Call to Order& Persons to be Heard Mr. Goodman called the meeting to order at 5:35 p.m. There was no one wishing to address the board. 2. 5:30 Public hearing regarding a proposed local law authorizing a monetary contribution to the City of Ithaca for Cass and Stewart Parks Mr. Goodman opened the public hearing at 5:36 p.m. There was no one wishing to address the board and the hearing was closed. Liz Vance, Director and Jim D'Alterio, Deputy Director, Cass Park Facilities were present and thanked the board for their continued support of Cass and Stewart Parks, adding that they are enjoyed by both the city and the town as well as other municipalities. Ms. Vance touched on the recent study of the recreational facilities of all the parks in the City. The consultant conducted a survey with excellent results to get a sense of the uses and value of the different parks and what people wanted to see moving forward. Ms. Vance stated that the recommendations around the governance and funding of the parks system that came out of the report focused on a conservancy model and a commission model with the final suggestion being more of a mix of the two with ownership staying at the governmental level and the commission taking care of the baseline operations and maintenance expenditures until a conservancy could get up and running to focus on generating donations and financial support. Ms. Vance stated that the study is in draft form and available on the city's website for review and comments from the Town. The City is hoping to develop a Master Plan for Cass Park that would tie in some of the recommendations in the report, but the decision to move ahead with that has not been made yet. Mr. Goodman noted that the yearly report of usage is in the correspondence folder with the pool passes being 34% the town and the ice rink being 45% the town. Mr. DePaolo noted that the wording in the proposed local law and resolution regarding "saving" the town residents' money is not really correct; residents that use the facility are getting a TB 2018-02-12 pg. 1 discount, but the town is not seeing any"savings" and would in fact save more by not spending this money. Some discussion followed and it is true that this is a gift to the City to support the parks, which is why there is the need for a local law, and next year we can adjust the language to better make that distinction. TB Resolution 2018 - 025: Adopt Local Law I of 2018 entitled "Authorizing a Monetary Gift to the City of Ithaca to Support Cass Park and Stewart Park Recreational Facilities" Whereas, the Town Board discussed the need for monetary support for the Cass Park and Stewart Park Recreational Facilities during its budget process, and Whereas, the Town Board adopted a budget for 2018 including an amount of$55,000.00 for a contribution towards City Parks, of which approximately $ 38,000 would result in a special benefit to Town residents, but the remainder would be considered a gift., and Whereas, pursuant to the Town's New York State Municipal Home Rule powers, a local law may be adopted to authorize the Town to make a gift to another municipality where the gift furthers a public purpose of the Town, Whereas, at its meeting on January 29, 2018, the Town Board discussed the proposed local law and set a public hearing for February 12`h at 5:30 p.m. to hear all interested parties on the proposed local law entitled "Authorizing a Monetary Gift to the City of Ithaca to Support Cass Park and Stewart Park Recreational Facilities", and Whereas, said public hearing was duly advertised and held on said date and time and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof, and Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that approval of the local law is a Type II action because it constitutes "routine or continuing agency administration and management, not including new programs or major reordering of priorities that may affect the environment," and thus approval of the local law is not subject to review under SEQRA, now therefore be it Resolved, that the Town Board hereby adopts Local Law 1 of 2018 entitled "AUTHORIZING A MONETARY GIFT TO THE CITY OF ITHACA TO SUPPORT CASS PARK AND STEWART PARK RECREATIONAL FACILITIES," and it is further Resolved, that the Town Clerk is hereby authorized and directed to file said local law with the Secretary of State as required by law. Discuss NYSERDA Grant Options - Nick Goldsmith, Sustainability Planner (Attachment 1) Nick Goldsmith gave an overview of the Grant and what other municipalities are thinking of doing with their grant monies. The Town is a Clean Energy Community by virtue of completing four out of ten high-impact actions as described in the memo. By doing that, we became eligible for a$50K grant from NYSERDA and we have to decide what proposal to do. The Town has focused on partnering with the City in replacing streetlights with LED lights and partnering with them to provide the maintenance of them since they have a lot more than we do. This plan would also be a shared service under the State's criteria. (More details are in the memo) The Board discussed different options, such as funds to help homeowners install greener technologies. Mr. Goldsmith noted that there is a deadline of April for the Town to submit its project but he could expand on some of the ideas and bring that back to the board. The board was generally in favor of the streetlight project but wanted a little more information on the other programs that could be possible as well as more information on what a maintenance agreement with the City would look like and cost or whether it would be better to look at another maintenance provider. 4. Continue discussion regarding Coddington Road Community Center easement Heather Mount, Director, explained that the Center would like to expand and would therefore need to change or abandon the easement. The board was concerned about access to the field and parking as well as our continued maintenance of the easement without the benefit of a useable field. Ms. Mount noted that the Center has done some community outreach for recreational opportunities but use of the field use has not been a big request. Discussion followed and the board seemed willing to have Mr. Goodman work with Ms. Mount to move the easement toward the back of the woods, retain parking privileges and use of the remain field area through a license agreement and remove our participation in maintenance of the field. 5. Discuss and consider setting a public hearing regarding a proposed sewer improvement East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement and establishing the sewer improvement area for same Mr. DePaolo had some questions on the budgeted amount and Mr. Weber responded that if the City, who is doing the work, goes over the stated amount, we would have to go through the full public interest order process again. That being said, the city should adhere to the agreement with the town regarding any overages but we have had trouble with that as shown in the recent Renzetti Place project. TB 2018-02-12 pg. 3 TB Resolution 2018-026: Order Setting a Public Hearing Reuardinu a Proposed Sewer Improvement for the Town of Ithaca, Tompkins Countv, New York, pursuant to Article 12-C of the Town Law, to be known as the Town of Ithaca East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement, and establishinu the Town of Ithaca East State Street/MLK Sanitary Sewer Upurade Replacement Sewer Improvement Area Present: Rod Howe, Tee-Ann Hunter, Bill Goodman, Pamela Bleiwas, Pat Leary, Rich DePaolo and Eric Levine Moved: Rod Howe Seconded: Tee-Ann Hunter Whereas, a map, plan and report, including an estimate of cost, have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Ithaca, Tompkins County, New York, relating to the establishment and construction, pursuant to Article 12-C of the Town Law, of Sewer system improvements to be known and identified as the Town of Ithaca East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement, (the "Improvement'), to provide such sewer Improvement to the present Town sewer system, such sewer system Improvement to be jointly constructed and jointly owned by the Town of Ithaca and the City of Ithaca, to serve a benefitted area in said Town to be known as the Town of Ithaca East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement Area (the "Sewer Improvement Area"); and Whereas, said map, plan and report, including estimate of cost, were prepared by a competent engineer, duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any person or persons interested in the subject matter thereof, and Whereas, the area of said Town determined to be benefited by said Town of Ithaca East State Street/MLK Sanitary Sewer Upgrade Sewer Improvement Area consists of the entire area of said Town excepting therefrom the area contained within the Village of Cayuga Heights, and Whereas, the Improvement proposed in connection with the establishment of the Sewer Improvement Area consists of replacing approximately 2,350 LE. of 10" RCP with 2,350 LE. of a new 15" sewer main in the same general alignment beginning at the intersection of Seneca Way to the intersection of Mitchell Street, including the replacement of approx.. 20 manholes, 32 services and other related ancillary facilities, at an initially determined maximum estimated cost to said Sewer Improvement Area of 41.57% of$990,528.00 or $411,762.49; and Whereas, said $411,762.49 is the maximum estimated cost, with the proposed method of financing to be employed by the Town of Ithaca consisting of the expenditure of current revenues and surplus funds from sewer rents and charges from said Sewer Improvement Area, and Whereas, it is now desired to call a public hearing for the purpose of considering said map, plan and report, including estimate of cost, and the providing of the Improvement, and to hear all persons interested in the subject thereof concerning the same, all in accordance with the provisions of Section 209-q of the Town Law; TB 2018-02-12 pg. 4 Now, therefore, it is hereby ordered, by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows: Section 1. A public hearing shall be held by the Town Board of the Town of Ithaca, Tompkins County, New York, at the Town Hall, 215 North Tioga Street, in Ithaca, New York, in said Town, on the 26th day of February, at 4:30 o'clock P.M., Prevailing Time, to consider the aforesaid map, plan, and report, including estimate of cost, and the question of providing the Improvement, and to hear all persons interested in the subject thereof concerning the same and to take such action thereon as is required by law. Section 2. The Town Clerk is hereby authorized and directed to publish a Notice of Public Hearing regarding the aforesaid Improvement to be published once in the official newspaper, and also to post a copy thereof on the town signboard maintained by the Town Clerk, not less than ten (10)nor more than twenty (20) days before the day designated for the hearing as aforesaid, all in accordance with the provisions of Section 209-q of the Town Law. Section 3. This Order shall take effect immediately. The question of the adoption of the foregoing Order was duly put to a vote on roll call, which resulted as follows: Rod Howe, aye; Tee-Ann Hunter, aye; Bill Goodman, aye; Pamela Bleiwas, aye; Pat Leary, aye; Rich DePaolo, aye and Eric Levine, aye. The Order was thereupon declared duly adopted. 6. Discuss and consider a budget amendment for the 2018 Ithaca Town Budget for the Joint Youth Commission Programs TB Resolution 2018-027: BUDGET AMENDMENT — Amending the 2018 Ithaca Town Budget for Joint Youth Commission Programs (Attachment 2) Whereas, the Town values highly its Youth Programs for the many benefits provided for the Town's young people; and Whereas, the Joint Youth Commission (JYC) has ably facilitated many of the Town's youth programs for many years; and Whereas, the Town has received a communication from the JYC requesting an amendment to the 2018 Ithaca Town Budget to 1) increase the budget for the JYC Youth Programs from the adopted total of $193,068 to an amended total of $193,071, and 2) to adjust the budgets of the individual programs within the amended total to meet the goals established by the JYC for 2018; now, therefore, be it Resolved, that appropriations for Joint Youth Commission Programs in the 2018 Ithaca Town Budget be amended as follows: TB 2018-02-12 pg. 5 • General Townwide Fund —Expenditures - Account A7320.461: Counselor-In-Training Program (Coddington Road Community Center) is increased from $15,887 to $19,862. - Account A7320.464: Youth Employment Program (Ithaca Youth Bureau / Youth Employment Services) is decreased from $75,751 to $71,750. - Account A7320.466: Youth Exploration Program (Learning Web) is increased from $53,550 to $53,579. and be it further Resolved, that revenues for Joint Youth Commission Programs in the 2018 Ithaca Town Budget be amended as follows: • General Townwide Fund—Revenue - Account A2350: Youth Services - County is increased from $67,583 to $67,903. - Account A2351: Youth Services - Village of Lansing is decreased from $16,125 to $15,810. - Account A2352: Youth Services - Town of Caroline is decreased from $15,920 to $15,918. Discuss and consider a refund for water and sewer charges for Cornell Maplewood Apartments TB Resolution 2018-028: Refund of Water and Sewer Charges for Cornell Maplewood Apartments, Utilitv Billinu Account A4318, Tax Map 63.2-2-10.2 Whereas, as of October 18, 2017 there remained a delinquent balance of $7,423.33 for water charges, $742.34 for water penalties, $3,907.73 for sewer charges and $390.78 for sewer penalties, a total of$12,464.18 on utility billing account no. A4318 for customer Cornell Maplewood Apartments, 900 Mitchell Street, Ithaca,NY 14850; and Whereas, Town Code Chapters 210 and 261 provides for all delinquent accounts for payment of water and sewer charges and penalties to be placed on the ensuing year's tax roll as a re-levy; and Whereas, all delinquent water and sewer charges and penalties for Cornell Maplewood Apartments as of October 18, 2017 in the amount of$12,464.18 were removed from the utility billing account and re-levied by Town Board Resolution No. 2017-134 to the 2018 Town and County Tax Roll on November 13, 2017; and Whereas, subsequent to 2018 tax bills being issued, Cornell University Real Estate TB 2018-02-12 pg-6 requested that the original calculation made by Bolton Point staff on March 1, 2017 be reviewed; and Whereas, the review of the original calculation made by Bolton Point staff determined an error had been made in said original calculation, resulting in overcharges $3,711.67 for water charges, $371.17 for water penalties, $1,953.86 for sewer charges and $195.39 for sewer penalties, a total of$6,232.09; and Whereas, taxes have been paid in full for the affected Tax Parcel, now, therefore be it Resolved, the Town Board of the Town of Ithaca hereby authorizes a refund of $6,232.09 to be paid to Cornell University Real Estate, 15 Thomwood Drive, Ithaca, NY 14850. Consider acceptance of the"Inlet Valley Ithaca Plan: Economic Development Feasibility Study and Strategic Plan" and discuss the recommendations TB Resolution 2018-029: Acceptance of the"Inlet Valley Ithaca Plan: Economic Development Feasibilitv Studv and Strategic Plan" Whereas the Town commissioned a study of the Inlet Valley Corridor by ConsultEcon which was previewed by the Economic and Development Committee on January 29, 2018, now therefore be it Resolved that the Town Board accepts the report by ConsultEcon; "Inlet Valley Ithaca Plan: Economic Development Feasibility Study and Strategic Plan" and discussion will continue at the Economic Development Committee regarding the strategies and recommendations contained therein. Continue discussion regarding noise permit applications (Attachment 3) Mr. Goodman reported on a discussion with Dan Mitchell of Ithaca Beer. They discussed facing any amplification toward Rte. 13 and continuing the process in place for permits at this time. Ms. Bleiwas suggested the P&O Committee look at it again. 10. Discuss and consider standardization of water tank for Ellis Hollow Tank project Mr. Goodman explained that in order to meet the established timeline, the tank must be a certain type; otherwise the Engineering Department would have to take a week or two to review in-kind TB 2018-02-12 pg. 7 submissions to see if they actually meet the parameters and minimums set out in the specifications. TB Resolution 2018-030: Authorizinu the Standardization of"Aquastore Glass Fused to Steel Bolted Water Tanks"for the Ellis Hollow Water Tank and Water Main Proiect Whereas during the evaluation of the 2014 Sapsucker Woods Tank Replacement Water Improvement Project, the Public Works Department investigated and compared the long term maintenance costs and specifications of tanks submitted during the bid process, and Whereas the Aquastore Glass Fused to Steel Bolted Tank was determined to be less expensive and easier to maintain than other tank options, and Whereas the Town of Ithaca currently has seven Aquastore Glass Fused to Steel Bolted tanks in the town-wide system and have found the manufacturer to be very responsive to emergency calls for repair/assistance to protect the integrity of town's water system as evidenced by a 6-hour response time for significant ice damage to the roof of the Christopher Circle Tank, and Whereas the Town of Ithaca Public Works Department has identified the need to install a water tank and main to serve the Maplewood development currently under construction and on an extremely tight timeline not conducive to evaluating "in-kind"water tank submittals, and Whereas the Townwide water system has been upgraded through the recent past with seven Aquastore water tanks based on their suitability, reliability, and economy through the usual bidding process, and Whereas the Public Works Department has assessed the ability to erect, test and disinfect the tank within the site constraints and project construction schedule and is comfortable with and familiar with the Aquastore Glass Fused to Steel Bolted water tank specifications, now therefore be it Resolved that for the reasons of efficiency, economy and standardization and pursuant to the authority conferred by Subdivision 5 of Section 103 of the General Municipal Law, it is determined by this Board that there is a need for standardization in the installation of an Aquastore Glass Fused to Steel Bolted Tank water tank, as manufactured by CST Storage of DeKalb IL, for the Town of Ithaca Ellis Hollow Tank and further Resolved that the Superintendent/Director of Public Works be and is hereby authorized to accept bids for a project that includes the purchase and installation of an Aquastore Glass Fused to Steel Bolted Tank water tank with the lowest responsive and responsible bidder after advertisement for sealed bids and public bidding in the manner provided by Section 103 of the General Municipal Law. The New York State Energy Research and Development Authority (NYSERDA) Clean Energy Communities (CEC) program provides grants to municipalities that earn the Clean Energy Community designation. Last week, the Town was designated a CEC for completing four of 10 "high-impact" actions: • Benchmarking: Adopt a policy to report the energy use of municipal buildings on an annual basis; • Solarize: Undertake a solarize campaign to increase the number of solar rooftops in the jurisdiction; • Climate Smart Communities Certification: Earn Climate Smart Community Certification through compliance with this robust, comprehensive rating system; and • Energy Code Enforcement Training: Train code compliance officers and other municipal officials in best practices in energy code enforcement through training, collaborative plans reviews, and joint onsite inspections of local construction projects. The Town now has three months to submit an application for $50,000 of project funding. This money is reserved for the Town, but our project proposal must score well enough to be approved. Many points are awarded for energy savings and greenhouse gas reductions. Other criteria include: collaboration and knowledge transfer; innovation and replicability; and economic development. A variety of potential projects ideas are provided by NYSERDA for guidance, such as: Installation of renewables (solar, wind, and ground source heat pump); Electric vehicles and charging stations; Community-focused campaigns; Advanced HVAC/combined heat and power; Wastewater and water treatment plant upgrades; Fleet fuel tracking; and LED streetlight conversion through utility buyback. There is an active local effort to address streetlights; more information is provided below. Cities nationwide have converted their streetlights to LED technology, resulting in major reductions in maintenance costs, electric costs, energy use, and carbon emissions, as well as improvements in lighting quality and perceived security.The City of Ithaca is leading a county-wide consortium to upgrade municipal streetlights to LED technology, and the Town has the option of joining several other local municipalities in this effort. The payback period, after accounting for the purchase of the lights from the utility and the purchase and installation of new LED lamps, has been 4 to 10 years for several cities nationwide. The City expects payback in less than 5 years for its 2,000 lights. NYSERDA CEC grants have been used by other municipalities for LED streetlight projects. The Town of Ithaca has nearly 300 lights that are currently leased from NYSEG, spread over 10 streetlighting districts. In addition to electricity costs, we pay a flat monthly lease fee for the lights, poles, and associated equipment, for an annual total of $50,000- 60,000. NYSEG maintains the lights. The proposal being discussed by Tompkins County municipalities is to buy back streetlights from NYSEG and convert them to LEDs (estimated annual savings of 50-70%). Another option could be to continue leasing from NYSEG, but switching to the new LED tariff(estimated annual savings of about 15%). Joining the local consortium opens the possibility for several shared services, which fall under the County's Shared Services Plan. Most of these items are opt-in, so if the Town decides to participate, it is not obligated to take part in all of them. • Each municipality could elect to negotiate the purchase of its existing streetlights from NYSEG on its own, or to use a consultant. The Town will soon receive a pricing proposal from NYSEG. • A GIS inventory of existing lights is planned to be a shared service. • The design of the new lighting system (number of lights, technical specifications, etc.) is planned to be a shared service. The City is in the process of engaging a design consultant. • The purchase of new LED lights could potentially take advantage of an existing bid and/or could pool the buying power of local municipalities. • The actual upgrade from existing lights to LED lights is planned to be a shared service. • The ongoing maintenance of the new LED lights is planned to be a shared service.The City of Ithaca is hiring additional staff to maintain its lights, and has made an offer to maintain the lights of other local munis at cost. On the following page is a rough financial estimate based on City of Ithaca analysis. This is intended to give a scale of the costs and benefits, and is by no means final. It shows a buyback and retrofit cost of about $200,000, annual savings of about $40,000, and a payback period of five years. My husband Kurt and I are writing to express our concern over proposed changes to the noise ordinance in the Town of Ithaca, specifically in regards to the Ithaca Beer Company and the negative impact that would have on our lives, our property values and our neighborhood. Several times over the past two years the music level was so loud that we could not watch television with all of the doors and windows closed. Some nights we could not sit on our deck and have a conversation. In addition, my husband works from home facilitating online courses and hosting web chats. The music can be heard in his office which is facing in the opposite direction to the IBC. It's impossible to entertain or enjoy our outside space when we are never sure of what's in store. While the music typically ends by 9:15 PM, which we appreciate, it is going full blast by 6:00 PM when most people are enjoying dinner (often outside in the summer). Each year as Ithaca Beer becomes more successful, they have increased the number and type of events. We anticipate the situation will get worse, not better. We encourage you to consider and balance the rights of all parties to find a mutually agreeable solution.
