Meeting of the Ithaca Town Board
Monday, September 26,2016 at 4:30 p.m.
Board Members Present: Bill Goodman, Supervisor; Rod Howe, Deputy Town Supervisor;
Pat Leary, Tee-Ann Hunter, Eric Levine, Rich DePaolo, and Pamela Bleiwas
Staff Present: Susan Ritter, Director of Planning, Bruce Bates, Director of Code Enforcement;
Mike Solvig, Director of Finance, Judy Drake, Director of Human Resources; Paulette
Terwilliger, Town Clerk; and Jim Weber, Highway Superintendent
1. Call to Order - 4:31 p.m.
2. Review draft agendas - Budget on October 6 and Regular on October 17
Mr. Goodman stated that the Planning Department would like to schedule a meeting to discuss
their Zoning Review and Approach report as well have an update from the Form Ithaca group
and suggested that the October Study Session might be used for that. The Report is being
reviewed by the Planning Committee right now and the next step would be for the full Board to
begin discussions on it. After some discussion about the timing of the study session and
Halloween, and board members' schedules, it was decided that another date might be better and
Ms. Ritter will check with the Form Ithaca group and Mr. Goodman will send out possible dates.
3. Committee Reports
Planning Committee - Mr. DePaolo reported that the Christine O'Malley from Historic Ithaca
and Brian McCracken from the City of Ithaca Preservation Committee came and talked about
how easy it would be for the Town to adopt a version of the model law and avail ourselves of
some potential grant resources after declaring ourselves a certified local government. It was
good to hear from them and they were excited to hear that we have an inventory of historic
properties underway. Mr. DePaolo added that the idea of working with the City was discussed
and they are willing to provide help and examples and maybe shared services in effect.
The Committee also continued the review of the Planning Department's Zoning Review and
Approach Report and although it is pretty dense, the Committee has been trying to make sure
that it is suitable for the general public and not come across as a Planning seminar.
The Committee also discussed an update regarding the oversight of rental properties that came
from the conference call with the City of Brookhaven's Code Enforcement Director who has
accessory apartment oversight and an owner occupancy requirement in some zones and in other
zones they have multiple family residences. In the zones they are trying to promote more
affordable options for families they have the owner-occupancy requirements and he would like
the Committee to answer the question about whether we would like to pursue any of these tjqjes
of options.
Mr. DePaolo reported that they also heard from Ms. Yunis regarding the drive-thru issue at
Dunkin Donuts and staff is going to provide the Committee with the traffic study provided to the

Planning Board during that process and we will discuss options from there because current
zoning is designed to prevent drive-thrus other than the one there and we will have to discuss
that given the plans for that area. Mr. DePaolo was interested in hearing from people who live
in the area rather than the benefits to the commuters.
Public Works Committee - Mr. Howe reported that PW staff reviewed their proposal for water
tanks based on the Water Study done by GHD; they propose doing two tanks. The Committee
thought this was reasonable and Mr. Weber explained using the map from the study saying that
in its existing state, the tank is about half the size it should be. The Town did put a control valve
in as a temporary fix to the pressure issues but the biggest issue is even if we put a larger tank in,
we are going to need two tanks for build out with Maplewood and the anticipated development
of East Hill. Mr. Weber thought the question is essentially whether to spend the money now to
prepare for the anticipated increase and fix the existing situation or put in the bigger tank and
continue with the issues as they arise, knowing that eventually we will need two teinks. Mr.
Goodman added that he called the Cornell Real Estate office and will be introducing them to the
idea that we might want a tank on Cornell property.
Mr. Howe went on to report that the Conservation Board requested permission for a sign on 96B
and the Committee saw no issues with it.
Codes and Ordinances Committee - Mr. Goodman reported that the draft mural law and sign
law were finalized and ready to come back to the board with the goal of reviewing and adopting
them by the end of the yeeir.
Personnel and Organization Committee - Ms. Bleiwas reported that we have an updated
proposal for the digital phone systems and a demonstration will be Wednesday for management
followed by another for staff with the goal of considering the contract at the October 17^
meeting.
Ms. Bleiwas reported that they discussed the Airbnb issue and Mr. Bates reviewed the types of
complaints associated with them. The committee felt that we should move forward with
allowing these because that is the reality of the way the world is moving and they recommended
it move to the Planning Committee for looking into parking, traffic, and the effect on rental
costs. Mr. DePaolo asked if they talked about owner occupancy and Ms. Bleiwas stated that they
did but thought the Planning Committee should look at the different options of owner occupancy
verses not regulating that. Ms. Hunter added that the Town of Union Springs adopted a law to
facilitate these and require that owners must be available within a certain period of time to
address any issues. Ms. Bleiwas said that it is very common in Ithaca to rent out your house for
the big graduation and reunion weekends £ind the committee did not want to infringe on that.
Ms. Bleiwas reported that they talked about the Personnel budget and the four new positions, two
of which have already been approved but there are also two additional code officers wanted for
the Maplewood development, so there are budget impacts to consider.
Ms. Bleiwas stated that the health insurance contributions for non-union employees was
discussed and forwarded to the board for consideration on October 17^ and they also looked at

our Domestic Violence Policy and a model from the County to begin a review and update. The
Committee also decided to look at all our policies on a yearly basis to make sure they are
updated in a timely manner.
Employee Relations Committee - Ms. Bleiwas reported that they reviewed comments from
Public Works suggestion box. One request for wheel-chucks was forwarded to the Safety
Committee and a suggestion that when a new major piece of equipment is purchased, the people
who use it should be consulted. Another comment about not being able to make ends meet on
$25 an hour was discussed and ways of increasing their wages by advancement such as getting a
CDL were discussed and asked to be communicated to those at Public Works. The committee
will also be looking at alternative dates for the employee picnic because it conflicts often with
two major events in the area that are heavily attended by Public Works and Bolton Point
employees.
Budget Committee - Mr. Levine reported that they reviewed the final tentative budget which
will be coming to the full board. He mentioned a few highlights; the budget increased from
S24.5M to $25.5M which is a 4.08 percent increase, the tax levy increase of around 2% which is
over the tax cap, but the tax bill will actually be lower with about a $22 decrease.
Mr. Goodman added that the Maplewood project will be paying about $200K in building permit
fees which will cover one new person and he has told EDR that they will probably have to pay
for the second person at about $100K a year. One of the new inspectors would most likely be a
temporary position. The other big ticket item is the new phone system at about $40K a year.
Mr. Goodman stated that he is suggesting that our contribution to the City Parks be cut to $50K
with $25K being put in to our own parks and recreation accounts and continue the contribution to
the Gorge Rangers.
Mr. DePaolo asked how the tax bill is going to go down and Mr. Solvig explained that it is
shifting the sales tax revenue from the General Fund to the Highway Fund which puts more of
the property tax revenue in to the General Fund which in essence has Cayuga Heights contribute
more than they have been to the highway maintenance instead of the Town residents shouldering
all of that because the Town takes care of those roads but VCH hasn't really been paying for
that. He added that our total assessment has also gone up so that helped with the amount and the
$100K to offset costs for the second code officer.
Records Management Advisory Board — Ms. Terwilliger explained that the board saw a
presentation on the new Laserfische repository and another will be given to the management
team and the P&O Committee and then to the full board in November/December. The goal is to
ask the Town Board to officially designate the digital copy of any town record available digitally
as the official document by 2017.
Sidewalk Ad Hoc Committee - Mr. Goodman reported that they are looking at sidewalk
districts to focus on areas we would really like to see sidewalks and there are ways to have the
whole town pay for some of the expense and property owners pay for other parts or percentages
of the sidewalk districts.

Supervisor's Report - Mr. Goodman reported that the relocation of the historic house on
Coddington Road is moving slowly forward with some issues coming up regarding the NYSEG
power lines. He also reported that the City did receive grant funding for the Housing Summit
and is moving forward with November 29"^ in the evening with a keynote speech followed by all
day on November 30*''. Mr. Goodman noted that the Plarming Board did declare the Maplewood
EIS adequate for public comment so the Town Board as an interested agency can submit
comments and he suggested putting that on the October 17*'' agenda.
4. Discussion items
a. Continue discussion regarding the draft Agreement for Municipal Cooperation - Bolton
Point - Mr. Goodman asked if there were any questions and noted that the approval of
the draft will be on the October 17*'' meeting. Mr. Goodman also touched on the
presentation last meeting about the new rate structure that was being proposed and will be
talked about at the Budget meeting.
b. Continue discussion regarding changing the Town's Fire Protection District to exclude
Ithaca College - Mr. Goodman reported on counsel's research on taking the college out
of the fire district. There was some discussion on emergency service and false alarm
calls and where those should or could be billed. The college can contract with the fire
department directly. Mr. Goodman noted that a college student is researching what other
colleges contribute toward municipal services and he hopes that will give us some up-to-
date information to use and inform both us and the public. More numbers and
information to follow.
c. Contract for Village of Cayuga Heights Intermunicipal Police Services Agreement -
Lake View Cemetery/Safe Routes to School - Mr. Goodman reported that this is for a
TAP grant application and will not cost the Town anything. The grant is to put a
sidewalk on Kline Rd and Wycoff Rd and through the Lake View Cemetery and they
want to show they will have police coverage which the Village of Cayuga Heights Police
has agreed to do but they need our permission since some of the cemetery is in the town.
Board and staff again expressed concerns about where the children will be crossing East
Shore Drive. Students and the cross country team routinely use the cemetery for walking
and running now but the crosswalk is not right there at the entrance to the cemetery and it
is on a bling curve. The Board decided to rely on the State dealing with those concerns
when they reviewed the application and actual site.
5. Discuss and consider authorization for Supervisor to sign the Intermunicipal Shared
Services Agreement (Public Works)
TB Resolution 2016-125: Authorization for Town Supervisor to sign the Intermunicipal
Shared Services Agreement regarding borrowing/lending machinerv. equipment, supplies
and services between municipalities and the Countv
Whereas, New York Highway Law Sections 142-d and New York General Municipal
Law Article 5-G authorizes municipalities to contract with other municipalities to exchange,

borrow, lend or maintain machinery and equipment, with or without operators and to borrow
materials and supplies from and lend materials and supplies to other municipalities; and
Whereas the current 5-year Agreement expires on October 31, 2016, and
Whereas, pursuant to the New York State Environmental Quality Review Act
{"SEQRA") and its implementing regulations at 6 NYCRR Part 617,it has been determined by
the Town Board that approval of this standard Agreement is a Type II action because it
constitutes routine or continuing agency administration and management, not including new
programs or major reordering of priorities that may affect the environment," and thus approval
of the standard Agreement is not subject to review under SEQRA, now therefore be it
Resolved that the Town Board hereby authorizes the Town Supervisor to execute and
sign the Shared Services Agreement on behalf of the Town, renewing the existing Agreement for
the next five years.

TB Resolution 2016 - 126c: Annroval of Collective Bar
Whereas, the collective bargaining agreement with the Public Works unit represented by
Teamsters Local 317 was ratified August 31, 2016, which set forth a wage increase of 2.0% for
2016, retroactive to January 1, 2016; now, therefore, be it
Resolved, the Town Board of the Town of Ithaca does hereby approve the said wages for
all of the Town of Ithaca employees (including new employees and promotions) for the year
2016, as detailed on the attached sheets.
TB Resolution 2016 - 126d: Authorizing the Justice Court Assistance Program Grant
Application - Security Package
Whereas in 2016 the NYS State Legislature once again established the Justice Court
Assistance Program to assist towns and villages in the operation of its Justice Courts, and
Whereas the Chief Administrative Judge of the State's Unified Court System is once
again entertaining grant applications for the year 2016, and
Whereas there are no matching fund requirements from the Town of Ithaca, and
Whereas the deadline date for application is October 13, 2016; now therefore be it

Resolved that this governing board of the Town of Ithaca authorizes and directs the Town
Justices to complete and file the 2016 Justice Court Assistance Program Grant Application with

Mr. Goodman moved to enter executive session to discuss current litigation with Badger
Equipment at 6:09 p.m., Ms. Bleiwas seconded, unanimous. Motion to reenter open session at
6:21 p.m. made by Ms. Bleiwas, seconded by Ms. Leary, unanimous.
