January 8, 2024

1. Swearing in of Town Board Members
Ms. Gutenberger was sworn in as a new Member of the Town Board.
Mr. Howe, Mr. DePaolo and Ms. Bleiwas were sworn in as Town Board Members and Town
Supervisor respectively.
2. Call to Order and Pledge of Allegiance — 5:36 p.m.
Mr. Howe noted that most of the resolutions/actions this evening are the standard organizational
actions and need no introduction or summary and if any member had a question, to please say so.
3. Consider Reappointment of Town Officials
TB Resolution 2024 - 001: Reappointment of Town Officials
Resolved that the Town Board hereby reappoints the following Town Officials for a term
continuing until the 1st day of January next succeeding the next biennial Town election to wit,
January 1, 2026:
Highway Superintendent — Joe Slater
Receiver of Taxes — Deborah Kelley
Deputy Receiver of Taxes — Donna Shaw
Town Clerk — Paulette Rosa
Town Engineer — Dan Thaete
Marriage Officers — Rod Howe and Paulette Rosa

4. Persons to be Heard
Mr. Zaharis spoke against the Carrowmoor land solar array, expressing concerns about fire

concerns with lightning strikes and hazardous smoke from those, contamination by copper wires
underground and scenic blight and more.
He also did not think a for -profit company should be receiving any type of PILOT from the
Town or the County. He spoke at the TCAD public hearing this afternoon and repeated his
concerns.
Mr. Zaharis said he was surprised to hear that the Planning Board had already approved the
project and submitted a document listing citations to support his concerns.

Mr. Howe stated that the Town does not make any decision regarding the PILOTS granted by
TCAD.
5. Public hearing regarding a proposed local law, Authorizing a monetary gift to the City
of Ithaca to support Cass and Stewart Park recreational facilities
Mr. DePaolo asked if we had concrete numbers for participation and benefits received by our
residents.
Ms. Shaw responded that we generally do not get those until the 2nd quarter, but our estimates
have been accurate in the past and the terminology used is "approximately."
TB Resolution 2024 - 002: Adoption of Local Law 1 of 2024, "Authorizing a monetary gift
to the City of Ithaca to support Cass Park and Stewart Park recreational facilities
Whereas, the Town Board adopted a budget for 2024 including an amount of $1.00,000.00 for a
contribution towards City Parks, of which approximately $62,000 would result in a special benefit
to Town residents, but the remainder would be considered a gift, and
Whereas, pursuant to the Town's New York State Municipal Home Rule powers, a local law may
be adopted to authorize the Town to make a gift to another municipality where the gift furthers a
public purpose of the Town, and
Whereas, a public hearing was duly advertised and held on. January 8, 2024, and all persons
interested permitted an opportunity to speak on behalf of or in opposition to the proposed local
law, and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval of the local law is a Type Il action because it constitutes "routine or continuing agency
administration and management, not including new programs or major reordering of priorities that
may affect the environment," and therefore this action is not subject to review under SEQRA, now
therefore be it

1.0. Consider approval of the Highway Expenditures Agreement
TB Resolution 2024 — 010: ALIproval of 2024 Agreement for Expenditure of Highway
Monies
Resolved that the Town Board of the Town of Ithaca approves the following Agreement with the
Highway Superintendent of the Town of Ithaca for 2024:
AGREEMENT between the Town Highway Superintendent of the Town of Ithaca, Tompkins
County, New York, and the undersigned members of the Town Board.
Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and

collected in the Town for the repair and improvement of highways, and received from the State
for State Aid for the repair and improvement of highways, shall be expended as follows:

GENERAL REPAIRS. The sum of $265,000 shall be set aside to be expended for primary
work and general repairs of town highways, including sluices, culverts, pavement markings,
guiderails, surface treating and bridges having a span of less than five feet and walks or the
renewals thereof.
PERMANENT IMPROVEMENTS. The sum of $250,000 shall be set aside to be expended
for the permanent improvement of town highways, including paving, guide rails, etc.
1. The sum of $115,000 shall be set aside to be expended for the permanent improvement of
Ridgecrest Road to re-establish shoulders, mill asphalt, and install an asphalt overly on
0.57 miles of road
2. The sum of $553,000 shall be set aside to be expended for the permanent improvement of
the Elm Street Extension to re-establish shoulders, mill asphalt, and install an asphalt
overly on 1.57 miles of road
3. The sum of $447,000 shall be set aside to be expended for the permanent improvement of
King Road West (from approximately #333 King Road W. to Sandbank Rd.) to re-
establish shoulders, mill asphalt, and install an asphalt overly on 0.98 miles of road
4. The sum of $30,000 shall be set aside to be expended for the permanent improvement of
Holly Creek Lane to re-establish shoulders, mill asphalt, and install an asphalt overly on
0.18 miles of road
The sum of $87,000 shall be set aside to be expended for the permanent improvement of
Larissa Lane & Schickel Road to re-establish shoulders, mill asphalt, and install an
asphalt overly on 0.55 miles of road
6. The sum of $52,000 shall be set aside to be expended for the permanent improvement of
Glenside Road to re-establish shoulders, mill asphalt, and install an asphalt overly on
0.20 miles of road
7. The sum of $116,000 shall be set aside to be expended for the permanent improvement of
Coy Glen Road to re-establish shoulders, mill asphalt, and install an asphalt overly on
0.72 miles of road

TB Resolution 2024 - 008: Authorizing Certain Expenditures by the Superintendent of
Highways without Prior Town Board Approval
Whereas, Section 142, Subdivision- 1(a) of the New York Highway Law authorizes the Town
Board to adopt a resolution permitting the Town Superintendent of Highways to purchase
equipment, tools and implements without prior approval of the Town Board in an amount or
amounts to be fixed by it from time to time; and
Whereas, the Town Board adopted a 2024 Ithaca Town Budget which included monies for the
purchase of vehicles, tools and equipment; and
Whereas, it is determined by this Board to be reasonable and proper and in the best interests of
the efficient functioning of the Public Works Department that the Town Superintendent of
Highways be granted permission to purchase such items without its prior approval in amounts
not to exceed the approved respective budgeted amounts; now therefore be it
Resolved, that the governing Town Board of the Town of Ithaca does hereby authorize the Town
Superintendent of Highways to spend amounts, not to exceed what is identified within the
adopted 2024 Ithaca Town Budget, without the prior approval of this Board, for the purchase
during fiscal year 2024 of vehicles, tools and equipment to be used for highway maintenance,
construction, reconstruction, and/or snow removal; except when the lowest responsive and
responsible bidder is not selected and be it further
Resolved, that the authorization hereinabove granted shall be construed as meaning that the total
amount spent on each item purchased by the Town Highway Superintendent during fiscal year
2024 shall not exceed the respective budgeted amount for that item in the adopted 2024 Town of
Ithaca budget.

TB Resolution 2024 - 009: Annual Approval of Certain Town Policies, Manuals and Plans
Whereas the Town Board reviews certain policies and procedures at its Organizational Meeting
as required by the Town of Ithaca Code or at direction of the Town Board, and
Whereas the Board Protocol Manual, Ethics Disclosure Form and Distribution List, Procurement,
Cash Management and Investment, Debt Management, Electronic Banking, Fund Balance,
Procurement, Green Fleet, Green Procurement Policies and the Emergency Preparedness Plan
and Town Protocol and Procedures Manual have been submitted to the Town Board for review,
now therefore be it
Resolved, the Ithaca Town Board hereby accepts, approves, and affirms the above listed policies,

13. Consider authorization of the submission of an application for a NYS Transportation
Alternatives Program (TAP) Grant for the East Shore Drive Bicycle and Pedestrian
Safety Corridor Project
TB Resolution 2024 -07 : Authorizing the submission of an application for a NYS
Transportation Alternatives Program (TAP) Grant for the East Shore Drive Bicycle and
Pedestrian Safety Corridor Project.
Whereas, the Town Board of the Town of Ithaca after due consideration, has determined
that it is desirable and in the public interest to submit a grant application under the NYS
Transportation Alternatives Program (TAP); and
Whereas, the Project shall be titled "East Shore Drive Bicycle and Pedestrian Safety
Corridor"(Project); and
Whereas, the Project will improve the safety for pedestrians and bicyclists, linking existing
multi -use trail infrastructure on approximately 700' of East Shore Drive (NYS-34) between
Boynton Middle School (N. Cayuga Street) and the Ithaca Youth Bureau (James L. Gibbs Dr.)
on this key corridor providing an important link to Stewart Park and the Cayuga Waterfront Trail
for walkers, joggers, and cyclists of all ages and from various City of Ithaca neighborhoods, as
well as nearby Town of Ithaca and Village of Cayuga Heights neighborhoods; and
Whereas, the total project cost is estimated to be one million and four hundred and thirty-three
thousand dollars ($1,433,000.00) intended to cover the design and construction with
reimbursement expected at the ratio of 80% grant funds and 20% local match; and
Whereas, The Town Board acknowledges that, if the grant is awarded, the Town of Ithaca will
pay in the first instance 1.00% of the cost of Engineering, ROW and Construction work for the
Project or portions thereof, with the understanding that qualified costs may be eligible for grant
reimbursement; and
Resolved, the Town Board of the Town of Ithaca hereby authorizes the submission of an
application for a NYS Transportation Alternatives Program (TAP) Grant and authorizes the
Supervisor, or his designee, to execute all related documents for this submission, and be it further
Resolved, the Town of Ithaca is committed to completing the Project as per the project
schedule provided in the application and will comply with all federal and state regulations.

Mr. flowc reported that the LISPS has already notified us they would like to renew for the next
terra of 5 years. The rate increase per year is built into the leas.
Reminder to let Ms. Rosa know if you intend to go to the A01" meeting in NYC as soon as
possible.
Mr. DePaolo asked about, the PILOT the gentleman spokeabout, Mr. Howe responded that the
WAD agency held a public hearing here at'Town Hall today and the same man spoke. Ile said
the Town has very little control over any PILOTS granted by the TCAD, and theTown recently
passed legislation regarding PILOTS for solar farms, and he WoUld get more information for the
next meeting.
