A LOCAL LAW PERMITTING ALL BUT SELECTED OFFICERS OF THE TOWN
TO RESIDE OUTSIDE THE TOWN OF ITHACA
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1.Purpose.The Town of Ithaca wishes to obtain and retain the services of
qualified,capable persons,some of whom who may reside outside the Town limits.The Town
Board of the Town of Ithaca does not deem it necessary for certain officers of the Town to be
residents of the Town.Accordingly,this local law is intended to permit the appointment to most
positions in the Town of persons who may not necessarily be residents or electors of the Town
of Ithaca.
Section 2.Authority.This local law is adopted pursuant to the authority contained in
Section 10 1.(i)and,to the extent this local law supersedes the Town Law,Section 10 1.(ii)
d.(3)of the Municipal HomeRuleLaw.
Section 3.Supersession of Town Law and Public Officers Law.This local law,to the
extent inconsistent with same,shall supersede the provisions of Section 23 of the Town Law ^d
Section 3 of the Public Officers Law,and any other provisions of the Town Law or Public
Officers Law that are inconsistent with this local law and which may be superseded by local laws
enacted pursuant to the Municipal Home Rule Law sections cited above.
Section 4.Notwithstanding the provisions of Section 23 of the Town Law and Section
3 of the Public Officers Law,all elective officers,all members of the Planning Board,Board
of Appeals,and Assessment Review Board,the Receiver of Taxes and Assessments,the
Superintendent of Highways,the Town Clerk,and the Deputy Supervisor shall be electors of
the Town of Ithaca.All other town officers need not be electors of the Town,provided that
such persons reside in the State of New York.
Section 5.Invalidity.In the event that any portion of this law is declared invalid by a
court of competent jurisdiction,the validity of the remaining portions shall not be affected by
such declaration of invalidity.
Section6. EffectiveDate. This law shalltakeeffecttendays after itsenactmentor upon
the filing of same with the Secretary of State of the State of New York,whichever is later.
