Board Members Present: Rod Howe, Supervisor; Members Eric Levine, Rich DePaolo, Bill

Staff Present: Judy Drake, Director of Human Resources; Marry Moseley, Director of Code
Enforcement; CJ Randall, Director of Planning; Paulette Rosa, Town Clerk; Joe Slater, Director
of Public Works; Donna Shaw, Director of Finance; and Dan Thaete, Director of Engineering
1. Call to order and Pledge of Allegiance — Mr. Howe opened the meeting at 5:30 p.m.
2. Persons to be heard and Board Comments — None
3. Consider approval and authorization for the Supervisor to sign:

a. Barton & Loguidice, D.P.C. contract for East Shore Drive Pedestrian and
Bicyclist Safety Corridor Project Feasibility Study
TB Resolution 2023 - 106: Authorization to Award Contract for East Shore Drive
Pedestrian and Bicyclist Safety Corridor Project Feasibility Study
Whereas on. October 27, 2022, then -Director of Planning (Director) received a proposal from
Barton & Loguidice (B&L) for Professional Engineering Services to conduct a feasibility study
(Study) to improve the safety for pedestrians and bicyclists and develop designs for
approximately 700' feet of East Shore Drive (NYS-34) between Boynton Middle School (N.
Cayuga Street) and the Ithaca Youth Bureau (James L. Gibbs Dr.), and
Whereas the Study will advance the multiyear Capital Improvement Plan project and the Better
Bike Network's Key Project Al: Build NY Route 13 Underpass Shared -Use Trail, and
Whereas B&L has adequately outlined related work experience, project objectives, and scope of
services that meet and/or exceed our expectations, and
Whereas the current Director of Planning and Director of Engineering, respectively, have
reviewed the updated July 6, 2023, proposal and qualifications of B&L and recommend approval
by the Town Board for the Study, not to exceed $39,500, and
Whereas in accordance with 6 NYCRR Section 617.5(c)(27), State Environmental Quality
Review, the Study is classified as Type II Action and not subject to environmental review, now,
therefore be it

Resolved that the Town Board approves the proposal for the East Shore Drive Pedestrian and
Bicyclist Safety Corridor Project Feasibility Study as submitted and authorizes the Town
Supervisor to execute said contract, subject to the review by the Attorney for the Town.

TB Resolution 2023 - 107: Authorization to Award Contract for Professional Surveying
Services — Highway Boundary Topographic Survey and Mapping along a section of East
Shore Drive (SR 34) in the Town of Ithaca
Whereas on June 12, 2023, Director of Planning (Director) received a proposal from Erdman
Anthony (EA) for Professional Surveying Services to conduct Highway Boundary Topographic
Survey and Mapping along a section of East Shore Drive (SR 34) in the Town of Ithaca, and
Whereas the Highway Boundary Topographic Survey and Mapping will advance the multiyear
Capital Improvement Plan project and the Better Bike Network's Key Project A1: Build NY
Route 13 Underpass Shared -Use Trail, and
Whereas Erdman Anthony has adequately outlined related work experience, project objectives,
and scope of services that meet and/or exceed our expectations, and
Whereas the Director of Planning and Director of Engineering, respectively, have reviewed the
proposal and qualifications of Erdman Anthony and recommend approval by the Town Board for
the Study, not to exceed $13,400, and
Whereas in accordance with 6 NYCRR Section 617.5(c)(27), State Environmental Quality
Review, the Study is classified as Type II Action and not subject to environmental review, now,
therefore be it
Resolved that the Town Board approves the proposal for the Professional Surveying Services —
Highway Boundary Topographic Survey and Mapping as submitted and authorizes the Town
Supervisor to execute said contract, subject to the review by the Attorney for the Town.

TB Resolution 2023 —1.08: Authorization to sign a letter of engagement with Chalifoux
Law, P.C., for services associated with securing easements related to the Forest Home
Pump Station Project.
Resolved that the Town Board approves the Letter of Engagement as submitted by Chalifoux
Law, P.C. for services associated with securing easements related to the Forest Home Pump
Station Project, in an amount not to exceed $5,000 and the Town Supervisor is authorized to
execute same.

d. Fahs Construction Group — Judd Falls Road Miscellaneous Repairs Project
TB Resolution 2023 - 109: Authorization to Award Contract for the 2023 Judd Falls Road
Miscellaneous Curbing, Sidewalk, and ADA Curb Ramp Repairs Project
Whereas the 2023 Town Budget included $300,000 for the rehabilitation of Judd Falls Road
pavement, curbing, and sidewalks; and
Whereas pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its
implementing regulations at 6 NYCRR Part 617, it has been determined by the Town Board that
approval, construction and implementation of the 2023 Judd Falls Road Miscellaneous Curbing,
Sidewalk, and ADA Curb Ramp Repairs Project (Project) is a Type II Action because the Action
constitutes "replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the
same site," and thus the Project is not subject to review under SEQRA; and
Whereas on June 30, 2023, the Director of Engineering (Director) received bids for the Project and
reviewed the bids and qualifications and determined the lowest responsive bid in the amount of
$98,580.00 was made by the lowest responsible bidder, Fahs Construction Group, Inc. 2224 Pierce
Creek Road, Binghamton, NY 13903; now, therefore be it
Resolved, that the Town Board authorizes the award of the contract for the Town of Ithaca 2023
Judd Falls Road Miscellaneous Curbing, Sidewalk, and ADA Curb Ramp Repairs Project to Fahs
Construction Group Inc.; and be it further
Resolved, that the Town Supervisor is authorized to execute such contract subject to approval of
the final contract documents by the Director and review by the Attorney for the Town; and be it
further
Resolved, that the Director is authorized to approve change orders to said contract without prior
authorization of this Board upon receipt of appropriate justification, provided the maximum
amount of such change orders shall not in the aggregate exceed $4929.00 (5% of bid price) and
that the total project cost, including contract, engineering, legal, inspection, and other expenses,
does not exceed the maximum authorized cost of $103,509 for the project.

4. Consider approval of a revised Fee Schedule
Mr. Moseley explained the research that went into the solar array fees and the new NYS
regulations adding multiple operating permits and various inspections that required adding a fee.
Mr. DePaolo had questions about the escrow aspect of the fees for solar and Mr. Moseley and
Ms. Randall explained that the escrow is used for professional services that may be required as
defined in the legislation and if there are funds left, they are returned and if there are more funds
needed, they are requested from the permit holder.
TB Resolution 2023 - 110: Approval of a revised Fee Schedule
Whereas the Personnel and Organization Committee periodically reviews the Town's Fee
Schedule and discusses any revisions and additions recommended by Staff, and
Whereas the revised Fee Schedule was reviewed at the July 1 Oth Committee meeting and
recommended to the Town Board for adoption, now, therefore be it
Resolved that the Town Board approves and adopts the revised Fee Schedule as submitted.
