A LOCAL LAW ADDING AND REVISING ACCESSORY DWELLING UNIT DEFINITIONS
IN CHAPTER 270, ZONING, OF THE TOWN OF ITHACA CODE
Be it enacted by the Town Board of the Town of Ithaca as follows:
Section 1. Chapter 270 (Zoning), Article III (Terminology) of the Town of Ithaca Code,
Section 270-5, titled "Definitions," is amended by adding the following definition:
ACCESSORY DWELLING UNIT, ATTACHED
A dwelling unit that is physically attached or connected to a principal dwelling by means
of a permanent enclosed, conditioned (heated and/or cooled) area, or that shares at least
one wall with the principal dwelling unit.
Section 2. Chapter 270 (Zoning), Article III (Terminology) of the Town of Ithaca Code,
Section 270-5, titled "Definitions," is amended by deleting the definition for "Detached
Accessory Dwelling Unit" and adding the following definition for "Accessory Dwelling Unit,
Detached":
ACCESSORY DWELLING UNIT, DETACHED
An accessory dwelling unit that occupies part or all of a structure that is on the same lot
as a principal dwelling, and (b) does not meet the definition of Accessory Dwelling Unit,
Attached.
Section 3. In the event that any portion of this law is declared invalid by a court of
competent jurisdiction, the validity of the remaining portions shall not be affected by such
declaration of invalidity.
Section 4. This local law shall take effect immediately upon its filing with the New York
State Secretary of State.
