Resolved that the Town Board will hold public hearings at its meeting on Monday, October 7,
2024,, held at 215 N. Tioga Street and broadcast via ZOOM and YouTubeLiveMeetings
beginning at 5:30 p.m. regarding:
a. The Preliminary Town of Ithaca 2025 Budget
b. The 2024 Assessment rolls and Special Benefit Districts for Tax Year 2025
c. Proposed amendment to the agreement with SCLIWC to increase water rates
d. Proposed Town of Ithaca Water Rate and Sewer bents

TB Resolution 2024 - XXX: Order Setting a Public Hearing Rei!ardini! a Proposed Sewer
Improvement for the Town of Ithaca, Tompkins County, New York,_pursuant to Article 12-
C of the Town Law,to be known as the Town of Ithaca 2024 Inlet Valley Sewer Improvement
and establishing the Town of Ithaca 2024 Inlet Valley Sewer Improvement Area.

Whereas,, a map, plan and report, including an estimate of cost., have been duly prepared in
such manner and in such detail as has heretofore been determined by the Town Board of the Town
of Ithaca, Tompkins County, New York, relating to the establishment and construction,) pursuant
to Article 12-C of the Town Law, of sewer system improvements to be known and identified as
the Town of Ithaca 2024 Inlet Valley Sewer Improvement (the "Improvement"), to provide such
Improvement to the present Town sewer system to serve a benefitted area in said Town to be
known as Town of Ithaca 2024 Inlet Valley Sewer Improvement Area (the "Sewer Improvement
Area"); and
Whereas., the area of said Town determined to be benefited by said Sewer Improvement
Area consists of the entire area of said Town excepting therefrom the area contained within the
Village of Cayuga Heights, and the Sewer Improvement Area boundaries shall consist of the entire
area of said Town outside of the Village of Cayuga Heights as more fully shown upon a map on
file in the office of the Town Clerk,which map is available for inspection by any person or persons
interested in same during regular office hours at said office; and
Whereas, said map, plan and report, including estimate of cost, were prepared by a
competent engineer, duly licensed by the State of New York and have been filed in the office of
the Town Clerk of said Town, where the same are available during regular office hours for
examination by any person or persons interested in the subject matter thereof-, and
Whereas, the Improvement proposed 'in connection with the establishment of the Sewer
Improvement Area consists of repairing concrete, replacing electronic and control elements,
replacing pump system components, installing permanent natural gas generators, making minor
site improvements, increasing the size of approximately 73 linear feet of an existing gravity sewer
main, and acquisition of approximately 0.12 acres of land, as well as other ancillary and incidental
improvements and expenses in connection therewith, at a maximum estimated -cost of
$1,278,685.00; and
Whereas, said maximum estimated cost shall be authorized to be financed by the
expenditure of current revenues and surplus funds from sewer rents and charges from said Sewer
Improvement Area or by the issuance by the Town of Ithaca of its serial bonds with a maximum
maturity not in excess of the forty year period prescribed by the Local Finance Law; and

Whereas, it is proposed that the cost of the Improvement shall be borne by the real property
in said Sewer hnprovement Area by assessing, levying upon and collecting from the several lots
and parcels of land within such Sewer Improvement Area,outside of any villages,which the Town
Board shall determine and specify to be especially benefitted by the Improvement, an amount
sufficient to pay the cost or the principal and interest on serial bonds and any bond anticipation
notes issued in anticipation of the issuance of serial bonds, as the same become due and payable;
and
WHEREAS, said maximum estimated cost is not greater than one-tenth of one per centum
of the full valuation of the taxable real property in the area of the Town of Ithaca outside of any
villages and, therefore, in accordance with the provisions of subdivision 13(a) of Section 209-q of
the Town Law, the permission of the State Comptroller is not required for such Improvement and
the establishment of said Sewer Improvement Area; and
Whereas, pursuant to the New York State Environmental Quality Review Act("SEQRA")
and its implementing regulations at 6 NYCRR Part 617,it has been determined by the Town Board
that approval, construction and implementation of the Improvement are an Unlisted Action for
which the Town Board will make a SEQR determination of significance after holding a public
hearing; and
Whereas., it is now desired to call. a public hearing for the purpose of considering said map,
plan and report including estimate of cost,, and the providing of the Improvement, and to hear all
persons interested in the subject thereof concerning the same, all in accordance with the provisions
of Section 209- 1 of the Town Law; now, therefore, be it
Ordered,, by the Town Board of the Town of Ithaca, Tompkins County, New York, as
follows:
Section 1. A public hearing shall be held by the Town Board of the Town of Ithaca,
Tompkins County, New York, at the Town .Hall, 215 North Tioga Street, in Ithaca, New York, in
said Town,, on October T, 2024, at 5:30 o'clock P.M.,, Prevailing Time, to consider the aforesaid
map, plan and report, including estimate of cost, and the question of providing the Improvement,
and to hear all persons interested in the subject thereof concerning the same and to take such action
thereon as is required by law.
Section 2. The Town Clerk is hereby authorized and directed to cause a copy of this Order
to be published once in the official newspaper, and also to post a copy thereof on the Town
signboard maintained by the Town Clerk, not less than ten (10) nor more than twenty (20) days
before the day designated for the hearing as aforesaid, all in accordance with the provisions of
Section 209-q of the Town Law.
Section 3. This Order shall take effect immediately.
The question of the adoption of the foregoing Order was duly put to a vote on roll call,which
resulted as follows:

Be it Resolved; the governing Town Board of the Town of Ithaca does hereby approve the
below proposed salaries for the elected officials for the year 2025:

TB Resolution 2024 - Authorization for the Town Supervisor to sign a revised Contract
with Barton & Loguidice, D.P.C. for the Detailed Construction Drawings and Specifications
Preparation Services associated with the King Road West Box Culvert rehabilitation
Project
Whereas on April 1, 2024, the Director of Engineering (Director) received proposals for the King
Road West Box Culvert Replacement Analysis and Detailed Construction Drawings Preparation
(Project); and
Whereas the Town Board awarded Part A of the contract of the Project to Barton & Loguidice
D.P.C. (B&L), for a fixed fee of$14,600 by TB Resolution 2024-034; and
Whereas B&L has completed Part A of the project and has provided an analysis of multiple
alternative solutions to repair or replace the failing box culvert with associated probable costs; and
Whereas B&L has provided a proposal to perform professional services to create detailed
construction drawings and specifications (Part B of the RFP) for the Project for a fixed fee of
$271,000; and
Whereas the Director has reviewed the alternative solutions and the proposal, and has
recommended rehabilitation of the existing box culvert and award of Part B of the RFP to B&L
for a fixed fee of$27,000; and
Whereas pursuant to New York State Environmental Quality Review Act (SEQRA) and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
that this is a Type 11 action because it constitutes "replacement in kind of facilities on the same
site, and thus, not Subject to review under SEQRA; now, therefore be it
Resolved,, that the Town Board awards Part B of the project and authorizes execution by the
Supervisor of a revised contract with Barton and Loguidice, D.P.C., 443 Electronics Parkway,
Liverpool, NY 130,88, subject to approval of the contract documents by the Director and review
by the Attorney for the Town, and be it further
Resolved that the Director is authorized to approve contract amendments, without further
authorization from the Town Board,provided the maximum amount of such amendments does not
exceed $4.,500 in aggregate, and be it further
Resolved that the total contract amount, including contingency, shall not exceed Forty Six
The One Hundred Dollars and Zero Cents ($46,100), which is an aggregate fee of$14,600
for Part A, $27,000 for Part B, and $4,500 for contingency.

TB Resolution 2024 - c: Resolution Proclaiming Community Plannin2 Month
Whereas., change is constant and affects all cities, towns,, and counties; and
Whereas, planners can help navigate this change with data-driven insights and expertise that
provide better choices for how people work and live; and
Whereas, the Town of Ithaca Chronology of Policy Decisions Establishing and Supporting
Item 6
Comprehensive Planning Process dates to 1937, established the Town of Ithaca as a leader in
community planning; and
Whereas, community planning provides an opportunity for all residents to be meaningfully
involved in making choices that determine the future of their community; and
Whereas, the full benefits of planning require public elected and appointed officials who

understand, support, and demand excellence in planning and plan implementation; and
Whereas, the month of October is designated as National Community Planning Month throughout
the United States of America and its territories,, and
Whereas, the American Planning Association endorses National Community Planning Month as
an opportunity to highlight how planning is essential to every community, and how planners are
uniquely positioned to identify solutions to communities' most difficult housing, transportation,
and land use questions, and
Whereas, the celebration of National Community Planning Month gives us the opportunity to
publicly recognize the participation and dedication of appointed Planning Board members who
have contributed their time and expertise to the improvement of the Town of Ithaca; and
Whereas., we recognize the many valuable contributions made by the professional planners of the
Town of Ithaca and extend our heartfelt thanks for the continued commitment to public service by
these professionals; now therefore be it
Resolved that the month of October 2024 is hereby designated as Community Planning Month in
the Town of Ithaca in conjunction with the celebration of National Community Planning Month.
TB Resolution 2024— d: Approve Permanent Appointment of Sus taro abillity Planner and
Water& Sewer Maintenance Supervisor
Whereas, the Town Board approved the provisional appointment of Hilary Swartwood as a
Sustainability Planner for the Planning Department, effective April 10, 2023; and
Whereas, the Town Board ratified the provisional promotional appointment of Travis Mills, as a
Water & Sewer Maintenance Supervisor for the Public Works Department, effective January 3 1,
202 1; and
Whereas, NYS Civil Service has developed the NY Hiring for Emergency Limited Placement
Statewide (NY HELPS) Program, which allows for competitive positions to be filled via m non-

copetitive appointment, which means examinations are not required, but candidates must meet
the minimum qualifications of the titles for which they apply; and
Whereas, the titles of ustainability Planner and Water & Sewer Maintenance Supervisor have
been approved under the NY HELPS program, which means those incumbents will no longer be
required to take a civil service examination for their provisional positions; now therefore be it

Resolved that the Town Board of the Town of Ithaca hereby appoints to permanent civil service
status effective September 1, 2024, Hilary Swartwood to the Sustainability Planner position and
Travis Mills to the Water & Sewer Maintenance Supervisor position, with no changes in their
wages and benefits.
