Present : David Powers Robert Powers Aldus Fogelsanger In the Matter of the Application ORDER of GRANTING BILLY J . BELOUS : VARIANCE 178 Kendall Avenue to vary the requirements of the Zoning Ordinance of the Town of Ithaca . : An application in the above matter for a variance having been presented by BILLY J . BELOUS to the Zoning Board of Appeals of the Town of Ithaca and a hearing by thesaid board having been duly held at the time and place stated above , after published notice and consideration having been given to the promotion of the health, safety, morals or general welfare of the community in harmony with the general purpose and intent of the zoning ordinance of the Town of Ithaca and it having been resolved and determined following such hearing that there are practical difficulties or unnecessary hardship in the way of carrying out the strict letter of the said ordinance and that the spirit of the ordinance shall be observed and public safety and welfare secured and substantial justice done by the entry of this order , it it hereby ' ORDERED that the variance applied for with respect to Section 7 of the town zoning ordinance be granted .
