Others: Rick Couture , Andy Sciarabba, Larry lacovelli , Orlando lacovelli , Mark lacovelli , and Marc Purdy. Call to Order Chairperson Sigel called the meeting to order at 7:03 p. m . AP22al ,of Ithaca College, owner, Rick Couture, Agent, requesting modification of ZB Resolution No. 2010-014, Condition 1 , "That the scoreboard be built as shown in the application materials", granted June 21 , 2010 to be permitted to construct a replacement scoreboard at Kostrinsky Field located at 130 Flora Brown Dr, Tax Parcel No. 41 :1 -30.2, Medium Density Residential. Rick Couture and Andy Sciarabba appeared before Board . Chairperson Sigel commented that the appeal seemed straightforward and that the applicant wishes to install a substantially smaller sign . He asked if applicant wanted to add anything. Mr. Sciarabba stated that the lights on the proposed sign will be white LED lights instead of red and amber. The proposed sign is approximately 67% smaller and shorter than the- previously proposed sign. Chairperson Sigel solicited comments from the Board; there were none. SEOR, Attorney Brock noted that the Part I of Environmental Assessment Form references a T. G . Miller letter dated April 189 2011 ; the date of the letter is April 26, 2011 . The EAF was corrected to reflect the correct date. Chairperson Sigel moved to make a negative determination of environmental significance for the reasons stated in Part II of the EAF prepared by Town staff. Mr. Niefer seconded. Vote—carried unanimously. ZB RESOLUTION NO. 2011-031 : Environmental Assessment. Ithaca Col/eee. 953 Danbv Rd (130 Flora Brown Dr), Tax Parcel No. 41104-30.2 MOTION made by Kirk Sigel, Seconded by James Niefer. Zoning Board of Appeals Minutes of June 20, 2011 Final RESOLVED, that in regards to the appeal of Ithaca College, requesting a modification of ZB Resolution No. 2010-014, that this Board makes a negative determination of environmental significance for the reasons stated in the Part 11 environmental assessment form prepared by Town staff. A vote on the motion resulted as follows: AYES: Sigel, Niefer, Krantz and King NAYS: None. ABSTAIN: None. Motion was carried unanimously. Public Hearing Chairperson Sigel opened the public hearing at 7:06 p . m . and invited the public to address the Board . There being no one, he closed the public hearing at 7:06 p. m . Chairperson Sigel proposed to re-move ZB Resolution No. 201 0=01 4 with slight modifications. Attorney Brock agreed . Chairperson Sigel asked if the sign would be installed in the same location . Mr. Couture responded that it would be. Attorney Brock reviewed the sections of the Code from which variances would be needed . She determined that the same sections of Town Code applied . Attorney Brock asked about the illumination of the sign. Mr. Sciarabba responded that the sign is intemally illuminated . All games are held during the days no night games. Attorney Brock went on to ask if the ad space would be lit and Mr. Couture said that it would not be. Chairperson Sigel moved to grant appeal of Ithaca College, using the language from ZB Resolution No. 2010-014 and modifying condition 1 to reference the materials submitted to the Board on June 20, 2011 . Seconded by Ron Krantz, Vote--cu. ZB RESOLUTION 2011-032: 31gn Varlance, Ithaca College, 953 Danby Rd (130 Flora Brown Dr). Tax Parcel No. 41 .= 1 -30.2 MOTION made by Kirk Sigel, Seconded by Ron Krantz. Resolved, that this board grants the appeal of Ithaca College, requesting variances from the requirements of Chapter 221, Sections: 221 =4A(7), 221 -6A(2), 221 -6A ( 1)(a), 221 -8A (2)0 221 =8A (6), and 221 -8CDE to be allowed to construct and replace a new scoreboard at Kostrinsky Field, 130 Flora Brown Dr, Tax Parcel No. 41 . - 1 =30.2, Medium Density Residential Zone, based upon the following. Findings: Page 2 of 10 i 1 Zoning Board of Appeals Minutes of June 20, 2011 Final 1 . The benefit cannot be achieve by any other means because the college needs a bigger scoreboard, 2. That there is no real undesirable change in the neighborhood character or to nearby properties since the scoreboard cannot be seen from Route 96B or adjacent properties, 3. The request is moderately substantial because it is a bigger scoreboard, but it is not a problem, 4. The request will not have any adverse physical or environmental affects, 5. The need for a variance should be seen as self-created since the college proposes to replace an existing scoreboard sign that is allowed without a permit, which predates the current Sign Ordinance, but that again does not really create any reason to deny the request, and 6. That this Board finds that the benefit to the applicant outweighs the detriment to the health, safety; and welfare of the community. Condition. 1 . That the scoreboard be built as shown on the applicant's materials submitted to the Zoning Board of Appeals at its June 20, 2011 meeting. A vote on the motion resulted as follows: AYES: Sigel, Krantz, Niefer, and King. NAYS: None. Motion passed unanimously. Appeal of Lawrence lacovelli, owner, requesting variances from the requirements of Chapter 270, Section 27"2C "Yard Regulations" of the Town of Ithaca Code to be permitted to maintain Insufficient side yard setbacks located at 167 Kendall Ave, Tax Parcel No. 54.445.2, High Density Residential. Larry and Mark lacovelli appeared before the board . Chairperson Sigel commented that the variance seemed straightforward. He noted that the request is for slightly more than a 1 foot reduction from the required setback at one corner of the house. Chairperson Sigel stated that this was a subdivision that has been approved by the Planning Board . He then asked Mr. lacovelli if there was anything he would like to add , Mr. lacovelll did not. Revised 4- 12-08 Information on the Criteria for an Area Variance or a Use Variance Area Variances : As per Article XXV, Section 270-213 of Town of Ithaca Code and Section 267-b of Town Law, the Zoning Board of Appeals, in making its determination for an area variance, will apply a balancing test of the benefit to the applicant weighed against the detriment to the health, safety, and welfare of the community by granting the area variance . The request that we are now submitting reduces the size of the proposed scoreboard to 225 sf. This represents a reduction in size of 67% of the approved scoreboard. The new board will be only 21 ' -3" tall (scoreboard and supports) while the approved larger board was proposed to be 28 . 9 ' tall. As you know, the Planning Board has recently reviewed the scoreboards for the new Athletic & Events Center, Freeman Field and Butterfield Stadium , all of which required and received approvals for sign variances . In 1997 the Upper Terrace Field was renamed Kostrinsky Field in recognition of former Bomber coach Doris Kostrinsky . The field, considered among the best in the small -college ranks, has hosted Ithaca softball since 1992 and has hosted over 50 playoff games . The NCAA Northeast Regionals being held there in 1995 , 1996, 1999, 2000, 2001 , 2002, 2004 and 2005 . The first three Empire 8 championship tournaments were held at Kostrinsky Field as well . Scoreboards existed at Ithaca College athletics fields from its earliest days, prior to the sign ordinance adopted in 1980 and updated in 1996 . The current ordinance would only allow for a four square foot sign in the residential zone . The sign ordinance allows for non -conforming signs that were in existence prior to the adoption of the sign ordinance but states that non -conforming signs cannot be changed or enlarged unless a variance is granted by the Zoning Board of Appeals . As part of the overall renovation of Kostrinsky Field, the College proposes to replace the scoreboard in keeping with other recent scoreboard upgrades on campus . A site plan drawing, catalog cut elevation of the sign and aerial google earth image that shows the location of the scoreboard are included . These show the dimensions and scale of the scoreboards as well as the location in relation to Route 96B . The scoreboard at Kostrinsky Field will be nineteen feet by thirty-six feet and mounted ten feet above adjacent grade . Due to its location in the interior of the campus , it is not visible from the public highway . A photograph taken from the entrance driveway at Longview has been included to illustrate the view in this location and the vegetative screening that exists between 96B and Kostrinksy Field . Ithaca College is requesting that the Town of Ithaca recognize that electronic scoreboards are a standard part of the operation of a collegiate level sports facility . Updating the scoreboard is a reasonable part of the process of keeping a field up to contemporary standards for sports facilities . The new scoreboard that will be installed is appropriately scaled for the facility and will have minimal visual impact on the adjacent neighborhood . The scoreboard does have a video display and so will produce the appearance of motion . 221 -6A(2 ) Freestanding signs in residential districts and/or agricultural districts shall in no case be located between the sidewalk and the street, nor closer than two feet from the sidewalk, nor closer than three feet from a building or structure, nor closer than 15 feet from a side lot line; the maximum height of sign and support shall be six feet. The height of the sign will be 29' overall , exceeding the 6' height allowed . 221 -6 (A)( 1 )(a ) One wall or freestanding sign, not exceeding four square feet in area, identifying a principal permitted enterprise or use other than residential. The scoreboard will measure 19' x 36' for a total of 684 square feet. 221 -8(A)(2 )(6 ) No sign, display or advertising device shall be illuminated by or contain flashing, intermittent, rotating, or moving lights. The sign will contain a video display that can produce the appearance of flashing . 221 -8( B ) , (C ) , ( D ) , and ( E ) . B. Permitted sources. (1) Direct illumination shall be permitted in all districts as follows: i (a) Visible lamps, not exceeding 25 watts per lamp. (b) Shielded linear light sources and gooseneck reflectors. (c) Floodlights. The scoreboard has no direct illumination . (2) Indirect illumination, including backlighted letters, is permitted in all districts. The scoreboard will be internally lit. (3) Self-illuminated copy-change theater signs are permitted in business districts. The scoreboard is not a theater sign so this does not apply. (4) Self-illuminated signs and letters are permitted in business and industrial districts. The scoreboard will be internally lit but this is not in a business or industrial district so this does not apply. C. Intensity. No sign shall produce illumination in excess of 10 footcandles above ambient light level at a distance of four feet on a level with the sign. The scoreboard produces a maximum of 371 . 61 footcandles which is required for viewing from behind home plate . Brightness levels can be adjusted . D. Color. In residential districts and/or agricultural districts illumination shall be white or amber. The scoreboard has Red LEDs. E . In addition to the foregoing requirements, all illuminations shall meet the requirements of the Outdoor Lighting Law, Chapter 173 of the Town of Ithaca Code. The purpose of Chapter 173 is to ". . . eliminate problems of glare and minimize light trespass to keep unnecessary direct light from shining onto abutting properties or streets, to help reduce the energy costs of outdoor lighting, and to reduce sky glow. " The field is not lit and all games are played during daylight hours. The scoreboard faces home plate and the large hillside behind home plate (which is owned by the College).
