Brief Description of Proposed Action:
The proposal involves subdividing 653 Elmira Road (Tax Parcel No. 35.-1-18) into two parcels: Parcel A, consisting of
2.6+/- acres and Parcel B, consisting of 45+/- acres. The purpose of the subdivision is to provide land for the future Black
Diamond Trail, a New York State recreational trail project that has been in development for over twenty years. The
resulting 45+/- acre parcel is largely undeveloped and is being purchased by the Town of Ithaca for eventual conveyance
to New York State Parks. The remaining 2.6+/- acre parcel contains a residence and additional structures and will be
retained by the current property owners. No development is proposed. The Town Board approved acquisition of the
property on February 13, 2023.

Part 3 Determination of Significance
For every question in Part 2 that was answered "moderate to large impact may occur", or if there is a need to explain why a
particular element of the proposed action may or will not result in a significant adverse environmental impact, please
complete Part 3. Part 3 should, in sufficient detail, identify the impact, including any measures or design elements that
have been included by the project sponsor to avoid or reduce impacts. Part 3 should also explain how the lead agency
determined that the impact may or will not be significant. Each potential impact should be assessed considering its setting,

The proposal to subdivide a 48+/- acre property into two parcels, for the purpose of providing land for the

endangered species, erosion, drainage, or flooding.
Parcel A will require a lot size variance because part of Parcel A is in the Conservation Zone, which has a
7-acre lot size minimum. No significant adverse environmental impact will occur as the planned use is for
passive recreation and protection of natural resources. Parcel A, at 2.6+/- acres in size, contains a residence
and several other structures that will be retained by the current property owners. No additional development
is expected on this parcel.
Parcel B, at 45+/- acres, is being purchased by the Town of Ithaca, for eventual conveyance to New York
State Parks, to facilitate the development of the future Black Diamond Trail. This land is adjacent to other
New York State Park lands and the Cayuga Inlet. Much of Parcel B is also located within a Tompkins County
Unique Natural Area (UNA-147, Cayuga Inlet Floodplain). With the exception of constructing future multi -use
trail and interpretive displays, Parcel B will remain undeveloped.
Regarding Part 1, question 12b: According to the NYS Office of Parks, Recreation and Historic Preservation
Cultural Resources Information System program, the property is located in an area that could be
archaeologically sensitive. However, per Cornell University's Digital Library database of aerial photos, the
property has been farmed in the past (based on 1938-1964 aerials), so it is presumed that any archaeological
resources would have been discovered with prior disturbances.
Regarding Part 1, question 13a: Parcel B contains the Cayuga Inlet, streams, and floodplains. The proposed
subdivision will facilitate the protection of these important resources. By subdividing the land, the Town of
Ithaca will become the owner of the undeveloped portion of the property and will manage the land for
passive recreation purposes and protection of its natural resources until such time that it is conveyed to

This letter acknowledges your referral of the proposed action identified above for review by the
Tompkins County Department of Planning and Sustainability pursuant to §239 -1, -m and -n of the New
York State General Municipal Law.
We have determined the proposed action will have a significant county -wide or inter -community impact.
Therefore, we recommend modification of the proposed action. If the decision -making body does not
incorporate the recommended modification, such approval will require a vote of a majority plus one of all
members of the decision -making body.
Recommended Modification
• We understand the intent of this subdivision is to convey Parcel B to public ownership and
protection. We recommend that this conveyance become a clear condition of the subdivision
approval by the Town. The purpose of this recommendation is to protect the important natural
resources found on Parcel B, which is largely located in a Special Flood Hazard Area and
includes portions of the Cayuga Inlet Floodplain UNA (UNA-147), a perennial stream, and
Palustrine Wetlands.
We look forward to receiving notification on the final action taken by your municipality within 30 days of
decision, as required by State law.
