Sincerely, State Records and Law Bureau (518) 473-2492 O'P 1Department 0fState LOCAL LAW NO.6 OF THE YEAR 2022 A LOCAL LAW ADDING SWIMMING POOL LOCATION REQUIREMENTS IN CHAPTER 270, ZONING, OF THE TOWN OF ITHACA CODE Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 270 (Zoning), Article VI (Agricultural Zones) of the Town of Ithaca Code, Section 270-32, titled "Yard regulations," is amended by adding a new Subsection A.6 reading as follows: "(6) Swimming pools. Private swimming pools allowed for one- or two-family dwellings or farms with dwellings per § 270-29.0 may not be located in a front yard, and must be at least 15 feet from any side lot line or rear lot line, as measured from the edge of the pool structure." Section 2. Chapter 270 (Zoning), Article VII (Lakefront Residential Zones) of the Town of Ithaca Code, Section 270-46, titled "Yard regulations," is amended by adding a new Subsection I reading as follows: 1. Swimming pools. Private swimming pools allowed for one- or two-family dwellings per § 270-43.13 may not be located in a front yard, must be at least 15 feet from any side lot line, and must comply with Subsection F's minimum setback from shoreline requirements. Setbacks shall be measured from the edge of the pool structure." Section 3. Chapter 270 (Zoning), Article VIII (Low Density Residential Zones) of the Town of Ithaca Code, Section 270-60, titled "Yard regulations," is amended by adding a new Subsection H reading as follows: "H. Swimming pools. Private swimming pools allowed for one- or two-family dwellings per § 270-56.13 may not be located in a front yard, and must be at least 15 feet from any side lot line or rear lot line, as measured from the edge of the pool structure." Section 4. Chapter 270 (Zoning), Article IX (Medium Density Residential Zones) of the Town of Ithaca Code, Section 270-71, titled "Yard regulations," is amended by adding a new Subsection H reading as follows: "H. Swimming pools. Private swimming pools allowed for one- or two-family dwellings per § 270-68.13 may not be located in a front yard, and must be at least 15 feet from any side lot line or rear lot line, as measured from the edge of the pool structure." Section 5. Chapter 270 (Zoning), Article X (High Density Residential Zones) of the Town of Ithaca Code, Section 270-82, titled "Yard regulations," is amended by adding a new Subsection H reading as follows: "H. Swimming pools. Private swimming pools allowed for one- or two-family dwellings per § 270-79.13 may not be located in a front yard, and must be at least 15 feet from any side lot line or rear lot line, as measured from the edge of the pool structure." Section 6. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 7. This local law shall take effect immediately upon its filing with the New York State Secretary of State. OA
