Mr. Howe called the meeting to order at 5:30 p.m.

Added Agenda Item—Septic System Exemption
Mr. Howe noted that this was discussed at a Public Works Committee before the formal request
was received.
Mr. Thaete stated that they do not anticipate any further development up the road and we are in
support of this waiver.
Mr. DePaolo asked about the language in the second whereas regarding "any future subdivision
unlikely..." and he thought that was ambiguous and does not foreclose on the ability of the
property being subdivided in the future. He asked if the sewer being installed is sized for a
single-family that suits the size of the home.
Mr. Thaete responded that the design he has seen is for a single-family home.
Mr. DePaolo said the concern he expressed at PWC was that without a sewer exemption, there
wouldn't be a residential subdivision on this property, and he asked if it was Engineering's
opinion that where the house is being sited is precluding future subdivision.
Mr. Thaete responded that with what they are showing, it would be difficult, and they would
most likely need approvals or variances from other regulating boards and ultimately would need
an exemption from this Board.

TB Resolution 2020- 158: Authorization for the Town Engineer to issue a Sewer
Exemption for 325 Bostwick Rd
Whereas the Town Engineer received a request for a Sewer Exemption from the owner(s) of 325
Bostwick Rd. The nearest sewer main is approximately 1,200 feet away which would cost
approximately $300K to connect to, and
Whereas the owners are constructing a single-family home on the property and have constructed
it in a location that would make any future subdivision unlikely, and they have expressed that
they do not have any intention (change made 1.15.2021 after listening to the audio recording) in
subdividing the property any further, and
in subdividing the property any further, and
Whereas the Tompkins County Health Department has designed a septic system for the property,
and there is plenty of room for a replacement system if needed, and
Whereas the Public Works Committee discussed the potential request at its March 17, 2020
meeting and recommended forwarding to the Town Board for review, now therefore be it
Resolved, that pursuant to Town Code Section 214-6, the Town Board hereby finds that the
applicant has shown unusual and extreme practical difficulties in connecting its house with the
public sewers because of the 1,200 foot distance from the nearest public sewer main, and the
$300,000 cost to connect to public sewer, and be it further
Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from the
Town Code Section 21.4-5 public sewer connection requirement for 325 Bostwick Rd. for the
installation of a new, onsite wastewater treatment system associated with the new single-family
residence being constructed on the property, subject to the consent of the Tompkins County
Health Department to this exemption.

3. Public hearing regarding the proposed acquisition of a trail easement from Emersub
LLC., for future expansion of the Gateway Trail
Mr. Howe started the discussion with a brief overview and opened the public hearing at 5:45
p.m. There was no one wishing to address the Board and Ms. Rosa noted for the record that no
one was indicating that they wished to speak and she had not received any emails, calls or
correspondence on the topic prior to or since the meeting was called to order, including the after
opening the public hearing. The public hearing was closed.
Mr. DePaolo moved to enter closed session to seek the advice of counsel at 5:58 p.m; seconded
by Mr. Levine, unanimous. Ms. Rosa placed attendees in the waiting room. Some staff

remained in the closed session.
Motion made by Mr. Goodman to re-enter open session at 6:38 p.m.; seconded by Mr. DePaolo,
unanimous.
Ms. Rosa admitted attendees back into the meeting.
Discussion
Mr. DePaolo moved the resolution for discussion, Mr. Howe seconded.
Mr. DePaolo stated that based on discussions with counsel, and potential liability issues and
financial risk, he is not comfortable with the language as drafted and would not support it.
Mr. Goodman stated that his thoughts have evolved on this and he now agrees that there is a
liability issue and although he is very supportive of trails and this connection, the town is not
adequately protected in this language.
Ms. Bleiwas stated that she is not in favor of the resolution and would like to see the language
renegotiated to protect the town more.
Mr. Levine, Ms. Hunter and Ms. Leary agreed with the above statements.
TB Resolution 2020 - 159: Authorization for Supervisor to sign an easement and right-of-
way agreement from Emersub 1.5 LLC, to be iointly held with the City of Ithaca, for the
purpose of a future trail extension.
Whereas, the multi-use Gateway Trail, was originally proposed and funded (in 2004) as a joint
project of the Town of Ithaca, City of Ithaca, and NY State Parks, that would connect the South
Hill Recreation Way (at Hudson Street) with Buttermilk Falls State Park, the existing bridge over
Route 13 and the future Black Diamond Trail, and
Whereas, due to the inability to secure an easement across the property previously owned and
operated by Emerson Power Transmission Corporation, the trail project was modified to a phased
project, with phase one terminating at Stone Quarry Road, and
Whereas, Emersub 15 LLC, the current owners of land, previously held by Emerson Power
Transmission Corporation, are now willing to enter into a joint agreement with the City and Town
of Ithaca for the purposes of providing an easement for a trail connection from Stone Quarry Road
to the City/Town intersection (as shown on Exhibit B of the Agreement), along with a separate
agreement with the City of Ithaca for the portion within the city, from the City/Town intersection
to South Aurora Street, thus allowing for a future extension of the Gateway Trail and a connection
with the South Hill Recreation Way, and
Whereas, the need for this easement and trail connection was included in the Generic
Environmental Impact Statement for the proposed Chain Works District Redevelopment Project

that was accepted by the City of Ithaca Planning and Development Board on March 8, 2016; and
was further specified in the Final Generic Environmental Impact Statement, accepted as complete
by the City Planning and Development Board on February 26, 2019, and
Whereas, the Town Board has reviewed the Trail Easement and Right-of-Way Agreement
providing the City and Town of Ithaca with a joint permanent easement from Emersub 15 LLC for
the purposes of the City and Town constructing and maintaining a public multi-use trail, and
Whereas, pursuant to NY General Municipal Law §247, on December 14, 2020, the Town Board
held a duly noticed public hearing on the proposed trail easement acquisition, during which the
Town Board heard all persons interested in the trail easement acquisition who appeared at such
time and through the designated means, now therefore be it
Resolved, that the Town Board authorizes the Supervisor to execute said easement and agreement
subject to review and approval by the Attorney for the Town.

Mr. Howe asked the board for what they would like counsel to ask for in the language.
Mr. DePaolo said, at a minimum, we need to convey that we do not feel adequately protected
given that there is known contamination on the site and given that there is a responsible party,
and therefore it did not seem logical that the town be inserted in the liability chain. He added
that there is a potential difference of interpretation about the liability language between our
counsel and the City's counsel, but if the city is comfortable with the language, one option would
be that they could retain the easement and the town could not be a party to the easement but
contribute to the trail in other ways.
The Board was happy with that statement and Ms. Brock stated that it gave her sufficient
direction.
4. Discuss and consider approval of the 2021 SCLIWC— Bolton Point Wage Scale
Ms. Drake stated that this is a routine resolution setting wages.
TB Resolution 2020- 160: Ratify Southern Cayuga Lake Intermunicipal Water
Commission 2021 Wage Scale and Employee Wages
Whereas, the Commission and UAW finalized a union contract for 2021-2023, which establishes
a 2.5% cost of living adjustment for 2021 that the Commission extended to non-union staff also,
and
Whereas, the Commission on December 10, 2020, approved the revised 2021 Wage Scale and

Wages for all Commission staff, now, therefore,be
Resolved, the Town Board of the Town of Ithaca does hereby ratify approval of the revised 2021
Wage Scale and Wages for all Commission staff as filed in the Human Resources Office.

5. Discuss and consider setting a public hearing regarding the proposed Public Interest
Order establishing the Campbell-Hopkins Water System Improvements Benefit Area
and project subject to Permissive Referendum
Mr. Thaete stated that this is the first of the water sewer projects and the King Rd E will be
coming to the board next month.
TB Resolution 2020-161: Order Setting a Public Hearing Regarding a Proposed Water
Improvement for the Town of Ithaca, Tompkins County, New York, pursuant to
Article 12-C of the Town Law, to be known as the Town of Ithaca Campbell Avenue-
Hopkins Place Water System Improvements Water Improvement and establishing the
Town of Ithaca Campbell Avenue-Hopkins Place Water System Improvements Water
Improvement Area
Present: Supervisor Rod Howe, Members Bill Goodman, Pat Leary, Tee-Ann Hunter, Eric
Levine, Pamela Bleiwas and Rich DePaolo

Whereas, a map, plan and report, including an estimate of cost, have been duly prepared in
such manner and in such detail as has heretofore been determined by the Town Board of the
Town of Ithaca,Tompkins County,New York,relating to the establishment and construction,
pursuant to Article 12-C of the Town Law, of water system improvements to be known and
identified as the Town of Ithaca Campbell Avenue-Hopkins Place Water System
Improvements Water Improvement, (the "Improvement"), to provide such Water
Improvement to the present Town water system, such water system Improvement to be
constructed and owned by the Town of Ithaca; to serve a benefitted area in said Town to be
known as the Town of Ithaca Campbell Avenue-Hopkins Place Water System Improvements
Water Improvement Area (the "Water Improvement Area"); and
Whereas,said map,plan and report,including estimate of cost,were prepared by a competent
engineer, duly licensed by the State of New York and have been filed in the office of the
Town Clerk of said Town, where the same are available during regular office hours for
examination by any person or persons interested in the subject matter thereof; and
Whereas,the area of said Town determined to be benefited by said Town of Ithaca Campbell
Avenue-Hopkins Place Water System Improvements Water Improvement Area consists of

the entire area of said Town excepting therefrom the area contained within the Village of
Cayuga Heights; and
Whereas, the Improvement proposed in connection with the establishment of the Water
Improvement Area consists of the installation of approximately 45 LF of 8"ductile iron water
main along Trumansburg Rd, 165 LF of 8"ductile iron water main along Hopkins Place, 528
LF of 8" ductile iron water main along Campbell Avenue, construction of a precast
building/pressure reducing station, installation/modification of approximately nine water
services, and associated appurtenances and other related ancillary facilities, at an initially
determined maximum estimated cost to said Water Improvement Area of$750,000; and
Whereas, said $750,000 maximum estimated cost, which is the cost of the project, shall be
authorized to be financed, at the option of the Town, by temporary financing under use of
available reserves or a bond anticipation note, and upon maturity of a bond anticipation note,
the issuance of serial bonds with a maximum maturity not in excess of the forty (40) year
period prescribed by the Local Finance Law, or directly by the issuance of such bonds; and
Whereas,it is proposed that the cost of the aforesaid improvements shall be borne by the real
property in said Water Improvement Area by assessing, levying upon and collecting from
the several lots and parcels of land within such Water Improvement Area, outside of any
village,which the Town Board shall determine and specify to be especially benefited by the
improvements, an amount sufficient to pay the principal and interest on serial bonds and
bond anticipation notes issued in anticipation of the issuance of serial bonds, as the same
become due and payable; and
Whereas, it is now desired to call a public hearing for the purpose of considering said map,
plan and report, including estimate of cost, and the providing of the Improvement, and to
hear all persons interested in the subject thereof concerning the same, all in accordance with
the provisions of Section 209-q of the Town Law;
Now, therefore, it is hereby ordered, by the Town Board of the Town of Ithaca, Tompkins
County,New York, as follows:
Section 1. A public hearing shall be held by the Town Board of the Town of Ithaca,
Tompkins County, New York, at the Town Hall, 21.5 North. Tioga Street, in Ithaca, New
York, in said Town, on the 30th day of December, 2020, at 11:00 o'clock A.M., Prevailing
Time, to consider the aforesaid plan, report and map, including estimate of cost, and the
question of providing the Improvement, and to hear all persons interested in the subject
thereof concerning the same and to take such action thereon as is required by law.
Section 2. The Town Clerk is hereby authorized and directed to publish a Notice of Public
Hearing regarding the aforesaid Improvement to be published once in the official newspaper,
and also to post a copy thereof on the town signboard maintained by the Town Clerk, not
less than ten nor more than twenty days before the day designated for the hearing as aforesaid,
all in accordance with the provisions of Section 209-q of the Town Law.

Section 3. This Order shall take effect immediately.
The question of the adoption of the foregoing Order was duly put to a vote on roll call, which
resulted as follows: Rod Howe, aye; Bill Goodman, aye; Pat Leary, aye; Tee-Ann Hunter, aye;
Eric Levine, aye; Pamela Bleiwas aye; and Rich DePaolo aye.
The Order was thereupon declared duly adopted.
6. Discuss and consider approval of the revised Records Management Policy
Ms. Hunter asked if the electronic records are purged automatically when they reach their
retention schedule.
Ms. Rosa responded that the records will be assigned a retention period and a report will
automatically be generated and sent to the Clerk to approve purging or disposition of those
records. That report will follow the same process as any other disposition by being attached to
the Disposition Form and getting department head approval and review by the RMAB.
TB Resolution 2020- 162: Adoption of revised Records Management Policy
Whereas, the New York State Archives has issued a revised and renamed Retention and
Disposition Schedule for New York Local Government Records pursuant to Article 57-A of the
Arts and Cultural Affairs Law, containing legal minimum retention periods for local government
records, which was adopted by the Town Board at its October 19, 2020 meeting, and
Whereas the Records Management Advisory Board(RMAB) met on September 29th and again
on November 23rd to discuss revisions to the Records Management Policy (Policy), the In-House
Scanning Procedures and the process for the permanent disposition of paper copies of records as
they are scanned and digitized, and
Whereas the RMAB has approved of the In-House Scanning Procedures and recommended
referral of the revised Records Management Policy to the Town Board for approval, and
Whereas the Town Board has discussed and reviewed the proposed Policy, now therefore be it
Resolved that the Town Board hereby approves and adopts the revised Records Management
Policy.

7. Discuss and consider approval of the revised Town of Ithaca Personnel Manual
Ms. Drake thanked the various boards, committees and staff who have worked on this update for

the past four years.
TB Resolution 2020- 163: Approval of Revised Personnel Manual
Whereas, the Personnel and Organization Committee in 2016. reviewed and discussed the current
Personnel Manual, and concluded that it would be advisable to revise the Personnel Manual; and
Whereas, the Personnel and Organization Committee revised the manual to include policies that
have been updated due to law changes or Town and Southern Cayuga Lake Intermunicipal Water
Commission (SCLIWC) contract negotiations and to include reference to the Greater Tompkins
County Municipal Health Insurance Consortium (GTCMHIC); and
Whereas, SCLIWC and GTCMHIC have reviewed and approved of the revised Personnel Manual;
and
Whereas, the Personnel and Organization Committee and Employee Relations Committee have
recommended approval of the revised 2020 Personnel Manual; now, therefore,be it
Resolved, that the Town Board of the Town of Ithaca does hereby approve the 2020 Personnel
Manual.

8. Discuss and consider approval of Streetlights Design Report and authorization for
Supervisor to sign an agreement with NYPA to implement the LED Streetlight Upgrade
Item 12 Consent December project
Mr. Howe noted that this is worded a bit oddly because it is going to the Public Works
Committee (PWC) tomorrow morning for review but there is a deadline of December 30th to get
it signed and avoid a fee.
There will be members of the public speaking at the committee and Mr. Thaete and Mr.
Goldsmith have reviewed and suggested approving the design report.
Ms. Hunter asked if the color temperature issue will be discussed at the PWC as well as the add-
ons such as wifi and cameras and are not part of this design report?
Mr. Howe responded that those are part of the design report we are being asked to approve,
pending approval by the committee.
Discussion followed on whether the action should wait until after the committee meeting.
The Board decided that if the PWC decided to make any changes to the Design Report, the board

could call a special meeting or act on this at the year end meeting if the board members at the
PWC felt it should come back to the full board.
The Board then discussed the LED lights and colors which will be discussed at the PWC as well
as locations around the town and city where one can see the different colors.
TB Resolution 2020- 164: Approval of the Streetlights Design Report and Authorization
for the Supervisor to sign an Agreement with NYPA to implement the LED Streetlight
Upgrade Proiect
Whereas the Town Board has previously discussed and approved an LED Streetlight Upgrade
which involves purchasing 272 streetlights from NYSEG and working with New York Power
Authority (NYPA) to implement the design,purchase, and replacement of the streetlights, and
Whereas the LED Streetlight Upgrade will significantly decrease electricity and maintenance
costs, reduce GHG emissions, and improve lighting quality, and
Whereas NYPA has provided the Town of Ithaca with a Design Report which provides detailed
information on the proposed design and installation of the new LED streetlights, and
Whereas Town staff and the Public Works Committee have discussed the Design Report and will
do so again at the December 15 meeting of the Public Works Committee, and
Whereas NYPA requires that the Town execute an Initial Customer Project Commitment(ICPC)
that will include but is not limited to agreement to the proposed design and approval to move
forward with the LED streetlight upgrade, and
Whereas the Town may be able to avoid an estimated $5,000 increase in LED streetlight
equipment costs by executing the ICPC in mid-December, now, therefore be it
Resolved that the Town Board hereby approves the Streetlights Design Report and Authorizes
the Town Supervisor to sign the Initial Customer Project Commitment (ICPC) on behalf of the
Town of Ithaca, pending approval of the Design Report by the Public Works Committee and
review and approval of the Initial Customer Project Commitment (ICPC) by the Attorney for the
Town.

9. Discuss and consider approval of, and authorization to sign a commitment letter to join
the Ithaca 2030 District
This was discussed at last month's study session and presentation by Mr. Goldsmith.

Property Owner/Manager/Developer Commitment Letter and become a member of the
Ithaca 2030 District
Whereas the Town Board was presented with the concept and details of the Ithaca 2030 District
plan by Nick Goldsmith, Sustainability Planner, at its November 23rd meeting and expressed
interest in moving forward, and
Whereas the effort is to encourage, facilitate and support the conversion of new build, major
renovations and conversion of older buildings to more efficient and greener energy uses, thereby
reducing their carbon footprint and reaching our 2030 reduction goal(s), and
Whereas the Town of Ithaca has initially identified the Historic Town Hall Office building for
the Ithaca 2030 District review, and
Whereas Mr. Goldsmith has submitted the Commitment Letter to the Board for review and
answered remaining questions, now therefore be it

1.0. Discuss and consider approval of budget line adjustments for 96B Sidewalk Project
TB Resolution 2020- 166: Acknowledte and authorize reallocation of budget line amounts
to cover cost overrun associated with inspection services for Danby Road/State Road 96B
sidewalk project.
Whereas, on August 7, 2017. the Town Board agreed to accept funding from NYS Department of
Transportation (DOT) for the State Route 96B/Danby Road Sidewalk Project for construction of
a sidewalk along the east side of Danby Road/State Route 96B, from Alumni Circle to the
City/Town of Ithaca municipal boundary; and
Whereas, on January 27, 2020 the Town Board authorized funding for the construction phase of
the sidewalk project; and
Whereas, inspection services are a requirement of the federal-aid project and on March 9, 2020
the Town Board agreed to authorize a supplemental agreement with Erdman Anthony (the
project design engineers) for inspection services at a maximum payable amount of$1.68,000, and
Whereas, an inspector is required to be present on the site whenever construction activity is
occurring, and Erdman Anthony's estimate of the Town's maximum payable amount was based
on the time anticipated for completion of the construction work; and

Whereas, construction took longer than expected and the costs for inspection exceeded the
amount allocated by the Town Board, as authorized in the March 9, 2020 resolution, by the
amount of$27,702.15 ($168,000 authorized); and
Whereas, the cost for sidewalk construction was lower by $38,648 from the amount authorized
by the Town Board on April 11, 2020, in which the accepted Bid Proposal submitted by Bothar
Construction LLC was $1,227,727,but the final construction costs were $1,1.89,079; now,
therefore be it
Resolved, that the Town Board acknowledges the cost overrun for the inspection services
associated with the Danby Road/State Road 96B sidewalk project, and in light of the
construction costs being lower than what was projected, authorizes the overrun costs to be taken
from the overall project budgeted total, and authorizes the Town Supervisor to execute any
necessary contract amendments with Erdman Anthony increasing the maximum inspection
services expenditure to $195,702.1.5, subject to the approval of the Attorney for the Town.

1.1. Resolution of Appreciation—Michael Solvig
The Board thanked Mr. Solvig and he responded saying he will miss everyone, and it has been a
pleasure working for the Town.
TB Resolution 2020- 167: Recognition of Michael Solvig's Dedicated Years of Service
Whereas Michael Solvig started his career at the Town of Ithaca on December 28, 2010, as the
Finance Officer, sharing over 30 years of municipal finance and purchasing experience from
Illinois; and
Whereas Mike has proven to be fiscally prudent,detail oriented and tireless in educating the Board
and staff about the Town's financial nuances and was known to be helpful, cooperative, and easy
to work with, and
Whereas Mike transformed an often-complicated budget development into a streamlined,
collaborative,informative, and user-friendly process, and produced a final budget that was easy to
read, extremely detailed and informative, even with the addition of tax caps and sudden changes
as to how sales tax can be distributed between funds; and
Whereas Mike has had to handle complex budgetary issues related to numerous intermunicipal
agreements and town cemeteries, and
Whereas Mike fostered a pro-active and be-ready approach to capital improvement projects to take
advantage of the best bidding environment, and was known to maintain an even keel and never
getting sticker shock when asked for more money, and

Whereas through Mike's skilled financial management and experience with bonding practices,
many capital projects and improvements were accomplished during his tenure that had been
delayed for many years, and
Whereas Mike's forward thinking and expertise allowed the Town to take advantage of interest -
bearing accounts to earn thousands of dollars in interest from under-utilized funds, and
Whereas Mike consistently examined expenditures, contracts, and financing options to get the
Town the biggest benefit possible and always seemed to manage the Town's funds in a way that
allowed staff to have the resources needed to do their jobs efficiently and effectively, and
Whereas after ten(10)years of dedicated and devoted service to our community, Mike has chosen
to retire from the Town of Ithaca, effective December 30, 2020, now, therefore, be it
Resolved, that the Town Board of the Town of Ithaca, on behalf of the Town and its citizens,
expresses its sincere appreciation and gratitude to Michael Solvig for his distinguished and
dedicated service to our community.

13. Report of Town Officials
Mr. Flowe reported that Cornell will be holding an informational video conficrence on their Earth
Source Heat Project on January 19"' and asked il'the Town had any particular questions we
would like to ask.
Mr. DePaolo reported that Charter Communications has allowed PECYASYS to put equipment tip
to get channel 13 back and there is a meeting next month to talk about Other issues.
