1) Call to Order and Pledge of Allegiance — 5:31p.m.
2) Persons to be Heard and Board Comments
Madelaine Spellman, spoke, saying that she was a Quaker and felt that every life was important
and asking the Town Board to support a call for a cease fire in the Israeli/Palestinian war.
3) Consider setting a public hearing regarding renewal of a contract with the Cayuga
Height Fire Department for emergency response and fire protection services
Mr. Howe noted that the final version of the contract will be in the next packet for the Board.
TB Resolution 2023 -1.85: Set a public hearing regarding a 3-year renewal of the contract
with the Village of Cayuga Heights Fire Department for emergency response and fire
protection for the Northeast portion of the Town outside of the Village
Resolved that the Town Board will hold a public hearing regarding a 3-year renewal of the
contract with the Village of Cayuga Heights Fire Department for Various Emergency Responses
and Fire Protection Services on Wednesday, December 27, 2023 at 11:00 am at which time all
persons wishing to be comment on the proposed contract will be heard.

4) Consider authorization awarding PWF Garage Door Opener(s) Contract subject to
Permissive Referendum
Mr. Slater described the project, saying that the new openers would increase safety with better
sensors and efficiency by having timers to close the doors when necessary.
TB Resolution 2023 -1.86: Authorization to award and execute agreement for Garage Door
Opener Replacement Services, Subject to Permissive Referendum

Whereas on November 22, 2023, the Town of Ithaca Director of Public Works (Director)
received proposals for the Garage Door Opener Replacement Services for the replacement of 7
commercial jackshaft garage door openers due to the existing openers being near their end of life
and safety features are no longer operational; and
Whereas pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval, construction and implementation of the Garage Door Opener Replacement Services is
a Type II Action because the Action constitutes "replacement, rehabilitation or reconstruction of
a structure or facility, in kind, on the same site," and thus the Project is not subject to review
under SEQRA; and
Whereas the Director reviewed the proposals and determined that the lowest, qualified contractor's
proposal of twenty-three thousand six hundred forty-four dollars and zero cents ($23,644.00) for
the work was made by Martin's Door Service LLC, 1116 Route 5 & 20 Geneva NY 14456, now
therefore be it
Resolved that the Director is authorized to approve change orders to said contract, not to exceed
$5,000 in aggregate, upon receipt of appropriate justification, and be it further
Resolved that the Town Board authorizes the Town Supervisor to award and execute an
agreement for the Garage Door Opener Replacement Services to Martin's Door Service LLC,
with a cost not to exceed twenty-eight thousand six hundred forty-four dollars and zero cents
($28,644.00), and subject to a permissive referendum pursuant to the provisions of Town Law
§220(2); and be it further
Resolved, that pursuant to Town Law §90 and §91, within ten (10) days from the date of this
resolution, the Town Clerk, in the same manner as provided for notice of a special election, shall
post and publish a notice which shall set forth the date of adoption of this resolution, shall
contain such resolution or an abstract of such resolution concisely setting forth the purpose and
effect thereof, shall specify that this resolution was adopted subject to a permissive referendum;
and shall publish such notice in the Ithaca Journal, a newspaper published in Tompkins County
having general circulation in the Town, and in addition thereto that the Town Clerk shall post or
cause to be posted on the sign -board of the Town, a copy of such notice within ten (10) days
after the date of adoption of this resolution.

5) Consider approval of, and authorization for Supervisor to sign a sewer easement
associated with 257 Coddington Road
Mr. Thaete noted that these easements or lack thereof come up every so often and there is no
compensation being given in exchange, just access for the existing sewer line. This is usually

found when someone comes to hook up to the sewer line and we discover there is no easement
on file.
TB Resolution 2023-187: Approval of and authorization to execute sanitary sewer easement
associated with the 257 Coddington Road.
Whereas, Alexander T. Estabrook and Amanda Asrelsky ("Applicants"), have installed a new
sewer lateral for the purposes of servicing a single-family residential home at 257 Coddington
Road, tax parcel number 53.-1-2, and
Whereas, upon review of this project, it was determined that no easement of record exists over the
Town of Ithaca owned sewer utility at this location, and
Whereas, the town has requested the applicant provide a sanitary sewer easement, over the town
owned utilities, prior to the Certificate of Compliance for the installation of improvements at this
location so as to protect and provide the necessary level of service at this location, and
Whereas, the sewer lateral and associated easements are shown on the drawing titled "Town of
Ithaca, Sanitary Sewer Easement 257 Coddington Rd" sheet V 100, dated 11 /20/2023, prepared by
Town of Ithaca, and
Whereas, the Engineering Department has reviewed the plans for the above improvement that is
proposed to be dedicated to the Town, and have found them generally acceptable, and request the
easements be sent to the Town Board for further discussion and consideration, now therefore be it
Resolved, that the Town of Ithaca Town Board hereby approves the Permanent Sewer Easement
and Right -of Way from Alexander T. Estabrook and Amanda Asrelsky, and authorizes the Town
Supervisor to execute the easement, subject to the following conditions:
1. The approval of the easement and authorization for execution by the Town Supervisor
is subject to the approval of the Attorney for the Town.
2. The specific surveyed and/or mapped location, deed , and abstract showing good
and marketable title for the proposed improvements and for the easement is submitted
in a form acceptable to the Attorney for the Town of Ithaca and Town of Ithaca Director
of Engineering, and prior to Town Supervisor execution of the easement.

6) Consider Sewer Exemption Requests:
Ms. Bleiwas asked if there is a certain level that is determined to be a hardship.
Mr. Thaete responded that we are a town -wide benefit system but the system is not town -wide,
and therefore people are required to hook up to our system unless there are extreme

circumstances. We are beginning to look at developing some parameters to make it easier for
people to go through this process, for example, if you are more than 500' feet from a sewer main
and building a single family home, can the Town Engineer grant the variance rather than going
through this process.
Mr. DePaolo asked whether or not there would be some kind of evaluation when it is a new build
that would need installation of a new septic system and those associated costs vs the cost of
hooking up to the existing system.
If we are using sewer availability as a growth -limiting factor, yet granting exemptions to anyone
who asks, that is not very limiting.
Mr. Howe noted that in each of the following cases, the Tompkins County Health Department
has approved the request and system to be installed.
TB Resolution 2023 - 188: Authorization for the Town Engineer to issue a Sewer
Exemption for 430 Bostwick Road
Whereas the Town Engineer received a request for a Sewer Exemption from Paul Carpenter
("contractor") on behalf of the owner(s) of 430 Bostwick Road B indicating there is no access to
town sewer and identifying the difficulties associated with connecting to municipal sewer due to
the nearest sewer main(s) being approximately 7200+/- feet away, which would require a main
extension at an estimated cost of $1,444,000, and
Whereas the current owners are replacing an existing septic system that has failed on the
property and the Tompkins County Health Department has designed and approved a septic
system for the existing home, now therefore be it
Resolved, pursuant to Town Code Section 21.4-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons
conveyed by town staff and the reasons detailed in the request for a sewer exemption submitted
to the Town Engineer, dated November 27t', 2023, and be it further
Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from Town
Code Section 21.4-5 Connection required, for 430 Bostwick Rd, for the installation of a new,
onsite wastewater treatment system associated with the existing single-family residence, subject
to the consent of the Tompkins County Health Department.

TB Resolution 2023 - 189: Authorization for the Town Engineer to issue a Sewer
Exemption for 171 Calkins Road
Whereas the Town Engineer received a request for a Sewer Exemption from the current owner,
J. Crispin Brotherton, of 171 Calkins Road indicating there is no access to town sewer and

identifying the difficulties associated with connecting to municipal sewer due to the nearest
sewer main(s) being approximately 2200+/- feet away, which would require a main extension at
an estimated cost of $660,000, and
Whereas the current owners are replacing an existing septic system that has failed on the
property and the Tompkins County Health Department has approved a septic system for the
existing home, now therefore be it
Resolved, pursuant to Town Code Section 21.4-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons
conveyed by town staff and the reasons detailed in the request for a sewer exemption submitted
to the Town Engineer, dated November 20, 2023, and be it further
Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from Town
Code Section 21.4-5 Connection required, for 171 Calkins Road, for the installation of a new,
onsite wastewater treatment system associated with a proposed new single-family residence,
subject to the consent of the Tompkins County Health Department.

TB Resolution 2023 - 190: Authorization for the Town Engineer to issue a Sewer
Exemption for 213 King Road West
Whereas the Town Engineer received a request for a Sewer Exemption from the future owner(s)
of 213 King Road West indicating there is no access to town sewer and identifying the
difficulties associated with connecting to municipal sewer due to the nearest sewer main(s) being
approximately 1500+/- feet away, which would require a main extension at an estimated cost of
$450,000, and
Whereas the future owners are constructing a single-family home on the property and the
Tompkins County Health Department has designed and approved a septic system for the
proposed home, now therefore be it
Resolved, pursuant to Town Code Section 21.4-6, the Town Board finds the applicant has shown
unusual and extreme practical difficulties in connecting to municipal sewer for the reasons
conveyed by town staff and the reasons detailed in the request for a sewer exemption submitted
to the Town Engineer, dated November 20, 2023, and be it further
Resolved, that the Town Board authorizes the Town Engineer to issue an exemption from Town
Code Section 21.4-5 Connection required, for 21.3 King Road West, for the installation of a new,
onsite wastewater treatment system associated with a proposed new single-family residence,
subject to the consent of the Tompkins County Health Department.

7) Consider approval and adoption of the Town of Ithaca Streetlight Policy
Mr. DePaolo stated the resolution is self-explanatory; this is not to dictate lighting outcomes in
new developments, subdivisions, and things of that nature, but rather an attempt to set
parameters for when residents or groups of residents/property owners who may want to make a
change to a light or request additional lighting, etc.
TB Resolution 2023 -191: Approval of a Town of Ithaca Streetlight Policy, where the
provisions of the Complete Streets Policy are not applicable
Whereas, the Town of Ithaca recognizes the importance of lighting for the safety of multi -modal
traffic in publicly traversed rights -of -way, and
Whereas, the Town also recognizes the need to exercise discretion in the placement and quality of
lighting to minimize excessive luminance and energy consumption, and
Whereas, the Town understands the need to enable a process by which members of the public can
request the installation, removal, relocation or modification of streetlights in areas where the
Town's Complete Streets Policy is not applicable, and
Whereas, the Public Works Committee, in coordination with Planning, Engineering, and Highway
Department staff, has overseen the development of, and reviewed, the Town of Ithaca Streetlight
Policy, and
Whereas, Town staff has created and identified guidance and technical materials to aid in public
understanding of the policy and in the review of applications, now therefore be it
Resolved that the Town Board hereby approves the Streetlight Policy, effective January 1, 2024.

8) Consider actions associated with the Town's Deer Management Program for 2024:
Mr. Smith gave an overview, saying that we have gone with the focused approach rather than
spreading the sites out. The site on South Hill and the Northwest area will not be used this year
and we are adding two additional sites, one on Slaterville Rd with local hunters requesting it, and
the Pine Tree Wildlife Preserve.
The rest of the material is the same as in the past.
Ms. Bleiwas asked why the numbers were down last year.
Mr. Smith responded that we are not sure, but it could have been due to the mild winter.

TB Resolution 2023 - 192: Authorization to Submit a Deer Damage Permit Application to
the NYS Department of Environmental Conservation for 2024
Whereas, in May 2017, the Town of Ithaca Conservation Board presented a report (titled "Deer
Management: Recommended Actions for the Town of Ithaca") to the Ithaca Town Board
regarding the overabundance of White-tailed deer in the Town of Ithaca; and
Whereas, this report outlined the history and justification of deer management (health and human
safety, ecological, agricultural losses, car -deer collisions, NYSDEC Deer Management Focus
Area), provided a review of local deer management programs in Tompkins County (Village of
Trumansburg, Cornell University, Village of Cayuga Heights, Village of Lansing), and provided
recommendations for a potential Town of Ithaca deer management program (form sub-
committee, utilize NYSDEC Deer Damage Permits for a Town program, measure impacts of
deer to asses effectiveness of program, coordinate efforts with adjacent municipalities and
Cornell University, etc.); and
Whereas, in September 2017 the Ithaca Town Board established a Deer Management Committee
which met several times in spring and summer 2018 and held a public meeting in May 2018
seeking feedback on the report and the potential of starting a deer management program, with the
feedback received being very positive; and
Whereas, pursuant to the New York State Environmental Quality Review Act ("SEQRA") and
its implementing regulations at 6 NYCRR Part 61.7, the establishment of this Deer Management
Program and submission of annual Deer Damage Permit applications is an Unlisted Action for
which the Town of Ithaca Town Board, acting as lead agency in an uncoordinated environmental
review with respect to these actions, has, on February 11, 2019 , made a negative environmental
determination of significance, after having reviewed and accepted as adequate a Short
Environmental Assessment Form Parts 1, 2 and 3; and
Whereas, the Town has previously applied for and received Deer Damage Permits from
NYSDEC (2019 — 3 locations and harvested 1 deer; 2020 — 6 locations and harvested 20 deer;
2021 — 9 locations and harvested 42 deer; 2022 — 9 locations and harvested 40 deer; 2023 - 9
locations and harvested 1.7 deer);
Now, therefore, be it
Resolved, that the Supervisor of the Town of Ithaca, is hereby authorized and directed to file a
new Deer Damage Permit application with NYS Department of Environmental Conservation for
activities in 2024, including any associated future documents, forms, or reports.

TB Resolution 2023 -193: Authorization to Sign a License Agreement with the City of
Ithaca for use of the Six Mile Creek Natural Area Property as part of the Town's Deer
Management Program for 2024

Whereas, the Town of Ithaca will be applying for a Deer Damage Permit from NYS Department
of Environmental Conservation for deer culling; and
Whereas, Town of Ithaca and City of Ithaca staff have identified three locations on City of Ithaca
owned lands in the Six Mile Creek Natural Area for the deer program; and
Whereas, the City of Ithaca has participated in the program the past four years and wish to
continue with using three locations on City of Ithaca owned lands in 2024; and
Whereas, a "Revocable License to Authorize Town Use of Six Mile Creek Natural Area
Property" has been prepared;
Now, therefore, be it
Resolved, that the Supervisor of the Town of Ithaca, is hereby authorized and directed to
negotiate and sign an agreement with the City of Ithaca for use of the Six Mile Creek Natural
Area as part of the Town's deer management program for 2024.

Variance for Culver-Glenside-Pine Tree Preserves
Mr. DePaolo asked about the 24/7 access and whether there are signs indicating this is
happening.
Mr. Smith responded that the application says 24/7 but the Town limits the hours to 1-hour
before dusk through 1-hour past dawn at Town -owned sites and yes, there are signs out at all
sites.
Mr. DePaolo stated that these are "wildlife preserves" and deer are wildlife so he can't support
this at the preserves.
TB Resolution 2023 - 194: Granting a variance from the Town of Ithaca Code, Chapter 200
"Parks & Recreation Areas" to allow Culver Road Preserve, Glenside Preserve, and Pine
Tree Wildlife Preserve to be used in the Town's 2024 Deer Management Program
Whereas, the Town of Ithaca Deer Management Program is requesting a variance from Town
Code Sections 200-3.A and 200-5.E to allow the Town Deer Management Program to operate a
bait/culling site on the Culver Road Preserve (Tax Parcel No.'s 31.-1-14.2, 31.-1-14.4, and 32.-1-
7), the Glenside Preserve (Tax Parcel No. 30.-1-1.3), and the Pine Tree Wildlife Preserve (Tax
Parcel No. 57.-1-11.1.3), which, if granted, would permit participants to be on the three Preserves
during normally closed hours and to possess and discharge firearms and/or archery equipment
(compound bow or crossbow), and

Whereas, the Town of Ithaca Deer Management Program is requesting a variance from Town
Code Sections 200-3.A and 200-5.E to allow the Town Deer Management Program to park and
access Tutelo Park (Tax Parcel No. 31.4-6.1) and East Ithaca Nature Preserve (Tax Parcel No.
57.-1-11.12), which, if granted, would permit participants to be on the two properties during
normally closed hours and to possess archery equipment (compound bow or crossbow), and
Whereas, the Town's Deer Management Program has been operating for the past Eve years on
private property and City and Town of Ithaca owned properties throughout the Town of Ithaca,
and
Whereas, a variance was granted by the Town Board to use the Culver Road Preserve in 2022
and 2023 and the Glenside Preserve in 2023 for the deer management program, and
Whereas, the Town's Culver Road Preserve (155 acres in total, 96 acres in the three tax parcels
listed above), Glenside Preserve (7 acres) and Pine Tree Wildlife Preserve (14 acres) presents an
opportunity for the town to support and actively participate in the deer management program for
the many reasons described in the Conservation Board's report, but especially the potential
ecological benefits, and
Whereas, the Town Board has discussed the request and determined that good cause exists for
another time -limited variance, now therefore be it
Resolved, that the Town Board grants a variance to the Town's Deer Management Program from
Town of Ithaca Code Sections 200-3.A "General Regulations" and 200-5.E "Prohibited
Activities" to allow participants to be on the Culver Road Preserve, Glenside Preserve and Pine
Tree Wildlife Preserve during normal closed hours (24 hours per day) and to allow participants
to possess and discharge firearms and/or archery equipment as part of the Town Deer
Management Program, and to allow participants to be on Tutelo Park and East Ithaca Nature
Preserve during normally closed hours (24 hours per day) and to allow participants to possess
archery equipment as part of the Town's Deer Management Program, with the following
conditions:
1. Program participants must adhere to all DEC regulations related to culling activities
contained in the Deer Damage Permit issued to the Town of Ithaca, and
2. This variance is valid February 1, 2024 through March 31, 2024, 1 hour prior to sunset
through 1 hour after sunrise, and
With the following Endings:
The Town Board Ends good cause to grant this variance. The benefit to the Town's Deer
Management Program outweighs the detriment that would result from strict enforcement
of Chapter 200, and

2. The Culver Road Preserve is approximately 155 acres (96 acres in portion requested to be
used), the Glenside Preserve is approximately 7 acres, and the Pine Tree Wildlife
Preserve is approximately 14 acres, all with adequate space to operate a bait site, and
3. Using the Town owned Culver Road Preserve, Glenside Preserve, and Pine Tree Wildlife
Preserve will support the Town's Deer Management Program and will help to reduce
deer browse on Town natural lands, and
4. Using the Town owned Tutelo Park and East Ithaca Nature Preserve will allow
participants to retrieve deer if necessary and to access the adjacent properties being used
in the program easier.

TB Resolution 2023 -195d: Approval of Collective Bargaining Agreement with the
United Auto Workers for Southern Cayuga Lake Intermunicipal Water Commission's
Employees for 2024-2026
Whereas, the Southern Cayuga Lake Intermunicipal Water Commission, in good faith, entered into
contract negotiations with the United Auto Workers union for a renewed collective bargaining
agreement for the contract that expires on December 31, 2023: and
Whereas, on December 4, 2023, the Commission's negotiating team reached tentative agreement
with the union's negotiating team; and
Whereas, the Commission reviewed and approved the tentative agreement at the December 7,
2023, Commission meeting; and
Whereas, on December 11, 2023, the employees in the union bargaining unit ratified the tentative
agreement; and
Whereas, the Town of Ithaca Town Board has reviewed the tentative agreement and determined it
to be acceptable as required by the contract and the Public Employees Relation Board; now,
therefore, be it

Resolved, the Town of Ithaca Town Board does hereby approve the tentative collective bargaining
agreement between the Commission and UAW unit; and, be it further
Resolved, the Town of Ithaca Town Board authorizes the Commission's negotiating team to sign
said contract as presented.

Resolved, that this Town Board authorizes and directs the Town Finance Officer to record all
budget transfers, amendments, and modifications, including all other changes deemed
appropriate and necessary.
1.0) Report of Town Committees
Mr. Howe reported that the Economic Development Committee met and focused on some of the
proposed activity in the Inlet Valley District and Overlay District; TCCOG met and the County
is voting on a County -Wide Rapid Response Team and we will be finding out more information
on that soon and the impacts to the Town; they are also looking at the Building Code
Administration and Operation Study and he didn't think much would be changing for the Town,
adding that we have already been a good partner, working with nearby towns to help with
inspections when they needed help, there was an update on the County -wide Trail Strategy

Report and Mr. Goodman added that people were very happy to hear about the acquisition of the
Becker property for the lower end ofthe'Frail, and finally, began discussing the level of interest
in installing C!ounty-wide charging stations where we indicated we WOLI]d be in support of that
initiative.
Mr. Howe also reported that Gary Stewart, Cornell Government COMMUnity Relati(mis Director
is stepping down at the end ofthe month and we certainly wish him Nvell.
