Board Members Present: Rod Howe, Supervisor; Members Eric Levine, Rich DePaolo, Bill
Goodman, Pamela Bleiwas, Rob Rosen and Margaret Johnson

1. Call to order and Pledge of Allegiance
2. Presentation of 2021 Audit—Tom Smith, EFPR
Mr. Howe introduced Mr. Smith, a member of our new auditing firm, EFPR
Mr. Smith gave an overview of the process or an audit and stated that the Town was issued a
Clean Unmodified Opinion, which is the highest opinion you can receive. He noted that
according to New York Accounting Auditing Standards, there is another report on the internal
controls and compliance with other state regulations. There was nothing to report and there is a
simple 2-page report at the end of the audit.
He highlighted pages 53-55 which shows the budget to actual expenditures for each of the major
funds and this is where you can see how the town stayed on track with what it budgeted and the
town did not overspend and the expenditures followed the budget. Another aspect we look at is
the budget adjustments, and there were none. That speaks to the hoe good the town's financial
team is.
Management letter is where we would put comments or recommendations and we did
recommend a new software for capital assets and a few other minor comments,but the Town is
incredibly well managed in this area.
There were no questions from the Board, but Ms. Shaw said it was a pleasure working with them
and especially getting the audit and reports done before beginning the next budget.
3. IFD—Chief Parson's presentation on Electric Fire Trucks (Attachment 1)
Chief Parsons and Deputy Chief Rob Covert
Chief Parsons went through a presentation outlining the goal and associated costs of transitioning
to electric powered fire apparatus. There are both hybrid and fully electric trucks.
Going through the presentation, of note is:

• Standard Internal Combustion Engine - $705K/Hybrid $1.4- $1.6M
• Renovations to the 3 fire stations to accommodate rapid chargers $1 M
• Estimated savings for Ithaca's busiest engine is $87K over 17 years
• Value is in greenhouse production, not monetary
• Takes time to build and deliver and will not meet the 2030 GND goal
• Timeline — 2023 1 heavy rescue +2 pumper trucks and station modifications $5.8M
2026 1 aerial truck $3.3M

Questions
Mr. Howe asked about grant funding for this type of project.
Chief Parsons said they are looking and the best scenario are offsets to cover the difference
between standard and electric costs. He does not see the prices coming down.
Mr. DePaolo asked about the warranty and the useful life expectancy of the battery is and the
replacement costs of the battery.
Chief Parsons responded that he only knows about his experience with the typical Toyota and
similar and he knows there are some out there with 10, 15 and more years on them.
Mr. DePaolo asked if the long-term plan as outlined take into effect inflation costs.
Chief Parsons responded that they are all in today's numbers. He is hopeful that the technology
will get better and eventually move to hydrogen fuel.
Mr. DePaolo asked if the involved parties are discussing the benefit of moving in this direction
versus taking this type of money and putting it elsewhere to meet our GND goals.
Chief Parsons responded that they are, and the challenge is that the resolution was written in
such a way as to assume that the technology will be available to us in 2025 and such and we are
not sure that is going to be the case, but we have to start somewhere.
Ms. Johnson said the possibilities are exciting. She asked about quantifying the estimates of
reduction in emissions.
Chief Parsons responded that he could probably get more bang for the buck to take that heavy
rescue and keep it standard motor and get better results from using that money towards a dump
truck or a loader. The Police Department actually uses the most fuel and produces the most
emissions so that, in his opinion, would be the place to start. Public works equipment is a heavy
producer,but the need to bring them back to the shop to recharge negates a lot of the benefits.

He is optimistic that technology will improve over the 10 years, and those that need to go back to
a base to recharge are not ideal for this right now,but in the future, a dense portable fuel will be
the answer.
Ms. Johnson asked about the size of the electric trucks and their maneuverability in that the
possibility of making roads more biker friendly is of great interest to her.
Chief Parsons responded that the pumper truck is narrower, but trucks are no wider than a bus,
but the ladder trucks are longer and that is the limiting factor in street design and maneuvering.
Mr. Howe thanked them for the presentation and added that the hope is that the costs will go
down over the years.

5. Public Hearings:
a. Noise permit application Mezey/Mitchell Wedding at RaNic
Mr. Howe opened the public hearing at 6:05 p.m. Mr. Howe noted that we did receive one email
in support of the event which was included in the packet. There was no one wishing to speak
and the hearing was closed.
Ms. Rosa stated that the applicants were hoping to make it tonight,but one is in construction and
the other in real estate and they are incredibly busy.
Mr. Goodman asked if we had heard from RaNic and what they plan to do in their plans for their
venue as far as noise permits. He also said the end time of 1 1pm is a little late and he would be
concerned if that were an every weekend occurrence.
Ms. Ritter said she has not heard anything from them.
Ms. Rosa stated that the applicants had put 11:00 p.m. down as a buffer in case there were any
type of delays,but the intention is to have cocktail hour and dinner music to start and the dancing
music would end by 1 Opm if on schedule. She added that the owner of RaNic and the events
manager emailed their permission to be the application holder/cosigners.
TB Resolution 2022 -098: Approval of a Noise Permit for a wedding at RaNic
Whereas the Town received a noise permit application from Gregory Mezey and Ryan Mitchell,
cosigned by RaNic for a band at their wedding ceremony and reception to be held on Saturday,
June 25th from 4:30 p.m. to 11:00 p.m., which includes a buffer on each end of the time frame to
cover any unexpected delays or similar with the main music planned to be between 6pm and
IOpm, and

Whereas a duly published public hearing was held on June 13, 2022, to hear all interested parties
on the application, now therefore be it
Resolved that the Town Board grants the applicants a noise permit, with the following :
Conditions
1. The speakers for the band will be faced toward the golf course and away from the homes,
and
2. No later than 11:00 p.m. with the following
Findings
1. The waiver from the requirements of Town Code Chapter 184 for the above music
event is necessary for a valid purpose, because music might not be able to conform at all
times to the requirements of Chapter 184, and wedding receptions generally include
amplified music, which is normal and not unusual in nature for a wedding venue, and
2. The waiver is the minimal intrusion needed,because the amplification is needed to for
weddings and such mitigating factors as the speakers will be facing the open golf course
and the nearest houses will have wedding guest staying in them, and
3. On balance, the need for and benefits of the waiver outweigh the needs and rights of
the surrounding neighbors to a peaceable and quiet environment, because the music is for
a limited amount of time on the specified date, with the above-listed conditions and other
findings mitigating the intrusion on the neighbors to the extent practicable.

b. Noise permit application—Ithaca Beer—June 18t'
Mr. Howe opened the public hearing at :61p.m. and noted that there are two parts to the draft
resolution; a date change for the previously approved Octoberfest due to a mistake on the
application and a new small event on June 18th that Ithaca Beer was not aware there was
entertainment associated with it at the time of booking.
Mr. Howe noted that the Town did receive an email around 5pm from Mr. Kopka, a lawyer
representing a couple of residents from the Peach Tree Ln area.
Rob Geiszler spoke, saying that he is going to be here at every public hearing because the
original ordinance that created Ithaca Beer calls for a limited number of small scale,
neighborhood oriented commercial areas that are located so as to meet present neighborhood
needs while not adversely affecting surrounding neighborhoods.
Over the years, the Board has been given extensive and uncontroverted evidence of the adverse
effects on the surrounding neighborhood by at least four neighbors, yet it has taken no action
whatsoever to enforce the terms of the ordinance to mitigate the adverse effects generated.

Mr. Geizler went on to say that the other part of the ordinance, section D three, says that the
operation of special events such as festivals and music series subject to the issuance of permits
are required. So, we can see that, if there are "special" events, it seems to me that the Board has
a very tenuous grasp on the English language. The word"special"within the context of the
ordinance has a meaning of being something other than usual or routine.
The initial application was for 23 concerts plus seven separate "special" events to be held from
April 23 and on and now we've added another one, so the total comes from 30 to 31 "special"
events. At what point do we cross the threshold from beings ordinary and routine to being
special? It seems to me the English language here speaks to this quite clearly.
There's nothing in the in the enabling ordinance that prohibits the board from refusing to issue
noise permits once the adverse effects come to the Board's attention.
There is no dispute that the concerts and special events have had adverse effects on the
surrounding neighborhood, none. The only information in front of the Board is that there have
been adverse effects, but still nothing has happened.
In the last few years,permits have been routinely granted. Since the first year of issuing permits,
there have been no attempts to contact affected neighbors other than the notices of the public
hearings; no discussions or mitigations.
There was one meeting in 2018,but that was it. Nothing more. The Board has had meetings with
Ithaca Beer, but not with us, and these are adverse effects.
Larry Salinger spoke, saying that the stated purpose of the noise ordinances is "to preserve the
public health, peace, comfort, repose, welfare, safety and good order by suppressing the making,
creation, or maintenance of existence of excessive, unnecessary, unnatural, or unusually loud
noises which are prolonged, unusual, or unnatural in their time,place and use or which are
detrimental to the environment."
It should be clear to everyone that the stated purpose of the town's noise ordinance has been
effectively ignored relative to the noise issues that continue to arise from Ithaca Beer Company's
repeated failure to conform to statutory requirements contained in the ordinance as well as the
terms and conditions contained in permits that the town board has granted.
The fact that Ithaca Beer Company cannot get its date straight, can't look for typos, doesn't know
what events have been booked or when, and can't seem to abide by the conditions imposed on it
as required by the noise permits that have been granted, suggested it knows that begging for
forgiveness is preferable to asking for permission, since the town board, based on past
performance, simply rolls over and gives in every time Ithaca Beer Company claims some error
or omission.
Somehow the board and Ithaca Beer Company have become so entangled with each other that
the Board has come to believe that the Town of Ithaca's very future depends upon Ithaca Beer

Company to run roughshod over the rights of peaceful, law abiding, taxpaying residents of the
town.
You are being played as dupes and patsy's by Ithaca Beer Company, and it is we who suffer the
consequences.
The Board is essentially ratifying the concept that exceptions to the law shall become the law,
and therefore have rendered the town's noise ordinance essentially meaningless.
Fortunately, there are other legal remedies available to us and we intend to pursue these remedies
as necessary in order to put a stop to these intrusions Thank you.
Ed Kopko, Attorney, spoke, saying firstly, that accounting report was just stellar and should be
publicized and you should be able to come up with the money for the fire trucks.
Secondly, he would like to ask members to read the legal points in his letter to the Board on
behalf of his clients as he believes the Town's own ordinance prohibits these types of serial
concerts and prohibits loud noise beyond a 25' foot radius. That is how the law is written, and
that is what is specifically contained in the letter, and you will see that the ordinances themselves
simply do not allow this.
Mr. Mitchell was asked to respond under the public hearing portion.
Mr. Mitchell said there was definitely a mistake in this year's application but he didn't think that
they have made it a habit of making mistakes and then asking for forgiveness.
He said that he thought that we had solved the problems with our weekly music on Wednesday
nights and it was with the advice from Mr. Geisler who talked about putting hay bales up and
trying to minimize the noise that that happened, and he thought we were having good
conversations about us being able to work better with the neighbors reduce the noise.
Mr. Mitchell said he has never heard that having some of the larger concerts during the year has
been an issue.
He did not feel like it's necessarily a pattern and he didn't think that our working with some of
the Town Board members has been very intimate but working on issues.
There has been concerned about the canned music and we have had Code Officers come out and
limit the level and we have had that exceeded that request and pointed the two speakers closest to
the neighbors down to the ground and when we did that, they stopped working and we haven't
even gotten them fixes.
Mr. Mitchell said he thinks he is doing what he can to try to appease the neighbors.
There was no one else wishing to speak and the hearing was closed.

Questions/determination
Mr. DePaolo commented that there's this impression on the part of some residents that the town
board is somehow doing anything and everything to disregard its own ordinances and curry favor
with Ithaca Beer, etc, etc, and I can just say, from my experience, having dealt with this now for
several years, the board has paid a great deal of attention to the correspondence to the situation
out there. Our code enforcement department has responded to complaints and the canned music
was turned down as a result of that.
We strongly urge mitigation for the Wednesday night music series that was implemented, and to
my understanding, relatively successfully.
There is a lot of attention being paid, and I think that the the purpose of the noise permit is to
balance the needs of the applicant and the affected parties, and I think we have always strived to
do that. We will continue to strive to do that.
He said that he does take some exception to references like dupes and patsy's and he thought if
you were to ask Mr. Mitchell, he would probably tell you that we're a royal pain in the ass, so I
think it's always a matter of perspective.
We are charged with the unenviable task of balancing disparate needs, and so I think that
whatever we end up doing is likely to not be seen as restrictive enough for the residents or
permissive enough for the applicant, and so we are kind of in a no-win situation.
Mr. Goodman stated that he went out there last Wednesday to listen to the canned music and
then realized I could hear the Wednesday music too. There were no hay bales as he had seen
previously, which was surprising, and he could clearly hear the noise of the band in the
neighborhood and it seemed louder than when the hay bales were being used.
He said he thinks Mr. Mitchell needs to really start looking at the idea of a portable band shell
and at this point, if having the live music is profitable enough that you want it to continue, you
need to start thinking about permanent mitigation measures.
Since that will take time, and this added event is a Saturday afternoon for 2 hours, I will support
that, but you need to start looking at permanent solutions.
Mr. Rosen said he went to Peach Tree Ln for the Wednesday music he could hear nothing,just
the birds, and when he went to Ithaca Beer, it was very busy with people and kids playing and
enjoying themselves and the music was playing; you could not hear anything of that on Peach
Tree Ln.
He said he was struck with the thought that there has got to be a way to have a sound engineer
look at this because Peach Tree is a long way away and there must be something to be done if
they are hearing this that far away.

Mr. Howe said he didn't think the hay bales have been used in a few years,but if we want, we
can ask Mr. Mitchell when the last time they were used was.

Whereas the Town received a request for a noise permit for an event on June 18, from Noon—
2pm associated with the Bikes and Beers national program, and
Whereas Mr. Mitchell was not aware music was a part of the package for the event until June 6th
and notified the Town to request a permit, and
Whereas Mr. Mitchell also noted an error in the previous application regarding the Annual
Hoptoberfest, which was listed as October 8th and is on October 15th, and
Whereas the Town Board waives the requirement of a public hearing for the change in date,
given that the change is months in advance and was listed in error, and
Whereas the Town Board held a properly advertised public hearing for the event on June 18,
2022, and included the notification of the change in date for October in the neighborhood notice,
now therefore be it
Resolved that the Town Board waives the need for an application on these changes/permit due to
the extenuating circumstances of a typographical error occurring on a previously approved
permit application and permit and the event coordinator not informing Ithaca Beer that music
was a standard part of the Bikes and Beers program, and be it further

6. Continue consideration of a noise permit for daily outdoor music at Ithaca Beer
Mr. Howe noted that there is no public hearing on this one as it was held last month and we
tabled it to give us the opportunity to go listen.
All Board members stated that they went to the Peach Tree Ln area and boundary and Ithaca
Beer and it was surprisingly inaudible at the boundary and then to Ithaca Beer where there were
plenty of people and the music was audible as background music and not intrusive.
Mr. DePaolo thanked Mr. Mitchell for working with the Town to establish a level. He added that
he felt the Board had done its due diligence in this and he did not think it was intrusive and he
considers himself sensitive to sound.
Mr. Rosen asked why a noise permit was needed when you can't hear it at the property line?
Mr. Howe responded that it is to be cautious because we have had concerns in the past.
Mr. DePaolo added that he didn't think it qualifies as the type of intrusion that needs to be
balanced with the criteria, but the applicant would rather be safe than sorry.
Mr. DePaolo added that the time granted to 9:30 is not an issue given it was not intrusive.
TB Resolution 2022 - 100: Approval of Noise Permit Application for daily music for the
lawn area
Whereas the Town received a request for a noise permit for daily piped music to the lawn area
during operations, and
Whereas a duly published public hearing was held on May 9th where the public was heard on the
request, and
Whereas the Town Board tabled the action to allow for members to visit the site when music is
playing outside to experience the impact on the neighboring community, now therefore be it
Resolved that the Town Board grants the appeal of Ithaca Beer, Dan Mitchell for a noise permit
on for daily music to the lawn area, with the following
Conditions
1. That music will be kept at a level that was arrived at between Ithaca Beer and Town Code
Enforcement last year, and
2. That music will be turned off to the outside area when there are no patrons outside, and
3. 11:30 a.m. - 9:30 p.m. and with the following
Findings:
1. The waiver from the requirements of Town Code Chapter 184 for the above music event
is necessary for a valid purpose, because music might not be able to conform at all times to

the requirements of Chapter 184, and Ithaca Beer's Planned Development Zone specifically
allows for music events, subject to or upon the issuance of any permits required (Town Code
§271-15.1)(3), and
2. The waiver is the minimal intrusion needed, because the amplification is needed to
provide dinner music to the area, no later than 11:30 a.m. through 9 p.m., which hours are
within "daytime hours" as defined by Town Code § 184-4; the entertainment is intended to
be background in nature and not overly intrusive, and
3. On balance, the need for and benefits of the waiver outweigh the needs and rights of the
surrounding neighbors to a peaceable and quiet environment, because the music is not
excessive or unusually loud, or unusual in nature or duration for this type of commercial
entity, with the above-listed limitations in place to minimize to the extent practicable, the
intrusion on the neighbors.

7. Consider authorization for an appraisal to be conducted on the proposed purchase of
real property

the property of George and Traci Sheldrake abutting the Town's Public Works Facility
Whereas the Town Board is interested in purchasing a strip of land abutting the Public Works
Facility from the Sheldrakes, and the next step is to get an appraisal, now therefore be it

licensed appraisal service, not to exceed $5,000, to continue the process and inform the Board

Whereas, on February 8, 2021, the Ithaca Town Board held a public hearing and subsequently
adopted a Public Interest Order authorizing the Town of Ithaca King Road East Water Main
Extension Water Improvement (the "Improvement") and the establishment of the Town of Ithaca
King Road East Water Main Extension Water Improvement Area ("Water Improvement Area"),
through TB Resolution 2021-019; and
Whereas, the notice of public hearing stated that the initially determined maximum estimated cost
to said Water Improvement Area was $1,050,000 and the adopted Public Interest Order stated that
the maximum amount proposed to be expended by the Town of Ithaca for the Improvement is
$1,050,000; and

Whereas, due to unforeseen road conditions, additional asphalt restoration will be needed in areas
within the project, and the cost of asphalt has increased due to the rise in oil prices; and
Whereas, no other changes are proposed to any aspect of the Improvement or Water Improvement
Area; and
Whereas, TB Resolution 2021-102 authorized the Director of Engineering to approve change
orders to the contract, without further authorization of this Board, provided that the maximum
amount of such change orders does not exceed $39,000.00 (approximately 3.86% of the awarded
bid of$1,011,000.00) in aggregate and the total project cost, including the contract, engineering,
legal and other expenses, does not exceed the maximum authorized cost of the project of
$1,050,000.00; and
Whereas, the Director of Engineering has approved change orders totaling $38,500.00 for asphalt
restoration, which does not leave an amount that will be adequate if additional unforeseen issues
are encountered; and
Whereas, the Director of Engineering is requesting additional funds to increase the project
construction contingency to an amount equal to 10% of the contract price, such amount would be
$101,100.00, an increase of $62,100.00 (approximately 6.14% of the awarded bid of
$1,011,000.00) such funds will be utilized for the asphalt remediation and if additional unforeseen
construction issues arise; and
Whereas, it is now desired to call a public hearing for the purpose of considering the increase in
the maximum amount to be expended by the Town of Ithaca from $1,050,000 to $1,112,100, and
to hear all persons interested in the subject thereof concerning the same, all in accordance with the
provisions of Section 209-q of the Town Law;
Now,therefore, it is hereby ordered,by the Town Board of the Town of Ithaca, Tompkins County,
New York, as follows:
Section 1. A public hearing shall be held by the Town Board of the Town of Ithaca, Tompkins
County,New York, at the Town Hall, 215 North Tioga Street, in Ithaca,New York, in said Town,
on the 27th day of June, 2022, at 4:30 o'clock P.M., Prevailing Time, to consider the aforesaid
increase in the maximum amount to be expended by the Town of Ithaca on the Improvement, and
to hear all persons interested in the subject thereof concerning the same and to take such action
thereon as is required by law.
Section 2. The Town Clerk is hereby authorized and directed to publish a Notice of Public
Hearing regarding the aforesaid increase in the maximum amount to be expended,with such Notice
to be published once in the official newspaper, and also to post a copy thereof on the town
signboard maintained by the Town Clerk, not less than ten (10) nor more than twenty (20) days
before the day designated for the hearing as aforesaid, all in accordance with the provisions of
Section 209-q of the Town Law.
Section 3. This Order shall take effect immediately.

10.Acknowledge receipt of annual Conservation Easement Inspections
Mr. DePaolo asked about the Ridgecrest Road easement that was given in lieu of parkland and
whether there is public access to it and if not,how does it meet the parkland set aside.
Ms. Ritter responded that it does not have public access and was more to protect wetlands on
private property.
Mr. DePaolo asked about the process and decision to allow that rather than public parkland.
Ms. Ritter responded that she hadn't read the background in almost a year,but her recollection
was that people did not feel there was an urgency for a park in this particular neighborhood given
that it is not densely populated.
The Board acknowledges receipt of the inspections and associated report.

13. Report of Town Officials
Mr. Howe reported that comments on the State's Climate Action Plan were drafted by him, Ms.
Johnson and Mr. Goldsmith and submitted.
He highlighted the Code Department's monthly report showing a record number of permits
issued this past month and thanked the staff.
Mr. Howe asked that members email Ms. Rosa with known vacation dates that will be put on the
internal Outlook calendar to help track availability given the Emergency Order and our
Videoconferencing Policy,
Mr. Howe stated that given the situation in the boardroom and the inability to hear clearly and
having to use the same microphone very close to residents faces, this qualifies as an
extraordinary circumstance and public bodies of the Town may meet virtually under our policy if
the Emergency Order is not extended, The Board agreed.
Ms. Rosa noted that early voting will be happening at Town Hall starting this weekend.

Mr. Howe noted the letter from Ms. Bageant regarding the encampment issues being discussed at
the City and County levels, adding that we are following it closely and will ask for an update
from them to the full board when there is more concrete information.

had to pull out to far out to turn left from Honness but my vision has been blocked due to the trailer. If
there is anyway to have them move so that it is safer to pull out that would be helpful. Note - I pass this
intersection daily and I believe it is the Crown Construction truck that is blocking the view. LK
