AT a meeting of the Zoning Board of Appeals of the Town of Ithaca, County of Tompkins, State of New York, held on Buttermilk Falls Road in said Town on June 25, 19580 DENYING VARIANCE An application in the above matter for a variance having been presented by KNIGHT PAVING COMPANY to the Zoning Board of Appeals of the Town of Ithaca and a hearing by the said board having been duly held at the time and place stated above, after published notice and consideration having been given to the promotion of the health, safety morals or general welfare of the community in harmony with the general purpose and intent of the zoning ordinance of the Town of Ithaca and it having been resolved and determined following such hearing that there were no practical difficulties or unnecessary hardships in the way of carrying out the strict letter of the said ordinance, it is hereby ORDERED that the variance applied for with respect to Sections 4 and 21 of the town zoning ordinance be denied. GRANTING VARIANCE An application in the above matter for a variance having been presented by Knight's Paving Company to the Zoning Board of Appeals of the Town of Ithaca and a hearing by the said board having been duly held at the time and place stated above, after published notice and consideration having been given to the promotion of the health, safety, morals or general welfare of the community in harmony with the general purpose and intent of the zoning ordinance of the Town of Ithaca and it having been resolved and determined following such hearing that there are practical difficulties or unnecessary hardship in the way of carrying out the strict letter of the said ordinance and that the spirit of the ordinance shall be observed and public safety and welfare secured and substantial justice done by the entry of this order, be it hereby ORDERED that the variance applied for with respect to the application to erect a building be granted. Y� Minutes of Meeting _ of Zoning Board of Appeals of the Town of Ithaca June 25, 1958. _ gnight Paving Company - Applicant. The meeting `of the Zoning Board of- Appeals of the Town of Ithaca was held on June 25, 1958 at 5:15 P. M. in the garage of David Powers on Buttermilk Falls Road as advertised.in the Ithaca Journal. Members present were: David Powers; Robert Powers; Aldua Fogelsanger. The acting chairman Aldus Fogeleanger called the meeting to order and stated that the purpose cif the meeting was to consider the petition of Knight Paving Company to erect an 8 x 12 building. After discussion the board unanimously adopted the following resolution, upon motion -duly made and seconded: WHEREAS the foundations -were in prior to October 1954 _..- and in view of the above stated facts there are practical difficulties and an unnecessary hardship in carrying,out --� the strict letter of the ordinance and WHEREAS thevariance applied for is in general accord with the spirit of the ordinance and the•public will; safety and welfare be served -and substantial justice will be done if said variance is granted, be it RESOLVED that the variance applied for be and is hereby, granted and an order to said effect shall be entered,in the office of the Town Clerk. The second item of business was the appeal of the Knight .Paving Company -for a permit to erect a'4000 gallon tank in addition to'those existing, which would be a variance of 'Sections 4 and 21 of the zoning ordinance. After discussion from the neighbors in the area and the attorney for the applicant William'Easton, Esq.,'the board unanimously adopted the following resolution, upon - motion duly made and seconded: WHEREAS there have been objections expressed to the board by various neighbors and there would be no practical f 65 66- difficulties or unnecessary hardship and the spirit of the ordinance had not been observed nor had public safety and welfare been secured -and substantial justice had not been done if said variance is granted and consideration having been given to the promotion of the health, safety, morals .and -general .welfare =of the community, be it RESOLVED, that the --variance applied for be and is A hereby denied and an order to said effect shall be entered in the office: of the Town Clerk. Ellison, General Manager J A vNv�9� March 3, 19 58 Mr. Ben Boynton Zoning Officer Town of Ithaca Ithaca, New York Dear Ben: I enclose petitions from 96 residents of the area affected by the industrial operations of the Knight Paviag Company asking that the request of that company for approval of expansion of its activities in the residential zone be denied. The people of the area appreciate this opportunity to make their reactions known to the Board of Zoning Appeals. They trust that the Board will take firm action in this matter, in the interest of protecting the value of residential property on both side of the city line and making it possible for the area to grow as a desirable residential zone. Boynton 120 Snydr.dill Road Ithaca, New York March 5, i i 1958 I Dear Mr. Boynton: The invasion'ofA a residential area by industry reduces the desirability of the area for resiand reduces its residential value. The establishment and expansion of the eght Paving Company on Vine Street'in the tom of Ithaca is an example of this down grading process. This business which has expanded its opera- tion without compliance'with existing laws has already depreciated the;,desirability of the residential properties in the area. Recent expansion which included the construction of several large tanks and the addition of more trucks have multiplied the already existing problems. Further expansion will certainly result in further depreciation of the area and reduction of property values. The Bryant Park Civic Association asks that the Town of Ithaca Zoning Advisory Board, the Town of Ithaca Planning Board, and the Ithaca Town Board develop a pro- gram which will protect this fine residential area from ruination through the invasion of industry. We urge: 1. That the request of the Knight Paving Company for reclassification of their properties as industrial be denied. I 2. That the request of the Knight Paving Company for approval of past ex- pansion in violation of existing zoning ordinances be denied. 3. That no further industrial expansion be granted to any business or in- dustry operating in this area. I 4. That no new industries be permitted to set up operation in the area. 5. That existing industries be encouraged to transfer their operations to industrial areas. 6. That any industry which does continue its established operat area be urged with the strongest measures possible to improve ance of its grounds and facilities and to reduce to the minim nuisance factors of noise, odors, and of waste products or ru as the oil seepage which runs down the gutters and comes into through strom sewers during simmer rains, rns in the the appear - m the .- off such basements Page Two- Mr. Ben Boynton- March 5, 1958 The many residents who live in this area paid high prices for their proper- ties. A price which included some important intangible factors. They could have purchased houses for -much less next to the city dump, the railroad tracks, or next to a factory. An industry which is noisy, unsightly, and gives off undesirable odors can move all of these undesirable features into the residential area and rob it of these important values. The question might justly be asked --Who then reinburses the residents for�this loss in value? It is our belief that one of the important features of zoning is�to prevent this kind of thing from occuring. We urge your careful consideration of all the factors and of the long range effects of the decisions regarding the issues at hand. Sincerely, William W.
