Theareathatsurroundstheprojectsiteischaracterizedbyruralresidentialdevelopment.Theproposalwillnotchangetheoverallcharacterofthearea.Impactstowater,air,plants,aesthetics,andotherresourceswillbeevaluatedinthesectionsbelow.3.ImpactonSurfaceWaterh.Theproposedactionmaycausesoilerosion,orotherwisecreateasourceofstormwaterdischargethatmayleadtosiltationorotherdegradationofreceivingwaterbodies.I.Theproposedactionmayaffectthewaterqualityofanywaterbodieswithinordownstreamofthesiteoftheproposedaction.4.ImpactonGroundwaterh.Otherimpacts:TheEAFMapperdatabaseindicatesthatthereisaprincipalaquifernearthesite.5.ImpactonFloodingd.Theproposedactionmayresultin,orrequire,modificationofexistingdrainagepatterns.Brieflydescribetheimpactonsurfacewater,groundwater,andflooding:Theprojectsiteisrelativelyflatandinvolvesminimalgrading.Therewillbesomeearth-movingactivitiesrelatedtotheconstructionoftheconcretepad,tower,andgravelaccessdrive.Theapplicationmaterialsstatethattheproposalwillphysicallydisturb.46+!-acresofthe12.3+!-acreprojectarea.TheTownofIthacaEngineeringDepartmenthasindicatedthattheprojectwillrequireasimpleErosionandSedimentationControlPlan(SimpleSWPPP).Thesubmittedapplicationdrawingsindicatetheconstructionofsiltfencingsurroundingtheareasofconstruction(limitedtoasmallportionoftheexistingclearedareaandexistingdriveway),tohelpfilterstormwaterrunoffandcontrolsitedrainage.Relatedtowaterquality,theapplicantproposestemporaryerosionandsedimentationcontrolpracticesthatwillcontroldustandminimizesoiltrackinganderosionoffsite.Thereisastreamthatrunsalongtheeasternpropertyboundarythatislocatedapproximately125-175feetfromtheexistingclearedareasoftheproperty.Thereisnoanticipatedadverseimpactonthestream,providedthattheproposederosioncontrolsareinstalledandproperlymaintained,andthatnoadditionaldisturbanceoccurspastanyoftheareasmarked“approximatelocationofnodisturbance”ontheplans.AccordingtotheNYSDECEAFMapperProgram,thereisaprincipalaquiferlocatedneartheprojectsite.NYSDECclassifiesprincipalaquifersas“aquifersknowntobehighlyproductiveorwhosegeologysuggestsabundantpotentialwatersupply,butwhicharenotintensivelyusedassourcesofwatersupplybymajormunicipalsystemsatthepresenttime”.AreviewoftheUSGSUnconsolidatedAquifersinTompkinsCountyWater-ResourcesReport(published2000)indicatesthattheprojectsiteislocatedwithinthe“SixMileCreekValley”aquifer,whichencompassesmostoftheareabetweenSlatervilleRoadandCoddingtonRoad.Theprojectwillnotinvolvesignificantdevelopmentthatwouldnegativelyimpacttheaquifer.Asnotedabove,theproposalincludesveryminimalgrading,withanyimpactstosurfacewater,groundwater,andfloodingbeingmitigatedviatheinstallationofsedimentanderosioncontrols.ThesecontrolsareoutlinedintheSimpleSWPPPthathasbeensubmittedandthatwillbeapprovedbytheTownEngineeringDepartmentbeforeabuildingpermitisissuedfortheproject.Basedontheaboveinformation,impactsidentifiedinthissectionwouldbeconsideredsmallinmagnitude.2 6.ImpactsonAirf.Otherimpacts:Theproposedactionwillincludeon-siteairemissions,includingfuelcombustion,wasteincineration,orotherprocessesoroperations.TheFEAFPart1,page6indicatesthattheprojectwillutilizeconstructionequipmentduringconstructionandabackupgeneratorduringoperations,bothofwhicharesourcesofon-siteairemissions.However,theuseofconstructionequipmentistemporaryandwillceaseoncetheprojectiscompleted(approximatelytwomonths).Thebackupgeneratorisproposedforemergenciesandwillonlyoperateintheeventofanemergency.Basedontheaboveinformation,impactsidentifiedinthissectionwouldbeconsideredsmallinmagnitude.7.ImpactsonPlantsandAnimals:j.Otherimpacts:TheprojectislocatedwithinaUniqueNaturalArea.TheprojectsiteislocatedwithinthedesignatedSixMileCreekValleyUniqueNaturaAreaandiszonedConservationbythetown.Therearenoknownendangeredorthreatenedplantoranimalspecieslocatedonornearthesitethatwouldbeimpactedbytheproposedtower,concretepad,oraccessroad.Additionally,therewillbenotreecuttingassociatedwiththeproposal.Theproposedtowerwillbeconstructedentirelywithinanexistingclearedarea;andtheexistingdrivewayaccesswillonlybewidenedbyfourfeettoaccommodatetheproposeduse.Historyofimpactsonplantsandanimals:Theprojectsiteis“Lot5”fromtheWiedmaierSubdivision,approvedbythePlanningBoardinDecember2003.In2007,thepropertyowneratthetimeperformedextensiveearthworkandillegaltreeclearinginpreparationforahousingsite.TheclearingwasinviolationofthesubdivisionapprovalandotherTownCodeprovisions.Priortotheearthwork,thesitewasamixofthickmeadow/brushandevergreenanddeciduoustrees.Topographically,thesitewasahilltop,withsteepslopingsidesleadingtostreamsonbothsides.Tocreatethelargelevelsitethatcurrentlyexists,thepropertyownerremovedthehilltop,andspreadouttheexcavatedmaterial,creatingalargeplateauwithsteepunstabilizedsides.ThepropertyownerwasrequiredbyNYSDECtoundertakeadditionalearthworktosoftenslopesandinstallpermanentstormwaterpracticestoremediatethesite.Tocorrectthesubdivisionapprovalviolations,thepropertyownerwasrequiredtohireaprofessionallandscapertore-landscapethehillsidewithanativeseedmixandplantapproximately250trees.Theremediationplansalsoidentifieda“nodisturbancezone”onthefiledsubdivisionplat,toinformallfutureownersandtoinsurethatthisportionofthelandwouldbeleftinanaturalstateinperpetuity.Therehasbeennofurtherclearingsincetheremediationplanswereestablished.Treesandotherlandscapingweremonitoredforaperiodoffiveyears,whichwasaconditionofPlanningBoardapproval.Nearlyalloftheplantingssurvivedorwerereplaced.Nonewillbedisturbedaspartoftheproposedproject.Basedontheaboveinformation,impactsidentifiedinthissectionwouldbeconsideredsmallinmagnitude.3 9.ImpactonAestheticResourcesc.Theproposedactionmaybevisiblefrompubliclyaccessiblevantagepoints:i.Seasonallyii.Yearroundd.Thesituationoractivityinwhichviewersareengagedwhileviewingtheproposedactionis:i.Routinetravelbyresidents,includingtraveltoandfromworkii.RecreationalortourismbasedactivitiesBrieflydescribetheimpactonaestheticresources:TheprojectsiteisnotlistedintheTownofIthacaScenicResourcesInventoryorintheTompkinsCountyScenicResourcesInventory.Itisnotinanareathatisofficiallydesignatedasafederal,state,orlocalscenicoraestheticresource.Theprojectsiteislocatedadjacenttoresidencesandisapproximately500-feetfromNYSRoute79E/SlatervilleRoad.Inordertoproperlyassesspotentialaestheticandvisualimpacts,theapplicantsubmittedincludedavisualanalysis“balloon-fly”attheproposedtowerheight(i34ft),alongwithbeforeandafterphotorenderingsandphotosimulationsofthetowerwithinthelandscapeatvariousviewpoints.Thesimulationsshowtheballooninsetoneachpage,followedbyaphotoshowingthetowerandanotherphotoshowingacamouflagedtowerthatismadetolooklikeanevergreentree.Thelistbelowincludesthespecificviewsinthevisualanalysiswherethetowerwillbevisible:a)P-i/S-i—IntersectionofWiedmaierCourtandNYSRoute79E/SlatervilleRoad,lookingsouthwest[towermostvisiblehere]b)P-3/S-3—LookingwestfromNYSRoute79E/SlatervilleRoad,neari667SlatervilleRoad(approx.i550-feetfromprojectsite)c)P-4/S-4—IntersectionofBurnsRoadandNYSRoute79E/SlatervilleRoad,lookingsouthd)P-5/S-5—LookingsouthfromBurnsWaye)P-6/S-6—LookingnortheastalongBurnsRoadThevisualanalysisillustratesthattheprojectwillonlybevisiblefromadjacentresidents,andthosetravelingalongNYSRoute79E/SlatervilleRoadorBurnsRoad,eitherrecreationallyoraspartofadailycommute.OtherthantheSouthHillRecreationWay,whichwillnotbeimpactedbythetower,therearenopublicparksorrecreationtrailsnearby,soonlytheadjacentpropertyownersandresidentsonWiedmaierCourt,BurnsRoad,andSlatervilleRoadwillseethetoweronaconsistentbasis.Ati34-feettall(plus4’lightningrod),thetowerwillbetallerthansurroundingtreesatfullleaf-out.However,inmostcases,onewillneedtodeliberatelylookforthetowerinordertoseeitwhilecommutinginavehicle.Theprojectwillbevisibleinthewinterwhenthedeciduoustreesthatsurroundthesitehavelosttheirleaves.However,thereshouldbeenoughconiferoustreestoadequatelyscreenthetowerfrommostviews.Theapplicanthasproposedadditionallandscapingaroundthebaseofthefenced-inarea,tomitigateaestheticimpactsofthegroundequipmentonadjacentresidences.Camouflagingthetoweritselftolooklikeanevergreentreeisnotrecommended,asitwillmakethetowerstandoutmorethannecessary,whichcouldcreatenegativeaestheticimpacts.Therearenosimilarprojectsvisibleneartheproposedproject.Thetwonearestpersonalwirelessservicetowersarelocatedatleastthreemilesawayfromtheproject(CornellmonopoleonDryden4 RoadintheTownofIthaca,andatowerintheTownofDanby).Thesefacilitiescanbeseenfromanumberofpublicandprivateproperties.Basedontheaboveinformation,impactsidentifiedinthissectionwouldbeconsideredsmallinmagnitude.14.ImpactonEnergye.OtherImpacts:Theprojectwillutilizeelectricpowerprovidedbythelocalutilitycompany.TheapplicantindicatedintheFEAFPart1thattheprojectwillutilizeelectricenergythatissourcedfromthelocalutilitycompany(NYSEG).Accordingtotheapplicationmaterials,thenewtowerwillresultinaminimalincreaseinelectricalpowerusage.ItisunknownifthefacilitywillneedtocomplywiththeTownofIthacaEnergyCode.Regardless,impactsassociatedwithenergyusagewouldbeconsideredsmallinmagnitude.15.ImpactonNoise,Odor,andLightf.OtherImpacts:Theprojectwillcreateconstructionnoiseandwillrequiresafetylighting.TheapplicantindicatedintheFEAFPart1thattheprojectwillcreatenoiseduringconstruction.Theemergencygeneratorwillalsocreatenoiseimpactswheninuse.Theclosestresidencewillbelocatedapproximately450-feetfromthetoweronceconstructed.Noiseimpactsareexpectedtobetemporary,withthemajorityceasingafterconstructionandthegeneratoronlyoperatingduringemergencies.Intermsoflightingimpacts,thetoweritselfdoesnotrequireorincludelighting,pursuanttoFAAstandards.Theprojectdoesincludea25W“floodlight”thatwillbemountedaround8-feethighandangleddowntowardstheequipmentcabinetsinamannerthatwillcomplywiththeTownOutdoorLightingLaw.Thelightisarequiredsafetyfeatureandisnotexpectedtocreatesignificantadverseimpactsonneighboringresidences.Basedontheaboveinformation,impactsidentifiedinthissectionwouldbeconsideredsmallinmagnitude.16.ImpactonHumanHealthWhilethereiscompetingscienceupondifferentfrequencyemissionsuponhumanhealth,especiallyfortransmittersandreceiverslocatedover150’intheair,theFCChaswhollyoccupiedthisfieldandpreemptedfederal,state,orlocalreviewofthisissue(humanhealtheffects)whentheprojectmeetstheminimumguidelinespromulgatedbytheFCC.Thisapplicationhasmetthoseminimumrequirements,andfurtherinquiryintoallegedorpotentialhealthimpactsisthusprecludedunderfederallaw.PursuanttoTownCode§270-219.Q,theTownofIthacahiredaconsultantteamtoexamineandevaluatetheapplicationandrelateddocumentation.TheconsultantteamspecificallyreviewedtheelectricalRF(radio-frequency)aspectsoftheproject,and,perTownCode,evaluatedtheRFinformationprovidedbytheapplicantforcompleteness,consistency,andadequacy.Theconsultant’swrittenreportdatedSeptember20,2024,revisedOctober21,2024,madethefindingthattheApplicantprovidedaRadioFrequencyEmissionsComplianceReport(ExhibitP)datedMarch14,2023,5
