Review of Correspondence MEETING OF THE ITHACA TOWN BOARD March 27, 2023 Board Members Present: Rod Howe, Supervisor; Members Eric Levine, Rich DePaolo, Bill Goodman, Pamela Bleiwas, and Rob Rosen Absent: Margaret Johnson Present: Judy Drake, Marty Moseley, CJ Randall, Paulette Rosa, Joe Slater, Donna Shaw, and Dan Thaete Mr. Howe opened the meeting at 4:30 p.m. 1. Consider award of the Public Works Facility Fueling Station Project TB Resolution 2023 - 059: Authorization to Award and Execute Construction Contract and Construction Phase Engineering Services for the Town of Ithaca Public Works Facility Fueling Station Project Whereas on. March 1.6, 2023, the Town of Ithaca Director of Engineering (Director) received bids for the Town of Ithaca Public Works Facility Fueling Station Project (the Improvement), for the removal and replacement of the Department of Public Works fleet fueling station, along with other work specified and indicated on the Contract Documents, and Whereas the Director has reviewed the bids, qualifications of the bidders, and the recommendation provided by Barton and Loguidice (project design engineer) and has determined that the lowest responsive bid of $610,075.00 for the project was made by the lowest responsive bidder, LaValley Bros Construction Inc., P.O. Box 208, Wolcott, NY, 1.4590, and Whereas, Barton and Loguidice, D.P.C. has provided a proposal totaling $44,252.50 for construction phase assistance and inspection services, and Whereas on February 13, 2023, the Town Board authorized and approved the Improvement, at a total cost not to exceed $825,000 subject to a permissive referendum pursuant to the provisions of Town Law §220, and Whereas the referendum period has expired, with no petitions against the Improvement being received, and therefore be it Resolved that the Town Board authorizes the award of the construction contract for the Town of Ithaca Public Works Facility Fueling Station Project to LaValley Bros Construction Inc. and authorizes the Town Supervisor to execute the contract, subject to final approval by the Director and review by the Attorney for the Town, and be it further, Resolved that the Director is authorized to approve change orders to said construction contract, not to exceed $61,000.00 in aggregate, upon receipt of appropriate justification, and be it further TB 2023-03-27 (Filed 4/4) Pg. 1 Resolved, that the Town Board approves and authorizes the Town Supervisor to execute a supplemental agreement for construction phase assistance and inspection services with Barton and Loguidice, D.P.C., not to exceed $44,252.50, subject to review by the Attorney for the Town. Consider approval of Fee Reduction Policy Mr. Howe noted that this is based upon the same process that the Board recently passed for water and sewer billing reduction requests and has been recommended by the Personnel and Organization Committee. TB Resolution 2023 - 060: Approval of Code Enforcement Department Fee Reduction Policy Whereas, the Personnel & Organization Committee has reviewed the draft Fee Reduction Policy and recommended its approval by the Town Board; now, therefore be it Resolved, the Town Board hereby approves the Code Enforcement Department Fee Reduction Policy as submitted, effective immediately. Consider a speed reduction request for Five Mile Dr. Mr. Howe noted that this is a big topic under discussion with the City and the State as Rte. 13a is a State Highway and a truck route and the Town, for its part, has received a petition and is involved in the discussions regarding mitigation options. TB Resolution 2023 — 061: Approval of a Speed Limit Reduction Request for New York State Route 1.3A also known as Five Mile Dr Whereas, the Ithaca Town Board, was issued a signature petition request from Town of Ithaca and City of Ithaca Residents that reside along the New York State Route 13A corridor, also known as Five Mile Drive, for a speed reduction, and Whereas, the excessive speeds, higher truck volumes, dangerous conditions for pedestrians and cyclists are some of the reasons for the request, and Whereas, the concerned residents have also stated since the last speed reduction request in March of 2019, in which New York State Department of Transportation denied the request, there was a bicyclist fatality reported in the City of Ithaca portion of NYS Route 13A, now therefore be it TB 2023-03-27 (Filed 4/4) Pg. 2 Resolved, that the Town Board of the Town of Ithaca requests the New York State Department of Transportation Traffic Safety Division to review and reduce the speed limit to 30 MPH on New York State Route 13A, between New York State Route 13 and the City of Ithaca municipal line. Consider setting a public hearing regarding an amendment to Town of Ithaca Code, Chapter 250-19 by adding a yield sign at the intersection of Calkins and Inlet Valley Dr. Mr. Howe noted that this is in support of efforts to mitigate issues with the intersection and has gone through the Public Works Committee. TB Resolution 2023 - 062: Set a public hearing regarding a local law amending Town of Ithaca Code, Chapter 250, Article III, entitled "Parking; Stop and Yield Intersections" to add the placement of a yield sign at the intersection of Calkins Rd and Inlet Valley Dr Resolved that the Town Board will hold a public hearing at its meeting on April 1.0, 2023, which begins at 5:30 p.m., at Town Hall, 215 N. Tioga St. on a proposed local law amending Town of Ithaca Code, Chapter 250, Article III, entitled "Parking; Stop and Yield Intersections" to add the placement of a yield sign at the intersection of Calkins Rd and Inlet Valley Dr., at which time all persons interested in addressing the Board on the proposed Local law will be heard. Committee Reports a) Budget — Town is in good shape and fund transferred were completed to meet our Fund Balance Policy. Sale tax revenue is over budget at this point. Discussed an additional financial institution. Discussed dissolving lighting districts, more to come. Discussed raising the minimum for senior tax exemption. b) Codes & Ordinances — February wrapped up the telecommunications ordinance recommending a setback of 300 feet from residences after looking at what other communities have done. Reviewed the other sections that have not been controversial as the small cell has been. Counsel is doing final review and research and may need a couple of meeting for the Board to review. c) Personnel and Organization/ERC — Discussed the draft Road Closure policy and the draft changes to the Volunteerism policy. Both should be forwarded to the Board soon. d) Planning — Discussed first application for the Commercial Historic Overlay District and asked some clarifying questions which the applicants will complete and return; recommended the Board move forward with appraisals for a couple of conservation easements. e) Public Works — Discussed the Calkins Rd/Inlet Valley Way intersection; reviewed the 13A petition; discussed cemetery water and sewer benefit assessment formula to begin drafting a policy; project update and May 6th event. f) Other/AdHoc • CWIO — Watershed manager busy with projects and prepping to reach out to municipalities for the next round of project support. Continue work on updating the Recreation Plan • SJC — Report on staffing issues and ways to move forward. 7. Hotchul has passed legislation adding a One -day marriage officiant license process to the Laws of NYS, Article 3, Section 11-D, now therefore be it Resolved that the Town Board approves the fee of $25 for the One -Day Marriage Officiant License to be processed and collected by the Town Clerk's Office. TB Resolution 2023 — 064d- Acknowledgement of Provisional Promotional Appointment of Administrative Assistant IV -PWD Whereas, there will be a vacancy in the position of Administrative Assistant IV due to a retirement on May 30, 2023; and Whereas, the Highway Superintendent with a selection committee has determined through interviews and evaluation that Becky Jordan, Deputy Town Clerk, possess the necessary knowledge, skills and ability to perform the duties of Administrative Assistant IV; and Whereas, the Highway Superintendent has chosen to promotionally appoint Becky Jordan to the Administrative Assistant IV position, effective May 21, 2023; now, therefore, be it Resolved, the Town Board of the Town of Ithaca does hereby acknowledge the Highway Superintendent's promotional provisional non-competitive appointment of Becky Jordan to the Administrative Assistant IV position, effective May 21, 2023; and be it further Resolved, this is a 40 hours a week position, at the hourly wage of $31.70, which is an estimated annual salary of $65,936, in Job Classification "D" step 1, with no change to full time benefits; and be it further Resolved, if the said successfully complete the non-competitive promotional civil service exam and the mandatory twenty-six (26) week probationary period there will be no further action required by the Town Board. TB Resolution No. 2023 — 064e: Approve Provisional Appointment of Administrative Assistant II -Codes TB 2023-03-27 (Filed 4/4) Pg. 12 Whereas there is a vacancy in the Administrative Assistant 1I position for the Code Enforcement Department due to a promotion; and Whereas the Interview Committee interviewed six candidates from an open recruitment for the position; and Whereas the Committee has determined that Emily Banwell possess the necessary knowledge and skills to satisfactorily perform the duties of the position; and Whereas Marty Moseley, Director of Code Enforcement, appointed Emily Banwell as Administrative Assistant I1, effective April 3, 2023; now, therefore be it Resolved the Town Board of the Town of Ithaca does hereby approve the provisional appointment of Emily Banwell as Administrative Assistant 11 for the Code Enforcement Department, effective April 3, 2023; and be it further Resolved the position is at 37.5 hours per week, at the hourly wage of $27.15, which is an estimated annual salary of $52,942 from B8010.100, in Job Classification `B", with full time benefits; and be it further Resolved, the said appointment is a provisional appointment pending the results from the next civil service exam for this position. TB Resolution 2023— 064f: Ratification of Town Clerk's Appointment of Deputy Town Clerk Whereas, there is presently a vacancy in the position of Deputy Town Clerk in the Town Clerk Department; and Whereas, the Interview Committee that consisted of Paulette Rosa, Town Clerk and Judy Drake, Human Resources Manager interviewed two candidates from the open recruitment; and Whereas, the Committee has determined that Ashley Colbert possesses the necessary knowledge and skills to satisfactorily perform the duties of the position and make the recommendation for appointment; now, therefore be it Whereas, Paulette Rosa, Town Clerk, appointed Emily Colbert to the regular Deputy Town Clerk position, effective April 10, 2023, now, therefore, be it Resolved, the Town Board of the Town of Ithaca does hereby acknowledge the appointment made by the Town Clerk, of Emily Colbert as a Deputy Town Clerk, effective, April 10, 2023; and be it further Resolved, the said position is in job classification "B" at 37.5 hours a week, at the hourly wage of $27.15 (hire rate), estimated annual wage of $52, 942, with full time benefits from account A1410.100; and be it further TB 2023-03-27 (Filed 4/4) Pg. 13 Resolved, a twenty-six (26) week probationary period applies with no further action by the Town Board if there is successful completion of the probationary period as determined by the Town Clerk, ITIMITTIMIN Me MUM1=1 Motion made by Rod Howe to enter executive session to discuss current gation regarding lighting on The Byway, seconded by Rich DePaolo, unanimous.
