Zoning Board of Appeals of Town of Ithaca
June 18 , 1955
Rocco Lucente , Tom Mix , Applicants .
The meeting of the Zoning Board of Appeals of the Town of Ithaca
was held on June 18 , 1955 at S0 P. M. at the town barn . The meeting was
duly - publicized in the Ithaca Journal on June ll and 12 , 1955 • The
members present were : Elmer Phillips, chairman; Thomas Smith; William
Rolston; and Constance K . Eberhardt, secretary . Harry Gordon, town
zoning officer was . also present .
c. The chairman called the meeting to order and stated that the first
order of business was to consider the petition of Rocco P. Lucente for
permission to . build upon - two 97 foot lots ; lots should have 100 foot
frontage under section 9 of the zoning ordinance . The lots . in question
are at 304 Tareyton Road. ( lots 2 and 16 on the Map of Extension No . 1
of Muriel Street Subdivision - October 12 , 1954 Carl Crandall ) .
After hearing testimony of the applicant and after discussion, the
board , upon motion dUy made and seconded, unanimously adopted the
f ollowi.ng re solution:
WHEREAS, because of _the topography of the area no other layout would
be feasible ; the lots have greater depth or width than required by the

ordinance ; the failure to meet the standards of the ordinance is not
significant being only three feet ; and

WHEREAS, no objections have been expressed to the board and in view

of the above stated facts there are practical difficulties and an unnessary
hardship in carrying out the strict letter of Section 9 of the Zoning
Ordinance ; and
WHEREAS, the variance applied for is in . general accord with the
spirit of the ordinance , the public safety and welfare will be served
and substantial -justice will be done -if said variance is granted, and
consideration having -been given to the. promotion of the_ health, safety,
morals and general welfare of the community, be it
RESOLVED, that the application be approved as long as circumstances are
the same and layout same as approved by the County Health Department and
an order , to said effect shall be entered in the office of the town clerk .
The application of Tom Dtx to erect a sigh which had been discussed at
the June lath meeting was considered again and the board , upon motion duly
made and seconded, unanimously adopted the following resolution :
WHEREAS , the sign is more attractive than the one which blew dom
and it is not" exceedinly large ; and
WHEREAS, there are practical difficulties and an unnecessary hardship in
carrying out the strict letter of Section 4 (74 ) of the Zoning Ordinance ; and
WHEREAS, the variance applied for is in general accord with the spirit
of the ordinance , the public. safety and welfare will be served and`
substantial justice will be done if said variance is granted , and consideration
having been given to the promotion of the health, safety, morals and general
welfare of the community, be it
RESOLVED, that the variance applied for be and is hereby granted and an
order to said effect . shal.l be entered in the office of the town clerk .
There being no other business , the meeting was adjourned .

GRANTING
ROCCO P . LUCENTE Do
to vary the requirements of the V) K) VARIANCE
Zoning Ordinance of the Town of Ithaca .
An application in the above matter for a variance having been
presented by ROCCO' P . LUCENTE to the Zoning Board of Appeals of the Town of
Ithaca and a hearing by the said board having been duly held at the time and
place stated above , after published notice and consideration having been given
to the promotion of the health, safety, morals or general welfare of the
community in harmony with the general purpose and intent of the zoning ordin -
ance of the Town of Ithaca and it having been resolved and determined following
such hearing that there are practical difficulties or unnecessary hardship
in the way of carrying out the strict letter of the said ordinance and that
the spirit of the ordinance shall be observed and public safety and welfare
secured and substantial justice done by the entry of this order , it is hereby
ORDERED that the variance applied for with respect to Section 9
of the town zoning ordinance be granted .
