TB Resolution 2018 - Adopt Local Law 1 of 2018 entitled "Authorizing a Monetary
Gift to the City of Ithaca to Support Cass Park and Stewart Park Recreational Facilities"
Whereas, the Town Board discussed the need for monetary support for the Cass Park and
Stewart Park Recreational Facilities during its budget process, and
Whereas, the Town Board adopted a budget for 2018 including an amount of$55,000.00 for a
contribution towards City Parks, of which approximately $ 38,000 would result in a special benefit to
Town residents, but the remainder would be considered a gift., and
Whereas, pursuant to the Town's New York State Municipal Home Rule powers, a local
law may be adopted to authorize the Town to make a gift to another municipality where the gift
furthers a public purpose of the Town,
Whereas, at its meeting on January 29, 2018, the Town Board discussed the proposed
local law and set a public hearing for February 12°i at 5:30 p.m. to hear all interested parties on
the proposed local law entitled "Authorizing a Monetary Gift to the City of Ithaca to Support
Cass Park and Stewart Park Recreational Facilities", and
Whereas, said public hearing was duly advertised and held on said date and time and all
parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said
proposed local law, or any part thereof, and
Whereas, pursuant to the New York State Environmental Quality Review Act
("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by
the Town Board that approval of the local law is a Type II action because it constitutes "routine
or continuing agency administration and management, not including new programs or major
reordering of priorities that may affect the environment," and thus approval of the local law is
not subject to review under SEQRA, now therefore be it
Resolved, that the Town Board hereby adopts Local Law 1 of 2018 entitled
"AUTHORIZING A MONETARY GIFT TO THE CITY OF ITHACA TO SUPPORT CASS
PARK AND STEWART PARK RECREATIONAL FACILITIES," and it is further
Resolved, that the Town Clerk is hereby authorized and directed to file said local law
with the Secretary of State as required by law.

LOCAL LAW NO. 1 OF THE YEAR 2018
A LOCAL LAW AUTHORIZING A MONETARY GIFT TO THE CITY OF ITHACA
TO SUPPORT CASS PARK AND STEWART PARK RECREATIONAL FACILITIES
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Authorization. This local law is adopted pursuant to New York
Municipal Home Rule Law §I0(1)(i), which grants local governments the power to adopt
local laws not inconsistent with the New York State Constitution or any general law,
relating to their property, affairs or government. The New York State Constitution,
Article VIII, §I does not prohibit municipalities from making gifts to or in aid of public
entities for public purposes.
Section 2. Purpose. The purpose of this local law is to authorize the Town of
Ithaca to make a gift to the City of Ithaca to support the City's Cass Park pool and skating
rink, and the City's recreational facilities at Stewart Park. The Town of Ithaca intends to
give the City of Ithaca Fifty Thousand Dollars ($55,000.00) in 2018 to support these
facilities, which are used by Town of Ithaca residents and serve a Town of Ithaca public
purpose. In exchange, the City of Ithaca will offer Town of Ithaca residents a discount on
recreation programs that is anticipated to save Town of Ithaca residents approximately
Thirty-Eight Thousand Dollars ($38,000). This law authorizes the Town of Ithaca to
make a gift to the City of Ithaca to the extent the Town's payments to the City exceed the
monetary benefit of the discounts received by Town residents.
Section 3. Gift to City of Ithaca. Upon execution of a Memorandum of
Understanding between the Town of Ithaca and the City of Ithaca, the Town of Ithaca is
authorized to make a gift to the City of Ithaca, pursuant to the Memorandum of
Understanding's terms, in the amount and for the purposes described in Section 2 above.
Section 4. Partial Invalidity. In the event that any portion of this law is
declared invalid by a court of competent jurisdiction, the validity of the remaining
portions shall not be affected by such declaration of invalidity.
Section 5. Effective Date. This local law shall take effect immediately upon
its filing with the New York Secretary of State.

TB Resolution 2018- : Order Setting a Public Hearing Regarding a Proposed
Sewer Improvement for the Town of Ithaca, Tompkins County, New York,
pursuant to Article 12-C of the Town Law, to be known as the Town of Ithaca East
State Street/MLK Sanitary Sewer Upgrade Sewer Improvement,and establishing
the Town of Ithaca East State Street/MLK Sanitary Sewer Upgrade Replacement

Whereas, a map, plan and report, including an estimate of cost, have been duty
prepared in such manner and in such detail as has heretofore been determined by the
Town Board of the Town of Ithaca, Tompkins County, New York, relating to the
establishment and construction, pursuant to Article 12-C of the Town Law, of Sewer
system improvements to be known and identified as the Town of Ithaca East State
Street/MLK Sanitary Sewer Upgrade Sewer Improvement, (the "Improvement'), to
provide such sewer Improvement to the present Town sewer system, such sewer system
Improvement to be jointly constructed and jointly owned by the Town of Ithaca and the
City of Ithaca; to serve a benefitted area in said Town to be known as the Town of Ithaca
East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement Area (the "Sewer
Improvement Area"); and
Whereas, said map, plan and report, including estimate of cost, were prepared by
a competent engineer, duly licensed by the State of New York, and have been filed in the
office of the Town Clerk of said Town, where the same are available during regular
office hours for examination by any person or persons interested in the subject matter
thereof; and
Whereas, the area of said Town determined to be benefited by said Town of
Ithaca East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement Area consists
of the entire area of said Town excepting therefrom the area contained within the Village
of Cayuga Heights, and
Whereas, the Improvement proposed in connection with the establishment of the
Sewer Improvement Area consists of replacing approximately 2,350 LF. of 10" RCP with
2,350 LF. of a new 15" sewer main in the same general alignment beginning at the
intersection of Seneca Way to the intersection of Mitchell Street, including the
replacement of approx.. 20 manholes, 32 services and other related ancillary facilities, at
an initially determined maximum estimated cost to said Sewer Improvement Area of
41.57% of$990,528.00 or$41.1,762.49; and

Whereas, said $411,762.49 is the maximum estimated cost, with the proposed
method of financing to be employed by the Town of Ithaca consisting of the expenditure
of current revenues and surplus funds from sewer rents and charges from said Sewer
Improvement Area, and
Whereas, it is now desired to call a public hearing for the purpose of considering
said map, plan and report, including estimate of cost, and the providing of the
Improvement, and to hear all persons interested in the subject thereof concerning the
same, all in accordance with the provisions of Section 209-q of the Town Law;
Now, therefore, it is hereby ordered, by the Town Board of the Town of Ithaca,
Tompkins County, New York, as follows:
Section 1. A public hearing shall be held by the Town Board of the Town of
Ithaca, Tompkins County, New York, at the Town Hall, 215 North Tioga Sweet, in
Ithaca, New York, in said Town, on the 26th day of February, at 4:30 o'clock P..M.,
Prevailing Time, to consider the aforesaid map, plan, and report; including estimate of
cost,and the question of providing the Improvement, and to hear all persons interested in
the subject thereof concerning the same and to take such action thereon as is required by
law.
Section 2. The Town Clerk is hereby authorized and directed to publish a
Notice of Public Hearing regarding the aforesaid Improvement to be published once in
the official newspaper, and also to post a copy thereof on the town signboard maintained
by the Town Clerk, not less than ten (10) nor more than twenty (20) days before the day
designated for the hearing as aforesaid, all in accordance with the provisions of Section
209-q of the Town Law.
Section 3. This Order shall take effect immediately.
The question of the adoption of the foregoing Order was duly put to a vote on roll
call, which resulted as follows:

TB Resolution 2018 - : BUDGET AMENDMENT — Amending the 2018 Ithaca
Town Budget for Joint Youth Commission Programs
Whereas, the Town values highly its Youth Programs for the many benefits
provided for the Town's young people; and
Whereas, the Joint Youth Commission (JYC) has ably facilitated many of the
Town's youth programs for many years; and
Whereas, the Town has received a communication from the JYC requesting an
amendment to the 2018 Ithaca Town Budget to 1) increase the budget for the JYC Youth
Programs from the adopted total of$193,068 to an amended total of$193,071, and 2) to
adjust the budgets of the individual programs within the amended total to meet the goals
established by the JYC for 2018; now, therefore, be it
Resolved, that appropriations for Joint Youth Commission Programs in the 2018
Ithaca Town Budget be amended as follows:
• General Townwide Fund—Expenditures
- Account A7320.461: Counselor-In-Training Program (Coddington Road
Community Center) is increased from$15,887 to $19,862.
- Account A7320.464: Youth Employment Program (Ithaca Youth Bureau /
Youth Employment Services) is decreased from $75,751 to $71,750.

Brief description of the Program;
The CIT Program at Camp Coddington provides opportunities for youth ages 15-17 to gain work experience In a Camp setting,
developing workplace skills that will assist them with obtaining a counselor position or other entry level position In the future.The
program includes a variety of workshops and presentations related to Interpersonal skill development,leadership skill building,
money management,how to look for employments and more.Guest presenters and local field trips enhance the program by
reinforcing the goals and supporting the youth In developing relationships with adults.After the training program,the youth pair up
with counselors to practice the skills they have learned.They also practice managing daily work assignments and supervisory
expectations at the camp.

One full-time program educator plans,recruits and facilitates youth development programs during the school year,generally during
the after school hours and with some lunchtime programming at DeWitt and Boynton middle schools;some fifth graders from

enhances the development of healthy lifestyle choices through programming that is designed to emphasis life skills development
and work/career readiness, Programs are typically offered In six to twelve week sessions,meeting the same day after school each
week. Summer programming is offered in a manner that is user-friendly to families,such as wrap around programs In Brooktondale

Brief description of the Program:
Youth Employment Service's work-readiness program is called YES Connect(YC)which serves teens ages 14.20.Program
components are designed on a continuum that allows teens to select their level of involvement. YC includes an Interview and Skills
Assessment,Private Employment Referral,Workshops and Trainings,l-to-1 Coaching,and targeted Subsidized Placements. In 2018
the program plans to serve roughly 100 teens in Tompkins County through YC and 55 teens in the City of Ithaca with subsidized
placements.We are proposing to serve an additional 20 teens in JYC communities through YC,and 36 teens In JYC communities with
subsidized placements.
(Note: Administrative costs also include youth YES Connect service to youth in Danby and Enfield since the JYC receives funds from
the County for this purpose. Money for youth salaries for Danby and Enfield youth is not included and YES will contract directly with
these communities if they want to support subsidized youth jobs.)

TB Resolution 2018 — : Refund of Water and Sewer Charges for Cornell Maplewood
Apartments, Utility Billing Account A4318, Tax Map 63.2-2-1.0.2
Whereas, as of October 18, 2017 there remained a delinquent balance of $7,423.33
for water charges, $742.34 for water penalties, $3,907.73 for sewer charges and $390.78 for
sewer penalties, a total of$12,464.18 on utility billing account no. T1235 for customer Cornell
Maplewood Apartments, 900 Mitchell Street, Ithaca,NY 14850; and
Whereas, Town Code Chapters 210 and 261 provides for all delinquent accounts for
payment of water and sewer charges and penalties to be placed on the ensuing years tax roll as a
re-levy; and
Whereas, all delinquent water and sewer charges and penalties for Cornell Maplewood
Apartments as of October 18, 2017 in the amount of$12,464.18 were removed from the utility
billing account and re-levied by Town Board Resolution No. 2017-134 to the 2018. Town and
County Tax Roll on November 13, 2017; and
Whereas, subsequent to 2018 tax bills being issued, Cornell University Real Estate
requested that the original calculation made by Bolton Point staff on March 1, 2017 be reviewed;
and
Whereas, the review of the original calculation made by Bolton Point staff determined an
error had been made in said original calculation, resulting in overcharges $3,711.67 for water
charges, $371.17 for water penalties, $1,953.86 for sewer charges and $195.39 for sewer
penalties, a total of$6,232.09; and
Whereas, taxes have been paid in full for the affected Tax Parcel, now,therefore be it
Resolved, the Town Board of the Town of Ithaca hereby authorizes a refund of
$6,232.09 to be paid to Cornell University Real Estate, 15 Thornwood Drive, Ithaca, NY 14850.

TB Resolution 2018 - : Acceptance of the "Inlet Vallev Ithaca Plan: Economic
Development Feasibilitv Study and Strategic Plan"
Whereas the Town commissioned a study of the Inlet Valley Corridor by ConsultEcon
which was previewed by the Economic and Development Committee on January 29, 2018, now
therefore be it
Resolved that the Town Board accepts the report by ConsultEeon; "Inlet Valley Ithaca
Plan: Economic Development Feasibility Study and Strategic Plan" and discussion will continue
at the Economic Development Committee regarding the strategies and recommendations
contained therein.

TB Resolution 2018 - Authorizing the Standardization of "Aquastore Glass Fused to
Steel Bolted Water Tanks"for the Ellis Hollow Water Tank and Water Main Project
Whereas during the evaluation of the 2014 Sapsucker Woods Tank Replacement Water
Improvement Project, the Public Works Department investigated and compared the long term
maintenance costs and specifications of tanks submitted during the bid process, and
Whereas the Aquastore Glass Fused to Steel Bolted Tank was determined to be less
expensive and easier to maintain than other tank options, and
Whereas: the Town of Ithaca currently has seven Aquastore Glass Fused to Steel Bolted
tanks in the town-wide system and have found the manufacture to be very responsive to
emergency calls for repair/assistance to protect the integrity of town's water system as evidenced
by a 6-hour response time for significant ice damage to the roof of the Christopher Circle Tank,
and
Whereas: the Town of Ithaca Public Works Department has identified the need to install
a water tank and main to serve the Maplewood development currently under construction and on
an extremely tight timeline not conducive to the evaluating "in-kind" water tank submittals, and
Whereas the Townwide water system has been upgraded through the recent past with
seven Aquastore water tanks based on their suitability, reliability, and economy through the
usual bidding process, and
Whereas: the Public Works Department has assessed the ability to erect, test and
disinfect the tank within the site constraints and project construction schedule and is comfortable
with and familiar with the Aquastore Glass Fused to Steel Bolted water tank specifications, now
therefore be it
Resolved: that for the reasons of efficiency, economy and standardization within the;
pursuant to the authority conferred by Subdivision 5 of Section 103 of the General Municipal
Law, it is determined by this Board that there is a need for standardization in the installation of
an Aquastore Glass Fused to Steel Bolted Tank water tank, as manufactured by CST Storage of
DeKalb IL, for the Town of Ithaca Ellis Hollow Tank.

ENGINEER'S REPORT
for
SAPSUCKER TANK REPLACEMENT
AND PRESSURE RELIEF VALVE BUILDING
The Sapsucker Tank is a steel tank built in 1958 and has a capacity of 500,000 gallons. The tank
receives water from the Bolton Point Transmission Main through the Apple Orchard Control Valve and
Christopher Pump Station.The Sapsucker Tank feeds a section of the Northeast part of the Town of Ithaca
and a portion of the Village of Cayuga Heights. The existing tank is 35 feet in diameter and 70 feet high.
Christopher Tank supplies water to 450 customers using approximately 221,000 gallons of water per day.
In 2008, an underwater camera was deployed into the tank inspecting the interior side wall and tank
bottom. The tank showed large areas where the existing interior coating has peeled off and rusted underneath.
There are areas on the interior that also show a significant loss of wall thickness to the steel sides.
The Northeast water system includes the Christopher Tank and Sapsucker Tank Grids. There have
been low pressure issues within the water system. The Town hired GHD Engineering to model, assess
conditions, and make recommendations for improvements to our water system (see attached report). The
report recommended the tank at the Sapsucker Woods Road site be raised 26 feet to meet a 35 psi minimum
water pressure to all customers in the tank zone. Due to the increased height of the new tank,the Apple
Orchard Control Valve will not be able to supply water to the tank. The pumps that were upgraded in 2014 at
the Christopher Pump station will be the primary source of water to the new tank. The height of the new tank
will have adverse higher pressures in the existing line served by the tank in the Varna area. To compensate for
the higher pressures, a new pressure reducing station will need to be placed on Freese Road.
Given the age of the tank and deterioration of the steel the tank is made of, it was agreed that the best
option is to replace the Sapsucker Tank with a new tank. GHD Engineering recommended the following
change to the Sapsucker Tank Zone:
1) Raised the new tank 26 feet to a new height of 100 feet at the overflow.The new height of the
proposed tank makes the use of a ground tank similar to the existing tank not feasible. A ground
tank 100 feet tall would lead to water quality problems due to stagnation of water inside the tank.
The proposed tank will be elevated with the bottom of the water being approximately 60 feet
above the ground.
2) Install a Pressure Relief Valve(PRV) Station on Freese Road. This station would relieve the
pressure issues on the Dryden system in Varna due to a higher tank.
3) Reduce the Tank size to 360,000 gallons from the current 500,000 gallons. The water services for
Dryden and Varna would be primarily supplied through the Apple Orchard PRV; with Sapsucker
Tank being used for as a secondary source for higher demands (fire flows).
Two types of tanks are being evaluated for the proposed tank. One proposed type of tank would be a
glass fused tank on top of a concrete pedestal (see attached drawings). The other proposed type of tank would
be an all steel tank called a pedesphere (see attached drawings). The Public Works Department recommends
the use of the glass lined tank due to a lower initial cost and lifecycle cost.
Because the existing tank will need to remain in service until the new tank is completed, the new tank
will be constructed on the same site adjacent to the existing tank(see site plan map). Once the new tank is in
service, the existing tank and concrete pad will be removed. The new PRV station will be built during the tank
construction and brought on line at the same time at the new tank. The cost analysis of each of the proposed
tank types of tank replacements and PRV station is attached.
