The MOTION carried unanimously.
At this time, Mr. Francese stated that.some examination of the
parcel to the West of Mr. Chase's parcel seems.to be in order to see
where the County roads might be going. Mr. Scannell agreed that such
an examination would be in order except that for the rezoning it is
only a routine matter at the moment. Mr. Lagrand Chase stated that the
County Planning Department should be aware of this need for road con-
nections. Mrs. Holcomb also noted that there is an additional time
lag now through the Health Department because of the fact that they do
not have an engineer. Proposals for the extensions of water and
sewer services must go to the Syracuse Regional Office of the D.E.C.
for processing.
PROPOSED FAMILY GROCERY STORE ON ELMIRA ROAD BY MR. AND MRS., THOMAS BELL
Mr. John Vasse, realtor, was present representing Mr. and Mrs.
Thomas Bell who operate Snow Village on Willow Avenue Ext. They have
been limited in the operation of Snow Village because of the lack of
snow this winter and would, therefore, like to open a family grocery
store called Bell's Convenience Food Store, on the Mancini„property on
the Elmira Road. Mr. Vasse presented a plot plan drawn by Anton
Egner and Assoc. He stated that the first problem with this proposal
is that the land is zoned light industrial and the request is for
�( business. He stated that according to thezoning ordinance retail is
more restrictive than industrial. However, he pointed out that Mill-
brook Bread and Dairylea are there in a retail operation. Mr. Vasse
stated that this was a hardship case since the Bell's have ordered theii
building already not knowing that they could not put it up in an indus-
trial area. He stated that there is an access road existing. He
further stated that the Health Department has said that the Bells can
count.on at least two months waiting on approval for their well and
septic system.
Mrs. Holcomb stated that she and Ken Kroohs had met with the
Bells and showed them the Light Industrial Section of our present
zoning ordinance in re uses and accessory uses.
Mrs. Holcomb continued by stating that the primary use for
Millbrook is as a distribution center. Dairylea is the same. Salino
Electric was allowed because it was a repair shop, however, it is now
retailing too and Mr. Cowan is talking with them.
Mr. Vasse asked what the intended zoning is for this area.
Mr. Francese read from Section 47, Page 20, of the present
zoning ordinance: Article X, Industrial Products. Use Regulations.
"In Industrial Districts buildings and land may be used for any lawful
purposes except for dwelling purposes He stated that it is
the intent of our new ordinance to allow retail in light industrial
districts.
Mr. Christianson stated that he had been thinking that a grocery

store for that area would be an ideal situation.
Mr. Francese stated that he felt the matter

Mr. Kroohs felt that if the matter goes to the Board of Appeals
asituation of lot by lot, piece by piece, unplanned development can
in effect occur.
Mrs. Holcomb was of the opinion that the Planning Board must
refer to the Board of Appeals for an interpretation of the present
zoning ordinance as pertains to this matter. However, the Planning
Board must be involved with the site plan and then the proposal must
go to the Town Board.
Mr. Kroohs stated that there.should be a note on the site plan
for this store that the access drive'onto Elmira Road will be closed
off eventually when further development.to the South occurs. You then
have one entrance and one exit for three or four stores.
MOTION by Mr. Sam Slack, seconded by Mr. Robert Scannelle
l RESOLVED, that the Planning Board request from the Zoning Board
of Appeals an interpretation of the present zoning ordinance of the
Town of Ithaca regarding the placing of a retail store in a light
industrial district.
We refer the Board particularly to Article VIII, Page 17, Light
Industrial Districts, and Article X, Page 20, Industrial Products.
The land in question is presently zoned Light Industrial..
Mrs. Holcomb noted that under this proposed resolution, the
Zoning Board of Appeals.can only give an advisory opinion. There was
no further discussion and the Chair called for a vote.

DISCUSSION OF PROPOSED ZONING ORDINANCE IN RE LIGHT INDUSTRIAL AND
BUSINESS.
Mrs. Holcomb stated that there seems to be a corollary problem
with the above discussion in connection with our new zoning ordinance.
She felt it necessary that the Planning Board discuss what they think
'{ the new zoning ordinance should say concerning light industrial and
business districts. Is it incompatible for the two uses to be corm
bined? If it is not incompatible, how do we do it? Do we want to
balance them? Are there certain kinds of light industrial uses that
are incompatible with business?

A regular meeting of the Town of Ithaca Planning Board was held
on Tuesday, March 19, 1974, in the Town of Ithaca Offices, 108 East
Green Street, Ithaca, New York, at 7:30 p.m.
PRESENT°. Chairwoman Barbara Holcomb, Robert Scannell, Robert
Christianson, Sam Slack, Kenneth Kroohs (Planning Engineer), Reynolds
Metz (Zoning Officer).

The meeting was opened by the Chair at 7.*30 p.m. It was noted
by the Chair that a quorum was not present.
CONSIDERATION OF SITE PLAN FOR PROPOSED FAMILY GROCERY STORE ON ELMIRA
ROAD ADJACENT TO MILLBROOK BREAD RETAIL OUTLET,
Mr. John Vasse, Realtor, stated that he was making his third
appearance before the Planning Board in connection with Mr. and Mrs.
Thomas Bell's proposal to establish.a retail grocery store to be called
Bell's Convenience Store on the Mancini property on the Elmira Road. The
store will be 40' x 601. He presented a plan prepared by Egner and
Assoc,, Architects. He stated that on -Saturday, March 9, 1974, the
Zoning Board of Appeals of the Town of Ithaca met and prepared an opinion.
for presentation to the Planning Board and determined that a store of
this nature could be placed in this Zone. Mr. Vasse pointed out that
the building is well off the highway and that there is a parking area
for 40-60 cars. Mr. Vasse also presented a picture of the actual
building to show just what it will look like. Mr. Vasse presented a
plan of the Mancini property and also�millbrook Bread site.
Mrs. Holcomb stated that the intent of the zoning ordinance is
to allow in a light industrial district all those more restrictive uses
except for residential uses. Mrs. Holcomb then read from the present
zoning ordinance, Section 46a (Page 20) referring to the nature and
form a site plan shall have for presentation to the Planning Board prior
to the issuance of a building permit. She noted that the procedure is
that the Town Board only takes action after recommendation from the
Planning Board. She further stated that the Planning Board had hoped
to ask the Town Board to take action on this matter at their meeting of
March 25th, 1974. Mrs. Holcomb stated that she did not see all of the
required plans and documents that the Planning Board needs.
Mr. Vasse felt that the documents previously submitted and the
ones being presented to this meeting should be sufficient. He stated
that the approval from the Health Department takes a very long time in
view of their present situation of not having an engineer. He stated
that he was sure that Anton Egner and Assoc. have a topography plan,and
asked if the Planning Board could take action subject to the receipt of
a satisfactory topo plan.

with the problems of the Bells, but that there are certain materials
and assurances required by the Planning Board in order to grant approval.
Mr. Vasse pointed out that this request is merely for a two -
person store and not an apartment complex.
Mr. Scannell suggested that the Planning Board could recommend
an a-proval to the Town Board with a notation that we have not seen
the drainage plans and would merely recommend approval on the basis of
what materials we have. It would then be up to them to act on the
matter as they see fit.
Mr. Scannell pointed out to Mr. Vasse that he should realize
that the Town Board might kick the matter right back to the Planning
Board for further study,
Mrs. Holcomb noted that this is a commercial use in a light
industrial district. She asked if we apply commercial yard requirements
rather than light industrial. She cited the Millbrook Bread case. It
was agreed to apply commercial yard requirements.

Mrs. Holcomb stated that it appeared to be the consensus of the
Board that this is a reasonable use for this site. Mr. Christianson
stated that he agreed and further stated that he felt it was very
desirable. Mr. Scannell expressed agreement also.
Mrs. Holcomb outlined the problems that have to be solved yet.
1. 10' shortage in side yard requirement on the south boundary .can
be aleviated by reducing the parking area.
2. Service road and parking area are to be blacktopped. Mr. Bell said
that it will be so.
3. Landscaping spelled out in more detail and -a time schedule prepared
for planting.
.4. Presentation of appropriate contour maps so that the Town Board can
discuss drainage problems.
5. A legal description noting metes and bounds.
6> Before a Building Permit is -issued they have to have Health Depart-
ment approval. Mr. Bell stated that this procedure is in process.
7. If the Bells do not have approval from the State -on the septic
system, by the time they go to the Town Board, they should get a letter
from Mr. Guest of the Tompkins County Health Dept, to the effect that
the request for approval has been forwarded to the State.
Mrs. Holcomb suggested that Mr. Bell ask that Mr. Niederkorn
of Anton Egner and Assoc, call the Planning Board office so that he
will know first-hand what the Board requires. She further -stated that
the Planning Board can give the Town Board a recommendation that in
concept this proposal is acceptable.to the Planning Board. This will
be done at the next meeting of the Planning Board when a quorum is
present.
CONSIDERATION OF SITE PLAN FOR PROPOSED EXPANSION OF NCR OFFICE BUILD-
ING ON DANBY ROAD,
Mr, James Tucker,.General Manager of NCR, submitted to the
Planning Board for their consideration and subsequent recommendation
to the Town Board plans for an expansion of the NCR Office Building.
The proposed building will be 66,000 sq.ft. and will be built on their
property at 950 Danby Road. He. stated that the architect is here from
Dayton, Ohio, with the proposed site plan and location plans. He
further stated that they do have a model of the proposed expansion,
but that it was too bulky to.carry on the airplane so they merely
brought pictures of the model for this particular meeting. The
proposal is for a two-story addition with a connection to the present
lobby of the existing building. Drainage will be through an existing
sluice flow and carry on down the hill. There will be more than
adequate parking and an entrance to the new parking lot will be direct-
ly across from the entrance to Ithaca College. The landscaping is in
a schematic form and will not be ready for the Town Board meeting on
April 8th, 1974.
Mr. Tucker indicated that the expansion of the office staff has
already occurred and that NCR is leasing property in the Airport
Industrial Park. The increase is approximately 20%, i.e 240 to 300
persons.
The set back of the proposed expansion is approximately 90' from
theedge of the pavement. (102' from the centre line of the Danby Rd.)

% RESOLVED, that the Planning Board of the Town of Ithaca recom-
mend and hereby does recommend to the Town Board that the proposed
extension to the National Cash Register Offices be approved with the
following conditions:
1. That a portion of the front parking lot as shown on the
site plan dated 3/19/74 by Lorenz, Williams, Lively and Likens be
moved to meet the requirement that parking shall not be allowed within
the required front yard.
2. That a more detailed drainage plan be presented with parti-
cular attention to:
a.. the contours and drainage between the proposed building
and Danby Road;
b. the present drainage pattern on the entire NCR site and
the connection of the new drainage system to the existing
system.
3. That a detailed landscaping plan be presented.
4. That the location of hydrants be clearly shown.
.5. That detailed utility plans be presented.
At this point, Mr. Olmstead stated that the letter requested by
the Planning Board from Mr..Shaffer of NCR to the Town Board re phasing
on shifts has been mailed to the Town Board for their meeting on the
8th of April, 1974..
There was no further discussion and the Chair called for a vote.

PROPOSED CONVENIENCE FOOD STORE BY MR. AND MRS. THOMAS BELL ON ELMIRA
ROAD.
Mrs. Holcomb stated that the Planning Board had received a
presentation of the proposed site plan for the above -noted grocery
store on the 19th of March, 1974. Mrs. Holcomb stated that a revised
site plan has just been presented this day by the Bells. The building
has been turned 90°. It will be necessary for the Planning Board to
look at the proposal over again. She noted that the contours have
been shown. The lot line problem has been taken care of. The drainage
is shown. There followed a brief discussion of the drainage. It was
noted that there is a vacant lot area between this proposed lot and
the drainage ditch. There is more than enough parking area.
MOTION by Mrs. Barbara Holcomb, seconded by Mr. Robert Scannell:
GWHEREAS, it is the consensus of the Planning Board of the Town
of Ithaca that a retail grocery store placed on the land owned by Mr.
and Mrs. Thomas Bell on Elmira Rci d adjacent to the Millbrook Bread
site is a reasonable use of the land, NOW, THEREFORE, BE IT
RESOLVED, that the Planning Board recommend and hereby does
recommend to the Town Board that they call a Public Hearing to consider

final site plan approval on Monday, April 8, 1974.
The Planning Board recommends the acceptance of the site plan
with the following conditions:
1. The proposed landscaping be spelled out as to types and
numbers of plants and that a planting schedule be stated.
2. The service road and parking area shall be surfaced with a
dust -free material.
3. The proposed entrance from Elmira Road be allowed only until
such time as the service road is extended to the property or properties
to the South, at which time the proposed entrance onto the Elmira Road
will be closed off.
4. Approval is received from the Health Department for water
and sewer service.

6. Percentage of grade on the parking area be reduced to a
.maximum of 4%.
There being no further discussion, the Chair called for a vote.

,Supervisor Schwan read a letter dated April 1, 1974 which he had
received from Dr. Frederick Beck, of 906 Danby Road. Dr. Beck said
that the proposed extension would add to the traffic problems in the
area, particularly in view of what has already happened in the.area:
-the widening of Danby Road and the new road built by Morse Chain Com-
pany with an entrance on Danby Road, Dr. Beck said he was unhappy
about the changes in the area and feat the Planning and Town Boards
should protect the residential property owners of the area.
Discussion developed the fact that NCR plans covered all the conditions
,. of the Planning Board recommendations except for a detailed landscap-
ing plan. Mr. Anderson.indicated that they are also working out a
traffic study with Ithaca College and taking other measures to improve
traffic flow in the area (staggered hours, for example). Councilman
Desch said he was very much concerned about.the.amount of parking con-
centrated in the front which presently is a beautifully wide area.
He had no complaint about the building, but was concerned that a large
_- amount of black -top would be concentrated in a small area. Council-
:.; man Desch said he was opposed to the extension only because of the
parking arrangement.
No other persons appearing to speak for or against the proposal, the
:._ Supervisor closed the hearing, and the Board took the following action:

RESOLVED, that the extension proposed by NCR, as on the presented site

the Planning Board at its meeting on May 21, 1974, by resolution,
recommended to the Ithaca Town Board.that they approve the amended
fixed sign _"Convenience Foods" for Bell's Gfocery Store.
Motion by Councilman McElwee# seconded by Councilman Desch,
RESOLVED, that the Town.Board of the Town of Ithaca approves the
amended fixed sign "Convenience Foods" for Bell's Grocery Store, on
the condition that no part of the sign or the lettering projects more
than two feet from the face of the building.

REPORT OF ZONING OFFICER I
Mr. Metz presented a preliminary application for two signs for
CC Bell's Convenience Food Store. He presented a drawing of a free stan-
ding.sign prepared by Cayuga Signs, Mr. Metz indicated that the free
standing sign is within the requirements for size according to the
Sign Ordinance,
Mrs. Holcomb read the Sign Ordinance in detail noting that the.
top of. the proposed sign is 20' from ground level. She noted that the
sign ordinance states that the smallest sign that is possible in the
circumstances should be used. There followed a lengthy discussion of
the size of the sign and the needs of the owner, Mrs. Holcomb pointed
out that the Planning Board has 60 days to report on an application.
Mr. Kroohs said that he will go out to the site and see where the sign
will go exactly,
In connection with the other proposed sign for the face of the
store, Mrs. Holcomb again referred to the Sign Ordinance re signs on
the face'of buildings in an industrial area, It was determined that
the proposed sign for the face of the building is too big, being 150
sq.ft., whereas the ordinance requires no more than 60 sq,ft,
it was determined that Mrs. Holcomb would write a letter to the
Bells stating that the Planning Board is investigating the free
standing sign because they feel it is too big, the intent of the sign
ordinance being to use.the smallest sign possible to achieve the pur-
pose of the sign. It would also be stated that the Planning Board has
determined that the sign on the face of'the building is definitely too
big,
ST. CATHERINE SUBDIVISION - "DUTCH" PRINCE
Mrs. Holcomb outlined the background of this area. She stated
the problems as shown on the map,
1. The water line on Siena Drive stops at Lot 2 Block 3. This line
should be looped to connect with the water line on Christopher
Lane,
2, Original plans showed the water line extending all the way from
Hanshaw Road to Christopher Lane on that road which is now named
Blackstone. Mr. Prince's latest plan shows the water line running
from Christopher Lane only to Lot 12 of Block 1 and not finishing
the loop to Blackstone.
3. The sewer line also stops at Lot 12, Block 1.
Mrs. Holcomb read a letter dated May 6, 1974, which she wrote
to Mr. John MacNeil on this matter. See copy attached to these Minutes.
MOTION by Mrs. Barbara Holcomb, seconded by Mr. Jack Lowee
RESOLVED, that with reference to the St. Catherine Subdivision
')eing developed by Arthur "Dutch" Prince if action has been taken to
comply with the requirements concerning water and sewer lines and if
it appears that approval from the Health Department is forthcoming, the
Planning Board will call a Public Hearing for May 21, 1974, to consider
approval of the remainder of the St. Catherine Subdivision.

PUBLIC HEARING: 8:00 P.M., ST. CATHERINE SUBDIVISION - ARTHUR "DUTCH"
PRINCE
Mrs. Holcomb declared the Public Hearing open at 8:00 p.m. and
read the Notice of Public Hearing and presented the Affidavit of Post-
ing and Publication sworn to by the Town Clerk. .(See attachments to
the Official. Minutes of this Meeting).
.Mr. Prince presented a set of plans and stated that he now has
all of the approvals required, but not all of the signatures. He did
have the signed approval of the N.Y.S. Department of.Health Regional
Office in Syracuse. He further stated that, as requested, the water
line coming South of Blackstone Avenue has been brought down to join
with the branch going up Siena Drive so that.the water line is now
looped. The sewer.line has been extended so that Lot 12 of.Block 1
and the two lots labelled Paul Petrella and St. Catherine of Siena
Church can be served. The plans show the water line extending North
on Siena.Drive to connect with the water line on Christopher Lane which
also completes a loop. Five hydrants are shown.
It should be clearly noted that a brook runs across the front of
the property on Lots 7-A through 13. The Zoning Enforcement Officer
must be aware that when issuing a building permit for these lots the
house locations must be inboard of the creek so that the creek is not
diverted. The persons building the house must install a culvert under
their driveway and the culvert must be checked by the Town Engineer
to be sure that it has a large enough capacity.
Mr. Kroohs stated to the Zoning Officer that Lots 2 through 7-A
of Block 2 shall be checked by the Town Engineer to ascertain if there
is to be fill and if so, that said filling will be done properly so
that drainage.problems for other properties are not created.
MOTION by Daniel Baker, seconded by Robert Scannell:
RESOLVED, that the Planning Board give final approval for Lots
2 through 14, Block 2, and Lots 2 through 12, Block 1, in the Arthur
"Dutch" Prince St. Catherine Subdivision. These Lots constitute the
remaining.portions of said subdivision.
There being no further discussion, the Chair called for a vote.

PROPOSED SIGNS FOR BELL's GROCERY STORE ON THE ELMIRA ROAD
Mrs. Holcomb outlined the background on this matter. She said
that the plan here presented is the plan that was presented at the last
Planning Board Meeting, May 7, 1974. There were some questions raised
that required,a field report. Mr. Larry Fabbroni has written a report
on the two proposed signs. At the last meeting, it was decided:
1. Re the sign for the face of the building: The limitation in this
case is kqs .f The sign requested was too big.

2. Re the free standing sign. It falls within the requirements of the
Sign Ordinance, but it is the intent of the Ordinance to use the small-
est_sign possible to fit the needsof the particular location.and use:
J` Mrs. Holcomb read the report on the two signs from Mr. Fabbroni.
Referring to the free standing sign, Mrs. Holcomb stated at this point
that it would seem to be indicated by Mr. Fabbroni's report that because
of the site limitations 12" letters could be seen. She noted that the
Millbrook sign is 24' to the top. There followed a lengthy discussion
of 12" letters as opposed to 18" letters. Mr. Christopher felt very
strongly that 18" letters are absolutely necessary as a minimum and
pointed out that the proposed free standing sign is 48 sq.ft. which is
well below the 100 sq.ft. maximum allowed by the Sign Ordinance,
Mr. Christianson stated that he felt that the Elmira Road area
where the grocery store is to be located will continue to grow and
there will be strip development. Eventually there will be one sign
after another trying to outdo each other. The basic intent of the Sign
Ordinance was to -keep a.little sense of conformity and thereby produce
less vistal clutter.
Mr. Bell wondered if he had come in with a request for a sign
of say 80 sq.ft. which would be 800 of the maximum allowable - would
the Board have reduced it to 48%.
Mrs. _Bell was concerned with the calculations of sight distance
since it was not know at that time where they were going to put the
sign. She,felt that discussion of the sign placement should be had
before a decision is made as to letter size.
Mrs. Holcomb stated that the placement of the sign would be
discussed later in this meeting.
Mr. Scannell said that he had no objection to the overall size
of the sign.
MOTION by Robert Scannell, seconded by Robert Christianson,
RESOLVED, that the Planning Board recommend to the Town Board
that the free-standing sign as presented, be approved with the provi-
sion that the letter size be reduced to.12". The sign as presented is.
6' x <<' and stands 20' from the ground to the top.
There being no further discussion, the Chair called for a vote.

REPORT ON ROAD AND TRAFFIC PROBLEMS IN NORTHEAST.
Mrs. Holcomb reported on a meeting this morning with the Town of
�( Ithaca, Village of Cayuga Heights, the Town of Lansing and the. County.
Each group had gone to their respective boards to discuss opening the
road proposed between Warren and Triphammer along the Town of Ithacae
Town of Lansing line. Each municipality sees this as a much larger
problem than this road alone. No one is ready to make a determination

A Meeting of the Town of Ithaca Planning Board was held in Town
Hall, 126 East Seneca Street, (second floor), Ithaca, N.Y., at 7:30 p.m'.,
on Tuesday, November 16, 1976.
PRESENT: Chairman Barbara Holcomb, Richard Black, Liese
Bronfenbrenner, Lawrence P.,Fabbroni (Planning Engineer/ Building
Inspector).
ALSO PRESENT Richard Leonardo, Mr. and Mrs. Thomas Bell, .Tom
Niederkorn.

INFORMAL DISCUSSION OF PROPOSED MODIFICATION OF LEONARDO SUBDIVISION,
DANBY READ.
Mr. Richard Leonardo was present and discussed the proposed
modification of the subdivision plan that the Planning Board approved
about four years ago. Ile showed the original plan and presented the
new modified plan. He noted that all of the lots have been enlarged.
A road has been moved 60' to the West and two more lots have been
added between Leonardo residence and Leona Street. He said that lot
#9 is impossible for building purposes and should be combined with lot
#8 to make one big lot. Lots #1, 2, and 3 remain the same and lots
#4, 5, 6, and 7 are changed. Leona Street has been changed and so
there is no access to the back lands. Lots #10 and 11 have been added.
Mr. Black felt -that there may a problem with lots #4, 5, 6, and
7 with sewer. The elevation drops 10 feet. He suggested that if the
house is set high enough, it should allow for gravity flow. Mr. Leonardo
appreciated the suggestion. Mr. Leonardo said that the back lands are
really undevelopable - they run right down into the Park.
Mr. Black said that he did not see any problems with the lots, but
was curious about the frontage on Lots #6 and 7. It was determined
that being on a corner, the lots would conform.
Mrs. Holcomb stated that the consensus is that Mr. Leonardo will
come back to the Board for a legal Public Hearing and that in the
meantime he will look again at lots #8 and 9. She noted that Mr.
Fabbroni has indicated that there is no problem with a single access
to the back land.
The Public Hearing was set for December 7, 1976.
INFORMAL DISCUSSION OF'THOMAS G. BELL PROPOSAL FOR SELF-SERVICE GASOLINE
ISLAND AT BELL'S CONVENIENCE FOODS, ELMIRA ROAD.
Mr. and Mrs. Bell were present and stated that they would like to
install a two -pump self-service gasoline island at their store on Route
13. Their plan was presented with their application for a building
permit. Ile said that the summer months comprise the majority of his
business. Ile said that they would realize a percentage of the product
sold from the oil company. He said it would be run on an inter-com
set up. He said that there will be a canopy over the top of the island

for weather. He said that there is easy access.

Mrs. Holcomb asked how many cars were originally approved for
parking? Mr. Bell said he thought 25. Mrs. Holcomb asked if this
proposal would impact his parking area: Mr. Bell said it would not
this is separate. Mrs. Holcomb requested that at the next Hearing when
there is a quorum Mr. Bell delineate the parking.
Mrs. Holcomb asked if there is a problem with zoning? Mr. Fabbroni
said there was no problem unless the Board knows something that:he does
not. He stated that he has been operating under the Zoning Board of
Appeals opinion that commercial is allowed in a light industrial zone.

INFORMAL DISCUSSION OF PROPOSED SUBDIVISION TO BE KNOWN AS DEFOREST PARK
DUBOIS ROAD.
Mr. Tom Niederkorn was present and offered the Board a site.plan
(preliminary) for DeForest Park dated October 28, 1976, Mr. Niederkorn
stated that no sewer or water lines serve the area. It is zoned R-30
residential. He noted that conventional planning just would not work
on the 97 acres of land. He said that they are proposing
it lots
of 2-1/4 acres up to 5 acres, the average being 3-1/2 acres. He
indicated,a looped road which has a steep grade of about 15%. The
project would be developed in stages. Lots 1, 21 31 41 18, 17, 16 would
be on a temporary hammerhead type road.
Mr. Black commented that it looks very nice. There followed a
lengthy discussion with the three Planning Board members and Mr. Fabbroni
making several suggestions which were very helpful to Mr. Niederkorn.
Mr. Niederkorn discussed an easement into the circle which would pro-
vide a second egress to the Niemi property for the distant future. Mr.
Niederkorn discussed an access permit for drainage ways and access to
streams.
Mr. Fabbroni wondered if in Phase 2 there would be an possibility
of coming in from Happy Lane which ends about.80' to 100' from the
boundary of Mr. VanEpps' land. Mr. Fabbroni commented that the lower
wooded part would make a nice park area. He noted that 100 of the
total land area is about 8 acres.
Mr. Niederkorn and the members of the Planning Board exchanged ideas
at some length and Mr. Niederkorn said he would work on these suggestions
and ideas and return to the Board in a more formal manner at a later
date.

meet to consider what their priorities are for recreational development
of that area. Mr. Fabbroni noted that as part of the Town's townwide
park plan it was considered that school grounds served the park require-
ments of that neighborhood. He said that these are substandard and
dangerous. The size is adequate but the surface is poor. Mr. Fabbroni
stated that the student could give 40 hours during recess periods and
roughly 10 hours a week during term sessions from basically the middle
of Decemberto the middle of April. Mr. Fabbroni said that he thought
the maximum expenditure for the Town would be about $300.00, but since
the maximum on the program is $800.00 it would definitely mean a maximum
expenditure of $400.00. Mr. Fabbroni stated that he is looking for a kind
of feeling of the Board in order to know how far to go down the -line with
this girl - Barbara Zimmerman. Mr. Fabbroni said that up to this time
he has been emphasizing -in-kind participation, as the Town's local share it
the proposed BOR project.
Mrs. Holcomb stated that Mr. Fabbroni is asking the Planning Board
to acknowledge the appropriateness of this student help for next semester.
She said that as far as she is concerned, she thinks that any help we can
get is good. Mr. Fabbroni commented that she is a very good girl.
Mr. Black stated that to his thinking $300.00 is a small amount for such
expertise. Mr. Aron agreed. Mrs. Holcomb stated that Mr. Fabbroni has
the blessing of the Planning Board to pursue this matter.
Turning to the new Town Barn, Mr. Fabbroni said that the cost is
about $30,000.00 over what was expected. They expect to execute about
$24,000.00 of change orders. Mr. Black asked what the total cost is.
Mr. Fabbroni said the total would be $190,000.00 for everything. Mr.
Black•asked how many bids were received. Mr. Fabbroni said the Town
received seven -general -bids with $151,000.00 as the base bid which was
./ $18,000.00 under the next closest bid. Mr. Aron asked if there was a
time penalty clause in -the bid. Mr. Fabbroni said .there was not but that
the Town stated their desired entry date into the building.

by the Chair at 8:00 p.m. Mrs. Holcomb presented for the record the Clerk'
Affidavit of Posting and Publication of said matter.

Mrs. Holcomb noted that the matter had been turned over to the Zoning
[ Board of Appeals for clarification at their last meeting, November 17, 1976.
In March of 1974 the Zoning Board had resolved that the Town of Ithaca -
'oning Board of Appeals interprets the present Zoning Ordinance to allow
•thin Light Industrial Districts any lawful use allowed in the more restric-
tive zones, with the exception of dwellings. i.e., the Zoning Board
specifically felt that the placing of a retail store in a Light Industrial
District was permitted. The Planning Board had requested the Zoning Board
again to review this resolution again at their November 17th meeting and
inform the Planning Board whether they meant any Light Industrial District
in the entire Town or just one particular one. Mr. Fabbroni reported that.
.the question had been raised at the Zoning Board meeting and the Zoning
Board reaffirmed their decision and -stated that they indeed meant the whole
Town wherever Light Industrial zoning exists.
Mr. Fabbroni presented new plans that Mr. Bell had delivered to him
on December 6, 1976. He indicated a site plan and a cross-section of the
dual -level pump area. Mr. Fabbroni also submitted Mr. Bell's addendum to
his original sign application asking for an additional 26.67 sq.ft, sign as a
changeable message sign on the same stanchion.
Mr. Black asked if this sign is within the limitations of the sign
ordinance. Mr. Fabbroni stated that it is well within it.
Mr. Bell indicated 20 parking spaces. Mr. Black asked if people can
negotiate this? Ile wondered if there was enough room. Mr. Fabbroni said
definitely.there is enough room for customers. Mr. Black felt that the
only problem might be the delivery truck.- Mr. Bell spoke to this and said
U'-hat they actually put in an imaginary island and it will definitely work.
. Henry Aron asked if there would be adequate lighting. Mr. Bell indicated
the mercury vapor lighting indicated on the plan. Mr. Black asked the size
of the canopy which Mr. Bell noted is 400 sq.ft. (201x201).
Mrs. Holcomb stated that when the Planning Board originally approved
this site plan access and egress was from Route 13. However, if a road is
constructed parallel to the highway, then there will be only one
entry from Route 13 instead of the two now existing. Mrs. Holcomb asked
if and when this happens will the site plan here presented still be
appropriate: Mr. Black stated definitely yes.
Mr. Aron noted that it is 100' from the road right of way to the pumps.
Mrs. Holcomb.asked for any questions or,comments from the floor. There
were none. Mrs. Holcomb asked for any further questions or comments from
the Planning Board members. There were none, except Mr. Black who stated
that the Bells have met all of the Planning Board questions and comments
from the November 16, 1976, meeting.

RESOLVED, that the Planning Board of the Town of Ithaca recommend and
hereby does recommend to the Town Board approval of the site plan as pre-

The Public Hearing in the above -noted matter was declared to be open by
(lie Chair. Mrs. Holcomb presented for the record the Clerk's Affidavit of
Posting and Publication of said matter.
Tor. Blatchlev stated that he did not care about a subdivision, he only
cared about selling two lots.
Mr. rabbroni stated that this matter refers to parts of tax parcel 6-
58-2-39.2 and that one of the parcels is near lot number 39.7 and one is
near lot number 40.
Mr. Black asked if Mr. Blatchley had subdivided his end lot. Mr.
Blatchley said that he had but it is not legally subdivided on a tax map.
It was noted that there are 6 lots along Honness Lane and 4 along Slater-
ville Road.
Mrs. Holcomb noted that one of the lots in question is in the right of
way of a proposed road into the subdivision from Honness Lane and one is
in the proposed road shown on the Highway Master Plan. Mr. Blatchley
agreed. He said that the 50' road is set aside for the Church.
Mr. Fabbroni stated that the biggest problem that he can see is what
the access to the backland is going to be. Mr. Blatchley indicated a
possibility from Honness Lane from the Hillside Missionary Alliance Church
and he spoke of 5 lots off Slaterville Road.. Mr. Blatchley stated that his
an is to put all of the land that is remaining up for sale.
Mr. Blatchley presented a map drawn by Carl Crandall dated April 7,
1969 which was approved by the Town Planning Board, Walter J. Schwan,
Chairman, on April 8, 1969.

Mr. Thomas Bell made presentation of his request for the
addition of a self-service gasoline operation, using plans and mar-_
No one appeared to speak for or against.:the proposed addi-
tion. Therefore, the Supervisor closed the heeding, and the Board
discussed the *utter further.
Tors. Holcomb reported that when Pell'5 was originally
approved the entrance.=as permitted on a temporary basist,. but if
there is any further commercial development south, then ,there will
be a continuation of the interior road to serve the property and
the existing exit would be closed.
Councilman McElwee asked if thers were any regulations as
far as New York State Building Code in relation to the location of
gasoline tanks with respect to distance from the buildings. Piro
Bell said the construction people said they were well within the
limits. Councilman McElwee recommended to r-ir. Bell that he should
be certain that he is legally c -within the iirlits or he might have a
Problem with the Fire Department.
The Planning Board has recommended this addition and it is
within the zoning requirements.
Motion by Supervisor Schwan, seconded by Councilman McElwee,
RESOLVED, that the Town Board of the Town of Ithaca hereby approves
the addition of a self-service gasoline operation at Bell's Con-
venience Foods Store on.Elmira Road, in accordance with plans sub-
mitted and presented by 1.r. Thomas Bell.
Unanimously carried.
r.r. Fabbroni noted that in connection with the addition of
the gasoline operation there is also a request for an increase in
the size of the changeable message sign. He asked the Board to
approve the larger sign which is still well within the 100 sq% fto
allowed.

Several weeks ago we discussed the window signs at

It appears to me that there may be a violation of
Sections 5.05-2, 5.05-3, and 5.05-5, Local Law #6-1980.
If there is a violation, you may apply for an advisory
decision to the Sign Review Board (Town Planning Board)
and an appeal to the Zoning Board of'Appeals.
I have enclosed a copy of Local Law #6-1980, a sign
permit application, and an appeal form for the Zoning
Board of Appeals.

them for seven years. We feel
they are
attractive as well as
serve useful
purposes: When lit during store
operation
hours,
customers
can easily tell
the store is open. During
daylight
hours, it
is hard to
see that the
inside lights are on, as there
is so much
reflection
off the
glass. The
signs are also eye-catching as
people drive
by.
Not everyone
sees the free
standing sign. So they also
serve the
purpose
of advertise-
ment.
We also feel that it is a well known and accepted practice that grocery
stores have advertisements in their windows and we feel that we are very
conservative in our display of window signs. We chose to use these
permanent -type signs rather than plaster the windows with large, weekly
sale type advertisements, which we understand are acceptable as long as
they are temporary. We feel that our signs are much neater appearing
than the weekly signs would be.
The front window area consists of six 6 foot x 6 foot window sections. The
area of the signs in question is approximately 29 square feet. See attached
sheet for sign measurements.

Each Board member present indicated that they were. Mr. May cited Sections
5.05-2, 5.05-3, and 5.05-5, of the Sign Law, as follows:
5.05-2 -- There shall be no more than 1 permanent window sign per window
and a maximum of 2 per enterprise.
5.05-3 -- The area of permanent window signs shall not exceed 25 per cent
of the area of the window or windows through which they are
visible, nor in any case exceed 4 square feet.
5.05-5 -- Exposed liminous tubing.or similar window signs shall consist of
one row only, the lettering not to exceed 6 inches in height and
three-quarters the window width.
After reviewing closely the pictures submitted, Mrs. Schultz stated
she would like to go and look at the premises again. Other members agreed
that they would like to do the same.
MOTION by Mr. Edward Mazza, seconded by Mrs. Carolyn Grigorov:
RESOLVED, that the matter of Sign Review in re signage at Bell's
Convenience Foods be and hereby is postponed until the next regular meeting
of the Board.
During discussion, Mr. Fabbroni stated that he would make the comment
that the comment had been made to him that, as one looks at the store,• it
is very difficult to know if the store is open in the daytime and that
these neon signs lit up in the windows give some sign of life inside:.
Mr. May said that he.thought the Board members should look at it.

REPORT OF THE COUNTY PLANNING BOARD CHAIRPERSON, TOWN COUNCILWOMAN SHIRLEY
RAFFENSPERGER.
Mrs. Raffensperger reported that the County Planning Board met last
Wednesday, September 9th, and received a report from Becky Bilderback of
Better Housing for Tompkins County Inc. in re rural rehabilitation --
no, suburban rehab. She stated that Ms. Bilderback spoke of grants for
planning money only, the program thus not being comparable to the City of
Ithaca rehabilition program. Mrs. Raffensperger suggested that this Board
might possibly wish.to contact ,that organization, Ms. Bilderback being at
the E.O.C. office, to see what parts of the Town are available for planning
assistance and rehabilitation. Mrs. Raffensperger commented that the Town
does have areas where some re-hab might be used, and added that very few
people know of this program. The Chair directed the Secretary to contact
Ms.•Bilderback for information on this program, such as, criteria, type of
assistance that is being provided.

down on the slab which is in place in the outdoors.
Mr. Baker commented that there are several trees and it is very hard to
see his building at all.

"BETTER HOUSING FOR TOMPKINS COUNTY, INC."
At 8:30 p.m., Chairman May welcomed Mrs. Bilderback to the Meeting of
the P11anning Board and thanked her for coming.
Mrs. Bilderback stated that "Better Housing for Tompkins County, Inc."
is formed out of the Economic Opportunity Corporation (E.O.C.). She stated
that they applied for the rural preservation combination funds which was a
new New York State program last winter. She described the program as requir-
ing that it be a non-profit private corporation on which no public officials
may sit which, therefore, eliminated. E.O.C., and so "Better Housing for
Tompkins County, Inc." was formed out of E.O.C. She stated that they are
tied as closely as possible to E.O.C. with 50% of the officers from the
E.O.C. Board. She noted that it will be a separate corporation.
Mrs. Bilderback described the current involvement with E.O.C. housing
programs such.as "weatherization", "CHORES", "Section 8" which is an existing
program of rental assistance and under which 18 units of modern rehab is
taking place, and which involves the upgrading of units through

Mr. Fabbroni indicated that the Planning Board had asked that Mr.
Thomas Bell come to the Planning Board and discuss what he wants to do
with the "ice box" located on his property,
Mr. Bell appeared before the Board and stated that the "structure"
was behind the building. He stated that there is no physical room inside
the store to store ice, e.g,,, on the 4th of July he sells between 4,000 and
5,000 lbs. of ice. Mr. Bell stated that it -does look ugly, he admitted,
but, he plans.to skirt it in in the spring. Mr. Bell stated that the
propane sign is down now and that they could also take off the block ice
sign. He stated that they have all their own. ice making equipment,
Mr. Aron asked if the "ice box" will'not still look like a discarded
truck without the wheels? Mr. Bell replied that it will not -- it will
look like an ice house like the one at Pete's, He stated that it is to
their advantage to keep the premises looking nice and they want to have it
look nice, Mr. Bell stated that the structure will be boxed in and the
wheel holes will not shows it will be painted; they can also put shrubs
around it.
Mrs. Bronfenbrenner wondered if it would be possible to have a sign,
Mr. Bell stated that a smaller sign that says "Ice" would be okay. The
sign is now 30 sq,ft. on a 16' building; it is 14' over -sized. Mr. Bell
passed around two 811x10" pictures of the area,
Mr. Bonnell noted that Mr. Bell is allowed to use the large free-
standing sign as a changeable message sign.
Mrs. Bronfenbrenner inquired -about Health Department requirements

been met noting that the ice is all bagged and properly stored.

Mr. Al Becker appeared before the Board to discuss the possibility
of a rezoning from R-30 to Business C a parcel with a 470' boundary at
601-603 Elmira Road. He stated that at this time the proposal involves
the development of one building, later being expanded out to a larger
building.. The proposal involves 1,728 sq. ft. of space.
Mr. Becker stated that Mr. Fabbroni has the plans and he had
another set with him. He stated that the purpose of the building and
the whole development is based around a sports retail complex. He
stated that he is opening a store of 900 sq. ft. not at this location.
He noted that the building is constructed of masonry.
Mr. Becker stated that the site plan is somewhat changed from what
was discussed with Mr. Fabbroni due to discussions with a neighbor.
He stated that the Beaujolais Restaurant is right across the street. He
stated that the building has been moved 180' northerly from.the site
plan presented because of the neighbor next door. The building is 77'
from the road right of way.
Mr. Becker stated that the residents of "Old Hundred" and Mr. Turco
have no opposition. He stated that Mr. Loran Marion has been contacted.
He stated that Mrs. Constance Cook will not help but will not fight it
in court; she owns. property in direct view of this. He stated that Mr.
Thomas Bell has no opposition. He said that Mr. Mancini is not

Mr. King cited Section 5.05-2 of the Town of Ithaca Sign Law in re
permanent window signs, as follows: "There shall be no more than 1 permanent
window sign per window and a maximum of 2 per enterprise."
Mr. King asked if the signs in question conform with the 1972 Sign
Ordinance, adding that, if so, the 1980 Sign Law does not permit the Town
to say that they cannot have them, and, maybe they are legal now.
Mr. Cartee stated that to his knowledge the signs were put in around
1976 or 1977 during the time when the Bells came before the Planning Board
and the Zoning -Board for a sign for the ice house.

Mr. Aron stated that to the best of his knowledge, the 1972 Sign
Ordinance did not address or cover window signs whatsoever and that is one
of the major items that the Planning Board was concerned with when it sat
down to talk about a new Sign Law. He stated that the 1980 Sign Law, thus,
addresses window signage specifically.
Mrs. Reuning stated that she thought the Board should first determine
if it has any right to determine what the Bells can do -- whether the signs
in question are non -conforming or not.
Mr. Aron stated that the Board can talk about that but what bothered
him the most is that the applicants are not present nor had they appeared
before the Planning Board.
Mr'. King commented that maybe they are exercising their consitutional
right to not appear before a body which has no jurisdiction and they may be
right.
Mr. Aron stated that that may be right but he felt very strongly about
compliance with ordinances where they apply. Mrs. Reuning.stated that she
agreed.
Mr. King stated that he questioned whether the Board has them properly
before it in the first place, adding that the signs have been there,
according to Mr. Bell's letter, for seven years. Mr. King stated that he
would like to have an opinion from the Town Counsel to.advise us if this
matter is properly before us at all -- whether this Board even has the power
to assert to require them to bring their signs into conformity with the
1980 Sign Law in view of the.fact that the signs existed before the 1980
Sign Law was adopted.

It was noted that the Planning Board members had received, with their
Agenda, a copy of the application for signage permit submitted by Thomas
A. Bell, dated September 3, 1981, such proposed signage comprising approxi-
mately 29 sq.ft., and such application being accompanied by two photographs
of such signage, the individual measurements of each sign involved in the
29 sq.ft.,.and a letter reading as follows:
"September 3, 1981
...Dear Mr. Cartee:
We are enclosing a Sign Application and Permit,_a check to cover the
application fee, as well as two photographs, in reference to our request
to obtain permission to keep the following signs in the front windows of
our business.establishment:
(1) illuminated, neon, hanging window signs
(2) metal "ice" sign leaning against window
(3) Deli Subs sign
We have had them for seven years. We feel they are attractive as well as
serve useful purposes: When lit during store operation hours, customers
can easily tell the store is open. During daylight hours, it is hard to
see that the inside lights are on, as there is so much reflection offfthe
glass. The signs are also eye-catching as people drive by. Not everyone
sees the free standing sign. So they also serve the purpose of advertise-
ment.
We also feel that it is a well known and accepted practice that grocery
stores have advertisements in their windows and we feel that we are very
conservative in our display of window signs. We chose to use these
permanent -type signs rather than plaster the windows with large, weekly
sale type advertisements, which we understand are acceptable as long as
they are temporary. We feel that our signs are much neater appearing
than the weekly signs would be.
The front window area consists of six 6 foot x 6 foot window sections. The
area of the signs in question is approximately 29 square feet. See attached
sheet for sign measurements.

5.05-2, 5.05-3, and 5.05-5, of the Sign Law, as follows:
5.05-2 -- There shall be no more than 1 permanent window sign per window
and a maximum of:2 per enterprise.
5.05-3 -- The area of permanent window signs shall not exceed 25 per cent
of the area of the window or windows through which they are
visible, nor in any case exceed 4 square feet.
5.05-5 -- Exposed liminous tubing or similar window signs shall consist of
one row only, the lettering not to exceed 6 inches in height and
three-quarters the window width.
After reviewing closely the pictures submitted, Mrs. Schultz stated
she would like to go and look at the premises again. Other members agreed
that they would like to do the same.

that the comment had been made to him that, as one looks at the store,: it
is very difficult.to know if the store is open in the daytime and that
these neon signs lit up in the windows give some sign of life inside.

RAFFENSPERGER,
Mrs. Raffensperger reported that the County Planning Board met last
Wednesday, September 9th, and received a report from Becky Bilderback of
Better Housing for Tompkins County In -c. in re rural rehabilitation --
not� suburban.rehab. She stated that Ms. Bilderback spoke of grants for
planning money only, the program thus not being comparable to t1,�. City of
Ithaca rehabilition program. Mrs. Raffensperger suggested that this Board
might possibly wish to contact that organization, Ms. Bilderback being at
the E.O.C. office, to see what parts of the Town are available for planning
assistance and rehabilitation. Mrs. Raffensperger commented that the Town
does have areas where some re-hab might be used, and added that very few
people know of this program. The Chair directed the Secretary to contact
Ms. Bilderback for information on this program, such as, criteria, type of
assistance that is being provided.
Mrs. Raffensperger reported that a report was received on the Warren
Road Improvement which was described as substantially completed.
