,Jung, Decker, Vignaux and Rubin Unanimous Appeal of Andy Slater, Crown Construction, agent and Chad Coates, owner, requesting a variance from the requirements of Chapter 270-71 C"Yard Regulations, side yards", to correct the 2014 survey that revealed an insufficient side yard setback, located at 219 Eastern Heights Dr.,Tax Parcel No. 57.4-8.127, Medium Density Residential (MDR). Mr. Rosen reviewed Mr. Bates' memo and noted that this appeal is similar to the one just granted in that it is an existing structure with a small deficiency; they are short approximately 1.5 feet for a house that was built in 1973. Mr. Rosen opened the public hearing at 7:15 pm; there was no one wishing to address the Board and the public hearing was closed. ZBA Resolution 0031-2015 Area Variance Chad Coates 219 Eastern Heights Dr.,TP 57.-1-8.127 MDR April 20,2015 Motion made by Mr. Rosen, seconded by Ms. Decker Resolved that this Board grant the appeal of Andy Slater, Crown Construction, agent and Chad Coates, owner, requesting a variance from the requirements of Chapter 270-71 C"Yard Regulations, side yards", to correct the 2014 survey that revealed an insufficient side yard setback, located at 219 Eastern Heights Dr.,Tax Parcel No. 57.4-8.127, Medium Density Residential (MDR)with the following: ZBA 4-20-2015 Adopted 5-15-2015 Pg. 2 i" Findings 1. That the benefit sought by the applicant cannot be achieved by any other means feasible in that it is the residence itself encroaching into the setback and the building would have to be moved, and 2. That there will not be an undesirable change in the neighborhood character or to nearby properties because the house has been there for almost 40 years, and 3. That the request is not substantial being a variance for 1.3 feet with a setback of 15 feet which is less than 10% and part of the house does in fact meet the setback but one corner does not, and 4. That there will not be any adverse physical or environmental effects as this is a SEQR Type II exempt action, and 5. That the alleged difficulty is not self-created as this house has been sold a number of times since it was built and the nonconformity was never caught, and 6. That the benefit to the applicant does outweighs any detriment to the health, safety and welfare of the community. And with the following: Conditions 1. That the setback be no smaller than 13 feet from the property line, and 2. That no construction or alterations be permitted to the house that would increase the non-conformity. Vote: Ayes—Rosen, King, Jung, Decker, Vignaux and Rubin Unanimous A ileal of Kenneth and Diane Schmidt.,owners, requesting a variance from the requirements of Chapter 270-70 "Height Limitations"of the Town of Ithaca Code, in order to construct a 20' 6" tall detached garage, located at 1205 Trumansburg Rd, Tax Parcel No. 26.4-37, Medium Density Residential (MDR). Ken and Diane Schmidt were present to answer any questions from the Board. Mr. Schmidt recapped what concerns the Board had that Mr. Fabbroni relayed to them from the last appearance. They have revised the plans to address those concerns by reducing the overall height and lowered the ceiling so it cannot be considered living space. The Board noted that the height is mitigated by the fact the roadway is at a higher elevation than the garage and it will appear almost the same height as the house. The Board felt the applicants ZBA 4-20-2015 Adopted 5-15-2015 Pg. 3 had addressed their concerns. ZBA Resolution 0026-2015 Area Variance-Height Kenneth and Diane Schmidt 1205 Trumansburg Rd,TP 57.4-8.127 MDR April 20,2015 Motion made by Mr. Rosen, seconded by Ms. Rubin Resolved that this Board grant the appeal of Kenneth and Diane Schmidt., owners, requesting a variance from the requirements of Chapter 270-70 "Height Limitations" of the Town of Ithaca Code, in order to construct a 20' 6" tall detached garage, located at 1205 Trumansburg Rd, Tax Parcel No. 26.4-37, Medium Density Residential (MDR)with the following: Findings 1. That the benefit sought by the applicant cannot be achieved by any other means feasible in that this is the lowest they can build the garage and still have the benefit of the storage loft, and 2. That there will not be an undesirable change in the neighborhood character or to nearby properties because a garage is a permitted use and the variance is not large and the area has a number of different uses including professional and medical buildings and the highway dominates the landscape, and 3. That the request is substantial being 20.5 feet where 15 feet is allowed which is an increase of 35% however, the building will sit 10 feet below the surface of the State highway and the impact of the additional height is greatly mitigated by that. The top of the garage will be less than 15 feet above highway grade, and 4. That there will not be any adverse physical or environmental effects as this is Type II and exempt from SEQR because it is construction of a minor accessory structure that does not change land use or density, and 5. That the alleged difficulty is self-created by the desire to have a storage.loft, but none the less, the benefit to the applicant does outweighs any detriment to the health, safety and welfare of the community. With the following: Conditions ZBA 4-20-2015 Adopted 5-15-2015 Pg.4 1. That the garage be constructed substantially as shown on the documents submitted to this board for the April meeting, and 2. That the garage height not exceed 21 feet from grade as shown on the drawings submitted to this board for the April meeting. Vote: Ayes—Rosen, King,Jung, Decker, Vignaux and Rubin Unanimous Adjourned Anneal of Jennifer and Terry Fee, owners, requesting a variance from the requirements of Chapter 270-71(E) and (C)"Yard regulations, accessory buildings" to place an 8' x 16' accessory structure in the front yard, with less than 15' to the side yard property line, located at 107 Birchwood Dr.,Tax Parcel No. 70.40-1.23, Medium Density Residential (MDR). Jennifer Fee was present for questions from the Board. Mr. Rosen started the discussion by noting that he took a number of pictures and sent them to the Board showing the shed in relation to the side yards and the street. Additional photos were printed out from the email and distributed to the Board and given to the applicant. Mr. Rosen recapped the appeal stating that the town did receive a complaint about the shed blocking a neighbor's view and in his opinion it does and it is prominent in the front yard. He added that these rules are made by the Town Board and there is no saying that sheds in the front yard are good or bad but people have an expectation from the Code of some uniformity and it isn't fair for someone else to have to look at the side of a shed. Ms. Jung noted that she went to the property and it does slope dramatically and the hypothetical path the Board had been talking about moving the shed by was not feasible. Ms. Fee agreed that in her mind, there is no way to move it to the back of the house without moving a significant number of trees. Mr. Rosen disagreed saying that he saw places in the back and side yard where the shed could be placed. Ms. Jung thought it might be possible, hypothetically, in the backyard if a retaining wall was put in but it would be costly and difficult. She added that the Board has to look at this request as if the shed were not already there and if the applicants had come before the Board prior to placing the shed,would the Board grant a variance. Mr. Rosen thought it could be put in the side yard or moved back. Ms. Fee stated that she measured and looked and looked and the problem is that the yard is very narrow and slopes significantly as well as being very wet a large portion of the time. She added that she hadn't looked at the side yard from what was said at the last appearance. Mr. Rosen responded that a variance for the side yard opposite its current location is an option. Lengthy discussion followed with the Board discussing the feasibility of moving the shed to the side yard and looking at the photos provided. The Board and the applicant discussed the trees and shrubs existing on the lot and various places it thought the shed could be relocated to. The Board was aware that other applicants had appeared before the Board for similar variances and been denied and this could set a precedent. They were sympathetic to the fact the shed was ZBA 4-20-2015 Adopted 5-15-2015 Pg.5 already built and in place,but felt they could not take that into consideration. Ms. Brock reviewed whether the variance requested as stated would allow for a side yard variance and determined it could be granted as posted because the variance is from the requirement of not in the front yard and did not state a different location. The applicant requested that the appeal be adjourned to the next meeting to allow her time to measure and investigate options for moving the shed to the side yard. Motion made by Mr. Rosen, seconded by Ms. Jung to adjourn the appeal to a future meeting that is convenient for the applicant and the Board. Unanimous Other Business College Crossings Mr. Bates reported that College Crossings has submitted an application for a use variance. The Board has granted a height and area variances to the project and they are asking for an increase in the area variances and for a use variance to allow mixed residential and commercial uses. This will be a Type I action and the question is whether the Zoning Board would like to be Lead Agency or allow the Planning Board to be Lead Agency as far as SEQR review is concerned. The Zoning Board was in favor of designating the Planning Board as Lead Agency and Mr. Bates will have more information on the project and a draft resolution for designation of Lead Agency for the next meeting.
